I don't get this. Is she Jose's witness? Is she presently employed by the FBI? Why would she ever have dinner or outside conversations with JB? Isn't this trial by ambush, which JP warned against? I don't think the SA got to depose her. She seems to be less cooperative and forthcoming with JA than she was with JB, IMO.

Baez needs to take down that horrible pad if he doesn't want it used against him. It's a distraction and it's in the way. The jurors need to see the inmate, imo.

As high a profile case that this is, I hardly think she would allow anyone to pay for her dinner. She pays for her own and puts it on her expense report to be reimbursed either for what she paid or per diem (allowed amount for that meal). Personally, I really don't care who paid but because some do, I firmly believe she was very careful about such things. It's not worth losing her job over.
I have no doubt that if this information gets back to her office, she will be spoken to about it at the least, if not reprimanded.

God I hate that. We have a real chance of this being a hung jury. I wouldn't be terribly surprised if Juror 4 hangs it.
I think it's good... maybe they put her in charge of those notes cause nobody else cared to listen. LOL In the end, she will follow the crowd, IMO.

This is why I hate that our judicial system has become so DNA-centric. One side puts up their expert, than the other, both to say that their evidence is more legitimate than the other. If one side says the DNA is inconclusive/irrelevant, than how can you trust the other side's?
Unfortunately, due to the CSI-ification of future juror pools this is what our legal system will be reduced to - scientists hawking their theories as hard evidence, while trying to "outdo" the opposing scientist. :banghead:

JA was trying to get her to testify to things she could not and she simply stated that. If she was really for the defense she would say yes it could be decomp, or chilli or ice cream or paint chips or a million other things and make him look like a fool.
She stayed professional and JA was trying to get her to slip. All part of the game.

I don't think this jury would do that to Judge Perry. They LOVE him. Juror #4 really loves him too I bet. And he spoils them and coddles them. I do not think they would do that to him.

I'm trying to be fair and really listen to the evidence presented by the DT team, but 3 hours of this? For what?! To say, "No blood"? "No DNA on shovel"? Okay, but why on God's green earth does it take THREE HOURS to get that information out? I sure didn't need an hour lesson on DNA to understand THAT.

And Dr. Vass and Dr. G were both very hostile toward JB/CM. Expected?

Quite a difference between both witnesses today, don't you think? Mr. Bloise was extremely respectful with JB, but Ms....uh, the current witness does not seem to be extending that same courtesy to JA.
She's lost a lot of points in my book. And not because she's a defense witness. She reminds me of a colleague I have who seems to try to prove her "superior" intellect by speaking loudly and quickly and using the biggest words she can, even when it's completely unnecessary.

Actually, I got the impression that Dr. Vass was trying not to laugh at JB. JMO.
I don't think Dr. G. was being any more hostile toward CM than he started being towards her to begin with.

Look, I went there this morning...and it were NONE TOO PRETTY! The tweets when she got on the stand were that she was the DT's own FBI witness. Huh?
But I have been trying to give her the benefit of the doubt because she is EXTREMELY SMART and I don't think the DT could have found this smart a witness for themselves. :loser:

I wouldn't read anything in to it. She just may feel the need to take a look at the defense because she has someone's hands in her life and wants to make sure before she'd convict. We can't read into anything the jury does. I remember some of the talking heads were convinced one of the jurors in the Scott Peterson case was pro-defense, but she voted to convict.

I believe he was trying to get across that EVEN the investigators believed for some reason that there was incest in the home. Why else would they ask for paternity results using Lee's sample. Regardless of the result of said test, it was being investigated that there may be incest in the home which goes to the DT theory.

There is no inconsistency within the FBI findings and witnesses. the way the information has been elicited from witnesses makes it seem that way which, IMHO, is what JB is trying to accomplish.

the crux of the whole thing imhoo is that this person found nothing that was worth analyzing:
blood or dna
because there was no blood and the fluid left behind was decomp fluid and could not be tested positively for either.

It started with hello. She appeared very rigid in her greeting to JA, defensive actually. That's fine, the jury will see that as well and it will diminish her credibility IMO.

IIRC, ICA told Jessie, Tony and her jail friend, Robin, about her father and brother attempting to molest her. They had to investigate it. It could go to motive. I think it was the responsible thing for the police to do.

What if this 17 marker matches Casey cause if I remember JB asked her about the marker inside the duct tape and I thought he only said it couldn't be Caylee's cause she was a 15, if I remember...so maybe the argument is JB opened the door to this question and the state knows Casey has a 17 even though this is just not a conclusive sample so really no value of evidence.

I agree with you on this one Dr. F. This is a dance between DT and SA and there has to be some give and take on both sides.
I am for the SA in this case but I'm also for a fair trial so that once she is convicted she stays convicted. Rock solid. JA seems to be a bit too agressive today JMHO.
I'm going to sign off and watch this from the comfort of my bed. I had to get up at 2:30 AM in order to catch the trial, and I"m worn out.

ICA or KC refers to Casey. JB is Baez. GM is George Mason. CA and GA are the parents. LA is Lee. LDB is the prosecutor along with JA. HHBP is the judge.

the newly note taking juror doesn't bother me - maybe she's writing notes as "counter argument" for any people trying to push for innocent. Maybe the questions she had floating around are now tied very neatly up with notes like "george excluded, lee excluded, no blood, " etc.

Regardless of the result of said test, it was being investigated that there may be incest in the home which goes to the DT theory.
IMO, the paternity test was asked for because there was lots of speculation on the boards that LA or GA could be the father, and LP was on NG every night saying that LA might be the father. It had to be checked considering the lack of facts and truthfulness at the time. JMO

I agree. I do not think the jury will "get" this from the fact there was a paternity test. Too much info to weed out AND also get this subtle point DT is trying to make. IMO

Key word "IF". She can go to dinner with whomever she wants to but needs to pay for her own meal. You are assuming she did not and needs to be spoken to about it. We don't even know if she is still presently employed there.

i dont know why its bugging me so much about juror 4 taking so many notes on defense case but not on the state case. im not sure what would be so note worthy now. (i do understand its her right to take notes and i'm glad shes paying attention. im just terrified of a hung jury)
to me its so simple. ICA was with Caylee at Time of Death, did not render aid, did not call
911. end of story. no matter what you believe that behavior says she had something to hide.
i think the defense is going with the theory..if you can't dazzle them with brillance..baffle them with bullsh**.
this case is stressing me out and something about this witness is bothering me as well. maybe i shut down as soon as i heard she spent the evening with JB?

Maybe cuz the state's case was clear and believable, and she is attempting to make sense of what the DT is putting forth. Someone who is hesitant to judge may be very careful to be fair and honest, IMO

Personally, I never saw Dr. Vaas or Dr. G as being "hostile" towards JB. IMHO their change in demeanor from the PT to the DT was solely due to way that they were being treated by JB.

It came from ICA first, years before. LE discovered it from JG and TonE. It was after doc dumps that the speculation by LP and NG started. NG even went as far as to accuse WS of starting rumors. NG was wrong.

It seems like JB could have covered lab contamination and insinuations about LA and Casey, as well as a little inconclusiveness, and even some education on DNA, in maybe two hours. Is he just not able to get to the point, or did he want to spend hours and hours on this? You'd thinking boring and alienating the jury would be something he'd try to avoid.

WS has been really glitchy for me in the past 20 min....
JB questioning Seubert - on top side tape 6 alleals
on the underside there were 17 on D3.....went thru 5 known samples - generated for Caylee, CA, KC, GA, LA known samples....went thru known sample staff...5 individuals for known staff....based upon report language utilized - did not draw conclusion and not utilized for comparison purposes....doesn't meet threshhold....very limited not suitable to compare ....there is an indiv. with D3 - one of their alleals was a 17....dna for that particular location was a16/17...didn't see any 16 D3.....object -

on the ducttape there was no 16 ....just 17 at level for detection for a peak....this could be 2 things? person can have .....heterozygot (2 peaks) or homozygot ( 1 peak)
1 peak recorded...so low cannot make determination for conclusive.....no 16 ...using threshhold from FBI lab - correct
JA = inconclusive should not.....result provided inconclusive....drop out alleals, 16/17 and then 16 doesn't appear....at one amplification may not get same results @ next amplification.....not dna of GA, @ that particular location.....dna types for KC, & Caylee - may have misspoke.....Caylee 14/15 and Kc is 15/19 - apologise for misstating that prevoulsy.
JA - lots about blood....blood shed during some event....forensic exams performed in lab....object OVERRULE!
examine bio fluids...cannot speak to how got on the item...just evidence it is there....if shot or stabbed blood gushing from wound...if someone killed in a manner does not shed blood - doesn't mean ...object - overrule
significance of lack of blood @ crime scene - method to kill doesn't involve bloodshed - can't say death didn't happen if not blood....correct can's say it didn't happen or not
JA - tape were you involved w/discussions about order exam of the tape what should come first second or third....not expect find any dna on tape...expectation should be on sticky side of tape across the face....expect to find it there...didn't expect neither here or there...expect if there were some dna it would be on underside....swampy area 6 months unlikely in your opinion (object - sidebar....

HHJBP, JA and JB are at the court reporter's computer looking back on the prior testimony

JB asking witness regarding the 17 allele at the D-3 marker on the sticky side of the tape, when she saw that, she attempted to eliminate others - she would have compared it to all of the lab personnel samples and known samples. There was only one marker. On the top side there were 6. On the other side there was only 1. She looked at the 5 known family samples, known lab personnel samples and 5 others in lab she did samples of. She did not draw any conclusions - her report indicated inconclusive.
Was there another individual who had a 17 at the D-3 marker. They had a 16-17. Was there a 16 on the duct tape?
OBJECTION BY JA - beyond - OVERRULED.
She thinks there was just a 17 on the tape at the level to create a peak.
This could be 2 things? A person could have 1 peak or 2 peaks. The lab person had 2 peaks. Only 1 peak was detected on the tape. This was inconclusive for reporting purposes based on the FBI lab thressholds.
CONTINUED CROSS EXAMINATION BY JA:
The results for this were inconclusive. At those low thresholds you can drop alleles out. That's why the scientific responsible response is that it is inconclusive. At that location, GA did not have a 17.

She tests for blood.

Regarding the duct tape - she was not involved in the order of examination of the tape. The possible area she would expect to find DNA on the tape would be on the sticky side. For DNA to survive in swampy area.......

why is this witness so unwilling to answer JA in any way that goes against JB? its bizarre considering she is am impartial witness. the way she hemmed and hawed over the DNA possible not surviving the elements on the duct tape was odd to me

Is it just me or does it appear ICA did her makeup a little better today? not trying to be snarky or against TOS. To me she just appears to have more color in her face and doesn't look as pasty/pale as she had.
Maybe she's using the prison tanning bed.

The other FBI lady said she did not expect to find any fingerprints or DNA (I believe on the tape) but she tested anyway because that's their protocol. No matter what they think the outcome may be, they have to treat it the same way as if it could contain evidence.
This witness won't admit that she did not expect to find DNA in such a degraded piece of evidence.

You can hear JA sighing real big as he straightens up each area that JB confused up. Poor guy...I don't know how he and LDB have stood the DT for 3 years.
That's why JA gets so offended by JB's slimy ways of asking questions and making insinuations.
JA is so obviously an honorable man, and he doesn't even like being around him. Considering this is all about finding what happened to a helpless little child he has the moral high ground as far as I am concerned.

I may not be understanding this witness, but it seems she knows what JA is trying to get, the points he's trying to make and she knows they are valid ones but seems to dance. Am I misunderstanding?
exactly correct...she appears to be playing devils advocate here.
She also reminds me a lot of Pamela Smart...anyone else see that resemblance?

IIRC, ICA told Jessie, Tony and her jail friend, Robin, about her father and brother attempting to molest her. They had to investigate it. It could go to motive. I think it was the responsible thing for the police to do.
(do I believe her? No)IIRC, on the witness stand, TL said KC only accused Lee of molesting her, and she accused George of physically abusing her. I don't remember what the other two said.

I hate to keep harping on this... but this woman testified during direct examination that Caylee and Casey were excluded because of this "17" and then when Jose was just back up there talking to her she said she could not exclude anyone?? Why did she say earlier that she could exclude Casey and Caylee... then switch that she could not exclude anyone?? She said it was inconclusive and she couldn't exclude anyone... WHY... then did she sit there and say that earlier?? She has my hinky meter up majorly!!

I respectfully disagree! Dr. Vass and Dr. G were TRUE professionals when being cross examined by the defense. No hostility at all, just the facts!!!
IMO they were both very combative. But that's just my opinion. I didn't like Dr G - I thought she had this celebrity air about her and to me in my own opinion she was very combative with CM. All in all again it's expected. It's State against defense. Otherwise, if all agreed, why have a trial.

Clarifying her testimony so many times and feeling the need to offer additional information decreases her credibility and professional demeanor. IMO
ITA, I have yet to hear this woman give a simple "yes" or "no" answer when asked a clear question.
It's always, "Well according to the notes I had made in relation to that particular..." or "Again, my report is inconclusive in so far as..."

I gotta say regarding Juror #4 - she said she couldn't judge. That's a big difference from assuming that ICA is innocent... So I don't think she'd be taking notes just to argue innocence. That would be technically judging too.
Guess she just didn't want to judge anyone guilty.
