It appears that CM was complaining about sidebars and the transcripts. CJBP explained to him that they are not broadcast live, but if anyone requests the transcripts, they can get them. They ARE public record!

CM says presumption that legislature knows what they are doing when writing legislation. They do not describe who exactly is considered "next of kin"
An uncle was mentioned as next of kin for identification in a minor custody case. No case law says an uncle is next of kin in a situation where the defendant objected to their presence.

CM: as you have said sequestration...to keep their testimony from being colored...there is a presumption although many of us my scoff at it...legislation knows what they are doing when they write it...the fact of the matter is when they said next of kin they did not define it...not a single case that allows a uncle to be next of kin...and I can say that after fairly extensive research...a uncle in a custody case...there have been extensions for children by case law and mothers as opposed to just husband and wife. In the Beasley case the defendant brought his son and daughter. Ones where there were challenges or one where the defendant wanted...there are a number of them and we find none where the defendant objected to an uncle...here is the situation at some point it has to stop what if Mr. Lee Anthony had already married the fiance? Anyone we can fill the court room with...there has been some impact on the testimony of the father....having listened to opening statements and all the witness including the tow truck and mr. anthony is called back again. We are asking the court not to extend what we see as a problem into an...line needs to be drawn...it should be drawn in his opinion with the Anthonys. In all humility...I don't care about their rights...Casey's rights...criminal case. We object. If you are interested in reading the cases I would like to state Davis...Gore v. State, (citing case law) Rose v. State...in that case the mother of the victim was allowed in the court.
HHJP: mr Anthony was taken...on July 30 2009 Mr. Baez was there and AL was there, Mr. Newcomb(?), Mr. Baez conducted cross examination starting on pg 376. Cross was not that long...(long pause)and just a second...

HHBP...no evidence to suggest LA testimony would be colored ....LA will be excused from rule of sequestration.
also reviewed GA testimony to GJ...nothing indicate any thing different....

HHJP: Mr. Baez's cross of Lee Anthony...has Casey ever told you she killed Caylee? no Caylee died by accident? no Has Casey ever told you anything about Caylee's death? no. Did she say she murdered her? no. Accident? no. I take it the gist of Lee's testimony centers around his contacts with her trying to find her during this period of time and the possibility of his use of the computer at some point will be asked of mr. Anthony...whether he did searches for chloroform. Specifically Mr. Mason what testimony will be colored if Mr. Anthony is allowed in the court.
CM: his role is activities as a potential agent of the police...I don't know what the prosecution will call him for.
HHJP: anything else?
CM: no
HHJP: mr Lippman?
ML: next of kin has not been defined in the criminal realm. words next of kin will mean blood relatives, they identify...(citing case law)plenty of times to depose, my client has given statements many times. Will not show emotion or facial expressions as Cindy and George have done.
HHJP: no evidence to indicate or suggest that Mr. Lee Anthony's testimony would be colored he has taken a depo. I have reviewed the GJ testimony of George Anthony. There is nothing that is inconsistant with the testimony he has given, there is nothing that would cause a conflict. Recess.

NOT from a retired officer, NOT from a 'true' mother who loved and cared about the child.... 911, if one would give a shred of belief... 911 would have been the ONLY logical step that would have been taken... this entire 'story' can never fit and is just that, IMHO, a story

Maybe I'm naive, but I have very little doubt that Lee is there for his parents and he knows what ICA did. He may be angry with her, I wouldn't blame him. During the "agents of the state" hearing I think he came across to her like.. "What can I do? You're in a mess of your own making." I'm glad he can support his mother and father, it is obviously very trying for them.

So the defense never got a deposition of Lee Anthony. Jose did cross examine Lee at the States deposition of Lee but no depo of their own. Why is that? TIA.

I expect it's easier to defend Casey if you distance yourself from the victim. When talking about someone rotting in the trunk it gets too close when it's sweet little Caylee whose face the jury can see looking at them in the phtos and not just some child, any child, forgot which one.

There was a motion heard this morning. Lippman argued that LA should be allowed in the courtroom and HHJP agreed.
HHJP also ruled on the Grand Jury testimony of GA. HHJP did not release it to the DT and, instead, returned the transcript copy to the SA.

I don`t know. In the third call I think he says "What" When Cindy says Caylee is missing for the first time. Can`t tell everything that is said in the background.
Do you have a link? Would love to blast my bose speakers and see if I can hear it. Pretty sure I remember hearing the same thing a couple years ago.
