A freeze frame (http://kfmb.images.worldnow.com/images/15466715_BG2.jpg) of the afternoon helicopter video clearly showed the rope hanging from the balcony in the exact same position as the evidence photo taken earlier in the day.

"The rope was hanging over the balcony from the moment (officers) arrived on scene until they seized it later in the evening as evidence," said Lt. Nesbit.

Some online observers have questioned the evidence photos themselves.

Three photos posted on the Sheriff's web site show the French doors of the mansion's balcony in three different positions.

CORONADO, Calif. (CBS8) -- Rebecca Zahau's cell phone logs show she engaged in a series of phone conversations and traded several text messages in the hours before her hanging death at the Spreckels mansion in Coronado.

***
According to the logs, Zahau also received a text message at 10:41 p.m. from Nina Romano, 41, the twin sister of Jonah Shacknai's second ex-wife, Dina Shacknai. Dina is the mother of Max Shacknai.

Contacted by News 8, Romano said she sent the text message to ask if she could come by the mansion.

SAN DIEGO (CBS8) - The San Diego County Sheriff's Department has opened a new examination of data contained in the cell phone of Rebecca Zahau, the woman found hanging at the Spreckels mansion July 13.

**************
Meanwhile, Bremner came forward Wednesday with new reports from witnesses in the Coronado neighborhood.

"We are now confirming information from a witness that there may have been a cry for help from a woman in the mansion around 11:30 p.m. the evening prior (to Zahau's death)," Bremner said. "So that's important in terms of the time of death and in terms of the surrounding circumstances."

I’ve been conducting a dynamic analysis of the forces and deflections that would have been involved in Rebecca’s fall from the balcony of the Shacknai mansion guest room.

I’d like to share my findings with you so that you can better understand why Rebecca did not suffer the traditional “hangman’s injury” when she fell from such a great height.

Sheriff to release cell phone and case files to Zahau family attorney

homicide Lt. Larry Nesbit said it was not possible to recover deleted data from Zahau's phone without dismantling the device, something investigators did not want to do. As a result, no new information was obtained from the reexamination.

Lt. Nesbit said the intact cell phone and other items belonging to the victim will be returned "in about one week" to the Zahau family attorney, Anne Bremner. The Seattle-based lawyer wants the cell phone and evidence in the case turned over as soon as possible.

"We going to do everything we can to investigate and have the phone forensically examined," Bremner said.

On Sept. 2, the San Diego County Medical Examiner and the Sheriff's department ruled Zahau's death a suicide, meaning the criminal investigation was officially closed.

As a result, the case file – including police reports and witness statements collected by investigators – will be turned over to the Zahau family in accordance with California Government Code and victims rights laws, Lt. Nesbit said.

Bremner said she is conducting her own review of California law to determine whether the case records can be released to the media after they are obtained by the family.

Spreckels homeowner Jonah Shacknai, whose extraordinarily troubled summer became the stuff of national news, scored a business victory Tuesday when his company received government approval for a new use of a cosmetic enhancer.

Medicis Pharmaceutical (NYSE:MRX) produces Restylane, a filler used to combat signs of aging, that the Food and Drug Administration now has approved for use in lip plumping.

The company's application received preliminary approval from a FDA panel in April. Shacknai is founder of the Scottsdale-based company, which reported $700 million in revenues last year.

“This marks another significant milestone for Restylane ...” Shacknai said in a statement Tuesday...

Rebecca Zahau’s body will be examined by renowned forensic pathologist Dr. Cyril Wecht, Zahau family attorney Anne Bremner said Thursday. Bremner last month hired Wecht, who has publicly questioned the results of the official autopsy, to consult in the case.

“The body has been exhumed,” Bremner said. “Dr. Wecht will be conducting the autopsy pro bono.”

Max Shacknai’s aunt at mansion hours before Zahau’s death

"I VOLUNTARILY told the detectives that I went by the mansion for a few minutes the night before at 10 p.m. but no one answered the door," Romano explained.

Records show the Northern California resident was one of the last persons to send a text message to Zahau, 32, before her bizarre death.

"I just wanted to talk to her about the accident and so I sent her a text message that just said, 'Hey, are you around? I'd like to come by.' And, I never heard from her. She never responded to me. It went nowhere because I didn't get any message back from her," Romano told News 8 during a September phone interview.

Detectives: Zahau Calm, Not Despondent
--Nov.4/2011----------snipped---

Investigators who spent time with her after her boyfriend's son was seriously injured were not concerned with her mental state, said an attorney who is examining the case files.

Coronado detectives told Sheriff's investigators after Rebecca Zahau died that she didn't feel responsible for grave injuries suffered by her boyfriend's son or show any signs of depression in the aftermath of his accident.

The statements, revealed in investigative files being reviewed by an attorney hired by the Zahau family, were made by detectives on July 19. They had accompanied Zahau to the hospital after Max Shacknai, 6, fell and suffered the head injuries that would ultimately kill him.

They described her as tearful, anxious and trembling, but they also concluded that her behavior was consistent with someone who had seen a loved one seriously injured, according to the attorney, Anne Bremner.

Bremner said the investigative files contain some information that already has been released, such as autopsy reports and search warrants. Other materials include photos, DVD's, lab reports, surveillance footage, medical records and videotaped interviews of Adam Shacknai and Xena Zahau.

Sheriff warns Zahau attorney; case file may be opened

Attorney Anne Bremner told News 8 that she considers the letter a threat. Her co-counsel, attorney Marty Rudoy, agreed.

"I believe there's an implied threat in the letter that they would release information hurtful to the victim and her family," said Rudoy. "It has chilled our willingness to release relevant information to the media that would help the public determine what happened in this case."

In an emailed response to News 8, a Sheriff's spokesperson acknowledged there is personal information in the Sheriff's case file.

"We wanted to state in the strongest possible terms to Miss Bremner some of the materials contained (in the case files) are exceedingly sensitive and personal," wrote Sheriff's spokesperson Jan Caldwell.

"We will not release material we would rather keep confidential, unless compelled to do so in response to unfounded or inaccurate assertions."
Cummins, the local First Amendment attorney, called the language in the letter "heavy handed."

"Law enforcement has had the public opportunity to explain their investigation and their conclusions; and now that they've turned over the entire file to the family, they now want to control what the family's message is," Cummins said. "It's not only a chilling effect on their speech, but it's almost a governmental effort to control the information that is released to the public."

County pathologist excited about new role

Dr. Jonathan Lucas... is now San Diego County's chief deputy medical examiner

As a forensic pathologist for the county medical examiner's office, Dr. Jonathan Lucas has been a combination of scientist, detective and teacher, mining the bodies and stories of the silent dead for information that is relevant to the living.
Late last month, Lucas, 44, took over the second-highest job in the office. The agency evaluates many of the county's suddenly or unexpectedly dead ---- 2,700 cases last year ----- and determines how and why the people died.
...
Wagner said Lucas has proved his professional mettle during 10 years as a deputy medical examiner for the office. Most recently, Lucas created and presented the office's 2010 report on county deaths, and he handled the office's investigation of the death of Rebecca Zahau in Coronado, a case that made national news, Wagner said.
Wagner said a panel of county officials, which included representatives from the district attorney's office, Human Resources Department, Sheriff's Department and a public safety group, voted unanimously to promote Lucas.
The position was left open when the previous chief deputy medical examiner, Dr. Christina Stanley, left to become chief medical examiner for Rhode Island, Lucas said.
...
Lucas began work as a deputy medical examiner at the San Diego County medical examiner's office in October 2001, he said.
The job was everything he had hoped it would be, Lucas said. It offers him the intellectual exercise he craves; it involves lots of science and work with his hands; and he works with a lot of people ---- living as well as dead.
It also provides an excellent opportunity for public service, Lucas said. Not only is it important to families to know what caused a person's death and the circumstances under which he or she died, but it also is useful information to inform the public's understanding of health threats from diabetes to illicit drug trends.

– A search warrant unsealed revealed that the head of the Intensive Care Unit at Rady Children’s Hospital, Dr. Bradley Peterson, initially believed his patient, Max Shacknai, may have been suffocated before he fell down the stairs. In Max’s autopsy report, the medical examiner disagreed and determined the boy’s injuries were consistent with an accidental neck injury sustained in the fall.

October 6th

– Homicide Lt. Larry Nesbit said it was not possible to recover deleted data from Zahau’s phone without dismantling the device, something investigators did not want to do. As a result, no new information was obtained from the re examination.

– Lt. Nesbit said the intact cell phone and other items belonging to the victim will be returned “in about one week” to the Zahau family attorney, Anne Bremner. The Seattle-based lawyer wants the cell phone and evidence in the case turned over as soon as possible.

Contains updates on mansion renovations and quotes from RZ's attorneys about the case.

Rudoy told News 8 that the San Diego County Sheriff still has not returned some of Zahau's personal belongs to the family, like her camera, computer or cell phone. He said the Sheriff did make the cell phone available for an independent forensic inspection by an expert hired by the family. That forensic report still is not complete, Rudoy said.

I believe the timeline should be changed to reflect Nina arrived mid-afternoon on July 12, 2011 rather than on July 11. Thank you

Mid- afternoon
- at some point in the afternoon Rebecca picks up Dina’s twin sister Nina from the airport.

Romano had traveled to San Diego to support the family and Rebecca had picked up Romano at a San Diego airport the afternoon following Max's fall.

That is what I thought... how could she get there so quickly on the 11th? Unless it was a scheduled visit.

Nina herself stated in her 2-hour long phone interview with CBS8 that she arrived on July 11, 2011 Monday in the evening to Coronado, SD. She also stated in the same interview that Rebecca picked her up from the airport and Rebecca handed her Rebecca's cellphone to navigate them to the hospital. (Nina made no mention of her own son or Rebecca's sister XZ being in the car in this interview).

Plz click on audio at

At audio 00:01:00 Nina says specifically "Rebecca picked me up from the airport Monday night."

In same phone interview, Nina says at audio 00:03:20 that "Rebecca asked me 'Are you good with directions?' and she handed me her cellphone."

Was what Nina saying true - that Rebecca needed Nina to navigate to them from the airport to the hospital? I don't know. But that is what Nina stated in phone interview. So Nina admitted to getting her fingerprints on Rebecca's cellphone. And we know that someone deleted the 12:50am Wednesday voicemail from Rebecca's cellphone the night Rebecca was found dead.

At 0:52, AS replies "I don't know" in response to "..is she still alive?". I clearly recall watching other videos where - oddly enough - he replies "Are you alive?" as if he was actually asking Rebecca whether she was still alive. Was that in another part of the same call? Or on another 911 call?

And, starting at 2:20, one can see the sign on the guest / sitting room door that is masked on every other photo and video I've previously seen.

These two articles are quite old and may have already been posted to this or to another thread. If that is the case, please blame it on this site's extremely limited, time consuming search capabilities and the myriad posts and threads.

BTW, just ignore the photos of the Spreckels Mansion in San Francisco. It is still worthwhile reading for reasons I am not yet ready to explore and discuss.

How do these SDSO investigations go so wrong? It's such a tragedy.

From your link

McStay said he has no faith in law enforcement and believes the San Diego County Sheriff's Department missed important clues in the investigation. He said he told sheriff's investigators about three people that could be connected to the disappearance of his son's family, but feels he was ignored.

"I've been consumed with knowing something happened to them. The San Diego Sheriff's Department is only doing whatever they felt they could do that would fit with their little theory and prove that they voluntarily walked away. The only thing you ever heard out of them or you ever saw was that," McStay said. "I have to hang on to the anger because the anger keeps me from cracking up … I think it hasn't really sunk in."

"All I've been screaming for was a thorough competent investigation. Take it out of their hands because they're corrupt and that's what I've been screaming. Four years I've been telling everybody," McStay added.

Once again the family's "grief" is being pointed out. Below is a quote from that article. This is the same excuse that was used against the Zahau family who criticized the SDLE. Shoddy shoddy police work. I sure hope Gore retires soon and or his political buddies quit protecting him. Shameful.

"Patrick McStay called the investigation into the disappearance "inept" and "incompetent."

On Friday, 10News reporter Michael Chen asked sheriff's spokeswoman Jan Caldwell, "He calls the sheriff's department 'incompetent.' How do you respond to that?"

"I think there's a lot of grief in that statement," said Caldwell."
