"... Presti and her daughter were found murdered in their home Wednesday afternoon. Coakley said investigators believe both victims were killed at about the same time, sometime between 10 p.m., Sunday, and noon or earlier Monday.

A neighbor reportedly called Presti's parents after being unable to reach her even though her minivan was in the driveway. Her parents made the gruesome discovery and called police.

Presti's 2 1/2-year-old son Sean was found in his crib, reportedly hungry and dehydrated but otherwise unharmed. He was taken to Winchester Hospital and released Wednesday night to the custody of a foster family, said Denise Monteiro, a spokeswoman for the state Department of Social Services."...

"Michael Bizanowicz, 41, was arrested shortly after 5 p.m. Friday, Coakley said. She said Bizanowicz was linked to the slayings by DNA evidence matched through the state's criminal offender database.

He is being held and will be arraigned Tuesday in Woburn District Court. Besides two counts of murder, he was also charged with one count of aggravated rape.

Bizanowicz is classified as a Level 3 sex offender the highest classification under the state system. Sex offenders are required to register in the city or town where they live, and are classified by the likelihood they will re-offend. "

Michael J. Bizanowicz walked into the Woburn Police Department in the summer of 2002 and registered as a convicted sex offender, but the paperwork was apparently lost and his neighbors were not informed of his status until 16 months later -- after he had allegedly raped and killed a woman and slit the throat of her 12-year-old daughter.

Michael Bizanowicz's name, face and troubled history as a convicted sex offender were splashed over the news outlets across the state after he was accused of the brutal murders of a Woburn mother and her 12-year-old daughter.

But his attorney wants the details of the murder in the district attorney's written outline of the case impounded to limit potentially damaging pretrial publicity.

At a hearing yesterday, defense attorney Stanley Norkunas told Middlesex Superior Court Judge Christopher Muse that for his client to receive a fair trial, the commonwealth's multipage "statement of the case'' should be impounded from public view to protect his client's rights.

Bizanowicz is not facing the DP, and he is still awaiting trial. Brother and uncle of the victims states he wishes the DP would apply.
