The U.S. Attorney's Office filed formal notice today to seek the death penalty against Duncan for the kidnapping of Dylan and Shasta Groene from their Wolf Lodge home and Dylan's murder.

In the paperwork, prosecutors said today that Duncan should be executed because he killed Dylan Groene in front of his sister, Shasta. They say Duncan would be a serious threat to others, if he's allowed to live.

Duncan trial: chemistry, metallurgy, dentistry experts on call

BOISE, Idaho (AP) -- At least nine experts on topics ranging from DNA to the chemistry of duct tape will be called to testify in the federal trial of Joseph Edward Duncan III.

Federal prosecutors gave the court and Duncan's attorneys formal notice of the FBI expert witnesses this week.

The federal trial is scheduled to begin Jan. 22, and most of the court documents filed in the case have been sealed. But two documents filed by prosecutors recently offer hints of the evidence that may be presented.

Federal prosecutors will call three computer experts to testify at the trial of convicted murderer and sex offender Joseph Duncan III.

The experts - Stacy Evans, a retired computer forensic examiner with the Intermountain West Regional Computer Forensic Laboratory; Loren Mercer, a computer forensic examiner with the same laboratory; and Curtis Rose, a senior partner in the firm of Jones, Rose and Dykstra - will testify about computer equipment and digital media owned and used by Duncan, according to documents filed in U.S. District Court on Tuesday.

Lawyers for Joseph Duncan seek one-year trial delay

BOISE, Idaho ? Attorneys for triple murderer Joseph Duncan are asking for another year to prepare for his federal kidnapping and murder trial.

Duncan's trial is set to begin in January, but a motion filed Wednesday in U.S. District Court contended his attorneys need more time.

Duncan is charged with kidnapping Dylan and Shasta Groene of Coeur d'Alene, Idaho, in 2005, and killing 9-year-old Dylan at a remote campsite in Montana. Shasta Groene, then 8, was rescued.

Convicted murderer Joseph Edward Duncan III walked into federal court Monday morning, changed his plea to guilty and avoided a lengthy jury trial in one of the most horrific cases in North Idaho history.

His fate will be in the hands of a federal jury, which will determine if he should be executed by lethal injection. Duncan's sentencing hearing is scheduled to begin Jan. 28 in Boise. He told U.S. District Judge Edward Lodge that he has never tried to shun accountability for his actions.

"I just wanted to say that since my arrest I have never made any attempt to deny my responsibility," Duncan said, reading from a yellow legal tablet. "My plea today is not a confession in the sense that I already confessed ... I will continue to accept that responsibility to the death."

Both sides are asking for delay in sentencing hearing until April at the earliest.
