Oh this is fabulous news!

“Yesterday, we turned over a preliminary case file to the District Attorney’s Office for him (http://www2.hickoryrecord.com/topics/types/person/tags/zahra/) to start reviewing and consider what course of action he wants to take concerning who he wants to charge and what charges he wants to pursue,” said Chief (http://www2.hickoryrecord.com/topics/types/position/tags/chief/) Tom Adkins (http://www2.hickoryrecord.com/topics/types/person/tags/tom-adkins/) of the Hickory Police Department (http://www2.hickoryrecord.com/topics/types/organization/tags/hickory-police-department/).

On Adam

He, too, is scheduled to appear in a Lenoir courtroom Jan. 27, on charges of failure to return rental property, two counts of communicating threats, assault with a deadly weapon and four counts of worthless checks. He’s scheduled to be back in a Newton courtroom Jan. 21 on four worthless check charges.
These days Adam Baker (http://www2.hickoryrecord.com/topics/types/person/tags/adam-baker/) is keeping a low profile.
“We have not requested any further information from him (http://www2.hickoryrecord.com/topics/types/person/tags/adam-baker/) within the last month,” Adkins (http://www2.hickoryrecord.com/topics/types/person/tags/tom-adkins/) said.

Stopped wasting their time? Well the wording of this entire article certainly leaves me to believe they expect to charge both concerning the heinous murder of this precious child.

I'm desperately hoping this is handled within the next week. Precious Zahra doesn't get to spend Christmas here on earth, and I despise the thought that whoever is responsible may get to celebrate the holidays with family and/or friends.

Feeling the exact same way! Unfortunately I don't think any charges will come until after the holidays, hope I am wrong because no mercy should be given to anyone involved.

I truly understand how daunting the task of finding out who harmed this precious child must be/was. But, like every one else I am saying, Its about time. Hopefully all involved in this get charged before Christmas. I can honestly say that would be one of the best presents I have ever received.

Though, it would be a mercy to wait, possibly, to the LE and DA office, who might have a chance to decompress the next couple of weeks, which might allow them to get a fresh start on the charges.

My thoughts too....

Whoever killed/dismembered/contributed should not be on the street this Christmas.

Kind of OT: Investigator in Zahra case charged with DWI after crashing into tree

Falowski is listed on key search warrant documents in the Zahra Baker case. Zahra was reported missing in early October, but police said on Nov. 12 that she was dead – and evidence later revealed she had been dismembered.

This is being discussed on the "Emotional Toll" thread. However, I am confident this will not affect Zahra's case at all.

Falowski was among the officers investigating the Zahra Baker case. Hickory Police Chief Tom Adkins said Falowski’s assignment to administrative duty will not adversely affect the Baker case or the other cases he was working on.

She looks so like her mum in that photo with Santa. Hoping her mum can still enjoy Christmas through the eyes of her other little ones as she mourns the Christmas that could have been with Zahra.

As to the file being turned over. I do not want to say what my fears are. I am afraid we won't see charges for a while. IMO the article and the tone of the statements from LE regarding teh handing over the case file does not give me confidence that there is a slam dunk case here against either EB or AB. I sincerely hope I am wrong but I have a bad feeling.

Based on this (http://i296.photobucket.com/albums/mm166/crankycrankerson/Zahra%20Baker%20%20-NC-/CampQualityzahra.jpg) picture, which we know appeared in the Sept. 22/08 issue of the Townsville Bulletin, I'd say this picture had to have been taken during her time in the States. She appears to be much taller, and her permanent teeth have come in. If I had to guess, I'd say this was from Christmas 2009.

Also note that she is wearing the same shirt that she wore in many pictures. I truly believe that she adored that shirt. She was just so pretty, she looked so happy. I hope that she has a beautiful Christmas in heaven with God and his angels.

O/T somewhat I know but I couldnt help it.

Gosh! Had my post all written out and lost it in cyberspace!

I am glad that LE seems to have done all they can in Zahra's case and turned it over to the D.A. to charge. There will probably be no movement until after the first of the year, but then I hope to see an inditement or inditements.

So sad, this investigator probably never saw a case like this where a child is dismembered, it's taken it's toll on everyone...I sure hope he's okay but this might just end his career...poor guy! JMHO

I'm thinking the prosecutor will send this case to The Grand Jury to get all indicted for Zahra's death. I wonder, did the autopsy report come back? JMHO

Charges in Zahra Baker case on hold until after the New Year

http://www.wbtv.com/Global/story.asp?S=13726990

Despite giving a preliminary investigation report on the Zahra Baker case to the District Attorney last week, Hickory Police officials do not expect any decision on possible charges to come quickly.

On Tuesday, Dec. 21, Hickory Police Chief Tom Adkins would not go into details, but would only say, "the investigation is not over."

Due to the approaching holidays, many of the principals that would be involved in any decision on possible charges would not be able to get together until after the first of the year.

The Catawba County Grand Jury meets on January 3rd and sources tell WBTV News that it would be difficult to have a presentation ready by that session.

In the past, District Attorney James C. Gaither has said there would be "No rush to judgment in this case, that officials would wait until all the evidence is in before deciding what to do next."

Police sources confirmed on Tuesday that not all of the lab results on evidence are back yet.

Seriously, I get tired of Christmas being used as an excuse to not get a job done. Joe Blow can't put his daily job off because of Christmas. Why does it seem like anything court related can?

As someone who doesn't celebrate Christmas, I can say, in my experience, everyone uses it as an excuse to blow off work, even if they show up. Service this week is awful, everywhere, and it is impossible to get anything done before New Years now.

However, there are a great number of "Joe Blows" who are involved in charges, not just the Big Wigs in the offices, and many of them are likely off a lot of days between now and Jan 4, as well, so it's not just one special rich guy making everybody wait.

Tis the season and all that.

JMOO

ETA: I also don't think it is a small factor that the budget re-starts in January, and the media will be "back to normal." Anything done this week would just go to continuance or sit on someone's desk anyway, so, IMO, it makes sense to wait. Why rush to prepare something that isn't going anywhere for a couple weeks? (Esp if the evidence isn't ready.)

FWIW, I feel the meaning of "justice delayed is justice denied" quite keenly, but I also try to live my life according to "do it once; do it correctly." So, my aphorisms are at odds at the moment.

But, happy holidays to everyone! (Take the breather and enjoy it.)

Well, Christmas is the holiest of seasons to Christians so I understand why this week is not a week of hard work. People's minds are on family and those who are close to them. It's a time to put aside the things we worry about all year long to just focus on Christmas. I don't begrudge anyone for wanting to forget work for just that little while. The world will still be here when it's over.

But I also understand the frustration of not moving forward every day on this case. But what can you do?
