An Amber Alert was issued for two young children missing from their home where the bodies of their grandparents and an uncle were found slain, police said Monday.

The Maricopa County Sheriff's Office said 18-month-old Brian Cervantes and his 3-year-old sister, Jennifer Cervantes, were believed to be with their father, Rodrigo Cervantes Zavala.

The grandparents and uncle found dead late Sunday were relatives of the children's mother, who was not at home at the time of the slayings, investigators said.

Bryan and Jennifer were discovered missing the evening of July 10, 2005 from their grandparents' home in Queen Creek, Arizona, where three people were found deceased. Bryan and Jennifer may be in the company of their father. They may still be in the local area, or they may travel to Michoacan, Mexico. The last time the children were seen, Bryan was wearing an orange shirt and blue shorts with airplanes on them, and Jennifer was wearing flowered jeans and a pink shirt with the letter "B" on it. CAUTION IS ADVISED.

Isabel Acosta begged for the safe return of her two young children Tuesday, two days after they disappeared from a home where Acosta's parents and brother were found murdered.

Late Tuesday night, authorities were still searching for the children's father, Acosta's ex-boyfriend Rodrigo Cervantes Zavala.

He is an undocumented immigrant described by the Maricopa County Sheriff's Office as an "investigative lead" in the three murders and the possible kidnapping of the children Sunday night at a house just outside Queen Creek.

The Sheriff's Office has not listed Cervantes Zavala as a suspect but executed a search warrant Monday night at his residence in Phoenix, Matteson said.

Investigators found indications that Cervantes Zavala had packed up belongings and left the residence, Matteson said.

He is believed to possibly be driving a green four-door 1993 Buick Regal with Arizona license plate 709 SDW.

Matteson said it's possible Cervantes Zavala and the children are in Mexico, another U.S. state or still in Arizona.

One more MAJOR problem when undocumented people are in the country. How do they go about tracking this guy down?

If Maricopa County Attorney Andrew Thomas hopes to persuade Mexican authorities to turn over a Mexican national suspected of killing three people near Queen Creek on July 11, he's going to have to forget about seeking the death penalty.

Or life in prison for that matter.

Thomas' dilemma is part of a drama being played out elsewhere in the country as well. Prosecutors in Denver and Los Angeles are struggling with ideologies and state laws while trying to extradite suspected killers of law enforcement officers.

The death penalty is especially at issue because Mexico does not impose the death penalty while several U.S. states do.

Thomas is not even saying what charges he has filed against Rodrigo Cervantes Zavala in the triple homicide. He won't even say if he has filed them. http://www.azcentral.com/arizonarepublic/local/articles/0724extradite24.html

Maricopa County Attorney Andrew Thomas will have to forget about seeking the death penalty if he wants Mexico to turn over a Mexican citizen suspected of killing three people near Queen Creek.

Mexico refuses to turn over criminal suspects who would certainly face the death penalty or life imprisonment without the possibility of parole _ something the country thinks is also a cruel punishment.

According to the Mexican penal code, first-degree murder carries a sentence of 30 to 60 years in prison.

Police: Girl, 4, recovered after father kidnapped her fatally struck by truck
PHOENIX (AP) — A 4-year-old girl allegedly kidnapped by her father last summer in an attack that also left three relatives dead was fatally struck by a hit-and-run driver, authorities said.

Jennifer Cervantes was playing outside a mini-mart where her mother was selling items a few feet away when she was hit by a truck Sunday, police said.

The driver, a 72-year-old man, pulled into a parking lot and surveyed the damage to his truck before looking at the child and driving off, authorities said. He was arrested at a nearby home after witnesses followed his truck and called police.

Ok the blurb really confused me until I read the article that was linked.

The children were found, and returned to their mother, about a week after they were abducted.

6 months later the little girl is run down and killed.

How tragic for the mother! Her mother and brother were murdered by her estranged husband six months ago. She gets her kids back, to have one of the children run down and killed - and the guy who did it was more concerned for his truck than the child he killed!!!! Unbelievable!!!!

As an aside, I wonder if the father knows the 72 yr old man? The father is still facing kidnapping and murder charges.... Most likely though this was not premeditated... just an uncaring person who valued his posssessions more than a child's life. http://www.websleuths.com/forums/images/smilies/frown.gif
