Zahau family attorneys set to meet with Sheriff Gore

Attorneys representing the family of Rebecca Zahau will travel to San Diego next week to meet with Sheriff Bill Gore.

The legal team of Anne Bremner and Martin Rudoy plan to discuss what they consider new evidence in Zahau's death at the Spreckels mansion in Coronado. Rudoy said they will ask Sheriff Gore to reopen the case.

Bremner and Sheriff Gore both have appeared on national broadcast media in recent days; Gore to defend his department's ruling that Zahau committed suicide; Bremner to argue that an independent review is warranted.

Attorney Rudoy, of Los Angeles, said the meeting has been in the works for a few days, and that both sides agreed to wait until after the Thanksgiving holiday. Rudoy said Bremner will fly down from Seattle for the meeting but he declined to divulge the exact date.

Maybe at the end of the meeting when Gore still says CASE CLOSED Rudoy can sell Gore some real estate!

..it's my thought that they're having this meeting-----( after all sheriffG could hardly say no ) as a preliminary step.

..they will present their "new evidence" ( he will shoot it down.)

..they can then---move on to the Attorney General, and be able to say in their presentation for an independant investigation, to her----that they have followed protocol, and did in fact request the case be re-opened by the SDSO 1st.

..which is what the desired outcome is anyway.

I think this is wonderful news! Long overdue, IMO, but I'm hopeful.

I don't know if a meeting will change anything, but it is the right thing for the Sheriff to do.

Oh to be a fly on the wall in that room when that goes down. I can't see Gore being able to be truly neutral and back out of the corner he put himself in. Even if he does can he and that department be trusted?

With AB looking over their shoulders the entire time I guess it could work but she will be exhausted. The trust is long gone in my opinion between these two.

AB & MR to BG...... whatever you say.... can and will be used in a civil case against you and your department.

I wonder where AS is? I wonder what JS and his lawyers are thinking. Is it just me or is the PR war for JS not in action. I wonder if that company is still working for him. If I was privy to these details, especially Dr. W's findings... I would have serious reservations about representing this client. I wonder if JS knew about the computer searches? Learning that information I wonder what if any conversations are going on in the Shacknai camp?

There is also one creepy disgustiing detail that niggles me. The underwear in the garbage can in the guest house. Is AS uncle pervy? If we believe the clothing was GS and possibly friends were the underwear hers and why were they disgarded? ewww this case just gets ickier and ickier.

Thank you, I have enjoyed reading all of the interesting posts. I am very hopeful for the family this week. But Gore has dumbfounded me so many times already, I am preparing for the worst.....: :(

I say go for it, Anne. Call him on his threat. We, members of the public Gore is apparently reluctant to shock with the (apparently) dirty details of Rebecca Zahau's personal life, could care less what those details are. We are interested in those details that pertain to Rebecca's death and the investigation of it, by the SDSO. Bring it!

It also says in the CPRA

Waiver of Exemption

Exempt material must not be disclosed to any member of the public if the material is to remain exempt from disclosure. Once material has been disclosed to a member of the public, it generally is available upon request to any and all members of the public. Confidential disclosures to another governmental agency in connection with the performance of its official duties, or disclosures in a legal proceeding are not disclosures to members of the public under CPRA and do not constitute a waiver of exempt material.

Now as far as I understand there is no legal proceeding underway, so this would mean that Sheriff Gore has basically waived his exempt status. But I would need someone with legal knowledge to confirm this.


As well, what a slimey piece of work he is. I think he forgets who the victim is in this case. IMO

First Amendment attorney, Guylyn Cummins of San Diego, is not affiliated with the Coronado death investigation, but she was taken aback when News 8 showed her the Sheriff's letter.

"I personally have never seen anything like this," Cummins said. "I think it's the first time that I've ever seen a law enforcement or governmental agency do this."

"What the letter's trying to say is, if you release something and we don't like your viewpoint -- or the information that you rely on -- then we're putting you on notice that we may come back and release anything that we want; whether it's part of the lawful investigation or simply digging up dirt on the victim," said Cummins.

Attorney Anne Bremner told News 8 that she considers the letter a threat. Her co-counsel, attorney Marty Rudoy, agreed.

"I believe there's an implied threat in the letter that they would release information hurtful to the victim and her family," said Rudoy. "It has chilled our willingness to release relevant information to the media that would help the public determine what happened in this case."

It seems to me Gore is more interested in protecting JS's reputation than RZ's and now his own. This sure does need to be completely investigated by a neutral party. I am astounded by Gore's veiled threat. He needs to RETIRE.

He's just representing the interests of the taxpayers who voted him into office. I think they have long lost interest in this case or spending more of their tax dollars investigating it just so Bremner can file a wrongful death lawsuit. Her goal could not be any more transparent.

JMONo other reason? How about truth? Money doesn't determine what is true. I'll admit it can be used to shape what might become the truth, but it cannot change what is already true. Truth is truth.

JS takes another PR risk by okaying an investigation inside the mansion but with calculated strings attached. A limited amount of time and the SDSO must co-operate and given BG's reputation there is no way this will occur.

Both JS and BG have everything to lose if the truth comes out so they manipulate, threaten, control and stall. IMO at this point BG is as bad as the possible murderer by not allowing this second investigation inside the mansion. He is aiding in the cover-up of the crime.

AB's latest statement that the letter is not RZ's WOW and BG thinks it is.... sickening how shoddy this investigation was.

How about the woman was most likely murdered. Some people are more concerned with justice...others...holding on to their money/power. If it comes about that there is liability in the killing/coverup...it would be equitable justice for a jury to decide.

These people are just making me sick!

As of Tuesday, the Zahau family was waiting to hear whether the sheriff's department will supervise the forensic testing. A sheriff's department spokeswoman said, "Our investigation is concluded and the family has the entire file -- to include scene photos. The house has left our control (months ago) and many, many people have walked through -- there's nothing there."

Good points, all of them! After hearing the potion of the 911 call that is available to us, I think the person who would call the victim 'a girl', his nephew 'the kid', enter the house to get a knife, but have no worries as to whether or not his brother was in the house also, possibly harmed, needs to, HAS to be further questioned and investigated. He has answers to this riddle.

'Are you alive?' What a piece of hooey!! Look at me, I can slide a table across the yard while I am calling 911, to pretend I'm cutting 'the girl' down, state I am doing cpr, despite the fact I didn't remove the t-shirt or rope from around her neck, or untie her arms. Hello, ring ring Gore, shouldn't this person who failed a lie detector test, was the only person at the victims home that night, unless you count Gina Romano and her black bag, be further investigated, interrogated?

Oh that's right, no one knows where he is!

In multiple polls, the taxpayers for whom Gore works, have voiced questions and concerns as to how the case was handled, the evidence that was not collected, including primary players finger prints, despite the fact that they fingerprinted Rebeccas little sister, who was known to be out of state.

Also, please provide links to where Anne Bremner has filed a wrongful death lawsuit, or stated that she was planning on that? Please provide links that have the family stating that this is about money, or the reason they can sue JS for money. Those links have been asked to be provided by you SEVERAL times. So far they are ignored or brushed over.

As far as transparent goals, they seem to be becoming more transparent in regards to Anne Bremner and the Zahau family each day. Justice for Rebecca, a murder victim. Unfortunately, I have a much different feeling about the transparency of other players, who are also becoming much more clear as Anne's investigation continues. There are many links to that stated fact, within this thread.

Nothing there? So says the sheriffs department that never even tried to do a re-enactment of this whole "suicide" scenario. Why didn't they try to see how far the bed would move if she hanged herself from the balcony? Or if she could have gotten her four separate head injuries from hanging? Or if the scratches on her back came from hanging? Or why she doesn't have any injuries to the back of her neck, while having extensive injuries to the front?

These two cases seem rather similar. A death under unusual circumstances, wealthy and powerful men with a lot at stake, and a gathering of evidence which the sheriff could not ignore. Guess we are waiting for the gathering of the evidence...

I have covered police and read about crime cases for many years, and I have never seen a sheriff's department stonewall like this one - actively prevent any investigation.

This has gone beyond bizarre.

The sheriff refuses to go to the house to supervise the defense team taking some measurements. This would be the same sheriff's department that never did an actual re-enactment of the whole suicide scenario, and yet they are convinced they done such a great job. What gives?

Six dead in six months within several blocks. That's one per month. Coronado is becoming the murder capital of the country on a per capita basis. Crazy and very sad indeed. I hope SDSO is watched carefully on this one so that justice is again not bypassed.

Murder/suicide seems to be rather common. Might explain why the attorneys have failed to follow through on their pledge from four months ago to make an official request to the AG for a new investigation.

Where do you get the idea there was no investigation? If LE reaches a conclusion and closes a case such as this one, the only way to reopen it is to make an official request to the AG or find new evidence. Such a request was publicly promised by the family attorney months ago and she has yet to deliver on her promise and I have yet to see her deliver new evidence.

I wonder how long it took SWAT to arrive? No one went in and tried to find other victims right away? I have never heard of SWATand a Robot coming to the scene once shots cease. The first officers on the scene goes in and look for victims! Did they call SWAT or an ambulance first?

They never did that when they found RZ.... cleared the mansion and other buildings looking for the killer.

This is all kind of weird responses. Very hands off attitude. Both cases come across as cold, uncaring and self perserving. Not the kind of LE that are there to serve and protect the citizens it's more like they protect themselves. There seemed to be no sense of rushing to victims aide and getting them help.

You find one victim... there are no other shots, no one threatening.... you LOOK for other victims immediately and GET THEM HELP!!!!!............ Does LE in Coronado not even own a vest?

Really? This is standard police procedure? I don't get it. They KNOW there have been shots fired, they have the balls to go in and find the one person but they don't bother looking for more. They just run out of the house and hide behind the bushes until someone else comes?

RZ's death was clearly NOT investigated as a possible murder. The fact that a world renowned ME said the death should be considered inconclusive because you CAN NOT rule out the possibility that RZ was strangled and then hung is NEW. And below is the rest of the things not investigated.

- family members with huge motive because of impending death of child and no alibis
- no past mental health problems or attempted suicide in victim
- no past rope skills shown for victim
- conflicting phone time lines
- voice mail that police and JS insist triggres suicide NEVER HEARD never investigated and never preserved as evidence
- blood at scene not processed
- tape on victim not processed
- underwear in guest house not processed
- liquid in guest house not processed
- inconclusive polygraph by AS... LE LIED and told the Zahau's he passed with flying colors!!!
- no other polygraphs conducted
- brother with inconclusive polygraph admits to viewing porn
- porn bondage viewed on mansion computer
- the hanging rope never established where it even came from
- bed not tested for movement
- railing dust evidence contradicts victim climbing over. RZ does NOT have a eleven inch waist!
- The ME's NEw conclusion that the neck injuries are NOT consistent with a drop hanging and that they are more consistent with a strangulation.
- Blood evidence showing RZ was lying flat when she died.
- Journal entries NOT from RZ

This is just the shortlist. MyBelle do you actually read thoroughly all of the posts and new evidence brought forward? I respect you have a different opinion. How can you ignore the above questions and evidence that was not investigated? For me...on the surface if you don't look at the actual facts it is easy to believe the PR line of LE but you just read the details and their investigation crumbles.

Making a request to the AG must be done so carefully. You really only have one shot. They are trying to get access to the mansion to find more evidence. SDSO is REFUSING to accompany them and that was a stipulation by JS the owner. In my opinion SDLE is thwarting any kind of NEW opportunities to gather new evidence. This is shameful and disturbing. If they are so sure of their conclusions why thwart any further inquiries? Also, SDLE was very aware there would be a new autopsy and they never even sent an officer to oversee. Again they are refusing to pariticpate and acknowledge the new evidence. The meeting was cancelled last month and SDSO actually threatened to damage the victim's reputation in a letter. How cold and cruel is that? SDSO refused to take calls and respond to the Zahau family months ago. SDSO refused to listen to the new evidence brought forward. SDSO refused to get look at the case with fresh eyes. Even when extremely compelling and experts of the highest renown literally "BEG" them to please re-look at this case.

Yes, it is standard police procedure when multiple shots are fired and number of assailants is unknown in order to protect the safety of others, including the safety of the officers responding. Did you not follow Columbine or the VA Tech shootings? Firefighters don't blindly enter unsafe buildings and police don't either.

Your accusation that the dead child's parents had a motive to murder and have no alibis is incredibly unfair and cruel. I've never heard of any case of a gravely injured child where the parents left the dying child's bedside and killed the person they thought responsible rather than let law enfocement do its job. afaik, there is no evidence that Max's parents were involved in any way in RZ's death.

There is a process in place to make an official request for another investigation and, afaik, the RZ family attorneys have not made an official request. The process is dictated by statute, not by the whim of some celebrity attorneys and pathologists.

Why not nail the facts down?

MyBelle that is true the laws will allow the family to make a formal request to the AG... but you need to bring as much solid evidence as possible. When you get National and International media attention it stays in the psyche of the nation. (I pray it doesn't take this long). People want answers they want as close to the truth as possible.... not just the Zahau family.

Justice must never be thwarted by taxpaying decisions and state boundaries indeed international boundaries. Truth and justice is at the heart of any nation, of a civilized and peaceful global society. Let this woman's death go by without answers to profound amounts of inconsistencies in the evidence and the long list of unanswered questions... and all women in the world suffer this injustice. If you let this case go by without justice being truly served.... we all begin to lose the good fight.

With so many unanswered questions and discrephencies in this case it screams out for re-investigation. I am sure the Zahau family would appreciate your sympathy. I don't get the impression this family wants a specific answer... they just want the truth. That would be healing. When you look at the evidence carefully the truth was not found out by LE. There are far more questions than answers.

It would take a "real" man to step above his ego and do the right thing. To re-open the investigation and admit it needs to be looked at further. Gore has been thrown many bones and refused to pick them up. He has let his ego get in the way of justice. Gore or any of his people... please re-investigate this case. It cries out for more answers. The recent arsons in LA... unprecedented... they might not be related but I get the feeling the disenfranchised have upped the anti on how to get the public's attention.

You couldn't be more wrong about the media losing interest. Just days ago ABC News named Rebecca's death (crime) Number 8 in national crime news. It followed Casey Anthony (2 stories) and Madoff along with other very recognizable crime news stories. That is hardly losing interest MyBelle!

(I pray it doesn't take this long). People want answers they want as close to the truth as possible.... not just the Zahau family.

Justice must never be thwarted by taxpaying decisions and state boundaries indeed international boundaries. Truth and justice is at the heart of any nation, of a civilized and peaceful global society. Let this woman's death go by without answers to profound amounts of inconsistencies in the evidence and the long list of unanswered questions... and all women in the world suffer this injustice. If you let this case go by without justice being truly served.... we all begin to lose the good fight.

With so many unanswered questions and discrephencies in this case it screams out for re-investigation. I am sure the Zahau family would appreciate your sympathy. I don't get the impression this family wants a specific answer... they just want the truth. That would be healing. When you look at the evidence carefully the truth was not found out by LE. There are far more questions than answers.

It would take a "real" man to step above his ego and do the right thing. To re-open the investigation and admit it needs to be looked at further. Gore has been thrown many bones and refused to pick them up. He has let his ego get in the way of justice. Gore or any of his people... please re-investigate this case. It cries out for more answers. This case is NOT about you... in the end it is about justice for everyone. You will regret for the rest of your life not re-investigating this case. If you have done wrong then retire and step down... walk away and at the very least do not stand in the way of justice... to let his case go by.... means everything you have worked for all the years and effort are for not.... YOU have the power to ensure justice and the truth is found. There is still opportunity Gore.. meet humbly, intelligently and with an open mind with AB... and let justice take it's due couirse. If you can't do that.... retire and get out of the way. Do the right thing.

RZ's death was clearly NOT investigated as a possible murder. The fact that a world renowned ME said the death should be considered inconclusive because you CAN NOT rule out the possibility that RZ was strangled and then hung is NEW. And below is the rest of the things not investigated.

- family members with huge motive because of impending death of child and no alibis
- no past mental health problems or attempted suicide in victim
- no past rope skills shown for victim
- conflicting phone time lines
- voice mail that police and JS insist triggres suicide NEVER HEARD never investigated and never preserved as evidence
- blood at scene not processed
- tape on victim not processed
- underwear in guest house not processed
- liquid in guest house not processed
- inconclusive polygraph by AS... LE LIED and told the Zahau's he passed with flying colors!!!
- no other polygraphs conducted
- brother with inconclusive polygraph admits to viewing porn
- porn bondage viewed on mansion computer
- the hanging rope never established where it even came from
- bed not tested for movement
- railing dust evidence contradicts victim climbing over. RZ does NOT have a eleven inch waist!
- The ME's NEw conclusion that the neck injuries are NOT consistent with a drop hanging and that they are more consistent with a strangulation.
- Blood evidence showing RZ was lying flat when she died.
- Journal entries NOT from RZ

This is just the shortlist. MyBelle do you actually read thoroughly all of the posts and new evidence brought forward? I respect you have a different opinion. How can you ignore the above questions and evidence that was not investigated? For me...on the surface if you don't look at the actual facts it is easy to believe the PR line of LE but you just read the details and their investigation crumbles.

Making a request to the AG must be done so carefully. You really only have one shot. They are trying to get access to the mansion to find more evidence. SDSO is REFUSING to accompany them and that was a stipulation by JS the owner. In my opinion SDLE is thwarting any kind of NEW opportunities to gather new evidence. This is shameful and disturbing. If they are so sure of their conclusions why thwart any further inquiries? Also, SDLE was very aware there would be a new autopsy and they never even sent an officer to oversee. Again they are refusing to pariticpate and acknowledge the new evidence. The meeting was cancelled last month and SDSO actually threatened to damage the victim's reputation in a letter. How cold and cruel is that? SDSO refused to take calls and respond to the Zahau family months ago. SDSO refused to listen to the new evidence brought forward. SDSO refused to get look at the case with fresh eyes. Even when extremely compelling and experts of the highest renown literally "BEG" them to please re-look at this case.

I think that in this list there is very little that I would call good evidence of anything let alone new evidence. Some of the conjectures here might have at one time been good starting places to follow a line of investigation and may even be good starting places now for anyone not convinced of LE's conclusions. But I think that any line of investigation you take will eventually lead you back to the same place and the same conclusion that there is no real evidence whatsoever that there was any other person or persons at the scene of Rebecca's unfortunate suicide.

Those are good points I didn't add the following... these all need to be substanciated and "investigasted" because SDLE didn't.

- impossible to hang yourself after you have been strangled
- how did RZ get over the railing with hands and feet tied and only brush off parts of an 11 inch section of dust on the railing?
- shoeprints "more than one" that LE missed on the balcony
- mixed DNA throughout the crime scene..not quite readible.. it was there but was wiped off?
- no other fingerprints from other family members.. NONE..again .suggesting the room was wiped clean
- who turned out the lights... the lights were turned off in crime scene photos
- AS was there!
- Who was using the mansion computer AFTER LE says RZ was dead?
- Follow the paint... it doesn't add up where it ended up
- Bed movement... no drag marks.. it was lifted not dragged... and doesn't seem to have moved far enough
- Why two knives?
- Why two paint brushes?
- Why the small garbage bag.... you can put your hand in this to hide fingerprints?
- Gardening gloves.... who was using them?
- What happened to the cuttings..from the rope...no fibre fromm cutting the rope was found by LE
- No footprints in the carpet... not even RZ's was it vaccuumed?
- What happened to the rest of the rope... rope measurements don't add up who got rid of the rest of the rope?
- What happened to the rope handle? Apparently it was a ski rope?
- Why was RZ's phone on the floor and turned off?
- Why wasn't the dog bone brought in as evidence? It is heavy it could have been used to hit someone on the head.
- Exactly what caused those bashes on the head RZ had?
- Hog tied... there was enough rope left trailing from her hands to have hog tied her
- Research 911 call behavior from guilty and not guilty parties and then re-listen to AS's 911 call
- AS failed the lie dectector test... it was inconvlusive and the examiner suggested it be done again
- Screams.. heard by at least two solid witnesses
- Witness to a woman outside the mansion the night she died
- no security at the mansion and AS had easy access

This is not the total list. And I just want to add.. YES... the request has gone to the AG!!!! It was a long long list. :great:

Dulcet I also want to add that it is standard procedure to take a good look at the family members and especially the partner of the deceased. JS has a documented history of violence toward the women in his life. He was NOT investigated thoroughly. There are many timeline holes.

And I ask you this.... when your brother texts you that your girlfriend hung herself... wouldn't you call him back immediately and ask him a few questions? JS didn't. His cell records show that and they don't show he left a message when he said he did either.

And when RZ allegedly listened to a message that JS sent she NEVER called him back?

I find it curious that the message on the door was in third person. JS speaks often in third person. His last address to share holders contained numerous third person remarks. And let's talk about block letters. The message was in block letters and JS has signed brochures in block letters. Coincidence?

JS's backhanded public attempts at PR. Asking the AG for a new investigation BUT.. BUT BUT BUT.... he is pleased etc. and has total belief in SDLE... really? Any lawyer KNOWS this letter will be absolutely ignored. He never asks a single question JS accepts all this information as satisfactory? Even his ex-sister in law has a list of questions but JS doesn't?

And the second backhanded public attempt at PR. Oh yes you can investigate at the mansion... but I have only given you less than a month.. oh and BUT BUT BUT... not unless you are accompanied by LE... because we all know where the SDSO's office stands on this case... no way in hell is Gore letting any SD officer attempt to undermine his wrapped up case. Really.. why not have your lawyer accompany the investigators...??? Come on.

The dog bone.... I have had one that looks very much like the one in the crime scene photo for my large dog. They are heavy. If you were raging angry that your son is lying in a hospital bed and you have just been told he may never walk or talk again.... and you have been told by your girlfriend that the boy tripped over the dog when he fell... I would not want to ever see the dog........ But if I am alone and worried sick about my boyfriend's child in the hospital..... if it was my dog... I would want that dog with me for the comfort... did someone tell RZ to put that dog in the Kennell?

...... it just isn't a stretch to see how someone would want answers especially the father.... wanting answers from the girlfriend... go back home... catch RZ just out of the shower with a t-shirt on... and start asking questions... and when she doesn't have the answer you want...do you lose it... fly into a rage..... do you use that t-shirt to strangle her... do you use the dog's bone to hit her on the head.... maybe... and when she ends up dead... do you cover it up...does your brother hear the screams and come into the mansion..... to find your girlfriend dead...... does he help you make it look like murder... he has rope tying and knoting skils... because of his job....but SDLE eventually jumps to suicide? There are really so many potential perps and theories that can now be deduced from the details of what was disclosed with the investigation records. Not to mention Nina's harrangings. It could be Dina, Nina, Adam, Jonah, all or any combination of them. The void of real closure is so lacking in this case - and the LE findings didn't address so many elements of the investigation whatsoever. LE was egregiously lacking in answers all around. And let's not forget that apparently Anne B only received the files - not the evidence itself.

I agree. The new wording makes me wonder if it was an actual request she sent or something else. Why would announcing that the request had been sent get in the way? Unless she 's fearful of the threats from SDSO? That they'll reveal some unpleasant truths from the evidence files now? I'm confused.

Me too. Did she even send the letter? I don't know. She posted on facebook that she did then deleted it. AG certainly haven't responded, or I presume it would have been reported. And what about the measurements defense team was trying to do? As far as I know they never got into the mansion because sheriff's department refused to supervise them.

Well I simply don't know how trustworthy she is. What could her strategy possibly be? If she doesn't want people to know something she shouldn't post it on facebook. Instead she posts something then deletes it. I don't know if the letter actually went out, and there have been no response from AG. When JS send his letter, the response was very quick.

SDSO had every opportunity well before their press conference to do their job and consider the possibility the boyfriend who has a a history of violence toward the women in his life, who had just learned his son would never walk and talk again might go after his girlfriend who he believed was responsibile for his son's impending death. Seemed SDSO was too busy preparing for their Media Event to properly investigate RZ's tragic death.

What we need is less politics & more service"the TRUTH" no matter what your status in society! This murder of RZ must be examined and the impossible excuses for her "self inflicted" wounds be tossed out. This poor woman has lost her life because the powers that be wanted revenge.This murder has got to be addressed,and attorney Bremner is right to contact the AG. It is not going to be covered up!!
