Since yesterday's thread is locked, in response to Noor and the issue of the judge stopping the trial.

The trial wasn't stopped because of Tammi crying. One of the jurors ran out of the room, and the judge was asking her when the jury returned if she was alright - not Tammi.

I wonder if TPS's family "leaked" that info to AZ Family (since Laurie Merrill has been in court covering the trial) to get the mental history in the Smith family out there since the judge didn't give TPS a directed verdict in the case.

Wonder if someone is worried that she'll be found guilty, and plan to use witnesses to show psych issues - especially since TPS herself wrote on a blog a long time ago that an ex-hubby and a doctor conspired to force psych drugs down her to combat (allegedly) phony mental illness.


ETA: that blog was where she was touting a book she was writing about her life, and how that particular ex was trying to control her with medication.

You're right about the juror running out of the room but the judge also did ask Tammi if she was alright. He said You doing OK Ms. Smith? Or something like that.

Well, the folks at InSession are all salivating over what will happen today. They have Jeff Guardiere (sp?), some sort of shrink on again. What will Jack say on cross? What will Tammi say? Will they come across all smoochy-coochy (my term) as they did with THE KISS yesterday? Mike Brooks brought up my favorite part of the anticipation... JURY QUESTIONS!

Yes.

I'm very surprised not to hear hearsay objections. The prosecution is really allowing them to paint a picture of normal adoptions, normal relationships between Tammi and her older kids and paint the father of Hannah as a deadbeat.

I would be objecting like mad.
I really, really hope the prosecution rebuts this testimony with the fathers of all the kids, and really shows that these adoptions were off the radar and would not be allowed normally, due to TS' criminal background.

Her youngest son is 15 now, she left her own son when he was only 7!

Yup, the baby was born about 9 months after Gabriel disappeared and Tammi got exactly what she wanted, a baby!

Why is the prosecution allowing so much hearsay? Make the defense work! And leading questions! By allowing them to get away with so much, yes, it makes things go faster but it allows the defense to paint a rosy picture through this slick, used car salesman. They better step it up or she's gonna' walk.

He's a performer, he played steel guitar with the band the Happy Goodman's back in the day. His first wife was Vickie Goodman, daughter of Howard Goodman and Vestal Goodman. Jack's daughter that keeps popping out the babies is the granddaughter of Howard & Vestal.

I recall a friend of mine who was a nurse but didnt make that much money one year and she had 2 boys and got back 9 thousand dollars and paid in almost nothing. i keep thinking this is one real incentive besides creating your own cult

No much, just that he has 3 other kids, he had a little trouble remembering what their ages are, I believe he said they had contact with one daughter.
Other than that it was left up in the air, (where they are now we don't know).
Maybe the prosecution will ask Jack.

I suspect the Prosecution has cards up their sleeves that they want Jack to keep talking and catch him in.

Also, notice the stories that TPS allegedly told JS about how she met Rachel, etc. are so different from what TPS told Det. Ramirez.

Tammi is a nurse but has felony convictions and lost custody of her own children . . . . how is that even congruent since she would be caring for vulnerable populations? Is she still a nurse or had some nurse's training in the past?

Rachel said that one of her children had DS and that the first test on her unborn baby showed it might have DS, and that's why she asked Tammi to pay for a second test.

I just looked up Jack's license info. He terminated his license on 4-30-2010.
Maybe that was around the same time they moved.

The only reason I can think why he still cares about the Phx r/e market is maybe they still own properties or he would like to be an active agent again once the market improves.

As an attorney, I disagree. I find this guy to be sleazy, but in my experience, many would not. Juries are gonna' love him. He can control his emotions much better than Tammi and he is doing a great job (or rather, the defense is doing a great job, through him) of normalizing what is actually bizarre behavior on the part of Tammi and what appears to me to be nefarious and desperate motivations to get a baby and keep Gabriel from his father.

He's painting a rosy, normal, loving picture and a lot of this could be avoided via hearsay objections, calls for speculation objections, etc.

I think he was talking about two different kids/adoptions. One being H and the other, S. Probably the dad of S is refusing to sign away his rights.

[bbm] Which is why I am putting on some $$$ on the prosecutors being ready with an AK-47 of questions that will bring his entire testimony down in flames.

Why would they let it go through otherwise? What's your take on this, as a lawyer?

Well, I suspect the defense was trying to "awe" the jury by having Jack say what big names he played with, like oh, they are important people, so they couldn't have done anything wrong.

They obtained a temporary guardianship for Rachel's baby and had not completed the foster/adoption classes . . . . the document was sent to them by Ken Schutt (Atty) for that baby . . . . they had that form with them @ EJ's as Tammi had conversation with EJ . . .there was a possiblity that EJ would say . . . here take my kid with you. (as an aside he keeps referring to Gabriel as "the child"). Temporary Guardianship/Power of Atty that EJ signed on 12/9/09. Purpose of the document "because we didn't know the mental state of the Mother and if child got hurt we wouldn't be able to obtain care for the child without the document. We strapped his little car seat in the car and went home. . . stopped on way home @ Walmart to get diapers/lotion and few things like that. Unusual happening the night he came home with Smiths phone rang approx 11pm it was Det. Agulara (sic) . . . @ Logan's employment there was a disturbance created by EJ and LE wanted to know where the child was . . . showed up @ our house @ 1:30 am need to verify child there . . . Det. Agulara and others with him - they were @ home due to fight between EJ and Logan . . . LE had to verify Gabe was in their home and safe. Gabe was in the bassinette next to their bed . . . Det. A said I have been with parents, both mother and father and baby is safer here . . . .objection - hearsay -

Where was Gabriel when LE left your home? In same bassinette asleep not knowing what happened. Gabriel lived with Smith approx. 9 days . . . one week from that following friday . . . 17th or 18th. Dec 9 - 18ish, 2009 . . . .Smiths did their own slight research pull up LE records (basically what we are all legally privy to) . . . those confirmed what Ej told us. Part of us wanted to get ahold of him, we were trying to determine EJ's mental state and determine Logan was what EJ said he was . . . Smiths understoon Logan had lot prob's as youngster - felony arrests . . . Gabriel life was a joy during the 9 days . . . JS tried to love on him a lot and speculated there was a lack of bonding . . .took him to see Santa - monumental thing in year one . . . took Gabriel to see EJ several times . . "everytime we were together except for one time" when TS took Gabe alone. Everytime we went we would load up everything EJ gave us for Gabriel . . .felt at some point EJ would come to her senses and ask for child back. . . . one time she called and said "I just need to see if he is ok now goback to your home".

EJ spoke of Logan durin the visits w/Gabriel . . . EJ was trying to Logan on board and allow them to adopt Logan . . . they were not a couple and he was not the Father according to EJ one time . . . he wasn't part of the equation as far as we knew . . . EJ was frightened of Logan. EJ filed with court . . . they learned Tues following the 9th on 13 or 14 - EJ had to answer a complaint that Logan had filed with court - JS did not personally see the paperwork . . .EJ and Logan went to court about 15th on Thurs. . . .Dec. 2009. Gabriel still living with Smiths on that day. Smiths didn't go to court with EJ that day but met her outside of court . . . Smith's had Gabriel and Hana with them. Did not meet w/EJ before the hearing. Plan to meet after court with Logan and Frank to discuss adoption with EJ and TS present. Outside courthouse . . . out front after the hearing. Smiths were excited to meet Logan for the first time . . . let Logan see they are good people - that never happened. TS jumped out . . . JS let TS out of the car - he went to park car - got kids out . . .. EJ very excited - she won he didn't get anything . . . JS concerned about when going to meet the Dad. . . EJ said Logan and Frank stormed out and passed them that day.

a real estate license here in Texas is outrageuos like 25 years ago it was 500 a year and you might need some sort of insurance too I just know unless your seeling I wouldnt want to pay it year after year for nothing.

As for nursing, at one time here in Texas they were so hard up for nurses I had a kook client who had all kinds of drug charges etc and she still got a job wherever she wanted even got to pick her schedule. I dont think it is like that now but in the 90's early 2000 they would take any nurse they could get. Now with all the public criminal records hospitals are being more picky i guess due to liability.

As an attorney, I disagree. I find this guy to be sleazy, but in my experience, many would not. Juries are gonna' love him. He can control his emotions much better than Tammi and he is doing a great job (or rather, the defense is doing a great job, through him) of normalizing what is actually bizarre behavior on the part of Tammi and what appears to me to be nefarious and desperate motivations to get a baby and keep Gabriel from his father.

He's painting a rosy, normal, loving picture and a lot of this could be avoided via hearsay objections, calls for speculation objections, etc.

I understand what your saying I just hope the jurors are NOT falling for it. I am hoping the prosecutors will show his true colors in their cross. Although if the jurors fall in love with him then the prosecutors will look mean. They will need to be very careful.

I think it's more about what he didn't say. He made it appear that they were one big happy family, with one of the kids staying at their house several times during the last few months. No mention that Tammi abandoned them, instead he rattled off names and ages and said something to the effect that they interact with them.

Logan would pick up Gabriel to EJ to exchange child for Logan's visit on Sat morning. . . . JS said no he would not get the children up @ 5:30 am to have the children @ 8 am in Tempe. JS wanted EJ to sleep with Gabriel that night (weird sounding statement to me?!)

They had already planned on deliver product . . . met at the Glass and Grass Church on McDonald . . . assume EJ picked church with a big parking lot. Logan was his Father he is supposed to be with his father!

Last time dropped Gabe off was with EJ . . . didn't know EJ was going to leave the State, during the 8-9 days they had started bonding with child, he was whining and whimpering and wanting to be back with Smiths when handing child over to EJ. EJ had no cell phone - landline - called her home and left msg on answering machine . . . left another message a little later on Friday evening - within a few hours. Tammi might have called EJ twice and left messages and didn't hear from EJ that night. EJ was not home she was out somewhere . . . concerned for what going on for the child. Smiths called again that Sat. morning - didn't reach EJ - left 3-4 messages on Sat. More messages on Sunday . . . increasing aggressive messages - if you have gotten back with Logan just tell us and we want to know Gabriel is okay. Did not go by the trailer . . . it was way out of the way . . . they had no means of contactng Logan. Didn't have a phone . . .no idea how to get ahold of him . . . went to Logan's place of work on Monday. TS came downstairs completely dressed . . . we gave our word we will meet him @ 8 am to meet Logan - went immediately to the trailer - no one came to the door.

Smiths went next door to neighbor - no answer there - no other trailers across or on other side of her. Went to Denny's and had breakfast. Back to trailer to no avail. Only other option was to see if find the Father. They remembered EJ's filing response to Logans allegations (a PO Box). . . look up 99 cent store in Tempe where he worked part time. (ETA . . . What? didn't LE call them to tell them first night that EJ was @ Logan's employment? How did he get a 99 cent store from a PO Box?)

I believe this is a CYA moment. In reality, they sent EJ on her way to pack and get going on the trip they all planned. That would be hard to do if Gabriel was at the Smith's house and needed to be passed off to Logan the next morning.

IMHO - Jack and Tammi knew exactly where EJ was going. It just didn't make sense to keep Gabriel at their house for the plan to work.

Having experienced enough trials, I'm not worried about foot and mouth disease! LOL. I was taught, and experience has proven to me, that it is much more effective, in certain situations, to forestall or interrupt the rhythm the other side wants to create, than to try to make a now likeable witness look like an a$$.

They really allowed this guy to paint a positive picture of Tammi's motivations and actions. I hope they can undo some of that damage on cross but letting that happen to begin with, when it can be prevented, is very risky.

EJ said Yes I should have told you . . . everythin is fine - JS said there are problems - what is up?

TS sent a text back saying too much info to text . . . call us. . . . EJ did not tell where she was . . . general local . . . on a 210 area code . . . JS was talking to EJ . . . Tammi looked up where is 210 . . . San Antonio Tx ., she was afraid they would tell Logan and life or safety would be at risk. EJ found someone who going to get her new identity go under ground, change hair color and never hear from her again. On Speaker phone during this conversation . . . Jack told EJ to come home, not the way to do this, what happens if he breaks his leg . . .can't get him in a hospital. Conversation ended with EJ on Tues. following friday after giving Gabriel back. EJ was upset . . . Jack picked up phone and immediately called Logan and told EJ they told Logan and gave EJ's phone number with the 210 area code.

Tell EJ anything other than come home . . . NO it was come home, that is not teh way to do things .. . no - come home.
Provided Logan with EJ's phone number - conversation with Logan because of volitle relationship they have - she is angry . . . you need to find her . . . .she is in San Antonio it is not that big of a town. Get your father to help you with LE involvement. WE were under the threat she was going to change her identity.

Let me say this, while I find this guy to be as greasy as a pizza, I would be ecstatic to have him as my witness. He is very, very good. Very smooth, very well-spoken, knows how to inject emotion into his testimony and he will come across as believable to most jurors. Ick.

Everything that comes out of his mouth is very calculated, he has to think to long to answer, sometimes he answers the question with a question, to give him time to think about his answer.

Nice that we can let God be the judge because Lord knows, I didn't do a crime...yet...but we all have our issues. This could very well be us someday, God forbid. Everything that comes out of his mouth is very calculated, he has to think to long to answer, sometimes he answers the question with a question, to give him time to think about his answer.

Prosecutor is doing a good job so far, but a bit inexperienced, IMO. Any trial attorney knows they can't show a witness a document without showing the other attorney first.

She joined the prosecution team only a few weeks before trial started (it's in the minutes). She went right from one trial to this one - the prosecution wanted her on the team because her experience is in computer crimes, as I understand.

Prosecutor calling him out that they just could not afford a baby, it wasn't that they were not going to buy one. JS says it doesn't matter if they did not or could not afford a baby.

His answer about that made no sense at all. $500 to each parent and $300 for legal fees. Was he bargain shopping.

He doesn't know Tammi was willing to pay $900/mo. for a surrogate and didn't really get into those minor details with her?
