LDB: we filed a motion to prohibit from the defense listing ? from witnesses. As to the admissability...it has been our experience so far that council has been asking witnesses things the defendant may or may not have said, there are acceptions for hearsay. For us to repeatedly object to this type of inquirey when council has already been warned. We are asking not to prohibit the question at this juncture but that council be ordered to proffer.
JB: our position is this is an untimely motion. but is timely for them. They can talk about spending the night, innuendos, the bruise...after they get it thought the back...one it is untimely second it limits cross. Certainly there are topics that are sensitive in nature topics that are close to objectionable. And to limit our cross of a witness affects the truth. We all know what we are talking about. They don't need advanced notice. This isn't a scripted events. To limit...providing proffers...I think the defense is significantly prejuiced...I think we have a theory of defense judge and we have a right to explore it...and ask them specific questions if there is an objection the prosecuters are capable of objecting.
HHJP: okay. Chapter 90 of the FL evidence code. Evidence must meet chapter 90. Attempts by the defense to illicit statements by the defendant though the witness. It is self serving. Under three acceptions there are foundation requirements. As of yet there has been no attempt to establish those three requirements. There for the states motion in limeline be proffered will be granted!

So if the SA hands over to the DT their transcripts of Dr. Weiss and Dr. Danziger, does that mean the transcripts will be released under the Sunshine law? I am very interested in reading those transcripts.

Depends on how the State is stating their case. In this instance they clearly defined in their OS that they are going day-by-day through the timeline, and the witnesses will be called according to that schedule.
Since the meat of this matter will be based on forensic experts, then, yes, in this case, the powerful testimony will be towards the end.

But, we haven't heard yet if Judge Perry will allow Tony's hearsay testimony based on yesterday's proffer, right? Anxious to hear his ruling...

It is so weird how KC is always adjusting her clothing. I wonder what that means? It really seems to be a compulsion. I wonder if she really thinks she is going to get off? I think she may get a lesser charge other than 1st degree murder, which would still keep her in the slammer for the rest of her youth. I think that would be fair considering it is circumstantial evidence & we don't know what actually happened, just that it was KC & KC only. My initial impression when this first came out is that it was an accident she covered up (very badly!). Then as the pics came out, the jailhouse tapes, etc. it really changed my mind. I just hope she gets jail at the very least.

technically, the state only asked if she spent the night places and if Caylee was there. They only asked Ricardo about actual sex and that was because Caylee slept in the same bed.
IIRC It was Jose Baez who asked if he was intimate with Casey while Caylee was present!

Where a party is denied the right to introduce evidence because that evidence would be inflammatory, hearsay, or would lack sufficient authentication, that party must make a proffer of what the evidence would have shown in order to preserve the issue for appeal.

And Judge Perry ruled that all hearsay regarding sexual abuse claims has to be heard in closed court to determine if it will be allowed into court/evidence (= must go through proffer).

I know it's immature, but every time they ask for a mistrial I want to yell "NO DO OVERS!" or "NO TAKSEY BACKSIES!" haha.

Casey doesn't look too happy with Mallory. I remember when she was on the phone with Lee and her mother from jail in the summer of 2008. She was speaking with Cindy, I think and said "Let me talk to Lee. I know he's there because I can see Mallory's car." She must have been able to see news feeds or something. She also said the name "Mallory" as if she was rolling her eyes. It always made me wonder if she liked Mallory. I got the impression that she didn't.

She showed up at the Anthony house right as they (or just after) LE roped it off after finding Caylee. MP showed up at the home and went inside - she wasn't there long - a deputy showed up and escorted her out.
