Secret document unsealed in Elizabeth Smart case
Prosecutors dropped a bombshell in the Elizabeth Smart kidnapping case today, revealing Brian David Mitchell and Wanda Eileen Barzee were indicted by a state grand jury last September -- a document that has remained secret until it was unsealed this morning. :eek:

EXCELLENT!!!!!!!!!!!!!!!! :dance: Elizabeth will be spared further trauma and I GURANTEE these nutcases will go away for a lonnnggggggggggg time!

I bet that there are already plea bargain talks taking place with Mitchell's lawyer. I hope he goes away for a couple of "forevers!"

Attorneys for accused Elizabeth Smart kidnapper Wanda Eileen Barzee on Friday asked that she be released into the community.
Third District Judge Judith Atherton replied with an emphatic "No!"
"That's out of the question," Atherton said. "Under no circumstances would I permit her release while all these serious felonies are pending."
Meanwhile, Salt Lake County prosecutors said they will initiate proceedings that could force Barzee to take anti-psychotic medications.

Noting that not all treatment alternatives have been explored, a judge ordered Friday a hearing to determine if Wanda Barzee, accused of kidnapping Elizabeth Smart, meets the criteria to be forcibly medicated in an attempt to restore her competency.

Attorneys believe the so-called "Sell" hearing will be the first of its kind in Utah. An exact date was not set Friday, but the court is looking at Nov. 22 as a possibility.

What makes the case unique is that Barzee is not considered a danger to the community. The only reason to restore her competency is so she can stand trial.

I'm confused. Aren't a lot of cases taken before the grand jury and the grand jury decide if the person/people should go on to trial or are indicted? Doesn't this just mean that they will go to trial....when they are sane enough? How does that keep Elizabeth from testifying?
