Watching Nancy Grace (I can't wait until she returns from vacation) last night, a defense attorney said he would not want to defend him and the best an attorney can do is plead for his life. If that is the thought among the "experts", there is a good chance that there won't be a trial. I hope not. I can't imagine Shasta and her family having to sit through it.

Actually, no, most children do testify in molestation cases along with their counselors, etc. Yes, a majority of parents don't want to have to put their child on a stand to describe the horrific details of what happened to them. But in order to put these low-lifes away, it's most likely the child would testify. These days if the child is young, they do it via closed-circuit tv so the child is not in the same room with the perp.

In this case though, I don't think Shasta would have to testify. If she did, it would be a video recording or like I said, she'd be in a totally different room from that of the pig.

He has a right to counsel. Hopefully, he/she does their duty to insure a due process, make sure the i's are dotted and the t's are crossed. Provide no ground for appeal or dismissal.

She is a beautiful little girl. I have just taken her into my heart. I live on the East Coast and was trying to find out what major department stores are out there so I can send a gift card for someone to buy her some new clothes for when she goes back to school. COEUR d'ALENE -- A brother of Dylan and Shasta Groene said drugs might have been involved in their disappearance and a triple murder last month near Wolf Lodge Bay.

First District Judge John Mitchell said Tuesday he would reluctantly agree with a plea deal to sentence Jesse Steven Groene to prison, but bring him back in six months to see if he can be placed on probation.

Groene, 18, was sentenced to six years in prison for felony burglary and five years for damaging a lock at the Kootenai County jail.

Mitchell ordered the sentences to run concurrently and allowed the first six months to be served at Cottonwood, where Groene would undergo in-patient drug treatment.

Mitchell told Groene if he is to succeed on probation in six months, he will have to stay away from people, maybe even family members, connected to a lifestyle which includes methamphetamine use.

During the sentencing, Groene said he's grown up in the past six weeks and has seen how drugs have affected his life.

Mitchell gave Groene four goals to meet so he could be considered for probation in six months.

Along with success in the programming at Cottonwood and a positive disciplinary report, Groene must have a plan for after-care, continuing counseling and how he was going to stay away from the drug life which has dogged him the majority of his teenage years.
"You'll have to stay away from a lot of people -- Some might be family members -- until the addiction is over," Mitchell said.

My family were the victims of a violent home invasion where myself my children were bound and terrorized by gunmen for 2 hours 45 min. My daughter(9 at the time)actually saw their faces and was with them throughout the ordeal. The defense was going to put her testimony against mine to try and prove I was lying about the events that unfolded. I had sworn statements from her pediatriacian and therapist and teachers saying she could in no way handle facing the offenders in court. She would have to testify no exception. So, we offered a deal. They still got mandatory 25 -50 year sentences (must serve 25)so it was worth not damaging her to avoid trial. It was sad though that the victims were pretty much forced into a deal to try and protect the mental health of a small child.

Sadly, the allowances you refer to are rare, and vary from state to state. In my state it varies by county. Most children don't have the luxury of closed circuit testimony.

I still see Brenda all the time, she picks the kids up after school, Danielle's older brother is really having problems right now, he still takes it personally that Danielle was killed.

That's what I want to know. How long was he watching them? I do hope that the kids were removed first and I hope they didn't have to witness anything so brutal as their family being executed. But now there are reports of Shasta witnessing the molestation of Dylan. God knows what these children endured.

What scares the "you know what" out of me is that these guys are getting so brazen that they would actually kill off a family in order to get to the child.

From what I read, Mom woke the kids. Then the kids saw Mom and stepdad and bro. being tied up. Then kids were carried to the truck and told to stay there. Duncan then went back into the house and beat them to death. They were then driven to somewhere and put into the jeep and then driven to a romote camping site. There were 2 or 3 different camping sites.

I'm so sorry to hear about your daughter's loss of such a wonderful friend. I took it hard when Danielle was found. I didn't even know her, yet it felt like i had lost my own child. I just can't explain it. I'm sorry to hear about Danielle's older brother. The healing process must just be awful when you lose a child the way they did. I can't even imagine it.

I hope the VD's are healing. I admired them during the entire ordeal and continue to admire them, especially whey I see Brenda on tv fighting the horrible epidemic of those who harm children.

Only Duncan knows for sure..........but it doesn't seem too far fetched to me that he would come in while all were sleeping, hold a gun on Mom and boyfriend; have Mom tie up boyfriend and Slade; then wake children, who she also ties (at the order of Duncan of course); he then carries children to truck and returns to beat them to death............I suppose in his sick mind he was protecting the children by the beatings so they didn't hear gunshots........for certain, Mom, boyfriend and Slade were killed because they could identify him.

In this scenario, everyone probably thought to fight back would get themselves killed; they probably also thought that it was just a burglarly and he would leave them bound, take what he wanted and go on his way.....if everyone was asleep, it makes sense they may not have also been able to think clearly.

Nanandjim I thought about it too and what I think happened is he was probably in a way stalking a little watching thier moves at the BBQ watched everyone leave knew they were drinking partying etc.. knocked on the front door and they opened the door if they were stoned and drunk as someone posted awhile back they wouldnt of been too hard to take down their defenses werent up. As far as being stoned and drunk I do not know for sure of course this is just my assumption. I have had people ring my door bell in the middle of the night before and let me say this had I been drunk or whatever there is no way I would of made it I opened the door like a idiot and they were asking extremely odd questions I was able to catch the hint something wasnt right and slammed the door locked it and called the cops. Whether it is fear, or conditioning or whatever, everyone kind of has the attitude that you go along and maybe you live. Prior to 9/11 a handful of people could take over a plane and control a whole planeload of passengers. Since 9/11 passengers feel they are probably going to die anyway, so they are fighting back with hijackers.
Most states have confusing laws, if a person breaks into your home and you shoot them, you could end up going to jail for murder. Unless they have a weapon and you can prove that they intended harm. Of course if they have a weapon or have a chance to physically harm you first, then you are probably dead anyway if that was their intent.
So for years when threatened people have been complying, in the hopes that they will not be killed. But since 9/11 and with all of the horrible murders lately, if someone breaks in people are now trying to fight back.
Self defense teachers for women have been trying to get across to women that you can fight back. And that if you don't fight back, you may not live through an attack. That is what we need to go back to in our laws.

All he had to do if he broke into the house was neutralize the boyfriend first. Maybe he was asleep. Maybe he was drunk/passed out. All he would have to do would be hit him over the head with a bat/pipe/gun then tie him up. Then he would be able to go after the mother and son in the same manner. Or, if he had a gun, simply point it at them and force them to submit. Most people aren't in a real hurry to rush someone pointing a gun at them point-blank, movies/TV to the contrary.

I hope you are never the victim of a violent crime, but wether or not her boyfriend was built like a linebacker or not, he was no match to a man with a weapon, or a man who held the life of two small children in their hands. My husband played defensive line man in college(division one )ball. He is 6 foot 4 and ways 274 lbs. However, the two punks who invaded our home had guns. My husband gladly let them tie him up and did what ever they asked in the hopes that the gun he had pressed to my 4 year olds head wouldn't go off. It's a whole different ballgame when they use children to get you to comply.
My husband tied me up at gun point, and then allowed himself to be tied up without fighting.This might be how this guy got everyone tied up, he might have forced one to tie up the others. We just felt like the less he resisted , the better chance we had of surviving. The cops have since said the ONLY reason we are alive is that my husbnd was able to connect with the assailant in a personal way, and because we complied to what ever they asked. One of the gun men cocked the gun and ws ready to blow us all away, but for some reason the other guy stopped him.I call it a God thing, because I surely don't believe we deserved to live more than anyone else who doesn't happen to get so lucky.
Sadly, that didn't work for Shasta's mom and her mom's boyfriend and brother. It just goes to show you that when people are hell bent on evil, they will do what ever. I don't fault these people for not fighting , they new he had dylan and shasta in that truck, they probably were told what horrible things were going to happen if they didn't comply. I imagin he took the boyfriend out first since he was the biggest.
It's really hard to assume that those people could have over powered this monster and prevented the whole thing, but we weren't there. They were obviously caught off guard very late at night.
I know my mind just hummed with fear throughout the whole thing. I was conscious of my children and where they were, but I hardly remember anything that actually happened to me because I was so focused on their safety. Shasta's mom may have been in the state of mind I was. Her mind probably just checked out when she realized her two babies had been carted out the door by that freak. I just think this is all so sad seeing as had they kept this animal locked up, he would have never been able to re-offend on such a depraved level.

Pedophilia continues to be the "unspoken crime"...Actual statistics on recitivism among convicted pedophiles are nearly impossible to confirm due to the fact that so many of the crimes STILL go unreported. Pedophilia can no longer be considered a "deviance", which can be cured like the common cold. As a serial killer who was being interviewed during the development of the FBI's profiler program stated, "what it all comes down to is, whatever gets you off, gets you off". My husband played defensive line man in college(division one )ball. He is 6 foot 4 and ways 274 lbs. However, the two punks who invaded our home had guns. My husband gladly let them tie him up and did what ever they asked in the hopes that the gun he had pressed to my 4 year olds head wouldn't go off. I agree with you. People will do absolutely anything to save their life, and esp. the lives of their children. They will commit crimes, participate in rape, and do whatever in order to survive. Just the fact that someone broke into your safe haven is enough to place someone into shock, and a threat to your child will almost garuantee (sp) your cooperation. In self defense class they try to teach that a successful self defense against an attack is one that you live to walk away from. Whether that means cooperating or fighting back- it depends on the attacker. I am glad you had a successful self defense.
No matter how big or small the person being attacked is, they have to make a decision of whether or not to fight back. But the attacker is the one who decides whether they will succeed or not.

Watching Nancy Grace (I can't wait until she returns from vacation) last night, a defense attorney said he would not want to defend him and the best an attorney can do is plead for his life. If that is the thought among the "experts", there is a good chance that there won't be a trial. I hope not. I can't imagine Shasta and her family having to sit through it.

The Jeep was reported as stolen. But unless Duncan did something to cause LE to run his license plates- no one would have known. LE doesn't run the plates of every vehicle they see, and look how many red jeeps there are out there. LE wouldn't run Duncan's plates unless he had a traffic violation or was caught somewhere he shouldn't have been or was caught doing a crime. Then of course the LE would run the plates and determine that the plates were stolen, and a check of the vehicle would have shown that it stolen.

I apologize if my posts seem to question the victims' actions. That is not what I intended. I was just trying to get a handle on how it happened and if more than one perp was involved.

From your story, I can easily see how it could happen if Duncan had a gun. I didn't realize that he had a weapon. It would seem logical that he did. Has this been mentioned at all in the press?

From what I read, Mom woke the kids. Then the kids saw Mom and stepdad and bro. being tied up. Then kids were carried to the truck and told to stay there. Duncan then went back into the house and beat them to death. They were then driven to somewhere and put into the jeep and then driven to a romote camping site. There were 2 or 3 different camping sites.
I would think that he had already made a camp setup somewhere before the crimes. I understand that they were taken away in a pickup truck then transferred to the jeep a short distance away, the pick up truck was found by police a day or so later, I don't know if they connected it as a possible connection or not, does anyone know if a truck was reported missing in the vacinity? I wonder if the neighbor ever said what type of strange vehicle was in front of his barn? could this have been duncan in the pick up truck? waiting and watching the events in there yard? I think le should look into some of the local stores for the type of tents that he used, maybe he bought them in town or on his way into c.d.

I havent watched Nancy's show this week, because I cant stand Lisa Pinto as the host--I'm sure she was a fine prosecutor, and sometimes I enjoy seeing her as a commentator, but she is an awful host....I sent an e-mail to the show at the CNN website, perhaps those of you who agree could join me. I really think the producers want to know what we, the viewers think of the people who are going to try and sub for Nancy.

Actually, no, most children do testify in molestation cases along with their counselors, etc. Yes, a majority of parents don't want to have to put their child on a stand to describe the horrific details of what happened to them. But in order to put these low-lifes away, it's most likely the child would testify. These days if the child is young, they do it via closed-circuit tv so the child is not in the same room with the perp.
Not every state has such a law. California doesn't. There is a bill right now in committee in the State Assembly that would allow children under 14 to testify by CCTV at the judge's discretion. Some of the major stores in the area are Macy's, Sears, JCPenney, Mervyn's, Nordstrom, just to name a few. Some of these are in Spokane, which is only about a half hour away from Coeur d'Alene. In addition, the malls all have Gap & Gap Kids, there are also a few TJ Maxx & Ross stores in the area.
She has one older brother who's in jail for the next 2 years. He says that all this has hit so close to home that he wants to change his ways. I hope it's true, Shasta has had enough violence and sadness in her life.

I think that Lisa is just as good as Nancy Grace but that isn't saying much. I admire Nancy Grace for her passion involving cases but she is a horrible host. The dramatics are so over board that it comes across as very fake. I like to watch her show because she does have good information but her dramatic performance affects me about the same as someone scraping their fingernails on a chalk board.:eek:

Before I continue, let me issue a grossness warning...

I'll try to put this as delicately as possible, and I'm sorry if it grosses anyone out, but if a body is left exposed in an area where there is wildlife (which means just about anywhere, really), animals are going to find it and feed on it. There is lots of wildlife in a remote wooded area like the one where these remains were found, and in that part of the country, the local fauna could include bears, wolves, moutain lions, coyotes...all kinds of critters. In the process, such a body is pretty much destroyed, except for the parts the animals have no use for (bones, scraps of clothing, etc.). Items such as these are scattered about by the animals as they feed.

Sorry, I know that was kind of graphic. But I'm sure that's what happened here. That would explain why we were told that "remains" were found, rather than a "body," as well as why identification is so challenging. A good forensic anthropologist can find out a lot of information (age, sex, race, etc.) from examining a bunch of bones, IF enough of them are sufficiently intact, but DNA may be the only way to make a positive ID. I believe that's why LE is waiting for the DNA results to make a defnite announcement.
