Would it not be fairly easy for the defense to argue that as this was the family car then she could have had a cut at some stage while getting stuff out of the boot. It's not like it was a car she had never been in before.

I'm wondering if the statement about no other injuries to the body includes internal? i.e. blood can be vomited up (sorry to be graphic) but no outward signs of trauma. Such as would be seen from internal bleeding, poisoning, etc. I'm definitely not saying these methods are related to this case, just wondering whether this blanket statement about injury applies to her internally.

Do we know the substance of the call though? A defence would argue that calling to check the details of an extant policy is hardly a crime, albeit suspicious in the circumstances.
It's the claim after the body turned up that is the damming one.

I pretty sure they said the insurance claim was made once the death certificate had been completed.
I dont like the way this case is heading this morning with the case being circumstantial however surely with GBC making phone calls to the insurance company three days before she disappeared surely this is premeditation. IMO
So many more causes of death if it was premeditated. But less with no obvious trauma.

Although I would not expect they would still be there after 2 months? I don't know for certain..I just know they are buggers to get out and until you do get them out they continue to itch and sting and can leave scratch type marks.. but not deep scratches.

I would find it VERY surprising if the Insurer had paid out his claim [given the nature of the investigation].
At this morning's bail application hearing for Mr Baden-Clay, it was also claimed police recovered a journal kept by his wife where she wrote about her husband's affair with Toni McHugh on April 18.
They say in their affidavit that this would have led to an argument between the two of them but Mr Davis said that was an assumption only.
The police are objecting to Mr Baden-Clay getting bail because they say he could interfere with potential witnesses.

My opinion only.. the life insurance firm will state whether he was checking to see how much she was worth dead, or attempting to up grade her cover to something more substantial..

I was referring to the words they used i.e. circumstantial and compelling evidence. Compelling is something you might use to refer to a novel you can't put down. But circumstantial can mean there is none, or limited, hard evidence to support their suppositions.
There is no cause of death, going by the media updates - gobsmacked!
I don't know about sightings of the car. Maybe their is no definitive proof that their cars were seen i.e. a white 4wd could be any car.

sounds like the Crown is not going to have an easy time prosecuting and getting a conviction in this case

yep. Confusing.. I mean there must be some cause of death. I do know its not always 100% determinable.. but a early 40's Woman does not just disappear and end up as she did under a bridge without some reason!.
I wonder if they'll say why police were immediately suspicious on the disappearance day?
Now I'm wondering if the accused used to watch CSI shows, with possible premeditation.

A scratch is not a bite - just my technical view but a bite leaves a teeth mark it does not leave a scratch mark. Do caterpillars even have teeth?

That is lower than low. My hubby would take months to make that call as he would be filled with grief.
IMO this shows the motive......money
how could Gerard be filled with grief at that point? its three days BEFOREshe goes missing.. Allison is ironing his shirts, getting the kids off to school on the MONDAY when he contacts the life insurance firm.. He doesnt get to play grief and worry until the Friday morning..when he has to ring the police and report her missing.. gone for a walk, a bit depressed. .

I believe wholeheartedly in the good work of the QPS and I still think GBC is responsible. I just hope they weren't overly focused on him from the beginning at the expense of all other theories. The Defence could use this theory very successfully if he was the only suspect from day 1 based on nothing more than circumstantial evidence...

He also alleged Mr Baden-Clay had a "deadline" of July 1 for when he intended to separate from his wife.
He claimed in Allison's journal there was a diagram of Ms McHugh's house, drawn by Mr Baden-Clay, as part of their counselling.
Mr Baden-Clay allegedly told police his affair with Ms McHugh had ended some time before Allison's disappearance, "when in fact the relationship was continuing when she went missing", the prosecutor argued.

I don't see how blood in the back of either of the family cars is going to do any good.
People get cuts and it can end up anywhere.
Unless they have a substantial amount of pooled blood, but then again it's hard to prove why it's there if it's the family car. Any other car they would have something.

Lol, no its not.. I had toad poison squirted into my eye and mouth and my whole face and throat went numb..knowing what they can do to the dogs, we ended up going to the doctors just to be sure,lol, and told the doctor it was from a toad.. they obviously knew nothing much about toads as they assumed I had been 'bitten' by a toad. Not sure I know of a toad ever biting! So sometimes stories get mixed up.
- Judgement relating to bail will be handed down at 2.30pm this afternoon.
- Prosecution are concerned as children could be potential witnesses in the trial.
- Allison wrote in her journal two days before she died that he was having an affair with another woman.
- Defence states QPS case is wildly inaccurate, the Crown says it is compelling.
- QPS won't say what they were looking for at NBC house.

I'm so glad her hands weren't removed. What an awful thing to say :( Now i have more questions about it. How does Gbc (even though i still think he did it IMO) get charged with murder if the only injury was a chipped tooth???

I know, how heartbreaking for her personally - dealing with this issue alone. She wasn't the type to vent or talk to friends about deep-seated worries. I recall the comment made by an acquaintance to the MSM informing that she ran into Allison in the supermarket [about one week, prior to her disappearance], and that Allison "just looked right through me..."

I'm starting to think maybe he won't be released on bail. It is much harder nowadays to monitor contact with potential witnesses because of technology, or when other parties are used as the go-between. I find it really interesting that they have now stated that TM would be called to trial as a witness. The risk of intimidating and/or influencing others may be what gets the bail application across the line.
This is also what i dont understand. Surely there must be more to it - the police surely must have had much more compelling evidence before going ahead and charging him. I mean, they could have waited and continued to investigate and try to obtain more evidence.

This is really getting depressing.
It's unfortunate that with a premeditated crime there is more planning goes into how they can murder without leaving evidence.

Exactly - so confusing. If there is so little on him, and no COD, what is Peter Davies so concerned about, what would be so significant for him to want to have it suppressed?

Does anyone think GBC will eventually get out of this ??? My partner is probably reading it all differently to me as he said he won't. I just have this very weird feeling that he will :banghead:
Don't know angel1..If he is guilty then I hope not. And we don't really know if some of the damning evidence is being withheld at this stage.. None much of what I heard so far is damning..just circumstancial..the life insurance thing is not great, but still doesn't prove anything. Does make me wonder about a 'hired' perp.. Just thinking out loud, I guess as it has been mentioned before..

Odd sort of counselling. Drawing a picture of your mistress's house for your wife. I guess he thought it was cathartic.
I'd fire that counsellor stat.

He claimed in Allison's journal there was a diagram of Ms McHugh's house, drawn by Mr Baden-Clay, as part of their counselling.
Mr Baden-Clay allegedly told police his affair with Ms McHugh had ended some time before Allison's disappearance, "when in fact the relationship was continuing when she went missing", the prosecutor argued.
He said Ms McHugh would give evidence at a trial.
Mr Davis has asked for a non publication order until 2.30pm today when it would be argued further.

it is my conviction that she wont be appearing for the defence, Louise.. her rapid ascent to retaining a lawyer, and most likely on the advice of the QPS leads me to believe that Toni knew what was coming down .
I wonder if it ever crossed Toni's mind that should she become the 2nd mrs BC thats where she would end up too.. at the bottom of the Kholo Creek.

What a coincidence, man calls about wife's life insurance. A few days later she disappears and is later found dead. Family suffering financial problems but able to keep paying insurance payments. Wow.
I just told my hubby the info regarding the insurance phone call and he replied "I called about ours the other day, don't go missing and go write some nice things about me in your diary.".
He thinks GBC didn't do it as he can't imagine killing the mother of your kids. He despises his ex wife but can't bear the thought of his kids losing her...

- Judgement relating to bail will be handed down at 2.30pm this afternoon.
- Prosecution are concerned as children could be potential witnesses in the trial.
- Allison wrote in her journal two days before she died that he was having an affair with another woman.
- Defence states QPS case is wildly inaccurate, the Crown says it is compelling.
- QPS won't say what they were looking for at NBC house.

- Mr Baden-Clay told police the mark on his face came from shaving but a forensic examination concluded that was not the case, and that it was a scratch.

He alleged the financial gain from Allison's death went to the motive for her murder.
He also alleged Mr Baden-Clay had a "deadline" of July 1 for when he intended to separate from his wife.
He claimed in Allison's journal there was a diagram of Ms McHugh's house, drawn by Mr Baden-Clay, as part of their counselling.
Mr Baden-Clay allegedly told police his affair with Ms McHugh had ended some time before Allison's disappearance, "when in fact the relationship was continuing when she went missing", the prosecutor argued.
He said Ms McHugh would give evidence at a trial.
The police are objecting to Mr Baden-Clay getting bail because they say he could interfere with potential witnesses.

when i read it, I yhink Ms McHugh will be a witness for the prosecution....but it is not that clear really??? It really just says that she will be a witness at the trial, but it nope, it does not in black and white say for the prosecution...

i think this adjourment till 2.30 augers in favour of no bail. obviuosly the judge want to study the evidence more JMOO

I have never, ever wanted to delve into the meaning of 'enhanced marriage facilitator.'
But you could be right, depressingly. What a ghastly scenario.

how could Gerard be filled with grief at that point? its three days BEFOREshe goes missing.. Allison is ironing his shirts, getting the kids off to school on the MONDAY when he contacts the life insurance firm.. He doesnt get to play grief and worry until the Friday morning..when he has to ring the police and report her missing.. gone for a walk, a bit depressed. .

I was referring to the claim after she had been found.
My hubby would not have been able to get past his grief to even think about making a claim for months and I would be the same for him.
That is what I meant.
It is all too sad for words IMO.

BLOOD was found in the rear of Gerard and Allison Baden-Clay's family car that was confirmed to be hers, according to a police affidavit submitted to a Supreme Court bail application hearing this morning.
But Peter Davis SC, for Mr Baden-Clay, disputed this, saying it was a luminal test only and not her blood.
Mr Davis said the only injury suffered by Allison as revealed in the post mortem was a chipped tooth. He asked why there would be blood in the car if she had no injuries.

My sister did the same. She didn't love her partner, but she kept trying to do the right thing for her kids and family, and he just kept on taking advantage of it.
