Authorities are moving forward with their investigation into the disappearance of a missing Bolingbrook woman and could exhume the body of her husband's previous wife on Monday to take another look at her mysterious death.

Volunteers continued their search efforts at 10 a.m. Monday, hoping to find a clue to the disappearance of 23-year-old Stacy Peterson, who has been missing for more than two weeks.

Meantime, authorities have been planning to exhume the body of Kathleen Savio, the third wife of Stacy's husband, Drew Peterson, who has officially been named a suspect in Stacy's case.

Investigators are reviewing the death of Sgt. Drew Peterson's third wife, Kathleen Savio, who was found dead in her bathtub in 2004. NBC5's Kim Vatis reported Monday that investigators will exhume Savio's body to further the investigation.

A spokesman for the Will County State's Attorney's Office isn't saying when the exhumation will occur.

State's Attorney James Glasgow said evidence strongly suggests that someone killed Savio and tried to make it look like an accident in 2004. At the time, her drowning was called accidental.

Glasgow moved to exhume the body in the hopes of gathering more information in the case and on Friday a judge signed his petition to exhume the body.

Investigators are preparing to exhume Kathleen Savio's body. With her ex-husband, Drew Peterson, a suspect in the disappearance of his fourth wife, Stacy Peterson, close friends are struggling to believe his story.

As CBS 2's Katie McCall reports, the people who searched for Stacy Peterson Monday are certainly focused on finding her, but they are also interested in finding out what happened to Savio, Drew Peterson's third wife.

Reporters stationed outside the Peterson home Monday were greeted by a man who appeared to be Drew Peterson's brother. He brought out a video camera, took a few shots, then went back inside.

As authorities erected a maroon tent near Kathleen Savio's grave in Hillside Monday to exhume her body, family members found themselves grappling with mixed emotions: relief that authorities were reinvestigating but also a fresh onslaught of grief.

For one thing, said Melissa Doman, Savio's niece, how do they rebury her?

"When we have a good idea, we'll call together family members and go from there," she said.

The body was exhumed in the 7 a.m. hour Tuesday. After a back hoe and two men with shovels opened the grave, a crane was used to hoist Kathleen Savio's casket from a plot at the Queen of Heaven Catholic Cemetery in west suburban Hillside. A little more than an hour later, the casket was placed in a van that took the body for a new autopsy at the Will County coroner's office.

The Will county coroner and state's attorney were present for the disinterment, along with Illinois State police investigators. Also present was the Rev. Chris Groh, who is chaplain of the Joliet Police Department. He came because Savio's family had requested a Roman Catholic priest, and led officials in a brief service.

Will County law enforcement did not want anyone in attendance other than investigation officials. That included Savio's family members, who expressed disappointment that they could not attend.

The body of Kathleen Savio was exhumed this morning and taken to the Will County morgue, and authorities said an autopsy on the third wife of a Bolingbrook police officer whose fourth wife is missing will be conducted later today.

Results of that autopsy are not expected to be available to investigators for several days and will not be released to the public, the Will County state's attorney's office said in a statement.

Savio's body was exhumed at Queen of Heaven Cemetery in west suburban Hillside.

An autopsy is being performed on Kathleen Savio, the third-wife of Bolingbrook Sergeant Drew Peterson. Peterson's current wife, Stacy, has been missing for two weeks.

After a Catholic priest offered a prayer at the site, Savio's body was exhumed from her grave early Tuesday morning.
"We were all raised Catholic. And it's something very sacred, which is why we wanted complete privacy when this was done," said Melissa Doman, Kathleen Savio's niece.

News helicopters hovered overhead as Savio's casket was lifted out of the ground and placed in a vehicle headed to a morgue. An autopsy will be performed by an independent medical examiner.

Crews Tuesday morning exhumed the body of suspended Bolingbrook police Sgt. Drew Peterson's third wife. The coroner said the autopsy was completed Tuesday night and the cause of death was still ruled as drowning.

The expert pathologist brought in to do the autopsy has completed 9,000 in his career. No ruling has been made yet about the manner of death, but authorities expect a ruling will be made within a couple of weeks at which point it should be known whether Savio died by accident, homicide or an unknown reason.

Continued dissection of an interview that a Bolingbrook police sergeant gave to the "Today Show's" Matt Lauer on Wednesday has included comments from friends and neighbors of Stacy Peterson, the officer's wife.

Drew Peterson flew to New York to appear on the morning news show and share his side of the stories of his missing fourth wife and the death of his third wife, whose body was exhumed Wednesday morning as part of an ongoing investigation.

Peterson has been named as a suspect in the 2004 death of Kathleen Savio, and a second autopsy is to be performed on her body.

On Thursday, Stacy Peterson's uncle, Kyle Toutges, spoke with NBC5's Dick Johnson and Zoraida Sambolin about his impressions of the Today Show interview.

A will emerges

A year after Savio's death and the beginning of the legal proceedings to settle her affairs, a will emerged. It was submitted in court on March 23, 2005. Hand-written in capital letters, it was scrawled across two pieces of lined notebook paper and witnessed by Alex J. Morelli and Gary L. Marcolina.

Division of property issues

The will names James B. Carroll, Drew Peterson's uncle, executor of the estate, according to a document filed in court by Kavanagh, who apparently had some concerns.

With the search for missing Illinois mother Stacy Peterson wearing on and another woman's exhumed body under examination, friends and family members of both women grow increasingly suspicious of her husband, Drew, despite his insistence Wednesday that he had nothing to do with either case.

"He's not asked anybody if we know where she is. Maybe because he already knows where she is?" said Sharon Bychowski, a friend of Stacy's.

"For the last two weeks, Vicki Connolly has watched in disbelief and with conflicting emotions as controversy swirls around her ex-husband, Bolingbrook police Sgt. Drew Peterson.

She doesn't know whether he had anything to do with the disappearance of his current wife, Stacy Peterson, who has been missing since Oct. 28, or the death of his third wife, Kathleen Savio, who died mysteriously in 2004.

But in the first interview granted by one of his ex-wives since Stacy's disappearance, Connolly, 48, said Thursday that during their marriage an increasingly controlling Peterson told her he could kill her and make it look like an accident. While she couldn't believe he would ever do it, something prompted her to confide in Bolingbrook police officers who she considered friends. "So they would know he said these things to me," she said.

She said Peterson would hit her but not hard enough to go to the hospital, and not often enough for her to expect it. It made it worse, she said, that she never knew it was coming. "It was mind games; it was head games," she said."

A noted forensic pathologist is expected to conduct a private autopsy of a Bolingbrook police sergeant's third wife, who drowned mysteriously in 2004.

Michael Baden, the former New York City chief medical examiner, was brought in at the request of Kathleen Savio's family.

"It's not for law enforcement purposes; it's for the benefit of the family," said Charles Pelkie, spokesman for Will County State's Atty. James Glasgow.

A man who found the body of former police officer Drew Peterson's third wife in a bathtub three years ago says when Peterson saw the woman for the first time he was obviously surprised — and distraught.

"He checked her pulse right away to see if she was dead or alive. Then he was, 'Oh my god, what am I gonna tell my kids? What am I gonna tell my kids?'" Steve Carcerano said today.

The ex-wife of a Bolingbrook police sergeant found drowned in her bathtub three years ago was murdered, according to a noted forensic pathologist who autopsied her remains Friday at the request of her family.

Former New York City chief medical examiner Michael Baden said in an interview with Fox News personality Greta Van Susteren that the remains of Kathleen Savio showed bruises that indicated a struggle, leading him to conclude her death was a homicide, not an accident as a coroner's jury previously ruled.

"I don't think there's any possibility this was an accident, and I don't think there's any indication this was suicide," Baden said.

Dave Brown has Drew Peterson, in part, to thank for a fantastic 26-year marriage.

"I'm so glad Drew let her go," Brown said of his wife Carol, who was married to Peterson from 1974 to 1980. "She's the most leveled-headed and good-looking person on the planet."

Carol Brown, now 50, was the first wife of Peterson, the former Bolingbrook police sergeant named a suspect in the disappearance of his fourth wife.

In response to a conclusion by an independent pathologist that Drew Peterson's third wife died in a homicide, Peterson's attorneys said her death "should not be a source of entertainment."

As CBS 2's Rafael Romo reports, nationally renowned pathologist and former New York City chief medical examiner Dr. Michael Baden concluded that Kathleen Savio died in a homicide. He said it was evident that she had been the victim of foul play after just taking a first look at Savio's body, which was exhumed earlier this week.

"My experience has been normal, healthy adults don't die accidentally in bathtubs, period," Baden said.

There are new comments from Drew Peterson Sunday morning. They come after a third autopsy was performed on his third wife, casting more doubt on the circumstances surrounding her death. CBS 2's Rafael Romo reports on what Peterson had to say.

Speaking to reporters outside his Bolingbrook home Saturday night, Drew Peterson said he's coping with his situation.

"I'm just ready for anything that may come," he said. "So I'm just working through the days. I'm doing fine. I'm just, uh, I lost 30 pounds. Jenny Craig has got nothing on me 'cause I lost 30 pounds through this ordeal, you know, it's very nerve-wracking."

Or rather, his lawyer did.

In his second interview within five days on NBC's "Today" show, Peterson's attorney, Joel Brodsky, did most of the talking, clearly frustrating interviewer Matt Lauer.

HILLSIDE -- Henry Savio dropped a red rose on his daughter's white casket during an emotional funeral service this week as Kathleen Savio was returned to her grave.

Other family members and friends somberly followed suit, adding roses wreathed with baby's breath to the new casket that was reburied Monday at Queen of Heaven Cemetery in Hillside.

According to published reports, a Bolingbrook woman who has been missing for a month told a clergyman that her husband had killed his former wife and made it look like an accident. Stacy Peterson has been missing for a month, and is married to former Bolingbrook police Sgt. Drew Peterson.

A source revealed the information to Chicago Sun-Times columnist Michael Sneed, NBC5 reported Wednesday night. The source said Stacy Peterson told the clergyman last August that her husband had killed Kathleen Savio, who was his third wife.

The Sun-Times also reported that on Oct. 28, the day she disappeared, Peterson told her husband she was leaving him, and issued an ultimatum. Peterson told her husband that she was planning a divorce and wanted him out of the house by the following Wednesday.

Stacy Peterson told a clergyman in August that her husband had claimed to have killed his former wife, Kathleen Savio, and made it look like an accident, according to a source close to the investigation

The source said the 23-year-old, who had been pregnant and living with Peterson when Savio was found dead in an empty bathtub in 2004, also told two other people close to her about her husband's statements regarding Savio's demise.

BOLINGBROOK, Ill. (AP) — The wife of a former police officer told a clergy member months before she disappeared that she feared her husband, a church official said Thursday, echoing comments the woman's sister made soon after she vanished.

Stacy Peterson requested a meeting in late August with a member of the Westbrook Christian Church pastoral staff when the church made a routine call to see why she and Drew Peterson had not attended recent services, Rob Daniels, the church's pastor of spiritual formation, told The Associated Press.

At the meeting, Peterson said "she feared for herself because of her husband," Daniels said.

He would not say whether Peterson was afraid her husband would kill her, only that she feared "bodily harm."

December 11, 2007 (BOLINGBROOK, Ill.) -- A former police officer's missing wife once confided in a pastor that her husband admitted killing his third wife, according to a published report.

Former Westbrook Christian Church pastor Neil Schori told Fox News Channel's Greta Van Susteren that he was "reeling inside" after his conversation with Stacy Peterson.

Schori said he asked Peterson when they met in August at a coffee shop to clarify what she had said about her husband, Drew Peterson, and she responded, "'He killed Kathleen (Savio)."'

BOLINGBROOK -- Stacy Peterson allegedly had a thing for the preacher saying she told him her husband killed his ex-wife.

"All I know for sure is, Stacy had a big crush on him," Drew Peterson said of the minister his wife supposedly confided in before disappearing nearly seven weeks ago.

"Every time she went to see him, she was all dolled up, all sexied up," Peterson said.

The preacher, Neil Schori, has said Stacy revealed to him Drew Peterson confessed to killing his ex-wife, Kathleen Savio, the day after she mysteriously died in March 2004. She reportedly dropped the bombshell on Schori during an August get-together in a coffee shop.

One of Drew Peterson's adult sons appeared Thursday before a Will County special grand jury investigating the disappearance of Peterson's fourth wife and the mysterious drowning of his third wife, but declined afterward to discuss the case.

Stephen Peterson, 28, an Oak Brook police officer, arrived in uniform Thursday morning at the Will County Court Building Annex, where the grand jury meets. About three hours later, he left the building and drove off in his marked squad car.

Craig Wall reporting for Fox News: "Sources have confirmed that prosecutors have subpoenaed bank records that show Drew Peterson, in the weeks after his wife’s disappearance funneled nearly a quarter of a million dollars to his son Steve, an Oak Brook police officer. Steve Peterson has now testified twice before the Grand Jury investigating Stacy Peterson’s disappearance and although he declined to comment, a law enforcement source said prosecutors most assuredly would want answers about the money trail.

According to sources, Drew Peterson has transferred more than $250,000 to his son from several bank accounts including joint accounts he held with Stacy. Investigators found that Drew wrote as many as six checks to Steve all within a few days in mid November including one check for more than $150,000.

Tonight Drew Peterson declined to comment and so did his attorney.

Joel Brodsky: "I'm not going to comment on my clients personal financial affairs. I'm sure, and if that’s true, I'm not even sure on whether or not it is, I'm sure there's legitimate reasons for it."

One legal expert says Peterson’s motive could be to protect his assets in case he gets sued. Tonight Kathleen Savio’s sister said the family has indeed contacted lawyers about filing a wrongful death lawsuit against Drew. He was in the mist of divorcing Kathleen when she mysteriously died in her bathtub in 2004.

Drew Peterson's former friend, Ric Mims, appeared again before a special grand jury Thursday, this time to testify about how he and Peterson used to follow Peterson's third wife around before their divorce was settled.

After spending about 45 minutes in the Will County grand jury room, Mims told reporters that he was asked mostly about Kathleen Savio, Peterson's ex-wife who was found dead in a dry bathtub in 2004.

The petition to reopen the estate of the third wife, Kathleen Savio, also alludes to an impending wrongful death lawsuit against Peterson.

The man leading them in the this direction is the same attorney who helped take O.J. Simpson for $33.5 on behalf of his dead wife Nicole Brown Simpson's family.

Attorney Martin Glink filed notice in Will County Circuit Court this week on behalf of Henry J. Savio and Susan Doman.

Their motion would be both a petition to reopen the case and a response to a Jan. 31 petition by Kathleen Savio's sister and brother, Anna Doman and Henry M. Savio, which sought to block the father from being named executor of the estate.

But the hearing was brief.

Joliet lawyer Lawrence Varsek simply asked Will County Judge Carmen Goodman if they could return to court on March 17.

The parties involved in the case need time to organize various issues, he said.

The judge quickly agreed.

The Savio family believes that all of Savio's assets should go to her children.

State police served Anthony "Bindy" Rock, 68, with his papers Friday, a source said. Contacted Friday night, Rock declined to comment.

Rock was a central figure in an unsanctioned undercover investigation Peterson undertook while he was on loan from the Bolingbrook Police Department to the Metropolitan Area Narcotics Squad in 1985. That investigation led to Peterson's indictment on charges of official misconduct and failure to report a bribe.

The death of the third wife of former police officer Drew Peterson has been officially declared a homicide after a second autopsy revealed she drowned, the Will County state's attorney said Thursday.

Kathleen Savio's body was exhumed in November after Peterson's fourth wife, Stacy Peterson, disappeared and questions arose about Savio's death.

Peterson's family members said the findings confirmed every suspicion they already had about Peterson, Ponce reported. Peterson declined to comment on the story.

"There's not a doubt in my mind," said Kerry Simmons, Stacy Peterson's stepsister. "I think he had something to do with it, and he had something to do with Stacy being gone."

Simmons also said that "there were mistakes" made in the autopsy four years ago.

But now, as authorities this week classified the death of Drew Peterson's ex-wife as a homicide and not an accidental drowning--as it was in 2004 when her body was found in her bathtub--the question is whether investigators are any closer to finding her killer.

The Will County state's attorney's office and the Illinois State Police are not calling Peterson a suspect as he's been called in the disappearance of his current wife, Stacy Peterson. But to some who have followed the case, authorities--who only took a second look at Savio's death after Stacy Peterson vanished last fall --are sending a clear signal they are onto something.

"I'm concerned that there's more emphasis and more of an effort to cater to the media frenzy than there is to looking into the issues surrounding the investigations," Odeh said. "It just seems to me that when there's nothing going on with the investigation and things are quiet in the media, it seems like sometimes either Joel or Drew says something to start the media frenzy all over again."

Brodsky has mounted an aggressive campaign for media coverage, including interviews with national TV shows.

Asked whether she discussed those issues with Brodsky, Odeh said, "Absolutely. I don't think it's appropriate. I think it is in the client's best interest to keep it quiet and focus on the case. But he just says the case is going to make us famous and we're all going to get book deals."

Attorney Harry Smith's statement raises new questions about a two-page, handwritten will that Drew Peterson unveiled 15 days after his ex-wife drowned in her bathtub in 2004.

The will -- dated March 2, 1997 -- named Peterson's uncle James B. Carroll as executor of Savio's estate. Carroll later awarded Peterson control of virtually all of Savio's assets, although Peterson and his third wife already had divorced.

For months, Drew Peterson has been an official suspect in the disappearance of his wife and the subject of speculation about the drowning death of one of his previous wives.

But since Stacy Peterson vanished in late October and authorities reopened the investigation into the 2004 death of Kathleen Savio, Peterson has not set foot in a courtroom in either case.

That is expected to change Monday. At 9:30 a.m. Peterson is scheduled to appear in a Joliet courtroom on a matter concerning the disappearance of his wife. The issue on which he will appear is relatively minor -- the planned return of his cars, computers and other items that police seized as part of their investigation of his wife's disappearance -- but it may nevertheless be significant.

Vicki Connolly, who was married to Peterson for 10 years, declined to discuss her appearance before the grand jury as she left the Joliet courthouse annex. Connolly told the Tribune last year that Peterson was controlling and told her he could kill her and make it look like an accident.

Measure would loosen hearsay restrictions at trials

A Will County state senator has filed a measure that, if passed, could influence the type of evidence allowed in a possible prosecution of Drew Peterson.

Sen. A.J. Wilhelmi (D- Joliet) has offered an amendment to the state's code of criminal procedure, backed by State's Atty. James Glasgow, that would allow hearsay testimony if the witness who made the statements was not available to testify in person because the defendant had a hand in that person's absence.

JOLIET – Will County Judge Carmen Goodman ruled Thursday morning that the estate of Kathleen Savio could be reopened.

Drew Peterson's Attorney Recommends Legal Council For Ex

WHEATON, Ill. -- The daughter of Drew Peterson's second wife and the sister of his third wife appeared Thursday before the grand jury investigating the third wife's death and his fourth wife's disappearance.

State police initially found no indication of foul play in connection with Savio's death. Their opinion was contradicted in November after a forensic pathologist performed additional tests on her remains and concluded she was the victim of a homicide.

Peterson's attorney, Joel Brodsky, claims Maniaci and Savio broke off their relationship the weekend before she was found dead.

Investigators probing the death of Drew Peterson's third wife, Kathleen Savio, now possess the bathtub in which her body was found.

One of the current homeowners told the Tribune on Friday that state police came to take the tub last week, but declined to comment further. A spokesman for the Will County state's attorney's office confirmed her information and said the tub was in storage.

"The state police removed the bathtub from the home where Kathleen Savio was found dead," said spokesman Charles Pelkie. "It's our belief that the tub will be a key piece of evidence in the prosecution of this case when charges are filed."

The decision to retain the current Will County Coroner’s Office or transition to a Medical Examiners Office to handle death investigations continued to heat up Thursday during a Will County Board Committee As A Whole meeting in Joliet.

"Drew Peterson’s teenage son by Kathleen Savio testified before the grand jury Thursday.

Dressed in a suit and tie, Thomas Peterson, 15, left the Will County Court Annex building at about 4:15 p.m. in a red Mercedes driven by his attorney Robert Novelle.

Although the boy was not available to speak to reporters, his father lambasted authorities for putting a teen through the grand jury process.

“That’s grueling for an adult let alone a 15-year-old kid,” Drew Peterson said shortly after his son returned home from hours of testimony in front of the grand jury investigating his mom’s death and his step-mom’s disappearance.

Peterson said he hired Novelle to represent his two teen sons to “protect them from the state police.”

Police interviewed both boys in November at the Will County Children’s Advocacy Center. Peterson said he had brokered a deal with the state to allow the interviews in return for a promise to keep them out of the grand jury process.

“Well, they lied,” Peterson said.

Shortly after the testimony, police subpoenaed both boys to testify before the grand jury. Novelle then filed a motion to quash the subpoenas served to Thomas Peterson and his brother Kristopher, 13."

When Kathleen Savio's lifeless body was discovered in the empty bathtub of her Bolingbrook home in 2004, state police immediately decided her death was not suspicious, a Will County deputy coroner's report obtained by the Tribune shows.

The investigators and experts re-examining her death as a possible murder are now asking how police could have been so quick to overlook signs that something sinister may have happened to the third wife of Drew Peterson, then a sergeant for the Bolingbrook Police Department.

They are suspicious about the absence of blood residue or a sediment ring on the walls of the tub where she was found, sources said. If she had bled from a head wound while drowning in slowly draining water—as the theory went—why was the tub not stained?

Attorneys for former Bolingbrook police Sgt. Drew Peterson made oral arguments before an appellate court Tuesday that the estate of his third wife, Kathleen Savio, never should have been re-opened despite a new autopsy that indicated her 2004 death was a homicide.

The appellate court said that it would have a ruling "soon."

Afterward, Peterson's legal team said that they are optimistic that the court would rule in their favor. If it does not, and Savio's family files a wrongful death lawsuit, Peterson's lawyers would be given subpoena powers to interview witnesses who have been called before the grand jury investigating the cases.

"We're going to be very aggressive," said attorney Andrew Abood.

Peterson spoke briefly outside the courthouse, making a joke about Fox News' Geraldo Rivera and commenting about embattled Gov. Rod Blagojevich hiring the same public relations firm he's retained.

"Probably a wise decision," Peterson said. "They've done very well for me."

Then he signed autographs for two men in a pickup truck.

Years ago, when officials determined her sister Kathleen Savio's death was an accident, Anna Marie Doman never thought she'd see Drew Peterson held responsible.

But that day came Thursday.
"I screamed," Doman said. "My brother just called me and said the state police called him so I know it's for real."

Doman said she had heard rumors of Peterson's imminent arrest before, but did not get her hopes up.
"When Henry (Savio) called, I'm like, say it again. Say it again," Doman said. "I wish I could call Kitty (Kathleen Savio) up. Anytime something big happened, that's who I'd be calling."

Peterson wasn't named a suspect in Savio's death, but state police determined the disappearance of his fourth wife, Stacy Peterson, is a "potential homicide" and say he is a suspect in the case.

Reached by phone shortly after Peterson's arrest was reported, Pamela Bosco, a spokeswoman for Stacy Peterson's family, said they had dreamed about Peterson's arrest.

"We anticipated the day, we had been patient waiting for it for what seemed like forever," Bosco said. "We're in full support of the Savio family. We'll patiently wait again as this unfolds."

Bosco said the new development gives them hope they will get answers about what happened to Stacy.

Charles B. Pelkie, spokesman for the state's attorney in Will County, Illinois, said a grand jury indicted Peterson in the murder of his third wife, Kathleen Savio, whose death had been ruled an accidental drowning.
He said the grand jury continues to meet and is studying the possibility of charges in Stacy Peterson's disappearance.

The news was also bittersweet for Stacy Peterson's family, who continue to wait for news about her disappearance.
"We have anticipated this coming. We have dreamed about it. We have been patient over it," Pam Bosco, spokesperson for Stacy Peterson's family told WLS-TV. "Now that it's here, it's almost a little bit calm. We're waiting for the storm to calm now. The calm before the storm."

Ernie Raines is also relieved about the arrest. His daughter, Christina Raines, is dating Peterson and was living with him before his arrest. Ernie Raines told CNN's Anderson Cooper he was with his daughter and Peterson as recently as last week, when they talked about going to Las Vegas, Nevada, and getting married.

Thursday night he spoke with his daughter after the arrest.
"My daughter was terrified, very emotional, upset," Ernie Raines said. "And I tried to tell her from the beginning that this was going to happen, be prepared."

Ernie Raines said more than anything, when he heard about the arrest, he was relieved.
"I'm glad justice finally came -- before he hurt my daughter," he said.

59 Leads in the Drew Peterson Case

To solve the murder of Kathleen Savio, authorities have done more than exhume her body; they've compiled a body of evidence. In documents obtained exclusively by Fox Chicago News, we've learned investigators put together a list of at least 59 leads.

The name that shows up most often is Drew Peterson. Kathleen's ex-husband appears 15 times, including a warrant for a DNA sample.

Another man in Kathleen's life who was interviewed was her boyfriend Steve Maniaci. Maniaci is mentioned as being robbed shortly before Kathleen's murder. The documents show Kathleen withdrew nine thousand dollars from a bank account to give to Steve. We asked private investigator Jim Miller to look at the paperwork. Miller, who's been in the business for more than 15 years, calls the lead list very thorough. He says it proves Drew Peterson is clearly the prime suspect.

JOLIET — Drew Peterson was reportedly set to fly to Reno, Nev., on Friday to discuss working as head of security at a brothel featured on an HBO reality series.
Instead, he'll likely spend the weekend where he'll only be allowed to watch basic cable if he's on his best behavior with the staff and other guests.
After the former Bolingbrook police sergeant was arrested on murder charges Thursday evening and questioned at state police District 5 headquarters, he was booked into the county jail.
A car brought Peterson inside the sallyport on the facility's north side. Once the garage door closed, the door that passes into the receiving area were opened.

Peterson was expected to spend the night in the jail's classification pod. The "E" pod, is designed to house 48 inmates, but jail staff is currently double-bunking that section.
However, the pod has the only recreation area that is not currently shut down as the staff prepares to begin housing inmates in the recently completed $70 expansion wing of the jail in the next few weeks.
Today, Peterson will then be brought to appear on television. He'll be formally arraigned over video broadcast to the courthouse.

Many times I met with Drew Peterson and told him right to his face that I was very suspicious of him….and he said that he understood that I was, he understood why I would be (he admitted he would be, too, with the limited information he said that I had) but that he was not guilty of any crimes against his wives.
He has now been indicted for murder in connection with the death of wife #3. In spite of my suspicion and maybe yours, suspicion is not enough. The prosecutor must still prove beyond a reasonable doubt:

It's been five years since March 1st, 2004 when Kathleen Savio was found dead in a dry bathtub. The Will County coroner ruled it was an accident, a ruling that was revisited when Stacy Peterson, Drew's fourth wife, vanished on October 29th 2009.

Ten days after her disappearance, on November ninth, a judge ordered that Kathleen Savio's body be exhumed to determine if Savio's death might have been more than accident.

At the request of Savio's family, forensic pathologist Doctor Michael Baden performed an autopsy, and said that in his opinion, Savio appeared to have been beaten before she drowned.

Doctor Baden called Savio's death a homicide. But, not until three months later in February 2008 did the Will County State's attorney officially agree.

A little more than an hour after news of the arrest burst into media reports, Savio's brother, Henry, said his family was "ecstatic," and many of the people associated with the years-long case also expressed pleasure with the news.
"We didn't really know too much what was going on. We wanted it to go this way and it did," Henry Savio, 50, said when reached by phone.

"It's been hard on my family, hard on my kids, my daughter has nightmares, I've had nightmares about this guy," Henry Savio said. "It's a miracle. We feel like opening up champagne right now. But we know it's a long road ahead, but at least we're one step ahead right now."

Henry said his sister was on his mind Thursday.
"I think my sister is smiling and saying good, it's about time. It's about time. I feel sorry for her kids, my nephews. They're always in our hearts," he said.

For some friends and supporters of Stacy, the momentum building over the last several weeks seem to lead directly to his arrest Thursday.

"With the grand jury coming to an end, we could sense something was about to happen," said Roy Taylor, a friend of Stacy Peterson. "We're elated. We've been living with this for 18 months. If he gets life in prison for one murder, we'd be OK with that. As long as he's behind bars, that's OK with us."

He said he requested the bond amount and the judge granted it "without question," and the judge also signed a search warrant which was executed at Peterson's Bolingbrook home tonight.

"I requested the $20 million bond because I felt this was as grave and serious a case as I've ever handled," Glasgow said, adding that he did not want to speculate on if Peterson could post the bail money.

Peterson is scheduled to appear for his arraignment Friday at 1:30 p.m. at the Will County courthouse in Joliet, authorities said.

Yellow police tape was blocking the entrance to the Peterson home while onlookers gawked and smiled and news helicopters whirled overhead.

Investigators were seen removing several large items from inside the home and placed them into the back of a white van. They entered and exited the home through the garage. Investigators stood at the door of the van, blocking the view for the public and assembled media.

Savio's body was found in a dry bathtub, hair soaked in blood from a head wound, just before the couple's divorce settlement was finalized. Her death originally was ruled an accidental drowning but authorities later said it was a homicide staged to look like an accident.

The indictment alleges that "Peterson on or about Feb. 29, 2004 ... caused Kathleen Savio to inhale fluid," causing her death.

Savio's family has long voiced suspicions, saying she feared Peterson and told relatives if she died it would not be an accident. Their fears resurfaced after the October 2007 disappearance of Stacy Peterson, then 23.

Former Bolingbrook cop indicted, taken into custody near his home

As part of that prosecution, the state's attorney said he plans to introduce statements made by Kathleen Savio herself under the state's new hearsay law.

"This case will be prosecuted in Will County. There may be a motion for a change of venue, so I am going to be careful with what I say," Glasgow said.

"We look forward to the challenge," Glasgow said. "I thought this was as grave and as serious a case that I have ever handled."

Peterson's stepbrother, Thomas Morphey, who says he helped Peterson carry Stacy's body out of the house and into a waiting sport utility vehicle, also was on the block and said he was relieved by the arrest.

"Justice is finally served," Morphey said.

Prosecutors say they'll test a new Illinois here-say law in the case, reports CBS News correspondent Cynthia Bowers. It allows the use of murder victims' words to be used against their accused killers. Bowers says prosecutors plan to cite Savio's predictions to relatives that Peterson would to kill her.

On The Early Show on Friday, another Peterson lawyer, Joel Brodsky, said forensic evidence his side will introduce will show that Savio's death was indeed an accident.
Brodsky also told co-anchor Maggie Rodriguez Peterson would plead "not guilty to all charges, obviously."

But Abood said one of Peterson's sons with Savio has "provided a lock-tight alibi" for his father, who faces up to 60 years in prison if convicted. In an appearance on CBS' "The Early Show" last month, 16-year-old Thomas Peterson appeared alongside his father and defended him. "I highly do not believe that my dad had murdered my mom. Drew Peterson's attorney this morning wasted no time in attacking a major foundation of the murder case against his client.

In an interview on WGN-Ch. 9, Joel Brodsky said he will attack the constitutionality of prosecutors trying to use statements by Peterson's dead ex-wife, Kathleen Savio, as evidence against him.

In a news conference Thursday night following Peterson's arrest, Will County State's Attorney James Glasgow said prosecutors will seek to admit statements made by Savio, essentially allowing her "to testify from beyond the grave."

"It's going to have to face a constitutional challenge," Brodsky said. "...We have now loosened the requirement for evidence in a homicide case ... We should make it stricter ... We're now involving rumor and innuendo and unreliable evidence in a homicide case."

"It made me feel good to see him chained up like the dog that he is," she said outside the courthouse. "I'm happy that Kathy's family has gotten justice for Kathleen Savio."

She said she plans to contact Drew's oldest son Stephen about the children. She also plans to contact an attorney about her visitation rights. She said the last time she saw her nephews was a year ago.

She's hopeful people who have information about her sister's disappearance will step forward now "that they know he's locked up."

Asked if the arrest gives her any sense of closure, she said "closure is bringing my sister home and getting her the justice she deserves."

Peterson, 55, appeared for an arraignment at the Will County Courthouse in Joliet in the early afternoon. The hearing was continued until May 18, and Will County State's Attorney James Glasgow said he expected Peterson's defense to ask for a change of venue.

He arrived at the courthouse at 1:05 p.m., in one of a fleet of transport vans that pulled out of a door in the Will County Jail and traveled a short distance down a ramp to the courthouse.

Peterson then exited through the back of the van, flanked by two correctional officers. He was in bound shackles, and was wearing a red jail jumpsuit. He looked up at a line of camera crews on the ledge above as the correctional officers led him into the courthouse building.

"I think we're going to look for a jury outside of Northern Illinois, that goes without saying," said Brodsky, adding "I believe an unbiased jury is going to clearly see that these charges are unfounded and the evidence is, at best, weak, circumstantial, and based on rumor."

Additionally, the attorney is strongly opposed to a recent law allowing certain third party statements, which previously would have likely been classified as hearsay, to be submitted into evidence and he confidently believes he is not the only lawyer who opposes this new law.
"It's a horrible law. Not only is it constitutionally problematic but just in general it allows so much rumor, innuendo, backyard gossip into a court of law where it doesn't belong. We believe we are going to be challenging that law."

Will County States Attorney James Glasgow views the ability to utilize select third party statements in a substantially different light and is likely going to use this new law to his advantage.
"In essence what you're basically allowing the victim of a violent crime to do is to testify from the grave," Glasgow said at a press briefing Thursday evening. Glasgow also clarified that the usage of these statements in court also comes with "very serious protections for the defendant's rights."

CHICAGO - Drew Peterson's lead attorney said he'll ask a judge to sharply reduce the former suburban Chicago police officer's bond from the current $20 million to "a reasonable level."

Joel Brodsky said at a news conference Sunday that a bond between $500,000 and $1 million would be within the range set in other murder cases in Will County.

"We are ... going to attempt to get this excessive bond down to a reasonable level and see that Drew is given the same bond as anybody who's accused of a similar crime," Brodsky said.


Peterson remains jailed on charges of first-degree murder in the 2004 death of his third wife, Kathleen Savio. Peterson is a suspect in the 2007 disappearance of his fourth wife, Stacy.

If the bond is reduced to $500,000, Brodsky said he thinks Peterson would be able to pay it. Peterson would have to post 10 percent to go free while he awaits trial.

'Doing fine in jail'
Speaking from a baggage claim area at O'Hare International Airport, Brodsky said he's been in contact with Peterson, who he described as "doing fine in jail."

Peterson, arrested Thursday, is being held in segregation at the Will County Adult Detention Facility in Joliet, both because he's a former Bolingbrook police officer and because his case is high-profile, Brodsky said.

And given the case's high profile, he said he'll likely ask the judge to move the case out of Will County or to seat a jury from outside of northern Illinois.

He said he hasn't made the decision yet because trying the case among people who know Peterson has its advantages.

"On one hand, Drew has been serving the citizens of Will County for 30 years, he's been a part of the thin blue line that's kept them safe, and he's certainly a well-known member of the community," Brodsky said. "On the other hand, obviously we have to worry about all the tremendous amount of negative publicity that's been given to him."

Peterson is next due in court May 18.

Many people have taken to calling that law the "Drew Peterson law" because they believe it was specifically drafted to allow the words of Kathleen Savio to be used against Drew Peterson in a court of law, even if they're not able to do so in person themselves.

"It's just simply a bad law," Brodsky said. "It allows rumor, backyard gossip and innuendo come into a court of law masquerading as evidence."

The Drew Peterson case continues to read like a black-comedy version of "The Silence of the Lambs" done by "Monty Python's Flying Circus," with the Keystone Cops standing in for the FBI.

The Peterson case has a long way to go, and it will generate thousands of hours of prime time and millions of tabloid sales yet. In macroeconomic terms, it might even be argued that Peterson is therefore a timely blessing for the embattled U.S. media industry. Cynics can claim that all the attention the media is giving his case -- like so many other sleazy, tawdry tales of lust, rage and evil before him -- is a good argument for wiping out the entire popular media complex with the financial equivalent of a giant meteorite.

Drew Peterson's adult son Stephen announced Monday that he has taken custody of the children, but relatives of Savio and Stacy Peterson are looking into whether they can change that.

"We'd seen a lawyer a ways back and were told we'd have to wait until he was charged," said Pamela Bosco, a friend of Stacy Peterson who has acted as a spokeswoman for her family. "We have to go back to a lawyer and see what's available to us."

In it he says, "All of the children of Drew Peterson fully support their father and know that he is innocent of the charges against him. We know him better than anyone else in the world and we know he is not guilty."

He goes on to say that the two boys Peterson had with Kathleen Savio and the two children he had with Stacy Peterson are staying with him.

Those children were home Thursday when police entered their Bolingbrook house and removed them after their father had been pulled over in a traffic stop. Officers shielded the children's faces as they were taken from the house.

The former police sergeant is being held in the Will County Jail in segregation. He is allowed two half-hour visits a week and all visitors must be on a pre-approved guest list.

So far Peterson's attorney says the younger children have not seen their dad.

Ernie Raines, the father of Drew Peterson's live-in fiancee, says his daughter, Chrissy, told him Peterson has enough money to cover a $20 million bond, the Joliet Herald-News reported Wednesday.

Peterson's lawyer has complained the bond set in the first-degree murder case against his client is way out of line and will seek to get it dropped to something more affordable.

But Raines says Peterson has plenty of money, which he was using as bait to keep Chrissy Raines in his home.

He is due back in court on Monday.

How Hearsay Evidence Could Help the Case Against Drew Peterson

For years, courts have allowed certain types of hearsay testimony. However, matters became complicated in 2004, when the U.S. Supreme Court issued a ruling in Crawford v. Washington, a case involving a husband, Michael Crawford, convicted of stabbing a man he claimed tried to rape his wife, Sylvia.

Then, in the case of Giles v.California last year, the Supreme Court ruled that statements to law enforcement officers are admissible as testimony if the defendant is found to have caused "unavailability."

Last fall came Illinois's new hearsay law — coincidentally, one of the last pieces of legislation signed by Rod Blagojevich before he left office in disgrace. The law seems to resemble the increasing number of statutes across the country essentially codifying the Giles decision. "A statement is not rendered inadmissible by the hearsay rule if it is offered against a party that has killed the declarant ... intending to procure the unavailability of the declarant as a witness in a criminal proceeding," the law states.

Those two Supreme Court cases, along with Illinois's law, may give Will County prosecutors key openings in their quest to invoke some of Savio's statements.

Savio's sister calls Drew Peterson evidence "strong"

Statements like that from Kathleen Savio's sister Sue Doman, who lives in Machesney Park, make up much of the evidence prosecutors plan to use against former Bolingbrook police officer Drew Peterson in his murder trial.

But Doman believes the evidence will hold up. She says, "My sister had over 100 pages of documentation of everything in her life. She documented all the times she tried to reach out to people and no one responded."

Doman will face Peterson in court during his next appearance Monday.
She says for the past five years she's visited her sister's grave, grieving and asking how she died. Savio's birthday is next month and Doman says she's looking forward to going there to celebrate what she hopes is justice being served.

Six days before Kathleen Savio’s lifeless body was found in an empty bathtub in her Bolingbrook, Ill., home, Drew Peterson’s lawyer prepared papers telling his client he had been subpoenaed and was to be deposed in his ongoing divorce battle.

Peterson, indicted last week on murder charges in Savio’s 2004 drowning death, stood to lose hundreds of thousands of dollars in the divorce from the sale of the couple’s home and Sud’s Pub, his bar, according to court documents. Savio was also going after half of his police pension, which pays $6,000 a month.

Instead of losing a bundle, Peterson got just about everything after Savio’s death, including custody of their two children.

The Chicago Tribune has learned the state’s attorney’s office is making a closer examination of the divorce and what was at stake as it prepares for the prosecution of Peterson, who is scheduled to be arraigned today.

UPDATE: Drew Peterson formally entered a plea of not guilty this morning on charges that he murdered his third wife, Kathleen Savio.

Meanwhile, prosecutors have asked for a new judge to be assigned to the case. The hearing currently is in recess.

Drew Peterson is scheduled to be arraigned this morning on charges he murdered his third wife five years ago. But the major issue at that hearing is whether he will get his bond reduced.

The arraignment at the Will County Courthouse in Joliet had been delayed because Peterson's lead attorney, Joel Brodsky, was doing a series of media interviews in New York, proclaiming his client's innocence, the day after Peterson was arrested on a Bolingbrook street.

As with all murder defendants at arraignment, the former Bolingbrook police officer will plead not guilty. But the major news to come out of his court appearance will focus on whether a Will County judge will lower Peterson's $20 million bail.

In November, Schoenstedt dismissed felony gun charges against Peterson after Will County prosecutors refused to give the defense communications between Illinois State Police and the state's attorney's office. Those documents had led to Peterson's arrest on the gun charges.
The defense challenged the motion, and a hearing on the issue was set for Thursday before another judge.
The prosecution move derailed defense attorney Joel Brodsky's plan to ask that bail be cut from $20 million to less than $500,000.

Outside court after the arraignment, Savio's family said they did not want Peterson released on reduced bail. Savio's father, Henry, said his one wish is "to have this done."

Bloom said even though most people who sit on juries want to be fair, they can still end up being swayed by things that have nothing to do with evidence.

“They say they won't, but they can be impacted by innuendo, suspicion, speculation and moral judgment,” he said.

That explains why Peterson reminds Black of a lawyer who displayed a mounted fish on his wall.

“It had a sign that said, 'I wouldn't be here either if I kept my mouth shut,”' said Black, chuckling.

"It's nothing but gamesmanship," he said. "I think it shows that the state does not want to try this case on the merits. It wants to try it on technicalities."

Brodsky, who today was granted face-to-face jailhouse visits with Peterson, said he was "leaning strongly" toward asking that a jury be picked from outside the county to hear the case.

He noted that Peterson had not cracked any jokes in court, and he added he had not instructed his client on how to behave. Still, after thearraignment ,there was a "little bit of levity" with Peterson, he said.

But Melissa Doman, Savio's niece, said she felt better seeing Peterson's demeanor changed.

"The smug smirk is gone," the Romeoville resident said. "I've seen him walking around for over a year with that smug smirk and it's gone. Now he's sitting in jail."

The prosecution's effort to eject a Will County judge from the case stalled the former Bolingbrook police sergeant's attempt to get a lower bond.

After Monday's arraignment, Henry Savio said it is his hope that the truth about how his daughter died comes out in court. The 73-year-old father said he is convinced that Peterson killed her for financial and child custody issues.

"My wish is to have this done," Henry Savio said. "My daughter was very determined. I always knew what happened to her couldn't just be an accident."

Added Melissa Doman, the slain woman's niece: "I've seen (Peterson) walking around for over a year with that smug smirk. Now, the smug smirk is gone."

JOLIET — Prosecutors bounced the judge from Drew Peterson's murder case, but lawyers for the alleged wife-killer are fighting to get him back on the bench.

At Peterson's arraignment Monday, State's Attorney James Glasgow accused Judge Richard Schoenstedt of "prejudice against the state" and moved to have him taken off the case.

"I think at this point I should step down and have another judge sit in my stead," Schoenstedt said as he made way for Judge Gerald Kinney to preside over Peterson's initial appearance with counsel. Kinney was in no hurry to get things under way, saying, "I haven't done much of anything in this matter."

And nothing much will get done until Thursday at the earliest, when Kinney will possibly hold a hearing to determine whether Glasgow can get Schoenstedt off the case.

Monday, Peterson remained silent, and even left it to Brodsky to reply "not guilty" when asked how he pleaded.

Still, the new Drew let his serious side slip long enough to "taunt" the relatives of his murdered wife, at least according to Savio's nephew, Michael Lisak. "He was waving at my mom, just continuously looking at my family, the Savio family, almost in a mocking way," Lisak said.

Brodsky, who during the hearing was granted daily, face-to-face visits with Peterson in the jail, claimed to be unaware of this.

The grand jury investigating the fate of Drew Peterson's last two wives wrapped up Tuesday with the testimony of potential star witness Thomas Morphey, a source said.

The grand jury's 18-month term is set to expire Thursday, but the source said it finished two days early.

The grand jury indicted Peterson two weeks ago on first-degree murder charges in connection with Savio's death, but no indictments are on file relating to either Stacy Peterson or Stebic's disappearance, although they may be under seal.

Pelkie declined to comment on whether or not the grand jury has returned indictments in either Stacy or Stebic's case.

Morphey, the last witness to testify before the grand jury, received immunity from the state's attorney's office within days of Stacy's October 2007 disappearance. The state police put Morphey in hiding for his safety for months, but he was called to testify for the first time just last week.

That's what Peterson's attorney, Joel Brodsky, is arguing in court papers that seek to reduce his client's $20 million bond on charges he murdered his third wife Kathleen Savio.

Brodsky also says that Peterson, 55, spent two years in the Army -- where he "on occasion" worked in President Gerald Ford's security detail -- has no criminal background and is rooted in Will County.

The former Bolingbrook police sergeant owns two cars, two Harley-Davidson motorcycles, an Ultralight aircraft and has paid off a line of credit on his home, according to the filing in Will County circuit court.

Both sides are due back in court Thursday before Chief Judge Gerald Kinney, who is expected to hear the defense team's objections to a motion by prosecutors to replace the judge now hearing the case, Richard Schoenstedt.

Will County Chief Judge Gerald Kinney today allowed prosecutors to replace a judge in the Drew Peterson murder case, saying the defense had not established a pattern of abuse by the state of its right to replace judges.

"I do not find that this has been established by the defense's response," Kinney said during a hearing held at the Will County courthouse.

Prosecutors had filed a motion to replace Judge Richard Schoenstedt, arguing he was prejudiced against the state.

Kinney assigned the case to Judge Carla Alessio Policandriotes -- at which point Peterson's attorney, Joel Brodsky, said he wanted to replace that judge. But after a brief recess, Brodsky withdrew his request.

A hearing with the new judge is scheduled for 1:30 p.m. Friday.

Circuit Judge Carla J. Alessio Policandriotes took over the murder case Thursday, after prosecutors successfully removed the Will County persiding judge who they claimed was "prejudice against the state."

Policandriotes will hear arguments Friday afternoon over whether the former Bolingbrook police sergeant's bond should be reduced, allowing him a chance to get out of jail pending trial.

Results of a Thursday autopsy on decayed partial human remains found along the Des Plaines River were inconclusive, but Stacy Peterson's family is hopeful they are hers. An expedited DNA analysis will likely take about two weeks.

Drew Peterson's lead attorney said he and his infamous client are confident the grisly discovery is insignificant to their case.

"I can just tell you we are not at all concerned," attorney Joel Brodsky said. "Not one bit."

Peterson's bond stands at $20 million

Bond for Drew Peterson will stay at $20 million. At a hearing today in Will County Circuit Court, a judge refused a request by Joel Brodsky, Peterson's lawyer, to have the bond reduced. Will County State's Attorney James Glasgow also claimed Peterson tried to solicit his ex-wife's murder in 2003.

Peterson is charged with murdering Savio and staging the death to look like an accidental drowning.

Peterson, jailed and facing murder charges in connection with Savio's death, called in collect to Mancow Muller's show on WLS to tell some jokes.

Mancow mentioned that Peterson's attorney, Joel Brodsky, promised Peterson would deliver some of his comedic stylings over the phone.

Peterson gets credit for trying, but that's about it.

Peterson is due back in court June 17, and with any luck, might reprise his comedy act as he is led from a county paddy wagon, just as he did before his arraignment May 8.

Chief Judge Gerald Kinney granted a defense request Monday to replace Judge Carla Alessio-Policandriotes (pahl-ee-KAN'-dree-oh-tihs). The case will now be handled by Judge Stephen White.

It was only last month that Alessio-Policandriotes was named to replace another judge, that time at the prosecutor's request. Shortly afterward, she refused to reduce the defendant's $20 million bail.

Defense attorney Andrew Abood said Brodsky was trying to help Peterson relax before making "some very serious decisions about his case." --In their court filing, Peterson's attorneys described him as being "sluggish, slow to respond and forgetful" due to being locked up in isolation. But White said the games would have to go.

As a former police officer and high-profile inmate, Peterson is being kept in solitary confinement in the facility's medical unit, which is the easiest area to segregate prisoners. Behind the clear door of his 6-by-9 foot cell, Peterson has a bed, toilet, sink and shower, which faces a centralized open area where guards monitor activity from a raised command bridge.

Peterson is allowed out of the cell for 90 minutes each day when he can sit in the common area, look through the small library of lawbooks or use a computer that does not have Internet access for legal research.

Peterson used one of a bank of phones near the chairs to call the radio station Wednesday afternoon.

Couple of odds and ends: The defense team expects an appellate court to rule in the next week or so on the motion to lower Drew Peterson's bond. If it is lowered substantially, he could post and get out of jail.

Also, the defense team said Wednesday they will definitely file a request to move this case out of Will County, but if that's not granted Drew Peterson's attorneys tell ABC7 that they will be ready to go to trial. That date has been set for August 24.

Attorneys for Drew Peterson, charged with murder in the 2004 drowning death of ex-wife Kathleen Savio, were in court Thursday seeking help as they sift through more than 30,000 pages of investigative reports and hundreds of hours of audio recordings turned over by prosecutors.
Joel Brodsky argued six motions before Judge Stephen White, essentially asking that prosecutors be required to give more details about their theory of how Peterson killed Savio as well as "Cliff's Notes" versions of the 9,470 investigative reports he has received.
"Are they saying my client held her underwater or knocked her unconscious or hit her over the head with a blunt object?" he said, later adding: "How did he do it? The state certainly has to prove that."
John Connor, chief of the Will County State's Attorney's major crimes unit, argued that all that information was detailed in the reports given to Peterson's lawyers.
"I've never seen a request like this in any homicide case I've participated in," he told the judge.

White denied or continued the motions. He did tell prosecutors to give Peterson's attorneys an estimated time that Savio was last seen alive as well as an estimated time her body was discovered in the bathtub of her Bolingbrook home

34 year-old Jeffrey Pachter is a warehouse worker who got to know Drew Peterson in the mid-90s when they both worked for a cable wiring company, that according to Pachter’s wife.
Peterson at the time was moonlighting from his job as a Bolingbrook Police Sergeant.
Pachter, who was 18, had been charged with criminal sexual abuse for his relationship with a girl who court records indicate was 13-to-16 years old.
Peterson reportedly helped Pachter get court records that later resulted in Pachter pleading guilty to a lesser charge.
When prosecutors arrested Peterson and charged him with the 2004 murder of his third wife, Kathleen Savio, they alleged he tried to hire a hit man in late 2003, while divorcing Savio.
Pachter’s wife, whom Jeffrey is now divorcing, said he never mentioned it at the time.
But late last year when Pachter tried to reconcile with his family, he told her all about it.
According to Mrs. Pachter, Jeff said Peterson called one night and offered him $25-thousand to kill Savio but he said no and no money was ever paid.
He only told one person at the time. That friend, she says, kept the secret until Peterson’s fourth wife Stacy disappeared, and then he went to police.
Pachter is vacation with his parents in Wisconsin.
We reached his mother by phone and she said they had no comment.

He wanted prosecutors to provide detailed descriptions of such matters as how Peterson allegedly drowned his third wife, Kathleen Savio; whether he used any weapons or tools to kill her; exactly where and when the alleged 2004 murder occurred; and how Peterson may have gained entry to her home.

Connor countered that all of the information Brodsky is entitled to can be found in the discovery evidence already handed over by prosecutors. But Brodsky said it was too much for him and Peterson's other attorneys to sift through.

Judge Stephen White denied all the requests in Brodsky's motion, but did tell Connor to come up with an approximate time Savio was last seen alive and about when her body was found

Brodsky also took issue with the 805 men and women listed as possible witnesses against Peterson. Connor is supposed to come up with the 50 most likely to testify by July 10, but was not forbidden from calling the remaining 755 at trial, which is scheduled to start Aug. 24.

White also shot down Brodsky's request for Peterson to take possession of the evidence against him while he is in jail. White said Peterson could review the evidence in the presence of his attorneys, who have been granted unlimited jailhouse visits with their client.

Brodsky asked whether Stark, Wawczak or Morphey were paid money or given consideration in regard to criminal charges that may have faced them.

White said this issue would be resolved July 10.

On the surface it would be easy to get the opinion that Peterson targets younger women because they are easy for him to control. When they start to reject his abusive behavior and absolute control over them he can't deal with it so he eliminates the problem.

One could easily argue that Drew Peterson is mentally ill and they would very likely be correct. But where he's in trouble is there is a very big difference between being mentally ill and legally insane. He will never past that litmus test. Clearly he understands the difference between right and wrong, he simply doesn't care. He can aid in his own defense although he'll likely continue to torpedo it. It appears at this time that he took great lengths to cover up his suspected crimes. So an insanity defense will never fly no matter how crazy he act or for that matter actually is right now. He will be judged as competent at the time the crime was committed.

But Drew Peterson has one more big stage with which to act out on and that will be his trial. Look for some over the top wacky behavior when he has a live jury and judge to play for. If the judge has any sense he will bar cameras from the court room. If Peterson sees a camera the dog and pony show will turn into the biggest three ring circus
ever played out in an American court room.

Estate of Third Wife of Drew Peterson Reopened

In March of 2008 Savio's father and siblings filed a petition to reopen the estate and remove Carrol as executor due to new evidence from Savio's exhumed body showing that her death was probably a homicide. The petition claimed that a wrongful death claim against Peterson and Carrol's poor performance as an executor supported their request. The trial court agreed and appointed Savio's father as the new executor.

The appellate court affirmed because the manifest weight of evidence supported the trial court's holding. First, the court held that the estate could be reopened because the wrongful death claim was a newly discovered asset of Savio's estate under the state's Wrongful Death Act. Under Illinois law, a newly discovered asset is one ground for reopening an closed estate. Second, the court held that Carrol's removal was justified because his actions in Savio's divorce case were contrary to the best interests of the estate and its beneficiaries. Finally, although Savio's children were next in line to be appointed executor under Illinois law, the appellate court felt that a court would not likely allow the minor children's guardian, Peterson, to be appointed as executor. Since Savio's father was the proper choice after the children, the court upheld the appointment.

Peterson was scheduled to stand trial Aug. 24 on charges that he murdered his ex-wife Kathleen Savio in 2004. But White canceled that trial date today, after asking Peterson whether he understood that he was giving up his right to a speedy trial.

Peterson, wearing blue jail scrubs, stared down at his lap and replied "Yes, your honor."

Peterson is next due to appear in court Aug. 14, when his attorneys will try to have the case moved outside of Will County and to challenge the constitutionality of a hearsay law passed last year that allows Savio to testify "from beyond the grave."

No new trial date has been set.

Speaking outside court after today's hearing, Brodsky said the defense team "can't digest all the information" prosecutors have given them without more time.

The cases for and against Drew Peterson’s trial won’t be ready by August 24.

With more than 40,000 pages of discovery to wade through, Peterson’s lawyer Joel Brodsky asked and got more time, according to reports from a court appearance today.

"We can't digest all that information and be ready by the end of August," Brodsky told the Herald News of Joliet today.

Peterson will go back to court Aug. 14, Brodsky said he will ask for a change of venue because there is no pool of impartial jurors in Will County . Brodsky also will dispute the constitutionality of the hearsay law passed last year, he said.

JOLIET — A state police detective took a break from the Drew Peterson case long enough to ask the alleged wife-killer's young girlfriend out on a date, Peterson's lawyer said after a court appearance Tuesday.

Attorney Joel Brodsky said, "I'll confirm that," when asked whether a state police investigator asked out Peterson's 24-year-old girlfriend and supposed fiancee, Chrissy Raines.

Brodsky also said he believes state police protocol "does not include dating a witness as a proper method" of investigation.

Brodsky said the detective asked Raines out to "dinner and a movie."

Raines' father, Ernie Raines, was shocked by Brodsky's claim.

"This is news to me," Ernie Raines said. "What is Joel trying to do?"

Ernie Raines thinks he has an idea.

"So this is what (Brodsky's) going to use for his defense, my daughter and this detective," Ernie Raines said before lashing out at the lawyer for messing with "the wrong family."

Charles B. Pelkie, the spokesman for the state's attorney's office, said there was no truth to Brodsky's claim.

"This is an absolutely ridiculous assertion," Pelkie said.

"You have two officers who have had multiple professional contacts with Christina Raines. They told her they would leave the door open to talk to her at any point, whether it was during business hours, whether it was after business hours, whether it was over coffee, lunch, dinner, whatever made her comfortable," he said, stressing that two investigators were always present with Christina Raines and calling their offer to meet with her "good detective work."

Hoping to thwart prosecutors, Drew Peterson's lawyers said Tuesday they will challenge a new "beyond the grave" hearsay law nicknamed after the former Bolingbrook police sergeant.

A new trial date has not been set, but lead Peterson attorney Joel Brodsky warned the hearsay law challenge is so crucial, both sides may fight all the way up to the U.S. Supreme Court.

"The state would have to stop the prosecution in its tracks and seek an appeal," Brodsky said if Will County Circuit Judge Stephen White agrees with him. "It would require, I believe, Drew's release."

Brodsky also said he will file a change-of-venue request to move the trial out of Will County due to the intense publicity - much of which Peterson fueled through national media appearances and other antics.

Sometimes called the Drew Peterson law, it allows a judge at a pretrial hearing in a murder case to determine whether hearsay evidence - testimony or documents that quote someone second hand who is not available in court - may be admitted at trial.

Prosecutors must prove in the pretrial hearing those statements are reliable and that the defendant's wrongdoing made the witness unavailable to testify. Brodsky argues it runs contrary to the Sixth Amendment, which guarantees a criminal defendant the right to confront his accuser in court for cross examination.

Kathleen Savio, the third wife of former police officer Drew Peterson, struggled with her killer, a pathologist concluded in autopsy notes recently obtained by CNN.

Kathleen Savio’s body was re-examined by well-known forensic pathologist Michael Baden in 2007. According to the new details, Baden found bruising on the body consistent with a struggle including “a 1-inch blunt-force laceration on the back of her head, five scraping abrasions and six blunt-force, black-and-blue bruises on her extremities, abdomen and buttocks.”

Savio's family has long voiced suspicions about the circumstances surrounding her death. In a lawsuit filed by the family, it is alleged that Peterson went to Savio's house on Feb. 28, 2004, to "brutally ... stalk, attack, repeatedly beat, then drown,” his third wife. Savio survived the attack for an unknown period of time before drowning, the lawsuit says.

Drew Peterson is being held at the Will County jail on $20 million bond, but denies wrongdoing. He said he misses his children and has prayed and read the Bible during his imprisonment. He also contends his fourth wife, Stacy, left him for another man when she disappeared in October 2007, and is most likely living outside Illinois.

The private forensic pathologist who conducted an autopsy on Drew Peterson's third wife affirmed the official findings that ruled the death a homicide, a copy of the autopsy report shows.

The report, obtained by CNN legal analyst Lisa Bloom, was written by noted pathologist Dr. Michael Baden. He conducted a third autopsy on the body of Kathleen Savio at the request of Savio's family in November 2007.

Savio's body was exhumed on November 13, 2007, and state pathologist Dr. Larry Blum performed a second autopsy. Three days later, Baden conducted another autopsy on behalf of Savio's family.

Baden also noted that even though the body was partially decomposed, "bruises and contusions caused by blunt force injuries shortly before death" were still visible on the right breast, the upper right thigh and the abdomen.

The severity of those injuries, Baden said in his report, indicated a struggle.

As part of the investigation into the 2004 death of Drew Peterson's third wife, Kathleen Savio, the latest autopsy revealed signs of a struggle.

The autopsy said there was a 1-inch blunt-force laceration on the back of her head, five scraping abrasions and six blunt-force, black-and-blue bruises on her extremities, abdomen and buttocks, CNN reported Thursday.

State police renewed their interest in Savio's death when the next wife - the now 24-year-old Stacy - vanished in October. State police have labeled their investigation of the young woman's whereabouts a potential homicide.

Soon after, Will County State's Attorney James Glasgow announced he was reopening Savio's case and said the scene of her death appeared to have been staged to conceal a homicide.

Savio's remains were exhumed in November of 2007. Forensic pathologist Larry Blum examined her body and prepared the autopsy report released Thursday by Glasgow's office. A third autopsy was conducted by celebrity forensic pathologist Michael Baden at the behest of Savio's relatives. After his examination, Baden announced live on cable television his belief that the death was a homicide.

JOLIET -- Drew Peterson's attorney tried to get his legal fees paid through the disgraced former cop's home owner's insurance.

The attorney, Joel Brodsky, claimed Country Mutual Insurance Company is responsible for covering Peterson's defense against a wrongful-death suit filed by the family of his slain third wife, Kathleen Savio, said Keith G. Carlson, a lawyer representing the insurance outfit.

Carlson, on behalf of Country Mutual, filed to have the court declare the insurance company not only has no obligation to fund Peterson's defense, but that it should not be on the hook to pay damages if the accused wife killer loses the wrongful-death suit to Savio's family.

Carlson pointed out that while Peterson's homeowner's insurance provides coverage for bodily injury, it is not to be paid out in the event the policy holder deliberately caused it, as alleged in the wrongful-death lawsuit.

Brodsky failed to return calls for comment on why he believes the insurance company should have to foot the bill for his defense of Peterson.

The declaration filed by Carlson also named Henry J. Savio and Anna Doman as defendants along with Peterson. He explained that Savio's sister and father were listed to clarify that the insurance company is not obligated to pay them for any judgment entered against Peterson if he loses the wrongful-death suit.

Brodsky had demanded Peterson's trial begin within 120 days of his May 7 arrest, as dictated by law, but backed off when confronted by the mountain of evidence the state produced against his client.

A new trial date may be scheduled next month.

In his motion, Brodsky blamed the media for having "prejudiced the jury pool," and claimed the Internet search engine Google returned 2.95 million results for Drew Peterson.

Brodsky's motion will be argued in court Aug. 14.

In his motion to have the murder case moved, Brodsky took a shot at Will County State's Attorney James Glasgow's office for a Feb. 21 press release titled "Pathologist declares Kathleen Savio's death a homicide," which he claims "prejudiced the jury pool in regards to the most contested fact of the entire case — namely the manner of death."

Charles B. Pelkie, the spokesman for the state's attorney's office, pointed out that Peterson's "name is not even mentioned" in the release and argued prosecutors have done nothing to poison the jury pool.

"The state's attorney has adopted a very strict interpretation of the Supreme Court rules regarding pretrial publicity," Pelkie said. "We follow both the spirit and the letter of those rules.

"We release only information that the public has a right to know," Pelkie added. "We've taken every step possible to ensure that this office did not contribute to the media frenzy that surrounded this case."

Brodsky and Peterson, on the other hand, have plunged head first into the media frenzy, with both attorney and client making numerous TV appearances since Stacy Peterson's disappearance nearly two years ago.

Drew Peterson asks judge to move trial

Joel Brodsky earlier had signaled his intention of doing either that or asking that jurors be selected from another county, arguing that widespread publicity would make it difficult for the former Bolingbrook police sergeant to get a fair trial.

Prosecutors believe an impartial jury can be selected from Will County, a spokesman said.

"We have taken every step necessary on our part to avoid the media circus that was swirling around this case," said Chuck Pelkie. "We've only released information that is public information."

Today's filing cites stories about Peterson that ran in the Chicago Tribune, CNN, Huffington Post and local television stations. Some of the stories detailing the order of protection Savio took out against Peterson and the letters she mailed out before her death exposed jurors to "highly significant information which may not be admissible at trial," the motion says.

Peterson's attorneys also objected to a 2008 press release from the Will County state's attorney's office that announced that results of an autopsy on Savio's exhumed remains showed her death was a homicide. The complete autopsy was not released, only the manner of death, which his attorneys argued "prejudiced the jury pool in regards to the most contested fact of the entire case -- namely the manner of death."

No mention is made in the filing of the national TV interviews Peterson and his attorneys have given, though his attorneys also filed a CD containing other media coverage.

The case is scheduled to resume Aug. 14. As of now, the trial would be held in Will County Circuit Court in Joliet.

Bolingbrook, Ill. / Drew Peterson's defense team today released briefs responding to the prosecution's decision to appeal a court's dismissal of gun charges against Drew Peterson.

On Nov. 20, 2008, the Will County Circuit Court dismissed an indictment against Peterson for possession of a firearm with a barrel length of less than 16 inches.

The Abood Law firm and the law firm of Brodsky and Odeh responded in a brief filed in the Appellate Court for the Third District.

Oral arguments are pending with reply briefs from both parties due in the upcoming months.

Peterson's lawyer files change of venue motion
Drew Peterson's attorney is trying to get the former police sergeant's murder trial moved out of the county where he's charged because of what he calls extensive and inflammatory media coverage.

Thursday's motion by Joel Brodsky was expected. He's long expressed concern that Peterson might not be able to get a fair trail in Will County, where he's charged in the 2004 drowning death of Kathleen Savio.

Since Peterson's fourth wife, Stacy Peterson, disappeared in 2007 the case has been the subject of scores of news reports -- many of which have included appearances by Brodsky and Peterson.

Peterson is a suspect in Stacy Peterson's disappearance, but hasn't been charged.

The motion is scheduled to be heard in Will County on Aug. 14.

A new state law passed last year makes it easier to use hearsay statements from victims who were allegedly killed to prevent them from testifying against their attackers.

A date for a hearing on the motion has not been set.

A recently enacted state law written to allow the use of beyond-the-grave hearsay evidence against Drew Peterson should be declared unconstitutional, according to a motion that Peterson's attorneys are expected to file today.

"The new hearsay law ... would allow gossip, innuendo, rumor and back fence scandal to come into court and masquerade as evidence," the motion states. The motion is posted on the Web site of Peterson's attorneys.

"Having a newly minted homicide, but not having evidence to prosecute anyone for it, the Will Couny State's Attorney decided to draft a new law," the motion asserts. That law "would allow him to introduce otherwise inadmissable evidence against Drew Peterson."

The motion also attacks the fact that the hearsay law can be used in cases in which a crime predates passage of the law, pointing out that ex post facto laws violate the state and U.S. constitutions.

Drew Peterson was in court on Monday, as his attorneys unveiled a new strategy for his defense.

Attorneys filed a motion to challenge the Illinois hearsay law, which allows statements from Peterson's dead third wife, Kathleen Savio, to be used in his trial. They say it was passed four years after the alleged murder happened, and that it's unconstitutional.

"Any attempt to introduce evidence through this statute violates the ex post facto provision of the United States Constitution," said Andrew Abood, one of Peterson's defense attorneys, in a news release.

We'll find out Friday if Drew Peterson will be able to take his show on the road.

The man charged with the murder of his third wife, Kathleen Savio, and suspected of having something to do with the disappearance of his fourth wife, Stacy Peterson, filed a motion in Will County last month to move his trial.

The request cites the saturation of coverage in newspapers, on television and online which, according to his attorney, makes it difficult for the former Bolingbrook police sergeant to get a fair trial.

Of course, Peterson hasn't exactly shied away from the attention. Remember, he didn't seem to mind being arrested and charged with murder at all.

He's even taken his story nationally, which sort of makes the request to move the trial seemingly a bit disingenuous.

If unmoved, the trial will be held in Will County Circuit Court in Joliet.
