Judge says person has 2 (1) apply force (2) of a sexual nature (3) causing bodily harm 2 commit sexual assault causing bodily harm
First two requirements if yes are sexual assault. If all three it's sexual assault causing bodily harm.
Bodily harm must be caused by act.
Sexual nature. Any act that is meant to degrade or demean her in a sexual nature
Heeney providing jury with tools to answer questions themselves. Adds this supersedes his previous answer.

I think the question was "what if".... a jury member was on here but i doubt it. I truly believe they all stuck to the law. JMO
Well, the media wasn't getting any more information than what the jury heard, but it's a chilling thought anyway. If the verdict doesn't go how the defence likes and they found out, would a tainted jury be grounds for appeal or a mistrial?

Acts to demean for sexual pleasure are also sexual assault. If removal of clothing violated sexual integrity of the child, that occurred.

That's not good, imo. If they come back with sexual assault and no bodily harm that means they think he didn't murder her.
I think they're going with manslaughter :(

I dont think they will go with sexual assault. I think if they are considering he sexually assaulted her, then they know the result ended up in Tori being hurt. I have a strong feeling majority of them are all on the right page, just one or two who need the clarification..

After the guilty plea (think positive) there are victim impact statements. I think my statement would make reference to "after I found out about all the child porn stuff on your computer, and the sex choking, and the references to your g/f's children...", just to make the jury aware while they're still in the courtroom.
I feel the need to know their reactions when they find out, and I think that's the only way.

I disagree nt ... they know she was murdered which is obviously bodily harm, but not necessarily as a direct result of the sexual assault.

Why aren't they going back to the evidence instead of mulling over what sexual assault means? She did not die from being raped but it does cause bodily harm when your 8!!! She would have died anyway from being kicked but the hammer just sped up the process, so what do these people think actually killed her?

I don't even want to know their reactions to this news, as I can imagine what it would be- I could not imagine being in their place when this news breaks to them. I think them finding this out in front of everyone would be a slap in the face for them- almost cruel.

I love how trials are done in Arizona. I just learned this whilst following the Tammi Smith trial. The jurors can ask the witnesses questions if they need clarification. Who needs a Judge?

I suspect some of them will require extensive counselling as a result of PTSD.

Lacerated liver would cause one to pee blood... So too would vaginal penetration of a child, blood wouldn't come from urethra, unless torn but more from the torn vaginal tissues of a child.

BTW, to those who wondered if possibly Judge Heeney was miffed about being called back, I highly highly doubt that. They take their positions very seriously and realize that it is part of their jobs to ensure that the jurors understand every aspect of what they are deliberating.
There are good Judges and jerk Judges. I don't think Judge Heeney is a jerk. We all know this is a very complex trial (well, given all the jurors know at this time anyway), so he fully understands that and that's why he took the time out to write out his explanations for them. He knows jurors aren't used to the law and it is his job to make them understand.

I think this is where the first question came in about if just having her undressed while contained is enough to charge for sexual assault. It seems apparent that there is at least a juror waiving on this charge for sure.....

I don't think so either but it's frustrating when you spend an entire day explaining to a jury how to come to a conclusion with a whole tree graph and they come back with the same question twice when he already answered YES it is sexual assault and than they asked with bodily harm? Sorry, I was being sarcastic with that post. There was obviously physical harm done to that child if she was peeing blood and that harm was done while she was with him in the car. Unless the jury aren't believing TLM's testimony.

So basic.
Tori, an 8 year old girl, was taken by two strangers on her way home from school.
She is dead.
The two strangers are TLM and MTR. Guilty. Go to jail.
The details are irrelevent imo. I just don't understand what is to discuss as it is very basic imo.

I'll have to disagree. Some of his decisions were "curious". I'll use the same word Blatchford used in her description. I had a problem with Judge Heeney throughout the trial. I don't think he's a jerk but I questioned his experience in murder trials this morning and I really would like to know his history. Not sure if there is a way to get that information with our infamous Privacy Laws but I would be very interested.

Given the limits of what we knew at the time, you were totally justified in feeling that way. So, confession time for me. I am 38 weeks pregnant (4th pregnancy)and have been having regular contractions since 6pm tonight and refuse to go to the hospital until the jury is done for the night. I even sent my husband to a movie so he doesn't figure out I am going into labor. Good thing the hospital is only a block away. Midwives have been paged and are fine with me hanging out at home for a bit.
Hopefully if this baby comes tonight I'll be back by 9am if there is no verdict tonight!!

Hugs, dont feel ashamed. Your heart I know ( I wont even assume) was in the right place and you just wanted justice for the right people and MR will get his justice one way or another Im sure of that
Edited to add - No i do not endorse any harm on MR but I do feel he will get what is coming to him either in jail or outside of jail. His face is known, His actions have been heard, He is no longer the innocent dupe in the publics eyes and he will never ever ever be able to change that.

You should not be ashamed. You made an educated decision based on the evidence presented. If the excluded evidence had been included I am sure you would have felt otherwise. There is nothing wrong with what you had felt was an accurate assumption at the time. JMO.

Clearly this jury is struggling. I don't think that his obtuse answers are helping. if someone doesn't understand the legalities, how does it help to explain it further by continuing to use highly technical legal language. He should have found a way to give a clear explanation in as close to layman's terms as possible. He is supposed to be an expert so he should be able to do that without making the decision for them. (Even though I think he took away their ability to make an objective decision by suppresing so much key evidence.)

So, confession time for me. I am 38 weeks pregnant (4th pregnancy)and have been having regular contractions since 6pm tonight and refuse to go to the hospital until the jury is done for the night. I even sent my husband to a movie so he doesn't figure out I am going into labor. Good thing the hospital is only a block away. Midwives have been paged and are fine with me hanging out at home for a bit.
Hopefully if this baby comes tonight I'll be back by 9am if there is no verdict tonight!!
Wowsers now how is that for commitment!!!!! Too a speedy and healthy delivery!!! cheers.

I'll have to disagree. Some of his decisions were "curious". I'll use the same word Blatchford used in her description. I had a problem with Judge Heeney throughout the trial. I don't think he's a jerk but I questioned his experience in murder trials this morning and I really would like to know his history. Not sure if there is a way to get that information with our infamous Privacy Laws but I would be very interested.
I'm pretty sure he was the judge for the Bandidos mass murders and same Crown for the trial as I recall. I'm off to confirm!
eta - yes it was Heeney and Gowdey who worked the Bandidos trial...

His movie is over at 10:20 Est so he should be good! I don't have quick labors usually. I had a child on Christmas morning and was home 3 hours later for breakfast brunch with the inlaws so I hopefully will be able to just cuddle with my baby and laptop tomorrow on the couch! LOL!

She did. I don't think Tori went to pee at all. I think the blood in his car was hers. 1 in 28 billion IIRC. :(
I am really surprised they are not back yet.
If they started with a preliminary vote to see where everyone was starting from.... I am struggling for the right words, but if everyone was on the "regardless of who swung the hammer she was kidnapped and raped and died during those intentional felonies" guilty vote.... they would be done by now.
And I don't get the can two people be guilty of sexual assault if _____ question from the jury. They are suppose to be deciding if he is guilty of the charge. It isn't relevant whether one, two or a dozen other people can be charged with her sexual assault. They aren't on trial today, he is.
It could be that one person is arguing that rape cannot be proven and MR may not have removed the clothes ... so the rest of the group needed an answer to the question of whether his presence during the removal of clothes was enough to convict of sexual assault. Maybe one of the three men is holding back thinking that women are vindictive and TLM is the most vindictive of all.

I want to thank those of you who have been here through thick and thin. I had other obligations that kept me from keeping up with the pace of the discussion and all of the details.
I drove by the courthouse tonight around 6:15, on my way home from work (see!...working too late on a Friday night). It was a bit of a zoo in that area. The road construction is making things awkward out in front of the courthouse; the tv news trucks are all still there, crowded around the courthouse; the fans were arriving for the big hockey final game less than a block away (hey, don't stand between Canadians and their hockey team!); and, there was a fairly major accident just across the bridge. The one 'regular' that I didn't see tonight was the guy who stands at the corner of Queens and Ridout, since the Rafferty trial began, holding his sign asking for Canada to bring back the death penalty. Perhaps I just didn't see him amongst the blur of activity.
I hope this vortex of activity is just a precursor to the stars aligning for justice for Tori. Bless Tori, her family and her community of Woodstock.

Yikes! I've heard from friends that the third, fourth, fifth... etc can come pretty quickly when they decide it's time.
Don't they have WIFI in delivery rooms these days?!

If it's a girl are you going to name her Tori? I'll bet you won't name her Terri-Lynne. How about Michael? That's my son's name but my son is not the MTR. No No No. Actually my son got a hoot out of Rafferty's saying he had colon cancer and that's why he takes oxycontin--my son howled and said, how can someone expect anyone to believe that.

I surely hope that no man worth his salt would be holding back thinking MR is not guilty of a rape. What other possible reason would a man have to load a kidnapped child into the car and drive to a secluded field for, Especially if she was kidnapped and they are in agreement of that charge. I'm pretty sure most men out there would know what the motive would be... Providing they have common sense... Unfortunately, common sense seems to be disappearing with each generation....

I have yet to see him on any corner, but i did drive by the smut shop on wellington right after commissioners and there was about a half dozen priest ( they had the white collars) with signs about abolishing porn. I think they also should have been at the court house.

I recall being almost two weeks overdue....water broke, and had to call the squash club to let my hubby know. I asked for him, they came back on the phone to say they couldn't find him. I said take another look. Nope, not here unless he is in the shower. Here's the scoop, take a look or I'll make you deliver! They found him in the shower! ;)
Next baby, almost a month early.
The results will wait. Go to the hospital! :grin:

When my grandson was born last year, the 2 grandma's were invited in to see him. We got a quick look at him, took his picture, and started sending it to everyone. While we were texting/tweeting/facebooking the nurses came and took him away. lol

That's my guess ... that there's one stubborn holdback that is separating all the evidence and eliminating it piece by piece without looking at the big picture ... we've seen that approach to interpretting evidence on various threads on this forum. One juror may be discarding everything said by TLM and then refusing to thread together the evidence that is available ... can't see the forest for the trees.
