Verdict Watch Discussion Thread:

reposting a few of the warnings:

Okay everybody - LISTEN UP! We are not bashing, accusing or blaming Tori's family here. It won't be allowed.

Children walk home from school every day without incident. Parents are not perfect, it's just not possible. Tori's parents DID NOT do this to her. TLM and an accomplice DID. That is where the blame goes.

We had a lot of family bashing in the early parts of this investigation after Tori went missing and a lot of baseless accusations - NONE OF WHICH PROVED TO BE TRUE. Victim and family bashing will not be allowed during this trial.

As some of you may have noticed, the members following this case are dropping in numbers. It's disheartening to us because we need and welcome discussion of both sides of every issue on Websleuths.

Zero tolerance means ZERO tolerance. Please discuss this case with respect to your fellow members. Subtle and veiled harassment and/or talking in code about other members will not be tolerated.

A word of caution on the Alerts in this forum. If you alert a post, make sure it is a clear violation of our Terms of Service. A difference of opinion is not a violation of TOS.

Please note that everything discussed in court and printed/tweeted is now within the realm of discussion. WS has never and does not now have a policy of "innocent until proven guilty." That is for the court room. Here, we discuss, speculate, theorize and judge according to the opinions we develop from following the case.

Keeping that in mind, abuse of our alert system is a good way to find yourself in timeout or worse. Abuse of the alert systems includes, but is not limited to:

Alerting repeatedly on the same poster;
Demanding a specific outcome;
Alerting on the same post more than once.

Once you have alerted a post, move on and don't question the decisions of our Administrators, Moderators or Owners.

Following this trial is very important to our members and we're going to see that they have their day in court. The "zero tolerance" policy in this forum will continue and it will be enforced.

deliberations started at: 2:42 pacific standard time local time

**back from dinner and deliberating at 7pm est**

**update: as of 1115 est the jury has deliberated for 3 hours and has asked to watch the 24 may video interview of TLM**

AM980_Court Their dinner reservations are at 6. They'll then deliberate until 9.

They probably won't sleep very well tonight, kind of sucks, the timing, they will literally just get going, and then go to bed!

Wonder if they will do a quick vote on all 3 charges before retiring for the evening?

While I am happy the time is near, I am sad at the same time. I imagine the family feels the same way. In a way this is a final good-bye to Victoria. After this is all said and done, it is all over, there is no bringing her back :( .

On March 28, 2009, 10 days before the kidnapping, Rafferty watched a movie about a man using a story about his lost dog to abduct a blonde, eight-year-old girl walking home alone after school. She is taken away in the man's car and forced later to perform sexual acts.

On April 23, 2009, after the kidnapping, he downloaded a movie about Karla Homolka.

But none of his disturbing Internet activity could be considered as evidence that Rafferty wanted or planned to rape eight-year-old Tori, largely because it was found under a faulty OPP search warrant.

City TV Reported that there was an OPP video (which we didn't see and the jury didn't see) The interogator likened him to Paul Bernardo at which point Rafferty gagged and hyperventilated.

IMO a jury has the right to hear everything that pertains to evidence. How can we expect a fair trial for the victim and their family when we omit things due to human error?

I wasn't downing his mother. I was just thinking she must feel awful knowing now because i am sure she didn't know about the laptop when she said her son was innocent. Again i was not trying to be rude in any way towards his mother.

I'm crunching on my salt-free tortilla like a maniac, that's what I'm doing. That jury better come back with First Degree Murder and nothing less--if they don't when they get home and get to hear what we just heard they will regret it forever. MOO!

I blame our laws. I said it before. Our laws protect the criminal not the victim and their family. I'm ashamed and disgusted.

It's no wonder poor Rodney had to suck it up so many times. How does a parent handle something like this? How does a parent listen and watch what the monster who is accused of murdering their little girl did, watch him rolling his eyes knowing what he has done leading up to their baby girl's murder.

No child has to go through what Victoria went through. Ever.

I have to go out, get away from this stuff, cannot fathom how this could be and need some space... so I'm going out to mow my lawn, and think and pray that the jury is guided to the right decision. Wow, this hurts me, a stranger to Tori... what must this information do to her mom and her dad? Thanks to all of you here, so faithfully watching for justice to be served.

If it were me on that jury and I found out that the judge didn't think I could use this information in an appropriate manner in determining guilt or innocence I'd be furious. And they can't even speak out about it.

This is going to have huge repercussions. It's as bad as the tapes that were left out of the Bernardo trial. Only this time it was the judge who did it not the defence attorney.

Me too. And I believe she confessed because she didn't want to testify in court. She probably thought if she confessed that was it. Rafferty would be free and she would take the fall.

I just read the article in London post ....did a google search and found link mentioned too ....I am absolutely sick...but not surprised ....I have and knew MR was heavily involved in child porn ....see article for Proof !!!!!!!!....Omg robynhood...this concludes my thoughts posted previously on thread a few days ago! ....abusive male , child perv ...IMO ..an confirmed by the lap top evidence found on M.R. laptop....knew there had to be something on those computers as mentioned by so many here ....ugh wish the jury knew the whole truth....so darn sad///robynhood!....yep released secs after jury was sequestered ...IMO there is tons more!!!....robynhood ...

The Canadian Charter of Rights and Freedoms includes provisions such as section 11(h) prohibiting double jeopardy. However, often, this prohibition applies only after the trial is finally concluded. Canadian law allows the prosecution to appeal from an acquittal. If the acquittal is thrown out, the new trial is not considered to be double jeopardy because the first trial and its judgment would have been annulled. This could really mess up these jurors for life. This is so not fair to the jurors. When a miscarriage of justice occurs like this...the LAW needs to correct it. He could theoretically walk because of this. THAT is not acceptable. MOO

From Detective Smyth. I bet he just wanted to throttle that SOB. I bet it has been hard for him to be quiet, after doing all that hard work and one error screws up the whole deal. I do not understand though. SO if they get a warrant for my house they can not search my dresser? Or my cupboards? The laptop was found in the car so I do not understand how that warrant did not cover it.

Have you read the studies where sick people who are prayed for do better than people who aren't, even when they don't know whether people are praying for them or not? I take that as evidence, not of any single God necessarily, but rather that there are things at work we don't understand.

Maybe the rage the better part of Canada is feeling right now will translate into energy that the jurors feel and act on. I hope.

I think the way the laws of search & seizure work Alison .. is that LE has to specify items of interest they are searching for in the warrant. If, during the course of that authorized search, they find something else that they believe could be or contained evidence of a crime, they have to get another warrant if it is not itemized on the original. Because they had no way of knowing what was on the laptop, they could not know that evidence would be contained on it, therefore their search was a violation under the Canadian Charter of Rights & Freedoms.

Police found nine child porn “movies” on the hard drive. It is not known exactly when they were downloaded or how long they were.

The investigation uncovered 13 women who reported that Rafferty had a penchant for sexual choking — some of which they said was not consensual.

Investigators said they were told Rafferty had one woman who was reluctant to participate in his sexual violence sign a consent note, saying she agreed “to what Mike and I are doing tonight sexual choking and passing out and other things.”

Yep you could hear all legal matters being discussed, but not supposed to repeat anything that the jury is not present for.

So they may have heard about the laptop evidence? I should have went to the court. Then I wouldn't have had a doubt at all! Not that i had much but i did have 1% doubt at times with TLM word. But wow this should never have been left out. JMO

It was bad enough back in 2009 when Tori was missing and then found and then to hear what happened. I believed we all grieved for Tori. But with MR pleading innocent i am angry at myself for trying to find holes in TLM story. When he is soooo guilty. The public and the jury was duped IMO. I hope the jury comes out with a guilty plea tonight. Lets waste no time getting this guy behind bars for 25 years and no parole!

So they may have heard about the laptop evidence? I should have went to the court. Then I wouldn't have had a doubt at all! Not that i had much but i did have 1% doubt at times with TLM word. But wow this should never have been left out. JMO

Im sure some of it came up in legal discussions, but I believe it was ruled In admissible at the pre trial hearing. Its a d**m shame it wasn't allowed

Good morning everybody. Slowly I am finding my speech back. Last evening I was sitting like thousand others head shaking on the couch following a rafferty special on CP24. I just couldn't and still can't believe what I had to listen too.....my GOD.

It followed a very restless night hunted by bad pictures and indescribable anger.

I had a wonderful experience this morning too. I took a little walk through my garden and said good morning to all my tulips. And there she was in the middle of red, pink and yellow....a tulip in the colour PURPLE. Good Morning Tori.

One to my mayor as we have a municipal police force that is funded by the city.
One to the comissioner of the RCMP Bob Paulson. In the latest federal budget the RCMP was hit with a 10% cutback. The federal treasury board funds the RCMP (thus writing to your federal MP).

Citizens of this country need funding for ICE (integrated child exploitation) units at all levels of policing.

I'm angry and I need to do something more than vent on here.

I watched all 7 parts of the interview. At one point I too wondered if MR would might said something if the detective had given him a chance. I do think the method the detective was using can be very successful on a PERSON, which MR is clearly not. I give the detective a ton of credit for managing to try to be nice to MR for as long as he did. I would have a really hard time doing his job. The more I watched, the angrier I got at MR. He is so cold.

When he said "It can wait one more day, when I talk to a lawyer and I know exactly all my rights" (said at 13:51, part 7 of the interview). The detective then tells him that he has two rights, to talk to a lawyer OR to keep his mouth shut. Then MR indignantly says "I have A LOT more rights than that".

***I couldn't stand it and I found myself yelling at him on the video, "YOU have a lot more rights than that, really?? What about Tori's rights!!!???!!??"***

Yes that would be the most logical thing to do. Some do it openly and others do it anonymously and take it from there. (per my long history of following jury trials)

I don't know about that. Although there were a couple of times you could tell he knew he was caught. He'd say something like "I'll deal with that when it comes". Once I think was when the detective mentioned that they would find his DNA on Tori's body.

here is an example from the US (not sure about you guys in Canada): I just got done following the Jason Young trial (he was convicted on 1st degree and it was a retrial no less..the jury hung the first time around)

they took a vote right off the bat and started discussing (much like this case the first day was only a few hours of deliberations)..

they had a break over the weekend iirc

they then deliberated another day

they then came back the next day and took another vote, went to lunch, came back and and 30 minutes or so later took another break (they had reached a decision but the foreperson wanted to take a short break to ensure everyone was solid on their vote).. they came back, voted again and notified the court they had reached a decision.

They did not have a tree ;-) (they also were not sequestered.. which I think should be a requirement in all deliberations of cases like this as there is currently an investigation into juror misconduct as there are allegations that a juror may have been texting during the deliberations.. so far unfounded)

I personally believe the tree and the sequestration could move the process along **unless** they are completely divided and cannot reach a unanimous decision. (this does happen unfortunately)

Michael Rafferty is charged with kidnapping, sexual assault causing bodily harm and first-degree murder. He has pleaded not guilty on all counts.
With the first two charges, the jury has only two choices: convict Mr. Rafferty or acquit him. But they have the option of bumping the murder charge down to manslaughter if they are convinced he took part in the crime but did not kill Tori himself.

Thanks - now I am getting a bit nervous - what would be considered a short deliberation versus a long deliberation? I truly do not follow trials and am trying to manage my expectations. Truth be known if they do not find him guilty of 1st degree I am going to fall into a weeping sack of chit.

I so wish I could go down there right now, I am waiting it out, hoping they have a verdict, maybe around lunch time, I will gladly spend my lunch hour at the courthouse hopefully watching MR crumble and cry and a guilty on all counts verdict is read. In anticipation I wore my necklace with little butterflies on and purple shirt.

On another note, I wonder what the question the jury has is????? Oh I am so impatient, that should have been my username :/

I've thought about this all night and must put it out there. I think I know exactly what happened, IMO, he watched the tapes of karla homolka to figure out how to take a child, watched info on how to rape a child and than watched child porn. What I truly in my gut believe, is this guy was trying to learn this business. WE heard he was a pimp + child porn= selling children. I think TLM didn't want to testify against him, not because she was scared to go on the stand, I think it was because she knows he's a sick puppy and if he got off by any chance, he would maybe go after her in some way since she already ratted him out, so she figured taking the fall for the murder would back him off. IMO I also believe LE knew all of this too but the Crown could not prove it without entering the evidence of the laptop.
