The DNA in this case is an artifact. IT MEANS NOTHING.

Simply put the "touch DNA" or "New DNA Testing" referred to in the show means nothing in this case.

If you clipped your nails, checked your underwear and clothes you would have all kinds of "new DNA" all over you everywhere. JonBenet went all over that Christmas day and picked up DNA from EVERYONE.
Dr Michael Baden agrees that the DNA evidence can be explained as the result of a combination of contamination and increasingly sensitive DNA tests:

The DNA recovered is so small, so degraded, that scientists were only able to get a partial profile. You need 10 DNA markers to put DNA into to CODIS so it can be compared to other criminal's DNA and 13 markers to be considered a full profile.


JonBenet's DNA only had 9 markers and one additional marker that was below standard.

That's how weak it was.

Later, with pressure to have the profile entered into CODIS, the unacceptable marker all of a sudden became acceptable. The public was never informed as to how this happened.


When private investigator Lou Smit said, "She got a piece of her killer" he was right but the killer was not an intruder.

There was NO FLESH, NO BLOOD, under JonBenet's nails.
