The Daniel Pelosi trial for killing millionaire Ted Ammon in his Hamptons mansion begins this week in a Suffolk County, NY courtroom. Here's a link to the story in The NY Daily News:

Pelosi was the blue collar guy who took up with Ammon's wife Generosa who has since died of cancer and who cut him out of her will.

There's an interesting article in today's Times about the trial
http://www.nytimes.com/aponline/national/AP-Banker-Slain.html
That article talks a bit about the prosecution and the strategy of the defense in this circumstantial evidence case.
Only thing I take exception to is the notion of Generosa as "beautiful." Not in any photo of her I ever saw.

Delay expected in start of Pelosi trial:
<<Suffolk County prosecutor Janet Albertson plans to ask Judge Robert Doyle to first hear legal motions and arguments involving the witness, the sources said.
The prosecution witness, an expert on stun guns, is expected to testify that small double-burn marks on Ammon's body were consistent with those made by stun guns, possibly one that Pelosi owned.
>>
Today's Newsday
http://www.newsday.com/news/local/longisland/ny-pelosi0328,0,6695212.story
<<Other than a 30-minute glimpse into the case at Pelosi's arraignment Tuesday, authorities have revealed little of their exhaustive investigation. It took police a year and a half and a grand jury nine months to charge him with second-degree murder. Fifty-one witnesses and more than 100 exhibits were brought before the grand jury.
Albertson said that evidence includes witnesses who say Pelosi implicated himself, missing pieces of Ammon's security system, and stun guns Pelosi purchased before the murder.
The defense starts from an unwavering, if unsurprising, assertion that Pelosi has been wrongly accused.
As the case moves into the courtroom, it's easier to see what is missing than what is there. No confession. No eyewitnesses. No murder weapon. Nothing to forensically connect Pelosi to the crime.
Nevertheless, such cases can be just as compelling as those built on forensic evidence and eyewitness accounts, prominent defense lawyers said. The lengthy investigation could have given the district attorney's office a chance to amass a pile of powerful circumstantial evidence, including phone records, store receipts and more, said defense lawyer Steven Wilutis of Miller Place.
Phone records could show who Pelosi was talking to before, during and after the crime. Store receipts could reveal when and where Pelosi bought his stun gun, which Albertson said was used in the attack.
"If the DA has everything she says she has, then it strikes me that there's a stronger case," said defense lawyer John Ray of Miller Place.>>
Lisa,
I remember when this murder happened, and I remember thinking he was so guilty and the wife had to know. Why else would she live a few million in case he was arrested?
I'm going to check out those links after I do some of my homework. They will be my reward for working hard!

Those articles were interesting. I found the last one to be the most compelling. I wonder just what she knew? Personally, I thought they both involved.

She certainly benefited from Ted's murder. She got the money and the kids and didn't have to share with Ted. I agree. I think that if Danny did it, he did it for him and Generosa.

Lawyers for Daniel Pelosi say a call from Theodore Ammon to a friend may shed light on events of his death

Hours before East Hampton millionaire Theodore Ammon was killed, he called a friend to tell her he was afraid of some men on what he believed was a gay beach.
According to an April 5 letter written by Assistant District Attorney Janet Albertson, Ammon made the phone call at 9:44 p.m. on Oct. 20, 2001, to Lori Finkel, a friend of Ammon from Manhattan who had a home in Bridgehampton.

Wow, that last Newsday article was something else! This case has every kind of strange detail anyone could imagine. Is it going to be televised?
No, ThoughtFox, it will not because the NY Legislature in their wisdom <cough cough--- they have NONE> chose to let the TV in courtrooms "experiment" die and not revive it. So no NY State trial is televised.
However, because of the sexy nature of this trial, I wonder if CTV might not cover it. It's also out on Long Island, close by, so that might increase the likelihood. It's such a juicy case, with money, sex, murder and mystery!
I hope others will come over to this lonely little thread and if there's enough interest, perhaps Danny boy or maybe Ted Ammon can rightly get a forum of his own.
EDITED TO ADD: TF, you like Columbo, too? Which episode was "How to Dial a Murder"---- was it Nicol Williamson, the motivational guru who murdered his friend for having the affair with his wife by setting his dogs on him with the trigger word "Rosebud"??

Pelosi jury is
on fast track
Jury selection for the murder trial of Long Island electrician Danny Pelosi got a whole lot faster yesterday.
Instead of being interviewed individually, potential jurors were quizzed by the judge, prosecutor and defense attorney in large groups.
"This way, jurors will be less bored.
This is going faster," said Pelosi attorney Gerald Shargel.
It took three days last week to interview 14 possible jurors. Yesterday, groups of 17 potential jurors were interviewed at once.
Suffolk County authorities expect the jury of 12, plus six alternates, to be chosen by the end of this week.
Pelosi, 41, is accused of bludgeoning millionaire Ted Ammon to death in Ammon's East Hampton mansion three years ago.
Three months after the slaying, Pelosi married Ammon's wealthy widow.
She died last year of cancer - after cutting Pelosi out of her will.

Pelosi surrenders in financier's slaying March 23, 2004
(CNN) -- A second man has been charged in connection with the October 2001 beating death of Long Island multimillionaire Ted Ammon.
Christopher Parinno, 36, a Long Island carpenter and electrician, Thursday pleaded not guilty to charges that he was an accomplice to the crime and was expected to post $50,000 bail.
He was indicted Wednesday on charges of criminal facilitation -- allegedly engaging "in conduct which provided" the killer the "means or opportunity" to commit the murder -- and hindering prosecution for allegedly "suppressing physical evidence that might aid in the discovery or apprehension" of the killer.
Suffolk County District Attorney Thomas Spota has charged Daniel Pelosi, 40, also an electrician, with committing the crime, striking Ammon in the head 31 times with a blunt object. Ammon was found dead in the bedroom of his mansion in the tony Long Island beach town of East Hampton.
Pelosi pleaded not guilty on a single charge of second-degree murder on March 23 and is being held without bail. If convicted he could receive 25 years to life in prison.
If convicted of aiding Pelosi, Parinno could be sentenced to a maximum of 15 years in prison.
"We've always maintained that we have no complicity in the murder," Parinno's attorney Ray Perini said in a telephone interview. "When we get this in front of a jury we are confident he will be found not guilty."

OPENING STATEMENTS IN PELOSI TRIAL TODAY
Prosecutors want to cross-examine murder suspect — if he takes the stand — about his criminal history

Lawyers are expected to give their opening statements today in Daniel Pelosi's murder trial and prosecutors intend to cross examine Pelosi if he takes the stand.
Suffolk prosecutors want to question Daniel Pelosi about more than 15 criminal convictions dating to 1980, as well as a number of police complaints and pending charges, if he takes the stand during his murder trial in Riverhead.
While defense lawyers won't say if Pelosi will testify, prosecutors could be entitled to question him about his criminal history if he does. Pelosi was arrested more than a dozen times on charges including drunken driving, assault, burglary and violating his parole, Parson said.

DA: BOOZY PELOSI BEAT BOTH WIVES
BY ROBERT GEARTY
DAILY NEWS STAFF WRITER
Prosecutors in Danny Pelosi's murder trial want jurors to hear evidence that the Long Island electrician beat his wives, including Generosa Ammon - the woman he allegedly killed for.
Violent acts by Pelosi, before and after financier Ted Ammon was bludgeoned in his Hamptons mansion, could help undermine his credibility should he take the stand, prosecutors said.
Prosecutor Ming Parson said at a court hearing yesterday that on more than one occasion, Pelosi physically abused Generosa Ammon "during his bouts with alcohol."
Parson said that Pelosi also was violent toward his first wife, Tamara, slapping her in the face during a fight in June 1996.
"He threatened to kill her, ruin her career and told her to watch her back wherever she was," said Parson.
Pelosi attorney Paul Bergman said Pelosi never laid a finger on Generosa Ammon. ....

PROSECUTOR: PELOSI MADE THREATS
by Robin Topping
Moments before lawyers were about to give opening statements in the Daniel Pelosi murder trial, Suffolk prosecutor Janet Albertson rose to deliver startling news to a packed courtroom in Riverhead.
With the jury waiting to be brought in, she said she had just learned of tape recordings in which Pelosi, while in jail, made "direct admissions" to the murder of millionaire Theodore Ammon. Pelosi had also "conspired" to intimidate and harm witnesses, "expressed a desire" to tamper with a juror, and threatened Albertson's own children, she said.....

PELOSI 'PLOT' VS. DA
by Kieran Crowley
September 30, 2004 -- The Ted Ammon murder trial came to a screeching halt yesterday when a prosecutor made stunning claims that accused killer Danny Pelosi was caught on tape threatening her two children, plotting to intimidate a juror — and even admitting to the slaying.
The bombshell allegations postponed opening arguments and could lead to a mistrial.
Suffolk County prosecutor Janet Albertson's allegations that Pelosi had been caught on jailhouse tapes as recently as last weekend confessing to the 2001 murder of millionaire Ammon drew gasps in the courtroom.

Jury-Tampering Claim Halts L.I. Murder Trial

RIVERHEAD, N.Y., Sept. 29 - It was a moment three years in the making as the Long Island electrician accused of killing the Manhattan financier R. Theodore Ammon strode into court here, winked at his family and sat down with his lawyers, ready to begin his murder trial.

Despite allegations made in court this week that Daniel Pelosi admitted to killing millionaire Theodore Ammon, jury tampering and other crimes, prosecutors will most likely use only the statements pertaining to the murder in his ongoing trial, Suffolk District Attorney Thomas Spota said Thursday.
Spota cautioned that any ruling on the evidence must come from State Supreme Court Justice Robert W. Doyle, the judge on the murder case, and other prosecutors must concur with his opinion. But, he said, since the new evidence is technically not part of the murder case against Pelosi, "I don't think we could introduce the new crimes."....

Tired 'killer' Danny's complaint: jailhouse snitch

A jailhouse informant who told prosecutors Danny Pelosi boasted of Ted Ammon's murder said the accused killer complained the bludgeon slaying was such hard work, he "should have just put one in his head."
Crackhead and small-time criminal Clayton Moultrie said Pelosi made a number of incriminating and threatening statements in the "bullpen" inside the Suffolk County Jail in Riverhead last month, according to a written statement Moultrie gave to Suffolk DA Thomas Spota's office.
The 39-year-old Riverhead man said Pelosi also threatened witnesses set to testify against him, calling them "dead meat" and claimed to have arranged "a bloodbath" for them. He said Pelosi offered the former inmate $100 for each tooth he knocked out of any prosecution witnesses' mouths....

Police have searched Danny Pelosi's jail cell and confiscated the accused killer's letters and notes as well as piles of defense documents, sources said.

After the papers were reviewed by a judge not involved in Pelosi's trial, some documents were ordered returned to the defense because they are confidential lawyer-client materials, the sources said.

I'm not convinced of this guy's guilt. I think there may be other possibilities. (i.e., the ex-wife hired someone). Or, she could have done it herself. From what I read, it was an overkill, and that is usually a sign of passion.
The problems that I'm running into now, but have just started reading is the other guys in jail saying he's admitted to it. Why in hell would any moron do that?
Also, he seems to have cared for and cares for the twins. It's puzzling.

WEEPING DRIVER DESCRIBES FINDING BODY
Says he and Theodore Ammon's partner investigated after they hadn't heard from him for two days
by Samuel Bruchey, staff writer
When the two men stepped inside Theodore Ammon's sprawling East Hampton mansion on Oct. 22, 2001, they had not heard from the millionaire venture capitalist in two days, and they had the feeling something was wrong.
"We called out 'Ted, Ted,' but nobody answered," Ammon's chauffeur, Milton Macias, testified in a Riverhead courtroom Monday....

GENEROSA THREATENED ME

Murdered millionaire Ted Ammon's family chauffeur yesterday revealed that Ammon's estranged wife twice cursed at him, threatened to break his leg and told him she'd make him and his family disappear if he didn't stop working for her husband.
Milton Macias, 62, of Manhattan, said that eight months before Ammon's October 2001 murder inside his East Hampton mansion, Generosa Ammon screamed at him outside the Stanhope Hotel on Fifth Avenue, where he arrived to pick up her twin children for a court-ordered visit with their father.

By PATRICK HEALY
RIVERHEAD, N.Y., Oct. 18 - The ivy-covered mansion on Middle Lane in East Hampton was quiet when R. PELOSI TRIAL TESTIMONY FOCUSES ON FINGERPRINTS
by Robin Topping
The prosecution in the Daniel Pelosi murder trial has shown the jury a crime scene video, dozens of photographs and exhibits, and yesterday offered police testimony on almost two dozen fingerprints taken from the East Hampton mansion where Theodore Ammon was killed in October 2001.
But while Daniel Pelosi's prints were found in four locations in that home, there were none in the master bedroom where Ammon was beaten to death. The other identified prints came from family members who had lived in the house, along with Pelosi, including Generosa Ammon, Ammon's widow and Pelosi's then-girlfriend, and the Ammons' two children. Prints were also matched to Ammon himself, and an East Hampton police sergeant who was one of the first on the scene, said Suffolk Det. Anthony Piazza, who processed the prints and testified in Riverhead yesterday....

For more than four hours on that day, Oct. 23, 2001, Kundle, who owns a security systems business in Massapequa, answered questions about the eight hidden cameras the size of pin heads, and a computer hard drive that recorded everything, tucked under the eaves on the second floor where no one could find it....

ACQUAINTANCE SAYS PELOSI TOLD HIM OF PLAN TO MURDER EAST HAMPTON FINANCIER

Son’s unanswered plea
In Daniel Pelosi’s letters to his father, he asks forgiveness and reconciliation, but dad elects to be estranged
BY SAMUEL BRUCHEY
STAFF WRITER
October 28, 2004
Desperate and lonely, Daniel Pelosi wrote a letter to his father from jail begging to stop their feud.
"I am sorry and I love you," he wrote in April 2003 while serving time for drunk driving. "I do not want to carry the cross of pain in never hearing your voice again."
Two months later, in one of his last communications before testifying against his son in Pelosi's trial for the murder of Theodore Ammon, Robert Pelosi penned a one-page response. "I know you have tried to call me on the phone," it began, "however, I cannot find it in myself to talk to you at this time."
The two letters have been presented to a jury in Riverhead. Neither implicates Pelosi. Both, however, illuminate a relationship torn by Daniel Pelosi's arrests, the strain of his brother James' death in 2002, and his marriage to Ammon's widow, Generosa, three months after the murder....

Pelosi in Ted's

BY ROBERT GEARTY

DAILY NEWS STAFF WRITERS
Long Island murder suspect Danny Pelosi told a lawyer he was inside Ted Ammon's East Hampton mansion the day the Wall Street mogul was slain there, bombshell court records filed yesterday reveal.
If true, the information blows a gaping hole in Pelosi's claim he was nowhere near Ammon's home when the millionaire was bludgeoned.
In a private chat with lawyer Michael Dowd, Pelosi allegedly said he went to the mansion Oct. 21, 2001, to remove the surveillance system's hard drive, according to papers filed in Suffolk County Surrogate Court.
Pelosi allegedly said he took the hard drive because it contained digital recordings of Ammon's estranged wife, Generosa, talking to some men about whacking her husband.
"I want you to know that there was a time that [Generosa Ammon] had some guys in the house, at the beach house, that she was talking to about killing Ted," Pelosi allegedly told Dowd, who recalled the conversation in a sworn Oct. 4 deposition.
"I went into the beach house the weekend Ted was murdered and took the hard drive of the surveillance unit," Dowd, who was Generosa Ammon's divorce attorney, said Pelosi told him.
The new evidence surfaced as Dowd was being questioned by an attorney representing Pelosi in a civil case in which he is challenging Generosa Ammon's will....

I believe that Generosa had a screw loose and probably was egged on by Pelosi to make sure that she got her 'fair share' of Ammon's money. I also believe that Pelosi killed Ammon. Both Generosa and Pelosi were partners in this crime, with Pelosi doing the dirty work. I hope that Pelosi gets what he deserves--and it's not Ted Ammon's money. What a sad, sad story (for Ted and his children, that is).

Prosecutors hoping murder defendant talks his way to conviction
By FRANK ELTMAN

RIVERHEAD, N.Y. -- Danny Pelosi just can't seem to shut up.
The accused murderer whispers to supporters at his trial. He chats with journalists seated behind the defense table. He loudly swaps insults with his father in open court.
And that's not all. Prosecutors say Pelosi spoke about killing his lover's millionaire husband to another girlfriend; to his boss; to a handful of fellow inmates. All are providing damning testimony against the Long Island electrician, who might just talk his way into a life sentence.
"It's only the second inning. This is a long ball game," he optimistically declared last week on a day when his ex-girlfriend testified about his loose lips, detailing Pelosi's admission of guilt in the brutal slaying.....

Mystery Hair Was Victim's, Expert Says at Pelosi Trial
By PATRICK HEALY
RIVERHEAD, N.Y., Nov. 1 - At the opening of Daniel Pelosi's murder trial, his lawyer told jurors that a crucial piece of evidence for the defense would be a mysterious pubic hair found on the shoulder of the man he is accused of beating to death, but not collected by the police.
But on Monday, a Suffolk County forensics expert testified that the missing hair had actually been the victim's own, growing from his left shoulder. The expert, Donald Doller, said investigators did not collect the hair because it was attached to the victim, R. Theodore Ammon, a multimillionaire who had made his fortune on Wall Street during the 1980's.
Mr. Doller's testimony here in State Supreme Court could damage a defense theory that Mr. Ammon was secretly bisexual and had been killed by a gay lover inside his East Hampton mansion in October 2001. Prosecutors say Mr. Pelosi was a greedy opportunist who romanced Mr. Ammon's estranged wife, Generosa, then beat Mr. Ammon to death to get at his $80 million fortune....

Jurors in Daniel Pelosi's trial for the murder of Theodore Ammon have been warned not to visit the sprawling estate where the millionaire financier was bludgeoned to death three years ago.
So prosecutors have placed a miniature version of the home inside the Riverhead courtroom.
Monday, jurors gathered around the 9-foot model of the second-floor as forensic scientist Donald Doller told them that Ammon was in bed when the brutal beating began, that one of the double doors to the bedroom was closed, and that a window opposite the bed was open and a screen removed.
Standing over the cardboard, fiber and balsa wood re-creation, Doller pointed out blood spattering on the outside and inside of a bedroom windowsill, atop a short stack of books on the floor, along a bench, and on the wall behind Ammon's bed.....

Victim's Home Was Watched Using Video, Pelosi Sister Says
By PETER C. BELLER
RIVERHEAD, N.Y., Nov. 3 - On the night the multimillionaire R. Theodore Ammon was beaten to death, Daniel Pelosi, the man accused of his murder, used a remote video surveillance system to check on whether Mr. Ammon was at his East Hampton mansion, Mr. Pelosi's sister testified Wednesday.
Mr. Pelosi, an electrician, had overseen the installation of a sophisticated video surveillance system at the mansion that allowed him to see live video of the interior and exterior of the house via a laptop computer connected to the system by a modem.
Mr. Ammon and his wife, Generosa, were in the midst of a bitter divorce in 2000 when Mr. Pelosi met Ms. Ammon while doing renovation work at her Upper East Side townhouse. They began an affair and married three months after Mr. Ammon's death in October 2001. Prosecutors say Mr. Pelosi wooed Ms. Ammon and killed Mr. Ammon to get at his $80 million fortune....

i have to say i was in the court room yesterday and a couple of other days, you really don't hear everything that goes on. I didn't get the impression Ms Lukert was testifing against Danny, just what she knew about the relationship of Danny and Ms Ammon and of course the night that they assume the murder took place and the conversations between the two. Also, the blood specialist kept contradicting himself on the stand...imo.

So, shopgirl, tell us more about your observations and experiences out in Riverhead!
Barbara Lukert, sister to Danny Pelosi, was described as a "hostile witness" so I guess she was subpoenaed and required to be there to testify. Frankly, I think when it comes to evidence against him, that only adds to its credibility.

She was subpoenaed, I beleive a few more family members will be also. I wouldn't say she is "hostile".
The courtroom has a very strange atmosphere..It goes from very intense one minute to light with laughter breaking out sometimes. Mr. Shargel seems to have a great presence in the court room. He seems very confident and really had the blood expert on the ropes yesterday, Ms Albertson seemed to shoot him looks of disdain when that was happening and tried to break the rhythm of Shargel and at one point asked to have the jury removed from the room.
Danny is also an interesting character, he does smile alot, especially at his family..

Hi Lisa,
I read the same report about her being hostile, i believe Janet ALbertson mentioned it in her opening. She called her something else yesterday, it seemed like she was both a defense and prosocution witness. I wish i could remember what term she used. There were some grand jury transcripts missing from what the DA had turned over and ALberston figured since she was close to the defendant he knew when she did go to grand jury that is when she used the term.
The jurors were listening intently...but not really any noticable reaction from anyone. WIth all the press there it must be very intimidating for them.
BY the way, the press gets the 1st 2 rows of seat on either side...I thought that was odd.
I do live in suffok and hope to go back...

The themes of sex, avarice and revenge that have coursed through the murder trial of Daniel Pelosi suddenly seem pedestrian.

Now, the Pelosi Trial Invokes a Realm of the Supernatural
By PATRICK HEALY
RIVERHEAD, N.Y., Nov. 4 - The murder case against Daniel Pelosi, the Long Island electrician accused of murdering the multimillionaire R. Theodore Ammon, was already plenty bizarre, with tales of $300,000 hotel bills, secret surveillance systems and stolen human ashes.
But on Thursday, it entered the realm of the occult.
Mr. Pelosi's lawyer, Gerald Shargel, argued in court that members of Mr. Pelosi's family had turned on the suspect, testifying against him because they believed they had been cursed. They accused Mr. Ammon's estranged wife, Generosa, of being a witch, Mr. Shargel said. Ms. Ammon married Mr. Pelosi three months after her husband was fatally beaten in his East Hampton home in October 2001.

DANNY DEMON DELAY
by Kieran Crowley
Danny Pelosi's murder trial came to a screeching halt yesterday when his lawyer asked Pelosi's sister — a key prosecution witness — if her relatives thought Ted Ammon's widow was a devil woman who put a "spell" on the family.
Suffolk County prosecutor Janet Albertson objected to the line of questioning and the jury was excused. Albertson told Supreme Court Justice Robert Doyle that Gerald Shargel's claims were "ridiculous" and should be excluded.
Shargel argued he had the legal right to cross-examine the murder suspect's sister, Barbara Lukert. He said he wanted to prove to the jury the Pelosi family was truly spooked by Danny's lover, Generosa Ammon....
That is one kooky family. Shargel is beginning to sound like Geragos with his outlandish theories and stories.

Nanny Says Pelosi Admitted Killing and Threatened Her
By PETER C. BELLER
RIVERHEAD, N.Y., Nov. 10 - A British nanny who cared for Theodore and Generosa Ammon's children testified on Wednesday that a drunken Daniel Pelosi sidled up to her one night and whispered in her ear that he had beaten Mr. Ammon to death. The next day, she said, he threatened to do the same to her.
The nanny, Kathryn Ann Mayne, is the second witness at Mr. Pelosi's murder trial to testify that he admitted killing Mr. Ammon, a wealthy New York financier, and she also said Mr. Pelosi claimed that the victim had offered him money to spare his life.
At the time of the October 2001 killing, Mr. Pelosi was having an affair with Ms. Ammon, who was estranged from her husband and in the middle of a bitter divorce. They married three months after Mr. Ammon, 52, was found beaten to death in his East Hampton home.
Last month, a former girlfriend of Mr. Pelosi's testified that he had admitted killing Mr. Ammon.
In her testimony in Suffolk County Court here, Ms. Mayne, who inherited $1 million from Ms. Ammon's estate, said Mr. Pelosi came home drunk one night to the house he shared with Ms. Ammon in Center Moriches. "I was sleeping on the couch," Ms. Mayne said. "Generosa didn't want to be alone in the house when he came home.
"He came and sat right next to me and whispered in my ear about how he had beaten him and beaten him," she said, referring to Mr. Ammon. The next day, she said, Mr. Pelosi told her, " 'I'm going to kill you.' "...

Kathryn Ann Mayne was dozing on the couch in the Center Moriches home where she cared for Generosa Ammon's children, when Daniel Pelosi bent over her and whispered that he had killed millionaire Theodore Ammon, she testified at Pelosi's murder trial Wednesday.
Pelosi, who had been drinking that night, told her "about how he had beaten him and beaten him and he had begged for his life ... and there was blood everywhere," Mayne said.
During questioning by Assistant District Attorney Janet Albertson, Mayne said Pelosi complained to her that Generosa, who inherited Ammons' fortune after his October 2001 murder, was not giving him the money he needed to pay gambling losses and other mounting debts. Pelosi told her, "I gave this woman money. I killed her husband. And now she won't give me a few hundred thousand dollars," Mayne recalled on the stand in Riverhead....

Phone log clues debated in Pelosi case
Cell phone records pinpoint where defendant was in early morning hours

Daniel Pelosi was in the Manorville area when he used his cell phone to call a friend at 1:28 a.m. -- the last call he made in the predawn hours of the day Theodore Ammon was murdered in East Hampton, phone records show.
The records were detailed Monday at Pelosi's murder trial in the testimony of prosecution witness John Anninos, a regional security manager for Sprint Communications. But the timing of the calls lie at the heart of the defense's case.
Pelosi's attorney Gerald Shargel of Manhattan has contended that records from cell towers that transmitted calls Pelosi made the night of Oct. 20 into early Oct. 21, 2001, indicate he was not in East Hampton when Ammon died. Shargel argues that Ammon, who was murdered in the master bedroom of his mansion on Middle Lane, was dead by 1 a.m. on Oct. 21....

After weeks of testimony from more than 20 witnesses, Daniel Pelosi's fate may hinge on the contents of the stomach of the man he is accused of murdering.
Suffolk Deputy Medical Examiner James Wilson told a jury in Riverhead this morning that he examined Theodore Ammon's stomach during an autopsy and found particles of tuna, wild rice and asparagus -- the remains of what the millionaire financier had eaten on October 20, 2001 -- his last meal. Expert asserts stun gun's use in Pelosi case
Prosecution witness contends that the device was used on Ammon the night he was killed
BY ROBIN TOPPING

Marks found on the back and neck of Theodore Ammon probably came from a stun gun, a prosecution witness testified yesterday in the Daniel Pelosi murder trial.
"It's quite possible and consistent with the use of a taser," said Dr. Robert Stratbucker, the medical director of Taser, an Arizona-based company that makes stun guns. Later, under strenuous cross-examination by defense attorney Gerald Shargel, Stratbucker went further, declaring, "There is nothing in the world that could have created this but a taser."
Assistant District Attorney Janet Albertson said outside of court that the use of the gun on Ammon provides an "evidentiary link" to Pelosi because of testimony that he bought at least one of the devices before the murder. Pelosi turned over a stun gun to Suffolk police before his indictment on charges of murdering Ammon in October 2001. Police tested the gun but found no link to the crime....

Stun Gun Used on Ammon, Expert Says
By PETER C. BELLER
RIVERHEAD, N.Y., Nov. 23 - Whoever killed R. Theodore Ammon, the Wall Street financier, shocked him repeatedly with a stun gun, leaving marks all over his body, including a large welt on his neck where the skin was burned away, an expert witness testified Tuesday at the trial of Daniel Pelosi, the man accused of killing Mr. Ammon.
That mark, as well as red dots and streaks on the victim's back, were made by a Taser gun before he was killed, said Dr. Robert Stratbucker, the medical director for Taser International, which manufactures the weapon.
Mr. Ammon, 52, was found beaten to death in the master bedroom of his East Hampton house in October 2001. Mr. Pelosi, accused of murdering Mr. Ammon to get at his $80 million fortune, owned several stun guns, witnesses have testified. Prosecution Rests, Stronger Than Expected, in Long Island Murder Trial
By PATRICK HEALY
If Daniel Pelosi, the Long Island electrician accused of killing a Manhattan financier, ever wonders where his friends have gone, he need look no further than the Suffolk County prosecutor's witness list.
A woman who once loved Mr. Pelosi, 41, testified that he had admitted to the 2001 murder of the financier, R. Theodore Ammon. A former friend and business partner said that Mr. Pelosi had plotted the murder a year in advance. An inmate Mr. Pelosi befriended in jail secretly recorded their conversations. Even Mr. Pelosi's father testified for the prosecution and then scolded Mr. Pelosi from the witness stand.
After six weeks of testimony from 40 witnesses in Long Island's most-watched murder trial in a decade, prosecutors have presented a stronger case against Mr. Pelosi than anyone had expected, painting him as a greedy thug who wooed Mr. Ammon's estranged wife and committed the murder to get at Mr. Ammon's fortune, according to lawyers who have followed the case....

Niece Provides Partial Alibi in Murder Trial
By PATRICK HEALY
RIVERHEAD, N.Y., Dec. 1 - If Daniel Pelosi is found not guilty of murdering R. Theodore Ammon, he may owe his freedom in part to his 15-year-old niece.
Mr. Pelosi's niece, Kelly Lukert, provided a partial alibi for his whereabouts in the early hours of Oct. 21, 2001, the time during which Mr. Ammon was beaten to death in his sprawling East Hampton home. On Wednesday, Ms. Lukert testified that Mr. Pelosi had stayed at her house that night, and popped into her bedroom between 3 a.m. and 4 a.m. to ask where he could find blankets....

I don't believe this guy. I mean I believe this guy had anonymous sex with someone in 1999 but I don't believe it was Ted Ammon.
I don't believe the niece either.

I can't believe this day and age people are still risking their lives for anonymous sex. I would hope Ted was smarter than that.

Forensic pathologist backs Pelosi's alibi
BY ROBIN TOPPING

December 3, 2004
The wine left in Theodore Ammon's stomach shows he was killed just three or four hours after his dinner -- when Daniel Pelosi was at least 40 minutes away -- according to a forensic pathologist hired by Pelosi's defense.
Werner Spitz, the former chief medical examiner for Wayne County, Mich., and a respected consultant and lecturer on determining the time of death, testified Thursday that he disagreed with the pathologist who performed Ammon's autopsy, who concluded he died four to 10 hours after his last meal.
Ammon ate his dinner of tuna, wild rice and asparagus between 9 and 9:30 p.m. in East Hampton on Oct. 20, 2001. Pelosi, who is charged with Ammon's murder, was in Center Moriches at 1 a.m., having arrived from Manhattan, according to witnesses. His cell phone was used from Center Moriches at 1:28 a.m. that night....

'DINNER' DEFENSE
by Kieran Crowley
A forensic pathologist testified yesterday that Danny Pelosi could not have killed Ted Ammon because the mogul died three or four hours after eating dinner — before Pelosi could have gone to the victim's East Hampton mansion.
Dr. Werner Spitz also said that, contrary to testimony by prosecution witnesses, marks on Ammon's neck and back were not caused by a stun gun, but by strangulation.
Spitz, a Michigan pathologist who has testified about the John F. Kennedy assassination and the JonBenet Ramsey murder, said the food-digestion process proves Pelosi's innocence....

Ammon's last meal
may serve Pelosi

DAILY NEWS STAFF WRITER
The stomach contents of Wall Street mogul Ted Ammon suggest he was slain hours earlier than prosecutors claim, a defense expert testified yesterday - handing Danny Pelosi a potential alibi.
Forensic pathologist Dr. Werner Spitz said the millionaire was killed between midnight and 1a.m. Oct. 21, 2001, a time frame that could clear Pelosi.
A Suffolk County medical examiner testified earlier in the trial that Ammon was beaten to death between 1 a.m. and 6 a.m., or 4-1/2 to 10 hours after his last meal. But Spitz, 78, who has done up to 60,000 autopsies over five decades, insisted it was "highly unlikely" that the estimated time of death was accurate....

Time of Death Is Challenged by Pathologist in Pelosi Trial
By PATRICK HEALY
RIVERHEAD, N.Y. Dec. 2 - A forensic pathologist at the murder trial of Daniel Pelosi told jurors on Thursday that the victim had been killed at a time when Mr. Pelosi, according to his lawyers, was elsewhere.
The pathologist, Werner Spitz, testified that the victim, R. Theodore Ammon, a Manhattan multimillionaire, was murdered inside his East Hampton home between midnight and 1 a.m. on Oct. 21, 2001. Cellphone records show that Mr. Pelosi was at least 40 miles away at the time.
Dr. Spitz, testifying for the defense, disputed earlier testimony from a Suffolk County medical examiner who said that Mr. Ammon had been killed between 1 a.m. and 6 a.m. Prosecutors say that time frame gave Mr. Pelosi, 41, ample time to commit the murder.
Mr. Pelosi, a Long Island electrician, was having an affair with Mr. Ammon's estranged wife, Generosa, when Mr. Ammon was killed; the Ammons were days away from finalizing a bitter divorce. Prosecutors have said that Mr. Pelosi wanted to gain control of Mr. Ammon's $80 million fortune.
Mr. Pelosi and Ms. Ammon married three months after Mr. Ammon's death, but later separated. She died of breast cancer last year.
Now it appears that a murder trial laced with stories of adultery, gambling and greed could boil down to the time of Mr. Ammon's death. ...

Throwing his book at him
Cross-examination seeks to discredit defense expert who disputes M.E. estimate on the time of death
BY ROBIN TOPPING

December 4, 2004
In a spirited cross-examination of the defense's star witness, prosecutor Janet Albertson went after forensic pathologist Werner Spitz on Friday, trying to discredit the person whose scientific opinion essentially excludes Daniel Pelosi as the murderer of Theodore Ammon.
Albertson took pains to challenge Spitz's most critical assertion that Ammon died three to four hours after he ate dinner - a timeline that would have Pelosi in Center Moriches when Ammon died in East Hampton.
Quoting Spitz's own pathology textbook back to him, Albertson cited a passage saying digestion is slowed by fear or apprehension. But Spitz countered that it would only apply in certain "extreme situations" over a long period.
Albertson argued the book differed from his testimony, but Spitz shot back: "This book is not made for you to interpret. Please allow me to consider what I considered when I made this book."...

Just wondering why you don't believe the niece? I understand she held up really well under harsh cross examination. I would think she would crack if she wasn't telling truth..

Hi, shopgirl! Have you had the chance to attend any sessions lately? I would be so interested in your elaboration on what you have heard. I am limited to the articles that I have posted links to and that is what I base my opinion on. I wish we had more info.

Pelosi defense may rest today
BY ROBIN TOPPING

The defense in the Daniel Pelosi murder case could rest as early as today, after the defense yesterday changed its mind about putting on its last witness of the day and defense attorney Gerald Shargel said he is anxious for the jury to begin deliberations.
"It's time to go to the jury," Shargel said outside court yesterday.
"We've been here since Sept. 7. There's been a lot of down time ... and this witness didn't matter that much. The core of the case is murder," he said.
Two more defense witnesses are expected to testify today, including a DNA expert expected to comment on a pubic hair found on Ammon's body. Summations could come as early as tomorrow, Shargel said, adding that he felt "very confident about the case."...

PELOSI'S PASS ON WITNESS
by Kieran Crowley
December 7, 2004 -- In an unexpected move yesterday, Danny Pelosi's lawyers cut their defense case short — saying they're confident the prosecution hasn't proven he killed millionaire Ted Ammon.
Attorney Gerald Shargel yesterday decided not to call key witness Joanne Matheson — Pelosi's friend and housekeeper for Ammon's widow, Generosa.
Matheson, who spent most of the day outside the fourth-floor courtroom in Riverhead, L.I., was expected to testify that the Ammon children's nanny, Kaye Mayne, once said she hated Pelosi, despite her protestations under oath. ...

Hi Lisa, Unfortunatly work has prevented me from attending the sessions, however i know a few people that have attended. I was told that the DA really went after her, claiming she was lying to for her uncle and at one point tried to impeach her testimony. She didn't waiver and from what i gather was a credible witness for the defense. For a young women it must have been difficult for her which is why i tend to beleive her. I am sorry we are not going to hear the tapes that this housekeeper has, i would think it would be interesting. I would really love to go for summations, i would think they would both be very reveting. I am not sure when they will be, the papers today say tomorrow which would not be possible. I am curious what your take in the case now this seems to be coming to an end?
