What's really scary is...this lady graduated law school in 87, which makes her MY age. Does she look 43 to you? I hate it when I see someone who looks old and I find out they're my age.
She doesn't try very hard IMO. That's why she looks old, kinda like her buddy AL.

JA: You make claims regarding how society perceives women who neglect their child why they party.....etc

AL: objection, there was no comment at all in her testimony regarding if a woman actually had neglected her child in any way

JA: So is your testimony that whether a woman parties or sees male strippers that's irrelevant to whether she's a good mother?

ER: Well.... yes, if a woman or man leads a lifestyle which perhaps you or I would reject, but that person is there 100% of the time in their parental role as a parent, I'm not sure that you or I would be right in calling them a bad parent. You can lead an unconventional lifestyle but be a good parent.

JA: But you argued that it's irrelevant, isn't that what you said?

ER: Yes, I believe I said that it is sometimes used in the press and sometimes by prosecutors to mislead regarding whether the mother was actually


JA: Interrupts witness and says, "Next question!!"

Judge interrupts: Mr. Ashton, listen up. You must let the witness answer the questions.

she has not done the research, as a psychologist might have, on the research question "is there a relationship between mothers that party and child neglect and child homicide?" she is not an expert in psychology...she can't answer this ;-)

He keeps asking one question and then when she asks for clarification, he completely asks a different question. Very confusing questioning.

She remains unruffled.

Sticks by her statement that a woman's mode of dress or whether she watched male strippers or used sex toys or other lifestyle questions may be completely irrelevant to her role as a mother. But that the media often cover these issue and even courts sometimes allow testimony regarding these issues.

This was a stupid move by AL in my opinion and a waste of the courts time, not to mention it was a low blow to the SA since they had no time to prepare for her testimony. But I gotta give JA props...he was brilliant!

AL: The prosecution's attempt to use photographs from up to years before this case and their descriptions of my client as "scantily clad", these things are irrelevant to this case.

And their decision later to seek the death penalty for some reason they won't disclose...
(sorry I missed a part)

Generally speaking when the death penalty is sought it is because there is a history of severe neglect or abuse of the child, or a particularly horrendous form of murder which also doesn't exist in this case.

....lack of evidence regarding whether this death was even a homicide or was a natural death, or some form of concealment of a natural death to look like a homicide, they have no evidence or facts

Fact that every single second of this young woman's life has been examined/excoriated is a part of this prosecution

Understand this is a unique motion. Asking your honor to look at traditional gender roles and gossip/innuendo is driving this case and driving decision to ask for dp

That was when AL was saying that there was no kind of torture, abuse, neglect, etc. of a child in this case, Casey was agreeing with her. Then AL went on to say the murder wasn't even particularly upsetting. or somethign like that.:banghead:

AL saying that sexist attitudes do exist and there is an undercurrent of these attitudes in this case, that the way every aspect of her life has been a feature of this prosecution show this, this kind of hearsay and opinion is all over this case, and is even driving this case and is driving the decision to ask for the death penalty.

AL: Casey Anthony, if I may draw a literary analogy, this is very much like Camus' "The Stranger" in which a man is convicted of the murder of his mother because he didn't act normal following her death although he was innocent

She has to be allowed to argue her motion, but I don't this His Honor is going to go for it. This isn't the trial, and these arguments will probably come up again in sentencing. But, she has to lay the foundation and give it a go, imo.

The prosecutor has never stated that they are seeking the death penalty because Casey was a "party girl." LDB stated yesterday that the pictures are to show where she was and what she was doing when she stated in her statement that she was looking for her child!

There is such emphasis on CA's clothing. Seems to me the defense is trying to take the spotlight off the real problem.

I think it is definately about appeal-But I also think it is JP's desire to get AL's argument on the record, specifically, and he will tailor his denial to address, specifically, why AL's argument does not show that the DP charge in this case is incompatible with the constitution (of Florida or the US).
My hope is that he will ultimately tell her that she has not convinced him that he should be quick to subvert the law of the people, that there is no recourse for her complaint within the courts. I believe JP respects that this 'high-brow' stuff is AL's passion...but he also has to weigh the question at hand-is the state violating KC's rights in bringing DP charges? If the state has followed the law, KC's sex will not be of issue, IMO.

If she could act that well, I think we would have seen her putting on a much different act for the public from the beginning of this case. Of course your opinion is different, everyone is entitled to their opinion. IMO her crying appeared very real but of course I don't know her feelings or motives (i.e. crying for herself, touched by the witnesses speaking up for her, crying for Caylee, a little of all of these, etc).
