What a goof! The first "federal" charges filed against Duncan are for driving the Jeep Cherokee across state lines. Below are snippets from the KXLY news article.

BOISE -- The U.S. attorney's office has filed it's first charge against convicted murderer Joseph Duncan, but it's not for abducting two north Idaho children and killing one of them.

A grand jury is expected to make a decision whether to indict Duncan on the more serious charges, as well as on the stolen car charge, in the next few weeks.

Duncan also faces the death penalty for allegedly killing 9-year-old Dylan Groene while he was staked out in the Montana wilderness with Dylan and his little sister, Shasta. He has not been charged yet.

Withing the last fifteen minutes or so, Duncan has been indicted by a Federal Grand Jury on Ten Federal Charges regarding the kidnapping of Shasta and Dylan.

This comes very shortly after he was charged earlier today for the murder of Anthony Martinez in Riverside, CA which you can read about at the link below to the thread started by Rle7.

Some of the ten federal charges against Duncan in the kidnapping of Shasta and Dylan and in the murder of Dylan are:

* Kidnapping Resulting in Death
* Aggravated Sexual Abuse of a Minor
* Expoloitation of a Child Resulting in Death
* Convicted Felon in Possession of a Firearm

Hopefully we'll hear the rest of the charges later this evening.

JED is expected to appear in Boise Federal Court in the coming days to face these charges and enter a plea. Federal prosecutors are expected to request that Duncan be transferred to the custody of U.S. Marshals until a trial.

Federal prosecutors will be seeking the death penalty.

Federal prosecutors said Joseph Edward Duncan III kidnapped Dylan and Shasta Groene to produce child pornography before he tortured and murdered the 9-year-old boy in the Montana wilderness.

In a 10-count federal indictment unsealed at U.S. District Court in Coeur d'Alene on Thursday, Duncan is charged with kidnapping, kidnapping resulting in death, use of firearms in an act of violence resulting in death and child sexual exploitation resulting in death.

Federal prosecutors said they intend to seek the death penalty.

Duncan, 43, of Fargo, N.D., engaged "in sexually explicit conduct for the purpose of producing visual depictions of such conduct," the U.S. Grand Jury panel decided in handing up the indictment. He also transported Dylan across state lines "knowing that such visual depictions would be transported in interstate and foreign commerce ..."

At the time of his arrest, local authorities said Duncan's motive for the Wolf Lodge murders was to kidnap the two youngest children "for sexual purposes" but did not elaborate.

Several weeks later, Thomas Moss, the U.S. Attorney for Idaho, told The Press in an exclusive interview Duncan was also being investigated for the production of child pornography involving the two Groene children.

Court documents also said Duncan committed similar crimes upon Shasta.

Shasta told investigators after her rescue on July 2, 2005, that Dylan was shot to death.

Duncan was also charged with possession of a Browning Arms 12-gauge short-barrel shotgun at the time of his arrest, after he and Shasta were discovered at a Coeur d'Alene diner.

The charging documents also said his death was the result of "substantial planning and premeditation."

The indictment also alleges the physical abuse of Dylan was, "especially heinous, cruel, and depraved."

U.S. Attorney's Office spokeswoman Jean McNeil didn't immediately return phone calls about the case...

...Duncan, a level III registered sex offender, was also charged with two counts of aggravated sexual abuse of a minor, felon in possession of a firearm, transportation of a stolen firearm, possession of an unregistered firearm, and transportation of a stolen vehicle.

BOISE -- Joseph Duncan appeared in federal court in Boise Friday and entered a not guilty plea on ten charges relating to the abduction of Shasta and Dylan Groene and Dylan's subsequent murder.

US District Judge Mikel Williams in Boise entered the not guilty plea to the latest charges on Duncan's behalf when his attorney, Tom Monaghan, said his client wished to remain silent.

BOISE – Joseph Duncan was ordered Friday to stand trial in federal court in March, but his attorney says the convicted killer's defense won't be ready by then.

"The responsibilities in a case such as this are so extensive that as much time as needed is certainly going to be granted," said defense attorney Roger Peven. "It's going to be quite a while."

At the arraignment, when Magistrate Judge Mikel Williams asked if Duncan was entering a not-guilty plea – a standard procedure at that point in an arraignment – the convicted killer balked.

"Oh, that's not right, that's not right," Duncan blurted out, as his defense attorney, Thomas Monaghan, sought to quiet him. The two conferred, and Monaghan told Williams that the defendant would remain silent, and "we'd ask the court to enter pleas of not guilty at this time."

His attorneys later described the incident as a "misunderstanding." Peven said it wasn't a sign that Duncan wants to plead guilty to the charges.

The U.S. Attorney's Office filed formal notice today to seek the death penalty against Duncan for the kidnapping of Dylan and Shasta Groene from their Wolf Lodge home and Dylan's murder.

In the paperwork, prosecutors said today that Duncan should be executed because he killed Dylan Groene in front of his sister, Shasta. They say Duncan would be a serious threat to others, if he's allowed to live.

As I've stated previously, IMO, our very humane form of administering the death penalty is too good for monsters that commit these unbelievably heinous crimes. May God forgive me, but I say he should be burned alive! Eye for an eye ...
