CRESTLINE, OHIO (WOIO) - Authorities in Crestline, Ohio have issued an endangered missing child advisory for 3-year old Haylee Elizabeth Jade Donathan.

Haylee was last seen in Crestline on May 28th, with her mother, Candace K. Watson and her mother's boyfriend Robbi Douglas Potter.
Mr. Potter is a Tier III sex offender and was recently released from prison and living at a halfway house after being convicted of sexual battery with a minor. Potter now has warrants for his arrest. Watson and Potter are believed to still be together, possibly at a private campground in the Central Ohio area.
Potter-27, is a white male, 6'0", 200 pounds with short, straight, brown hair. He has a beard and blue eyes. Candace Watson-24, is a white female, 5'1", 170 pounds with shoulder-length, straight brown hair.
They are believed to be driving a 1988 blue or black Chevy pick-up truck with a 30-day tag Q645916 or Ohio license plate CKX6248 or EKB3855.

taking another look at this poster, it's quite confusing. Note it now shows 3 Last Seen dates. Two of the dates under little Haylee Eliz's name show 5/28 and 5/30. Then you scroll to the very bottom of the poster and it lists last seen as 6/2/09. ( maybe they were seen at one of the campgrounds-but I would not go by this last date as we already know many people call in and say they 'saw' so & so somehwere and that usually does not pan out)
After watching and reading all news reports, they were LAST SEEN 5/28/09. The grandmother originally says she 'spoke' to her briefly on May 31st, something about the Candace saying, " I just dropped him off & I'll talk to you when I get there."

Short note on Haylee D:
She is indeed in serious danger. I found 11 Oct 05 for dob on the web - but stories conflict on her age - is it 3 or 4?
She has a natal Mars - Pluto quincunx. Progressed Sun has moved to sextile Pluto and is now quincunx Mars, too - forming a yod. (Called a fateful finger of God - one of my teachers used to say that he was sure he knew which finger - don't mean to offend, but you get the idea) Planetary combo suggests violent assault to life (Sun). Prog Sun also now sesquisquare Uranus, sudden event, not a good mix with the Mars - Pluto stuff. Prog Moon may be travelling in the vicinity of transitting Uranus, but I can't be sure w/o a timed chart. So this is the progressed background, which is not good. At the end of May, transitting Mercury is conjunct natal Mars, so here is a trigger. Mercury suggests a car trip (short). There is some Jupiter activity, so I am hoping that it lends protective energy to Haylee - but could also suggest the trip (longer, a journey) as well.
Wish I had better news to report. Hope that somehow she can be safe - there's Jupiter Uranus, a "thank the Lord" transit, but the angle is hard.

bringing some facts over from haylee's thread: Candace took off with the rso 28 May. When she didn't show up at Grandma's as she was supposed to do (on nancy grace grandma said that while Candace was on drugs she had custody..) she became concern. Police verified a call for service on 1 June to the home where grandma and a female roommate live.
Mom last talked to her daughter on 31 May. Candace has a cell phone and it is NOT ON. IIRC her debit card was also last used on 31 May.

A poster on the other Haylee thread is concerned that the uproar in the press could put mother and child in more danger from this animal - I agree. Haylee has Uranian activity in her chart- I have seen cases where this shows a person featured in the news. I can't tell if this will work out for the good or bad, remember that there is a t Uranus to n Jupiter connection believed to be miraculous at times. (quincunx, though) Also, Haylee is experiencing t Jupiter trine n Jupiter, a protective influence. Here's hoping for the best.

it is almost a catch 22, isn't it Neptunian? No one knows where they are... between Ohio, Colorado, and possibly Arizona... the media attention could cause this dude to snap or it could help citizens assist in finding the vehicle, etc...

I think the police behavior was lax! You have an escaped con (tier III so.. the worst of the worst) run off with a child! The gma reported it on 1 june and it wasn't issued until 8 june? I am not sure what exactly to think.. but I DO know that if this was my grandchild I would be furious! I hope they are found safely and soon... ((this one is getting to me after the sandra cantu and neveah buchanan cases back to back))

I have been reading the threads on this case. I have thought all along that mom was most likely in danger also. Now that it has been said the atm card has not been used, myspace no hits, and the phone is off (wondering if off means not paid or just turned off) it looks like the mother and child may no longer be with us. Am I reading the above right? Is it saying most likely mom and child have been harmed?

Candace's brother Cyle Watson ( he's a SO as well working at the Half-way house) was arrested today along with Haylee's FATHER, James Donathan and his girlfriend, Nicole Kirkpatrick (spelling?).
I believe they said her debit card had a transaction from Colorado on June 1st.

also from the videos.... The two camped at the Hickory Roads campground in Marion Ohio the first night they were on the lam. the persons checking them into the campground said they checked in as two adults only... They did not register a child. The camp ground people did not see a child. They left the next morning

Jane w/Issues said that Candace was spotted at a Walmart in Marion Ohio returning a tent. It was a friend of hers that seen her there she thinks it was last Sat. Police are checking it out for a return receipt.
As soon as I find a video from her show I'll post it.

Unless this has been cleared up, it looks a Candace Walker (DOB 7.19.84) has a warrant out for her arrest in Phoenix. For one count marijuana violation and another dangerous drug violation in March of 2008.

It's understandable there is some confusion but as in all cases, different news agencies are always quick to quote 'any' infor they hear in order to get the story out. Interesting though, THIS MISSING POSTER indicates 3 different last seen dates. Beats me.
Am watching NG and the woman reporter giving the intro brief says 3 yrs old and at the same time, the TV 'liner' notes says 4 yrs old.
I think the 10/11/05 date is correct.

Candace came and picked him up much later on that night around 3am which would make it 5/29
He was not aware they were going to leave town.
When they first left town, they camped @ Hickory Road Campgrounds in Marion, Ohio.

She registered, it was noted ONLY 2 ADULTS-no child in registration and has been reported none of the people around there saw a child at all. On NG tonight, they said she was at the campground on the 29th & 30th. The first day she registered 2 adults and the 2nd day, 2 adults + 1 child registered.
Candace called the grandmother from her cell on the 31st and said she just dropped Potter off in a town called Bucyrus and would talk to her when she got back home.
( LE said the town is 10 mi away on the NG show but I mapped it and it's 15 mi. away, also LE did not confirm they traced a ping to that town YET)
Then on June 1st, her debit card was used somewhere in Colorado.
LE is currently checking out Walmart because it was reported she 'returned' a tent and had run into a friend that works there in a salon. They are checking for receipts & item return paperwork, also need to confirm what day that was if it really was her at the store.

map I did of the campground they were spotted at and the walmart where the tent was returned. Upon looking at the distance... I am betting that the tent was returned in May not June
ETA: I would hazard a guess that it was returned for the money. If the bankcard was used in Colorado that is most likely where they were next headed

One of the victims' mothers has a warning for Haylee's mom.
"I would tell her to get away. Run, as fast as you can. I mean, even if she doesn't do it for herself, she's gotta do it for her child," the mother said.
Haylee's father, his girlfriend and the girl's uncle are charged with helping Potter escape.
Investigators were checking possible leads near Phoenix, Ariz., after receiving tips that Haylee may be there. The Northern Ohio Violent Fugitive Task Force is handling the search.
Talks are underway to get the case featured on America's Most Wanted.

It was also the Ohio State General Attorney's office that declared an amber alert had issued, at 10 p.m. Monday, June 8. This was not an error, it did but for failure to meet a criterion, it had to be withdrawn. The word then went out as an urgent advisory. There are often problems with the amber alert and Marc Klaas is trying to expand the use and applicable situations. This time, however, the stumble was due to Candace having legal custody.
I think the muddle over H. Eliz. Jade's age is just hasty utterances because 2005 was four years ago and the failure to consider that she was born late in that year. It happens often.

U.S. Marshals say surveillance video could help them track down a Crawford County woman missing with her 4 year-old daughter.
The surveillance video from a Marion Walmart shows a woman belived to be Candace Watson getting into a truck with convicted sex offender Robbi Potter.
U.S Marshals say if you look closely, you can see a child believed to be Haylee Donathan in the vehicle.

The surveillance video is from a Marion Wal-Mart parking lot two weeks ago.
In the video the girl and her mother's boyfriend, who is a convicted sex offender, wait in the truck while the mother goes inside to make a return.

Police say Haylee Donathan, 3, has been missing since May 31, 2009, when she was picked up by her mother and her boyfriend. Both are wanted by police.
According to police, days before she picked up her daughter, Candace Watson helped her boyfriend -- convicted sex offender Robbi Potter -- escape from a halfway house in Mansfield, Ohio.
Police issued arrest warrants for both Potter and Watson.
Potter is a Tier III sex offender, the most serious classifcation.

Cyle Watson calls his involvement in the case of his missing 4-year-old niece "a trick gone bad."
Cyle Watson was at the Volunteers of America on North Main Street with Potter. Cyle Watson, Haylee's father James Donathan, and Donathan's girlfriend Nicole Kirkpatrick were arrested Tuesday night for reportedly helping Potter escape, an allegation Watson denies.
Cyle Watson calls Potter a manipulative person, who told him in prison one of his victims was 16, not 7 or 9.
"I can imagine that's what he told my sister," he said. "Things are really, really serious. It went from a trick to now.
"He messed with another girl. He might be messing with my niece."
Watson said his sister can take care of herself, adding he doesn't believe she knows Potter's history.
"If she's willingly doing it (knowing what Potter has done), I don't know what to think," Watson said. "That's mind-boggling."

Do you see that Haylee was with them and if she is o.k. (relatively) or if she is being hurt or is she frightened? I guess what I'm asking is how is she physically and emotionally. Thank you for your time.
I'm afraid we'll have to wait for another occasion as I am not seeing Haylee in this gasoline station transaction. There are some protective planets in the House of the child but afflicted by Mercury in House 8.
Candace & Robbi are in mutual reception: Venus actually belongs in Taurus and Mars belongs in Aries. He is in control but could further empower himself by resorting to Aries functioning. He could screw up his courage and do the right thing, for instance.
You probably heard the FBI and the marshals appeal to him to turn himself in. She, on the flip side, could assume her stronger position in Taurus, where she belongs. This means she would devise a self-protective Taurean strategy to extricate her daughter and herself from this predicament. She would do this without antagonizing Robbi, performing as Venus in Taurus with determination and will power. Mary Watson drew little comfort from the most recent sighting of her daughter. Watson is the mother of Candace Watson and grandmother of 4-year-old Haylee Donathan, who are believed to be with fugitive sex offender Robbi Potter, 27.
The suspected pickup in the case was captured on a surveillance camera at a gas station in Stratton, Colo., on June 2. Stratton is about 150 miles east of Denver.
“That was two weeks ago,” Mary Watson said. “There’s nothing there. I know they’re really trying, but that’s old news.”
Watson has called her daughter’s cell phone repeatedly, but it always goes directly to voicemail.
She is considering trying to gain emergency custody of Haylee “so we can get her on Amber Alert,” but said she’s short of money for an attorney. Authorities have not issued such an alert because Haylee’s situation does not meet the criteria. It is not considered an abduction.
Mary Watson is just trying to hold out hope. “I don’t know how much more of this I can take,” she said. “We need them found.”

Nationwide Manhunt Under Way for Sex Offender, Girlfriend and Her 3-Year-Old Daughter

The U.S. Marshals Northern Ohio Violent Fugitive Task Force has launched a nationwide hunt for a convicted sex offender believed to be on the run with his girlfriend and her 3-year-old daughter.
Robbie Douglas Potter, 27, is a convicted Tier-III sex offender for crimes against a minor and is wanted for parole and probation violations after fleeing a halfway house on May 28, according to the U.S. Marshals.
“Our Task Force is working around the clock to locate this fugitive and ensure the safety of this little child.” said U.S. Marshal Pete Elliott.
The task force said the vehicle and a female, believed to be Candace Watson, were captured on a surveillance camera at a gas station in Stratton, Colo. on June 2.
The force is offering $10,000 reward for any information leading to Potter’s arrest.

Grandma given emergency custody of Haylee Donathan

Late Friday afternoon, a domestic relations magistrate gave custody of 4-year-old Haylee Donathan to her maternal grandmother, Mary Watson.
An Amber Alert was not initially issued in the case, since Haylee was with her mother, who authorities believe is voluntarily with Potter.
But, with Mary now deemed the custodial parent, an Amber Alert can be issued.
An Amber Alert will also allow authorities to use electronic billboards to run images of the vehicle Potter may be driving.
Mary Watson said, “Thank the Lord.”
Two local attorneys, Heather Cockley and Charles Lynch, helped Mary obtain custody of Haylee free of charge.
According to U.S. Marshal Peter Elliot, “This is a priority case for our task force. We are hopeful that this new ability to receive tips via text will bring the one key tip we need to bring this manhunt to an end and bring little Haylee home safely.”

Wednesday evening Candace Watson’s roommate appeared on Nancy Grace and discussed the Haylee Donathan case.
Samantha Covert said she saw Haylee, 4, in bed with Haylee's mother Watson, 24, and convicted sex offender Robbi Potter, 27, on the morning of May 28, the day the three went missing.
Covert said when Watson left the house she had a basket full of clothes, blankets, and pillows.
Haylee’s grandmother, Mary Watson also appeared and said in the last phone conversation she had with her daughter, she sounded scared.

While Haylee Donathan’s case did not meet the criteria for the release of an Amber Alert, it will now get more attention nationwide through a Missing Child Alert.
Mary Watson, Haylee’s grandmother, was awarded emergency custody of the missing 4-year-old on Friday with the goal of allowing law enforcement to issue an Amber Alert.
Local attorneys Charles Lynch and Heather Cockley took Mary Watson’s case free of charge to help her gain custody of Haylee. Cockley said Monday the case qualifies for a Missing Child Alert, rather than an Amber Alert.
“It’s exactly the same except an Amber Alert goes out over the Emergency Broadcast System,” Cockley said. “What (criteria) we didn’t meet is a confirmed abduction.”
Cockley said a Missing Child Alert will allow Haylee’s case to go to law enforcement nationwide.
“Let’s keep hoping and praying,” she said.

Haylee Donathan is coming home.
The 4-year-old Crestline girl, the subject of a month-long nationwide manhunt, was found unharmed Tuesday afternoon at a Christian retreat center near San Diego. Authorities found Haylee with fugitive sex offender Robbi Potter and her mother, Candace Watson. They were arrested without incident.
“I believe they were a little shocked that we were able to find them,” U.S. Marshal Peter Elliott said Tuesday night at a news conference outside the Richland County sheriff’s department.
The Richland County division of the Northern Ohio Violent Fugitive Task Force and U.S. Marshals, who formed a partnership in January, have been working the case around the clock.
“These guys haven’t slept in a week,” Elliott said of the task force officers standing behind him. “They’ve been crabby, believe it or not.”
Mary Watson, Haylee’s grandmother, thanked the task force and the media for their efforts.
“I want to hold her,” she said. “I probably won’t let her go.”
Elliott said tips led authorities to Haylee, Potter and Candace Watson, who were in the same pickup caught on surveillance camera in Colorado. They were arrested around 7:30 p.m. Eastern time.
“Candace had dyed her hair a little darker,” Elliott said. “Robbi had changed his appearance a little bit.”
As for Haylee, the U.S. Marshal said she appeared happy and relatively healthy.

A 4-year-old Ohio girl who was considered to be in serious danger because she was with a fugitive sex offender and her mother was found safe Tuesday night in California.
Haylee Elizabeth Jade Donathan was found safe at a Christian commune near San Diego, 10TV News reported.
Haylee was being held by Child Protection Services in San Diego County.
Her mother, Candace Watson and her boyfriend, Robbie Potter, were in the San Diego County Jail.
News of Haylee's recovery was announced at press conference in Mansfield late Tuesday night by Peter J. Elliott, the U.S. Marshal for the Northern District of Ohio. Standing next to Elliott at the press conference was Mary Watson, Haylee's grandmother, who had been granted emergency custody of Haylee after the girl's disappearance.
"I never lost hope at all, I knew these U.S. Marshals were doing their job and that they would be found," Mary Watson said.
Elliott said Haylee, Candace Watson and Potter were discovered at the Morning Star Ranch in Valley Center, Calif., about 50 miles north of downtown San Diego. Elliott said Haylee may have a case of chicken pox but is otherwise healthy. Candace Watson and Potter were arrested without incident.
Elliott said a tip from someone in California who saw a billboard with Haylee's picture led to the child's discovery. Elliott said both Candace Watson and Potter had changed their appearance since leaving Ohio.

Haylee Donathan’s uncle is going back to prison for eight years.
Cyle Watson’s prison term has nothing to do with his reported involvement in the missing 4-year-old’s case. Richland County Common Pleas Judge James DeWeese sentenced Watson, 21, to eight years in prison on Tuesday for a probation violation. Watson had marijuana brought into the Volunteers of America and supplied other residents with the drug.
In August 2006, Watson was sentenced to three years in prison for rape. He said he had consensual sex with a 12-year-old girl who lied about her age. DeWeese also gave Watson five years probation for attempted rape. He had eight years in prison hanging over his head if he re-offended.
Watson was released from prison Feb. 28. He violated terms of his probation about a month later by going to a strip club and having contact with minors.

Authorities stormed the ranch in a dramatic Tuesday afternoon raid to find young Haylee Donathan; her mother, Candace Watson; and Robbie Potter, Watson's boyfriend and a registered sex offender who had escaped from a half-way house.
In a news conference Tuesday, police did not say what lead them to the remote Morning Star Ranch to rescue Haylee.
Despite exhaustive media coverage and hundreds of law enforcement agencies on the case, Haylee and the two adults had spent more than a week on the ranch without raising suspicions, said Kevin Carlin, a member of the ranch in the neighborhood of Valley Center.
They told their hosts they were married, he said.
Ranch members became suspicious when a former guest saw billboards urging help in finding Haylee and the two adults while traveling in Las Vegas, Nevada, Carlin said during a phone interview.
The ranch contacted police, who coordinated the secret rescue mission pulled off Tuesday.
"We cooperated fully," he said.
Just before the raid, Carlin said the other families were moved to safety but went about their own business, even going for a swim.
"It was pretty tense because there were armed men on our property and helicopters overhead," he said. '"The couple didn't resist arrest, and it went smoothly."
A few families live on the ranch in several separate homes, according to Carlin, who declined to give an exact number of people.
Haylee, Watson and Potter slept in the same room, but Carlin said he was not sure if they slept in the same bed.

Sheriff's deputies, acting on a tip, arrested wanted sex offender Robbi Potter, 27, and his girlfriend Candace Watson, 24, about 3 p.m. at a Christian retreat on Keys Creek Road, authorities said.
Yesterday afternoon, a resident at the retreat and rehabilitation center, Morning Star Ranch, was driving in the Los Angeles area and saw a billboard with photos of the missing girl and the fugitives, said Deputy U.S. Marshal Omar Castillo.
The resident immediately recognized them from the ranch, as well as the photo of their pickup.
He called the ranch's manager, and the manager verified the photos and license plate. He then called 911 and deputies found the family shortly after.
Haylee seemed to be in good spirits, although she appeared to have suffered a possible mild case of chicken pox, Castillo said.
She will be handed over to her grandmother.
Castillo said the family had been staying at the ranch for about a week, and may have visited the Wild Animal Park three days ago, said another tipster who called authorities.
U.S. marshals were offering a $10,000 reward for information leading to the arrest of Potter.

Losing a child to a sex offender is a mother's nightmare. But what if that mother is the one who brought the sex offender into her home?
In the cases of at least three Midwestern children reported missing this year, police have discovered that their mothers had relationships with known sex offenders.
One little boy was found safe in a motel. One little girl was found buried in a riverside grave. And the third -- 3-year-old Haylee Donathan --was found Tuesday in San Diego.
Federal authorities hunting Haylee's abductors knew who they are looking for -- her mother Candace Watson, 24, and Robbi Potter, 27, a convicted sex offender she is accused of helping escape from a post-prison halfway house in Mansfield, Ohio, May 28.
Ken Lanning, a consultant and former FBI agent who spent two decades studying the sexual victimization of children, said that, in general, the first hurdle for pedophiles on the prowl is access to children. One of the most common ways to get that, outside of abusing a family member, is to latch on to a woman with children, often in a romantic relationship.
And while mothers of the abused children run the gamut from being knowingly involved with the abuse to being completely fooled, Lanning said, most fall into the category that is hardest for police to deal with -- "mom should have known."
Lanning said that while some would consider a mother's attention to a sex offender crime enough, some women don't just turn a blind eye to abuse. They participate.
Lanning added he's heard of some women who actually consent to the predator having sex with their children, with the stipulation that the predator has sex with them first.
Those are the cases that are easy to prosecute, he said. Most of the others fall into a grey area with authorities unable to prove how much about the sex offender the mother knew and whether or not she knowingly put her children at risk.

The nationwide search for Haylee Donathan, her mother Candace Watson, and sex offender Robbi Potter ended at a Christian ranch (the Twelve Tribes) outside Los Angeles after authorities followed up on a tip. Haylee Donathan was unharmed.
A resident at the Twelve Tribes ranch, a Christian retreat, saw the pictures of Haylee Donathan and the two adults on a billboard and recognized them from the ranch. They immediately called the Twelve Tribes ranch manager, who checked the plates of the pickup the fugitives arrived in. After verifying the plates and that Candace Watson and Robbi Potter were indeed visitors at the ranch, the manager called 911.
Police responded and found Haylee Donaldson unharmed and in good spirits, according to Deputy U.S. Marshal Omar Castillo. He added that she may have just gotten over the chicken pox but otherwise seemed fine. Haylee Donathan will be returned to Ohio and placed in custody of her grandmother, who was awarded emergency custody of the child as a precaution pending developments in the case.
Castillo said the three had been at the Twelve Tribes Ranch for about a week. According to a second tipster, the three may have even visited a Wild Animal Park together a few days previous to their discovery and capture.

Uncle's case will go 'straight to grand jury'

MANSFIELD — A hearing for Cyle Watson was held Wednesday in Mansfield Municipal Court to determine if there is enough evidence to send Watson’s case to a grand jury for his role in helping another sex offender escape from the Volunteers of America halfway house.
His attorney, Steve Cockley, said the case will be taken “straight to the grand jury.”
Watson, 21, has been in the news recently because of his niece, Haylee Donathan, who was with convicted sex offender Robbi Potter and her mother, Candace Watson.
Watson was charged with complicity to escape for reportedly arranging for a ride for Potter to leave the VOA. Watson previously told the News Journal his involvement in the case was “a trick gone bad.”
Also on Tuesday, Richland County Common Pleas Judge James DeWeese sentenced Cyle Watson to eight years in prison for a probation violation. Watson had marijuana brought into the Volunteers of America halfway house and supplied residents with pot.

MANSFIELD — The three people accused of helping fugitive sex offender Robbi Potter escape from a halfway house waived their preliminary hearing Thursday, but police paperwork has provided details of their reported involvement.
Cyle Watson, 21, of the Volunteers of America, 290 N. Main St.; James Donathan, 24, of 270 N. Main St.; and Nicole Kirkpatrick, 20, of 728 Mansfield Washington Road all have been charged with complicity to escape. Their cases will be presented to next month’s grand jury.
Drew Deserto, assistant chief deputy with the U.S. Marshals Northern Ohio Violent Fugitive Task Force, said Thursday there were no new developments in the case.
According to a report filed by Richland County sheriff’s Capt. Eric Bosko, Cyle Watson admitted making phone calls to arrange a ride for Potter, then withheld information about his escape. In a jailhouse interview with the News Journal last week, Watson denied any involvement, calling the episode “a trick gone bad.”
Watson and Potter were sent to the VOA after serving prison sentences. Watson said he’d wanted to dupe Potter into thinking he had arranged a ride, hoping Potter would be arrested for leaving the halfway house.
Watson, who said he didn’t like Potter, served prison time with the fugitive at Belmont Correctional Institution. He said he wanted to pay Potter back for money he owed Watson.
Donathan, who is Haylee’s father, lives in an apartment next to the VOA. According to Bosko’s report, Donathan confessed to letting Potter hole up at his apartment for three hours.
Kirkpatrick, Donathan’s girlfriend, reportedly let Potter use her cell phone to call Candace Watson and arrange a ride.

Mansfield, OH – U.S. Marshal Pete Elliott announces the capture of fugitive sex offender Robbi Potter, 27, along with the capture of associate Candace Watson, 24, and the safe recovery of 4 year old missing child Haylee Donathan. Yesterday at approximately 4:30 pm (PST), a tip was received by the San Diego County Sheriff’s Office, who then quickly responded to a Christian retreat center in Valley Center, Calif., where they were able to apprehend Potter and Watson and safely recover little Haylee without incident. The tipster reportedly saw one of the digital nationwide billboards which were put up by Clear Channel Communications in partnership with the U.S. Marshals. The tipster immediately recognized the trio as residents at the Christian retreat center and called 911 to report the tip.
Potter was wanted on a state warrant for parole violation and on a federal warrant for probation violation. Potter is a convicted Tier III sex offender for crimes of sex offenses of minors. On May 28, Potter fled a halfway house in Mansfield, which led to the violation charges. Watson was charged in June by the Richland County Sheriff’s Office with complicity to escape.
The U.S. Marshals Northern Ohio Violent Fugitive Task Force led an intense nationwide manhunt over the last several weeks in search of Potter, Watson and little Haylee. Substantial assistance was provided from the Ohio Bureau of Criminal Identification and Investigation, Richland County Sheriff’s Office, Ohio Adult Parole Authority, Shelby Police Department, Plymouth Police Department and Crestline Police Department, along with other partner agencies assigned to the task force. The case received significant national media attention, especially on CNN shows Nancy Grace, Jane Velez-Mitchell and Headline News, as well as America’s Most Wanted. This exposure resulted in several hundred tips received and investigated by the task force and U.S. Marshals nationwide.
Potter and Watson will face extradition back to Ohio to face their charges. Haylee is in the custody of the San Diego County Children Services pending further review. The U.S. Marshals are also investigating possible federal Adam Walsh Act violation charges on Potter as well as federal harboring charges on Watson.
“We are very thankful to our partners in the media, especially CNN, America’s Most Wanted and Clear Channel Communications, for getting the photos and story out nationwide.” said U.S. Marshal Pete Elliott. “Clear Channel was able to quickly put up digital billboards in multiple states across the nation and this ultimately led to the tip that brought a safe ending to this investigation.”
Assistant Chief Deputy U.S. Marshal Drew Deserto stated “I am extremely proud of all of the Deputy Marshals, Task Force Officers and law enforcement partners that worked day and night on this case. Their determination and perseverance were critical to this investigation and we can all rest easy to now have Haylee safely recovered and Potter back in custody.”

OT sort of........Yesterday was my DD's birthday. She is a Cancer, born in the year of the Dog. Years ago, I began studying astrology, following moon phases, and it helped me tremendously in parenting her as she is a very sensitive and emotional soul. She was extremely emotional yesterday and declared it was the worst birthday ever but once we all got together and went out for dinner and celebrated last evening, she was Ms. Personality! The evening turned out swell. This sign never ceases to intrigue me. This is why I am curious about the influences of this particular new moon. Thanks, WM

Grandmother Hopes Girl Will Return To Ohio Soon

Investigators were working to determine where Candace Watson and Potter were for the last few weeks. Candace Watson was seen on surveillance video at a Marion Wal-Mart. A few days later, Potter's truck was spotted at a Colorado gas station.
Authorities hope to learn more about how the trio ended up in California, Connelly reported.
On Wednesday, Haylee was seen drawing pictures, including one of a dog. Deputies said that she was smiling and talking about Hannah Montana.
In addition to the Ohio charges, Potter could face federal charges that carry longer prison sentences, Connelly reported.
Mary Watson was awarded emergency custody of Haylee but the move is being protested by Candace Watson from her California jail cell, Connelly reported.
Mary Watson said that she believes her daughter is angry with her for reporting them missing to police.
The custody battle could be settled in a courtroom, Connelly reported.

Kenin Carlin, 53, who has lived at the ranch for six years, said the three showed up at the avocado, grapefruit and persimmon farm about a week ago. The well-kept farm consists of several buildings, including a main house, fruit groves, a large garden and a pen where goats and other animals are kept.
“We don't do background checks,” Carlin said. “We welcomed Robbi and Candace and Haylee. They told us they were from Ohio, but we don't watch television. We didn't know CNN was doing a nightly thing on them.”
The three were given a room on the second floor of the main house.
Carlin said Watson helped out in the kitchen and Potter worked in the avocado groves.
“You can say in retrospect they were on their best behavior. They didn't act strange or threatening in any way. . . . They were pretty normal people,” Carlin said. “They didn't seem like a perfectly happy couple, but a lot of young couples have problems.”
Deputies gathered near the entrance of the ranch and then decided they needed reinforcements because they had information that Potter might be violent.
Carlin said the deputies “came with plenty of force.”
“There was a helicopter up overhead. It was definitely tense,” he said.
Carlin said he and others quietly emptied the house, moving residents to another building on the other side of the compound.
“We just wanted to get people out of the way,” he said.
The arrests were uneventful. “They surrendered and were handcuffed and were marched out,” he said.
Haylee seemed to be in good spirits, although she appeared to have suffered a possible mild case of chickenpox, Castillo said.
She will be handed over to her grandmother.
Carlin said Potter and Watson told him they had heard about the ranch from someone camping at a nearby beach with them.
“In retrospect they were obviously on the run looking for a place that was incognito,” he said.

UPDATE: Member of Christian ranch tipped off authorities to Haylee Donathan’s whereabout

A resident of the ranch was in Las Vegas and saw the recent Amber Alert issued in the case, which showed a photo of the truck the three were driving, and the truck’s license plate number.
The resident called the ranch and authorities were tipped off that the three had been helping out and living at the communal ranch for about a week.
The ranch resident who was contacted about the alert, Kenin Carlin, 53, told the San Diego Union-Tribune that, “the three showed up at the avocado, grapefruit and persimmon farm about a week ago."

MANSFIELD — Haylee Donathan’s mother knew sex offender Robbi Potter was on the run, authorities said Wednesday.
“She provided him with money and transportation to avoid arrest,” U.S. Marshal Pete Elliott said. “She says she’s in love with him.”
“They had been hanging out at beaches and sleeping at truck stops,” Elliott said.
Potter and Watson learned about Morning Star Ranch when someone at the beach handed them a flier.
“They told them they were a down-and-out family that needed help,” Elliott said.
Potter and Watson claimed they were married, Carlin said, adding they were on their best behavior.
Watson could be charged with harboring a fugitive.
Elliott said the extradition process normally takes about 10 days. Federal authorities will bring Potter back to Ohio, while the Richland County Sheriff’s Office will transport Watson, unless she, too, is charged federally.
Mary Watson, Haylee’s grandmother, was awarded emergency custody of Haylee late last week. She doesn’t want to believe her daughter knowingly put Haylee in danger.
“I got really mixed feelings about that,” Mary Watson said. “I don’t know what to think. I want to talk to her.”
Watson is more concerned about Haylee and being reunited with her granddaughter. Haylee’s being evaluated, which could take two or three days. The National Center for Missing & Exploited Children is involved in the case.
Watson doesn’t know if she can wait for Haylee to come home.
“I was going to see if I can get on a plane and go,” Watson said.
Watson, 47, of Mansfield said she can handle raising Haylee.
“I’ve had temporary custody before,” she said. “Haylee loves her Ma-Maw. I know she wants to be with me.”

Sex Offender in Amber Alert Appears in Court

Potter was arraigned Wednesday afternoon in federal court in San Diego for allegedly violating terms of his supervised release in northern Ohio.
U.S. Magistrate Judge Ruben Brooks told Potter he was accused of violating probation for allegedly absconding from a Volunteers of America halfway house on May 28 without notifying his probation officer of his new address.
Potter also allegedly tested positive for marijuana at the halfway house on May 25, the judge said.
Brooks ordered the defendant held without bail pending a hearing on Monday.
A hearing was set for July 9, in which federal prosecutors will have to establish that Potter is the person that Ohio authorities are seeking, the judge said.
Watson is due in Superior Court downtown tomorrow for an extradition hearing. Her daughter, meanwhile, is being cared for at the county's Polinsky Children's Center, according to sheriff's spokeswoman Jan Caldwell.

HLN Nancy Grace reported on the case of formerly missing child Haylee Donathan on June 24, 2009. Grace had a discussion panel on the show along with Haylee Donathan’s grandmother, Mary Watson and the U.S. Marshall on the case, Peter Elliott.
Nancy Grace kept the case in the headlines and was credited by U.S. Marshall Peter Elliott for giving the case the air time, which generated several tips from the San Diego area. The tips made it possible for the missing child to be found.
Watson and Potter reportedly told the ranch owner that they were husband and wife. Candace Potter was working in the kitchen to pay for room and board on the ranch. Both Watson and Potter worked on the farm.
Candace Watson, 24, will be charged with harboring a federal fugitive and aiding and abetting his escape.
Watson had darkened her hair to alter her appearance. Potter had grown out facial hair to alter his appearance.
Mary Watson has filed for custody of her granddaughter. Watson was interviewed by Nancy Grace and stated that she would abide by whatever rules Children’s Protective Services set. Watson has not been reunited with her granddaughter yet, as Haylee is having physical exams and being evaluated. Officials need to determine whether Haylee has been a victim of a crime in California.
The discussion on Nancy Grace got lively as it was debated whether Candace Watson would lose custody of her child and who would be eligible for custody. Haylee’s father, James Donathan, is currently in jail and reportedly involved with the breakout of Robbie Potter. The father may also be facing charges, along with his girlfriend. It appears that the only likely candidate for custody would be the grandmother, who was not complicit in any way with the endangerment to her granddaughter.

I don't think the emotionality of Cancer was a factor in locating and apprehending the fugitives. Instead it related to the facets of Cancer that are family, Grandmother Watson (who was not only jumping up and down waiting for a break in the case but who got custody) and the facet of Cancer that is shelter, base of operations, dwelling. The three were situated at Morning Star, Valley Center as a family and had a roof over their heads. Much more comfortable for them but this also allowed the marshals to find them.

The Haylee Donathan case reminds me of a similar scenario, one that occurred in Tampa, Florida but didn’t have a happy ending. The role of a mother is a cherished one. Mother’s are given the most precious gift, carriers of new life. With all gifts come responsibility and the task of caring, nurturing, and protecting children. The choices that mothers make have great consequences. The company one keeps, the people we bring into our lives, and the people we choose to allow around our children can be a matter of life and death. In the case of Amanda Brown, her mother made the same choice as Haylee Donathan’s, to date a sex offender.
Robbi Potter, the tier III registered sex offender escaped from a halfway home and ran off with Haylee Donathan’s mother, Candace Watson. When U.S. Marshals picked up the trio, Candace reportedly told officers that she was in love with Potter. Haylee Donathan has been missing for one month. Think about that, one month. One month with a registered sex offender, sleeping in the same room, and quite possibly the same bed. Haylee Donathan will need to undergo evaluation to determine whether or not she has been sexually abused.
On September 9, 1989, Amanda Brown’s mother, Kathryn Hartman met a sex offender. She wasn’t aware of his past; the sex offender registry hadn’t been established back in 1989. The man’s name was Willie Crain, and the choice that Kathryn Hartman would soon make would change her life, and the life of her daughter, Amanda Brown, permanently. It was Willie Crain’s daughter who introduced Kathryn Hartman to the sex offender. When the two met in a bar, they seemed to hit it off. After drinking, dancing, and spending time together they agreed to see each other again, they were to meet the next day.

VALLEY CENTER — A chance encounter at a beach campground apparently was the reason a fugitive couple from Ohio and a 4-year-old girl ended up at a communal farm in Valley Center, where the child was rescued this week.
With an Amber Alert on road signs across the country, Robbie Potter and his girlfriend, Candace Watson, and Watson's daughter, Haylee Donathan, were on the run and staying at the campground when they met someone who told them about the Morning Star Ranch, said Kevin Carlin, who has lived at the ranch for six years.
The Christian organic farm, where anyone is welcome if they are willing to pitch in and live the “moral” life, welcomed the couple and gave them a room in the main house.
Candace Watson, who had legal custody of Haylee, is scheduled to appear in San Diego Superior Court this morning on a fugitive warrant. She can waive extradition to Ohio or challenge it, which would require further hearings. Potter appeared at a hearing in federal court yesterday afternoon on a warrant from Ohio, and a hearing on his bail was set for Monday.
“We pray to be delivered from evil every day, and it's obvious we were,” he said. “None of our children were harmed. There were no criminal acts here.”
Carlin said the ranch community wants to thank the Sheriff's Department for the way everything was handled.
“We're very thankful for the police and how . . . helpful they were to us, and how much care they took not to cause harm,” he said.

Mother of Ohio girl waives extradition

SAN DIEGO — The mother of a 4-year-old girl who was the focus of a nationwide search that ended when she was found safe in Valley Center waived extradition Thursday and will soon return to Ohio.
Meanwhile, Candace Watson, 24, will be held without bail in San Diego County until law enforcement officials from Ohio come to get her, which usually happens within 30 days, prosecutors said.
Superior Court Judge David M. Szumowski set a July 15 court date to ensure that the process is moving as planned.
Attorneys said little about the case in court during the brief extradition hearing Thursday morning.
Outside the courtroom, however, Deputy District Attorney Jane Via explained that more hearings would have been required if Watson had decided to fight extradition. The attorney said the process can take up to 120 days.
Via said Watson will probably be charged with complicity to escape, a felony, upon her return to Ohio. Citing a conversation with prosecutors from that state, Via said Watson is accused of aiding and abetting in her boyfriend's disappearance.
Potter appeared in federal court Wednesday on a warrant from Ohio, and a bail hearing has been scheduled for Monday.
Candace Watson, 24, waived extradition Thursday and will soon return to Ohio after being on the run for a month with her daughter, Haylee Donathan.

CLEVELAND -- The woman who fled Ohio with a wanted sex offender and took her little daughter with her will face federal charges.
U.S. Marshal for the Northern District of Ohio Peter J. Elliott says Candace Watson will be charged with harboring a fugitive.
She is currently in the San Diego County Jail.
Haylee was expected to be returned soon to Mansfield into the custody of her grandmother.

(CNN) -- A 4-year-old, whose mother took her cross-country with her sex-offender boyfriend, won't be handed back to her mother, according to the girl's maternal grandmother.
"There's no way that I would do that," Mary Watson said Wednesday on HLN's "Nancy Grace."
Watson said she plans to follow the decisions of social services agencies overseeing the well-publicized case of young Haylee Donathan and will not let Haylee see her mother, Candace Watson.
"If (she) is not allowed to see her, she is not allowed to see her," Mary Watson said. "That's the way it is going to be."
After she was arrested, Watson said she "was in love with him and knew she would help him any way she could," Pete Elliott, the U.S. marshal for the northern district of Ohio, told "Nancy Grace."

The national spotlight on the case of the missing 4-year-old Crestline girl came to Mansfield as CNN's Nancy Grace Show ran a live update Wednesday night from the Richland County Sheriff's Office.
A CNN crew set up the live remote so Haylee's grandmother, Mary Watson, could be interviewed along with U.S. Marshal Peter Elliott about the successful completion to the case.
Mary Watson says she thanks everyone involved in the case and is just waiting for authorities in San Diego to release Haylee and send her home.
The U.S. Marshals will pursue a federal charge against Potter through the Adam Walsh Act and Candace Watson will be charged for harboring a fugitive.

Mom In National Amber Alert Case Waives Extradition

The girl -- who may have contracted a mild case of chicken pox but was otherwise in good health and good spirits -- was taken to the county's Polinsky Children's Center and is to be returned to her grandmother in Ohio as soon as possible, authorities said.
Watson signed extradition papers in a hearing before San Diego Superior Court Judge David Szumowski, who ordered her held without bail. A hearing was set for July 15 to make sure authorities from Ohio have picked her up.
"That hearing is set to ensure that Ohio either has come and picked her up or that we track Ohio's progress very closely so that we don't keep someone in custody beyond their lawful detention date," Via said outside court.
Potter was arraigned Wednesday in federal court in San Diego for allegedly violating terms of his supervised release in northern Ohio.
U.S. Magistrate Judge Ruben Brooks told Potter he was accused of violating probation for allegedly absconding from a Volunteers of America halfway house on May 28 without notifying his probation officer of his new address.
Brooks ordered him held without bail pending a hearing on Monday.
A hearing was set for July 9, in which federal prosecutors will have to establish that Potter is the person that Ohio authorities are seeking, the judge said.

MANSFIELD — Haylee Donathan’s mother was charged Thursday with harboring a federal fugitive, a charge that could put her in prison for five years.
“We want to send a clear message that we don’t tolerate anybody who harbors a fugitive,” U.S. Marshal Pete Elliott said.
Watson waived extradition Thursday in San Diego County Court. She faces a charge of complicity to escape for her reported involvement in Potter walking away from the Volunteers of America on May 28.
Since Watson has been charged at the federal level, Elliott said he didn’t know how her extradition would be affected.
Potter is scheduled for a detention hearing on Monday. He was wanted on a state warrant for a parole violation and on a federal warrant for a probation violation. In 2006, Potter was sentenced to three years in prison for two counts of sexual battery involving 7- and 9-year-old victims.
As of Thursday evening, Mary Watson had not spoken to Haylee. She is hopeful of flying to California to be reunited with her granddaughter.
“I’m upset and stressed because it’s taking so long,” Watson said. “I’m to my breaking point.”
Watson also is dealing with the possibility her children will both end up in prison. Son Cyle Watson, a convicted sex offender, was sentenced Tuesday to eight years in prison for a probation violation for having marijuana brought into the VOA. He also has been charged with complicity to escape in Potter’s case.
“I went down and saw Cyle this morning. He said he’s probably going to be shipped to prison tomorrow,” Mary Watson said. “It’s been a really bad day.”

The grandmother of Haylee Donathan, the 4-year-old Ohio girl found this week at a Valley Center ranch with her mother and fugitive boyfriend, said Thursday she is still trying to make her way to California to reunite with the child.
"I just want to hold her and hug her and kiss her and let her know that 'Maw Ma' still loves her," Mary Watson said in an telephone interview from her Ohio home.
Watson said she has not been able to talk to Haylee, despite calls to the Polinsky Children's Center in San Diego, where Watson said Haylee was staying since she was found at Morning Star Ranch, a Christian commune farm on Keys Ranch Road.
The little girl was at the center of a monthlong nationwide search after she disappeared with her mother, Candace Watson, on May 28.
Watson said she wants to get to the West Coast as fast as possible but is in financial straits and has no money to do so. Nor does she have a place to stay.
"I'm just so stressed," said Mary Watson, who said she has been unemployed since last August. "I just can't handle any more today."
Watson said she was just released from the hospital ---- which is where she was when she got the call that Haylee had been found safe.
"I just started screaming and crying," she said.
Peter Elliott, the U.S. Marshal in the Northern District of Ohio, said he believes the National Center for Missing and Exploited Children will help Watson get a plane ticket to California.
Officials from the national center did not immediately return a phone call Thursday afternoon.
Mary Watson said no travel arrangements have been made, and she is still in limbo.
Watson said she has not spoken with her 24-year-old daughter since her capture Tuesday afternoon, after a tipster called the San Diego Sheriff's Department and reported that the missing and sought-after trio was at the Morning Star Ranch.

SAN DIEGO -- There is new information about the Ohio mother charged with helping a child molester escape from a halfway house and taking her own daughter along on a cross-country trek to San Diego.
Candace Watson and Robbie Potter reportedly just met on May 28 -- the same day, authorities said, that she helped him escape from a federal halfway house.
For the first time, Watson's mother, Mary, has indicated that mental illness may be involved.
"She's supposed to be on bipolar medication but she never has the money to go to a doctor or the time, but she needs to," Mary Watson said. "I hope everything works out for her and she does get the help she needs."
Four-year-old Haylee is still in protective custody at the Polinsky Children's Center. Her grandmother has been awarded emergency custody but she's still waiting for permission to bring the girl back to Ohio.
She's fed up with the legal process but thankful she was finally able to talk to Haylee over the phone this weekend. She said the child is full of questions that she can't answer.
"She tells everybody she loves us and we've been telling her we love her and as far as anything else that's been going on we don't know," Watson said.
Candace Watson and Robbie Potter remain in federal custody without bail while they await extradition to Ohio.
Haylee's grandmother said the national Center for Missing and Exploited Children will cover her airfare to San Diego but she is struggling to find a place to stay.

The grandmother of the 4-year-old missing Ohio girl found in San Diego County with her mother and her mother's sex offender boyfriend is growing increasingly frustrated.
Mary Watson can't understand the delays preventing her from seeing her granddaughter, Haylee Donathan.
Now, four days after Haylee was taken into protective custody her grandmother in Ohio said she's fed up with the bureaucracy. She told 10News that her bags are packed and she's ready to fly out to San Diego to pick up the little girl but it's not happening and she's growing impatient.
"As far as I'm concerned -- pardon my language -- [they] don't know what they're doing," Mary Watson told 10News.
Watson's angry at the legal process and the time involved.
"I have custody of my granddaughter," she said. "I have legal rights and they won't give her to me. Won't even let me talk to her."
County Child Welfare Services won't comment on any specific cases but told 10News that there is always an investigation before a child is placed.
After 48 hours a petition is filed in juvenile court for a custody order then it could be weeks or months before a decision is made. Relatives get priority, but nothing's automatic. And Grandma Watson's tired of waiting.
"They told me they'll keep her until July 15th... somehting about some court," Watson told 10News. "[They] said they had custody and I don't know how."
Mrs. Watson said she's been told some other relative is trying to win custody, but has no idea who that might be.

As I read the news articles I wondered, "What is the delay?" But I assume it is because another relative has filed for custody. Would a chart reveal anthing more?
I am so glad Haylee was found safe and I hope she is okay with not signs of abuse. The image of her being carried by LE and waving her little hand and smiling for the news media will forever be ingrained in my mind. :~)

Haylee Donathan's grandmother has spoken to her by phone.
"I've been talking to her three or four times a day," Mary Watson said. "The first day, she didn't seem too good. Since I've been talking to her three or four times a day, she's been real good."
Haylee, 4, is staying in San Diego at the Polinsky Children's Center, a 24-hour facility for the temporary emergency shelter of children who must be separated from their families for their own safety or when parents cannot provide care. The facility includes six residential cottages, a nursery, an on-site library, infirmary and gymnasium.
Potter, 27, waived a hearing Monday. He is scheduled for a removal hearing at 9 a.m. July 9. He was arrested on an Ohio warrant for a parole violation and on a federal warrant for a probation violation.
U.S. Marshal Pete Elliott said Monday federal officials also are pursuing a charge through the Adam Walsh Act. As a Tier III sex offender -- the most serious designation -- Potter could not leave the area.
"I hope they do everything they can do to him," Mary Watson said.
Potter, who has convictions for sexual battery with 7- and 9-year-old victims, walked away from a local halfway house May 28. Authorities believe Watson gave him a ride, knowing he was on the run. She was arrested and charged by the state with complicity to escape. Since then, Watson, 24, also has been charged with harboring a federal fugitive.
Last week, Watson waived her extradition hearing on the state charge. Elliott wasn't sure how the federal case would affect extradition.

Local attorneys Charles Lynch and Heather Cockley took Mary Watson’s case pro bono to help her get emergency custody.

“Richland County Juvenile Court has assumed jurisdiction of the case. They’ll be determining what’s in the best interest of the child.”

“She’s just anxious to see Haylee,” Cockley said.

Arrest in Haylee case highlights big month for task force

The arrest of Robbi Potter was the highlight of a banner month for the Richland County division of the Northern Ohio Violent Fugitive Task Force.
As part of a national fugitive sweep by U.S. Marshals in June, the Richland County division arrested 83 fugitives, including Potter, and cleared 108 arrest warrants last month. Locals also seized three illegal firearms and narcotics.
“We had a really good month,” Richland County sheriff’s Capt. Eric Bosko said.
Other local highlights included the June 18 arrest of attempted murder suspect Bryan Mobley and an operation that targeted 41 drug traffickers in Wayne County.
Since its inception in 2005, Operation Falcon has made more than 91,000 arrests nationally and cleared nearly 118,000 warrants. U.S. Marshal Pete Elliott credited the local task force and others in northern Ohio.
“The cooperation and enthusiasm of law enforcement agencies in the Northern District of Ohio has always been incredible,” Elliott said. “We are facing new challenges in law enforcement and must always adapt to overcome sometimes overwhelming odds when faced with the criminal element that places our communities in danger.”

And what is in Haylee Donathan's best interest may be not living with her grandma. Mary Watson's son, Cyle, is in prison, sentenced to eight years for parole violation. He had served time before for the rape of a 12-year-old girl, which is where he met Robbi Potter. Cyle Watson also has charges pending for helping Robbi Potter escape.
Mary Watson's daughter, Candace, is facing heavy jail time as well.
Although there may be more to the decision made by Richland County Children Services, most would understand if there was not. Having two children in the Ohio penal system might not disqualify a person for custody, but it most likely weighs heavily against it.
Somewhere within that family lies a dark connection. Mary Watson has a son who raped a child. She has a daughter who fled the state with a fugitive who was a known sex offender against children. The connection may not be through Mary Watson, but that is a chance the Richland County Children Services do not seem to be willing to take.
It is unknown exactly when Haylee Donathan will return to Ohio. It is known, however, where she is not going to be staying when she gets there.

Perhaps the most important fact to know about "Adam Walsh Child Protection and Safety Act of 2006" (HR 4472) is that, the full U.S. House has never seen portions of this bill, nor have they voted on portions of it, before the rules were suspended. Congressional procedure was thwarted. How could this happen, well here is how. Be ready to see how ONE Congressman -using tricks in the rules- controlled the entire U.S. House to pass this very bad law! Then again, when the bill came back from the Senate This Congressman followed the same procedures to deny the full house access to the morphed bill.
The second important fact is what happened in the Senate -behind closed doors- where HR-4472 was again morphed into a new creature. Like in the House, Senators were also denied access to the -behind closed doors sessions- on a new creature which was ultimately dedicated to a murdered child victim, Adam Walsh, by someone who is not known, and not known to be a sex offender.
The following outlines the birth, or morphism, of the bill HR-4472 into enactment! A law created by a handful of Congressmen, not representative of the nation, and using a congressional rule known as "suspension of the rules" and to obtain the signatures and votes of the remainder of lawmakers without their knowledge.
Could the remainder of the lawmakers stop this runaway train, yes, but likely it would have been at the expense of their career. They would have been accused of coddling former sex offenders, certainly political suicide. The story:
Historical Background:
In May of 2005 Sen. Hatch introduced "Sex Offender Registration and Notification Act" (S-1086) and was working on this bill. Then the Senate passed the bill in May of 2006 and sent it to the US House.
A stalemate ensued, neither side liking what the other presented. Rep. Sensenbrenner knew that the Senate did not like his bill, there must have been some back-door discussions which let him know that. Clearly lawmakers were being pressured to come up with something although at that time no one knew where the pressure was coming from

Then in December of 2005 Rep. Sensenbrenner, wanting a do-over, introduced the "Children's Safety and Violent Crime Reduction Act of 2005" (HR-4472 Version-1). Remember, when the bill was introduced it was referred to the House Judiciary Committee, guess who was Chairman, Rep. Sensenbrenner. Key point to remember.
Construction of HR 4472 Version-1 (CLICK > Text of Legislation > Version #1): The bill began with the guts of the former HR-3132 (which died in the Senate), with many provisions made harsher. Additionally, there were many sections dealing with gangs not a subject of this Op-Ed. This made up HR 4472 as introduced (Version-1) and it was referred to the Judiciary Committee.
NOTE: While in the Judiciary Committee, another group of bills get morphed into HR-4472, for discussion sake I'll refer to them as "The Morphed Bills." Watch carefully the dates bills are introduced in the House and when the House ultimately votes on HR-4472 (packaged w/morphed bills) on March 8, 2006.
The March 8th Transcript (color coded to point out certain things) along with the above, will help folks verify and understand what took place and who did object and on what basis. The result was HR 4472 passed -under suspension of the rules- and sent to the Senate. Remember, this was March 8, 2006!

The Center for Disease Control (CDC) developed the Youth Risk Behavior Surveillance System (YRBSS) to monitor six categories of priority health-risk behaviors among youth. Of the six categories two are relevant to our chart, sexual behaviors and alcohol (and other drug) use. The six risk behaviors contribute markedly to the leading causes of death, disability, and social problems among youth and adults in the United States. YRBSS includes a national school-based survey conducted by CDC as well as state, territorial, and local school-based surveys conducted by education and health agencies. In these surveys, conducted biennially since 1991, representative samples of students in grades 9-12 are drawn. In 2003, a total of 15,214 students completed the national survey and 32 states and 20 school districts also obtained data representative of their jurisdiction.

SEN. ORRIN HATCH (R), UTAH: Well, the bill really puts the screws to those who are sexual predators, and you know, sexual offenders. You know, we have around 500,000 of them in this country that we know of, and about 150,000 of them we don`t know even where they are, even though they`re supposed to report in. This bill stop that. This bill will require them to report in regularly. If they don`t, they`re going back to jail. If they break the rules after that, they`ll have to wear a leg brace or leg monitor that we can talk to them any time we want. If they try to take that off, they`re going to get hit really hard.
So the bill also makes inroads with regard to using the Internet and using, you know, the on-line approach to try and lure young girls away.
GRACE: Senator Hatch, do you expect a lot of political wrangling? Elizabeth is there with her father, trying to make a difference on Capitol Hill. Do you believe a lot of addendums will be added and this will actually meet opposition?
HATCH: No, I don`t. As a matter of fact, I signed off on the bill this evening. We`ve got the bill worked out between the House and the Senate. I really don`t believe that anybody is going to fight it. It should come up tomorrow. And I believe we`ll get it through.
And I think we all owe, you know, Ed Smart and his beautiful daughter, Elizabeth, a great deal of thanks and a lot of others, as well, but they have particularly worked very hard. And so has John Walsh. We want to get this bill through this week so that the president can sign it on the 27th of April [sic July], which was -- would be the 25th anniversary of Adam Walsh`s death. And it`s named the Adam Walsh Bill.

83 Fugitives Arrested In National Fugitive Sweep

The Richland County Division of the Northern Ohio Violent Fugitive Task Force participated during the month of June in "Operation Falcon," a national fugitive sweep.
The local division arrested 83 fugitives and cleared 108 arrest warrants. The task force also seized three illegal firearms, including two sawed-off shotguns, and illegal narcotics.
The highlighted case for the Richland County division was the Robbi Potter escape investigation that drew national attention. Potter, a convicted sex offender and bank robber, escaped from the Volunteers of America sex offender treatment facility in Mansfield.
He later was arrested with his girlfriend, Candace Watson, in San Diego County, California, along with Watson's four-year-old daughter Haylee Donathan.

I really do think that he manipulated her,” Mary Watson said, adding she has spoken to her daughter only once since her arrest.

Spon said when there are allegations regarding the care or lack of that rises to the level where a child is dependent, neglected or abused as defined by law and proven by clear evidence the court has the right and duty to make the finding of dependency. He said the court then as the authority to provide protection to serve the best interests of the child.
Spon said child protective services in San Diego, California, did an investigation regarding Haylee's circumstances and extended family which raised issues that appear to be of legitimate concern. He said the claims were submitted to Richland County Children Services which agreed with the recommendation to place Haylee in foster care.
Spon said all parties will have the opportunity to respond to the claims. Attorneys representing Candace Watson and Haylee's biological father James Donathan entered denials to the complaints.
A pre-trial hearing will be held in two weeks followed by a trial date to be set in three weeks.
Richland County Children Services will be working with Mary Watson to arrange temporary visitations with Haylee. Watson has not spoken with Haylee since June 30 at the request of children services.
Watson is scheduled to return to Ohio on July 28 and Potter is scheduled to return on Aug. 3.

Haylee Donathan, the missing 4-year-old who was discovered at a San Diego, Calif. Christian ranch on June 23, has returned to Ohio.
On Thursday, attorneys attended a hearing before Juvenile Court Judge Ron Spon, who will ultimately determine if Haylee was neglected or abused as alleged by Children Services.
Children Services filed a complaint against Haylee’s mother, father, and grandmother, but attorneys for each party deny claims of abuse and neglect.
Officials at Children Services also requested there be no contact between Haylee and her grandmother who had been speaking with her by phone three to four times a day. Mary Watson’s attorney, Heather Cockley said, “We haven’t had any visitation. The child is upset because she thinks that her grandmother has stopped calling her.”
Mary Watson was granted visitation, but only if it is supervised.
Two of Mary Watson’s children have been in trouble with the law. Candace Watson faces possible prison time for assisting Potter’s escape from a halfway house and for harboring a fugitive. Her brother Cyle Watson is serving eight years in prison for a probation violation and has a prior conviction for the rape of a 12-year-old girl.

Attorneys for all sides attended a hearing Thursday before Juvenile Court Judge Ron Spon, who must determine if Haylee is dependent, neglected or abused, as Children Services alleges.
This month, Spon awarded custody of Haylee to Children Services. Mary Watson, Haylee’s grandmother, had been granted temporary emergency custody in domestic relations court. Juvenile court supersedes domestic relations court, Spon said.
“This is a very important case,” Spon said. “This little girl has gone through an awful lot. This court is going to make sure her best interests are provided for.”
Children Services filed a complaint against Haylee’s mother, father and grandmother. Attorneys for Candace Watson, James Donathan and Mary Watson denied the claims.
“She (Mary Watson) is ready, willing and able to have this child in her home,” attorney Heather Cockley said.
When Children Services took custody of Haylee, officials requested there be no contact between Haylee and her grandmother. They had been talking three or four times a day by phone.
“We haven’t had any visitation,” Cockley said. “The child is upset because she thinks that her grandmother has stopped calling her.”
Spon granted Mary Watson visitation but said it had to be supervised.
“The concerns of the (San Diego) agency have basis in fact,” the judge said.
Spon said he would schedule a pretrial conference in two weeks and a trial three weeks after that. If Children Services prevails, Spon will decide whether or not Haylee remains in foster care.
“Parents have a right to raise their own children apart from government interference,” Spon said after the hearing, “but it’s not an unqualified right.”

Indictments were released Thursday for five people in connection with an incident that led to a month-long, nationwide manhunt and national headlines.

Potter and Watson were arrested June 23 at a Christian retreat center near San Diego. Watson's 4-year-old daughter, Haylee Donathan, was with the couple.
Potter and Watson also face federal charges. Extradited Tuesday, they made initial appearances in federal court Thursday in Youngstown. They are scheduled for preliminary hearings Aug. 13.
Watson's federal charge is harboring a fugitive. She waived a reading of her complaint on Thursday and would have been released on an unsecured bond if not for her local charge.
Also indicted for complicity to escape were Cyle Watson, 21, Lorain Correctional Institution; James S. Donathan, 24, last known address, 290 N. Main St.; and Nicole A. Kirkpatrick, 20, last known address, 728 Mansfield-Washington Road.
Kvochick detailed the trio's alleged involvement.
"Cyle Watson is accused of providing transportation to get away from the VOA," he said. "(James) Donathan procured a telephone for Robbi Potter and acted as a lookout for the vehicle that was to help him escape. It is alleged that Robbi used Nicole Kirkpatrick's phone while he was on the run."
Cyle Watson is Haylee's uncle. He was sentenced last month to eight years in prison for violating his probation by having marijuana brought into the halfway house.
James Donathan is Haylee's father.

Five people have been indicted by the Richland County Grand Jury for their involvement with an escape indictment that led to a nationwide manhunt.
Robbi Potter, 27, is charged with third-degree felony charges of escape and failure to register for a change of address. Potter is accused of escaping from the Volunteers of America's half-way house on May 28.

Potter hit with another charge in US Court

Robbi Potter was hit with his most serious charge yet on Thursday.
The accused fugitive and convicted sex offender appeared in U.S. District Court, the Northern District of Ohio, for a scheduled revocation of supervised release hearing.
Instead, Potter, 27, learned he was indicted through the Adam Walsh Act, which U.S. Marshals had recommended. Deputy U.S. Marshal Brian Fitzgibbon explained the charge.
“The Adam Walsh Act is a federal statute passed about two years ago,” Fitzgibbon said. “The federal government intervenes when a sex offender crosses state lines, and he fails to notify either state of his registration. It kind of makes it universal.”
Fitzgibbon said Potter, whose last known address was 290 N. Main St., Mansfield, could receive up to 10 years in prison if convicted.
Because of the new charge, assistant federal public defender Carlos Warner asked for a continuance of the original hearing. Magistrate George Limbert granted the request, rescheduling the hearing for 11 a.m. Sept. 18.
Limbert will decide then if there’s probable cause to hold Potter for a probation violation. If so, the next step would be a revocation hearing. Potter could receive up to two years in prison for a probation violation, Assistant U.S. Attorney David Toepfer said. Potter is on federal probation for a July 2002 bank robbery in Bristol, Tenn.
Potter also faces charges of escape and failure to notify of change of address, both third-degree felonies punishable by up to five years in prison, at the state level.
Sporting a full beard and tattoos on both arms, Potter entered the courtroom in an orange jail jumpsuit, shackled at the hands and feet. He and Warner conferred for several minutes before the public defender asked for a continuance.
As for Watson, she is charged federally with harboring a federal fugitive and at the state level for complicity to commit escape. She posted federal bond but was being held at the Richland County Jail on a $50,000 cash bond for the state charge.
Fitzgibbon said Potter’s case ultimately could go through the local court system instead of the federal level.
“Either way, he’s looking at significant time,” the deputy U.S. marshal said.

Potter was in the company of Haylee Donathan, 4, and her mother Candace Watson, 25, when he fled from a Mansfield halfway house and was later captured near San Diego, California.
If convicted, Potter faces up to 10 years in prison and also faces an additional two years behind bars for a probation violation for a 2002 bank robbery in Tennessee. Potter also faces third-degree felony counts of escape and failure to notify of a change of address, with both charges carrying five-year prison terms.
Another hearing for Potter is set for 11 a.m., September 18 in federal court.

Haylee has been in foster care since late July, when she returned to Ohio from San Diego. She, her mother and her mother’s sex offender boyfriend were the subjects of a month-long manhunt that drew national headlines.
Richland County Juvenile Court Judge Ron Spon, who granted custody to Children Services, has set a trial for Sept. 10. The judge must decide if Haylee is dependent, neglected or abused, as Children Services alleges. If the county agency prevails, Spon will decide whether or not Haylee remains in foster care.
Watson, Haylee’s mother Candace Watson and at least one other relative have submitted claims seeking custody.
METRICH handled the investigation of Mary Watson. Commander Lt. Dino Sgambellone declined to say what type of drug the grandmother was allegedly selling and deferred further comment to Sheriff Steve Sheldon.
“We knew that there were issues,” Sheldon said. “They (METRICH officials) thought it was something that should be brought out before (the custody trial), just to give the court the advantage of full knowledge of it.”
Sheldon said he felt for Haylee’s grandmother — to a degree.
“It’s an unfortunate thing for Mary Watson, but obviously we still want what’s best for Haylee,” the sheriff said.

Another grandma seeks custody of Haylee

Connie Donathan, Haylee's paternal grandmother, filed a petition Thursday in Richland County Juvenile Court seeking custody of the 4-year-old, the subject of a monthlong nationwide manhunt this summer when her mother ran away with a convicted sex offender.
"I'm very concerned," Donathan said. "I want Haylee to know that she has a very loving family on the Donathan side."
Juvenile Court Judge Ron Spon was to rule on the matter Thursday, but at a late morning hearing Haylee's mother and father admitted to allegations of dependency.
"Your rights as parents will be affected, and the court could divest you of some or all of your parental rights, at least in the short term, maybe a couple of years," Spon told Candace Watson and James Donathan.
The judge noted an allegation of dependency was not as serious as one of neglect or abuse.
A tearful Watson, who has no listed address but previously lived in Crestline, dabbed her eyes with a tissue as the judge spoke.
She and James Donathan appeared in county jail jumpsuits, shackled at the hands and feet. They were arrested in connection with Robbi Potter's escape from the local Volunteers of America halfway house.
In mid-June, Connie Donathan moved to Madison Township from Florida to be available for Haylee. She contacted Children Services to let the agency know she was interested in taking custody of the girl. Donathan said a home study by Children Services turned up nothing more than her need to get a booster seat and get more hours at work.
"The thought of her going with strangers ... she's a part of us," Connie Donathan said.
Haylee's maternal grandmother Mary Watson was arrested on a drug trafficking charge last month, but she continues to press for custody. Also expressing interest in raising the girl is a Virginia couple related to Haylee on her mother's side. They have not yet filed for custody.
If the judge rules in her favor at that point, Mary Watson could contest Children Services' claim that her home would not be suitable for Haylee, which would lead to a trial. She also could admit to the claim, as Haylee's parents did.
If Spon rules Mary Watson out, the case will move to a disposition, where the judge would decide who gets custody of Haylee.
Spon scheduled the disposition for Sept. 30 and blocked off three days for it, saying he wants to resolve the situation and stop uprooting Haylee.

"I just wish that they would get this over with," Mary Watson said. "(Haylee's parents are) going to get married eventually."
Haylee's custody also is an issue. Several family members have filed petitions to raise the girl. Juvenile Court Judge Ron Spon is expected to make a ruling in the coming weeks.

James Donathan, 24, whose last known address was 290 N. Main St., was sentenced Tuesday to three years in prison for complicity to escape. Richland County Common Pleas Judge James DeWeese told Donathan he could apply for early release if he stayed out of trouble.

Richland County Juvenile Court Judge Ron Spon issued several rulings Thursday, clearing the way for a hearing starting Wednesday that will determine who gets custody of Haylee.
In Thursday’s hearing, Spon ruled the 4-year-old’s grandmother, Mary Watson, will not have a say in whether Haylee is dependent. Normally, a grandparent would not have standing to participate in dependency hearings, but Watson contested the issue.
Spon also ruled that while Mary Watson still can seek custody of the girl, she will have to pay for her own attorney.
“You’re still going to be in the case to assert your desire to be legal custodian,” Spon said.
Spon blocked off three days for the custody hearing. He also terminated the appointments of attorneys Heather Cockley and Lore Whitney, who had been representing Mary Watson and paternal grandmother Connie Donathan, respectively.
“It’s not in the public’s best economic interest,” Spon said. “The law doesn’t require that I give all of you attorneys at public expense.”
Two couples also are interested in custody. Steve and Susan Janoski live in Virginia. Susan is Mary Watson’s stepsister. Ken and Loretta Means, who live in Mansfield, are Mary Watson’s cousins.
“This complicated case is further complicated because other people have stepped forward,” Spon said.
Mary Watson said the situation is out of her control.

Before the scheduled start of the 4-year-old's custody trial Wednesday, attorney Edith Gilliland filed a motion to close the courtroom to the media.
"Allowing continued access of this matter would subject this child, of tender years, to further unnecessary public scrutiny and is not in the best interest of the child," she wrote in her motion.
Juvenile Court Judge Ron Spon scheduled a hearing on the issue for Friday at 9 a.m. News Journal Editor Tom Brennan said the newspaper's attorney will argue to keep the courtroom open.
Spon said the First Amendment offers the media a "powerful and protected right."
"It goes to the very essence of our democracy, which is the right of the public to have access to information," he said.
Gilliland also filed a motion for a continuance in the custody hearing, which Spon granted. He did not schedule another trial date.
After the hearing, Gilliland would not give a reason for the motion, but court administrator Mike Casto said the local agency wants to hold off until Haylee's mother is sentenced Oct. 12.
"This little child is in shelter care," Spon said. "She is bonding with the foster parents, who are providing appropriate care."
The foster family is an option to become permanent custodians. Haylee's parents, maternal grandmother Mary Watson and paternal grandmother Connie Donathan also are seeking custody of the girl. Others interested in custody are Ken and Loretta Means, who live in Mansfield and are Mary Watson's cousins, and Steve and Susan Janoski, of Virginia. Steve Janoski said his wife is Mary Watson's stepsister, a claim Mary Watson disputes.
"The catch-22 is that if this child doesn't have any contact with potential legal custodians, we can exacerbate a problem with regard to negative emotional impact ... if the child is removed from foster care and placed with a custodian she might not even know," Spon said.
Gilliland also is expected Friday to tell Spon why some of Haylee's relatives have been excluded from having contact with the girl.
"It is helpful to this court in making the appropriate decision, but also because state statutes require that the agency first consider the relatives for placement prior to placing the child in foster care," Spon said.

In denying a motion to close his courtroom, Richland County Juvenile Court Judge Ron Spon said Friday it's vital the public know how the legal process works.
Children Services asked the judge to exclude media from hearings involving the custody of Haylee Donathan, a move opposed by the News Journal.
After attorneys for the newspaper and the agency failed to reach a compromise in two hours of conferences, Spon listened to oral arguments in open session and then ruled the hearings will remain open.
"To close these proceedings would tend to detract from confidence that the public might have in the judicial branch of government," the judge said. "It is very important in a free society for citizens to know what we do."
Candace Watson, 25, who has no known address but previously lived in Crestline, will be sentenced Oct. 12 for complicity to escape. She could receive up to five years in prison.
Representing the News Journal, attorney William Kolis cited the Ohio Supreme Court, which ruled a custody case can be closed only if public access could harm the child or endanger the fairness of the proceeding or if the potential for harm outweighs the benefits of public access.
Gilliland did not provide any evidence to support her claims at Friday's hearing.
"Statements that have been made are simply emotional arguments," Kolis said. "No evidence has been submitted to show that any harm would happen."
Spon agreed.
"We have a major problem. No evidence has been presented," Spon said. "The court cannot base its decision by making a judgment when no evidence has been presented. If the court were to make such a ruling, it would be overturned as an abuse of discretion."
Gilliland declined comment afterward. It's not known if the agency will appeal the judge's decision.
Spon will decide who gets custody of Haylee after her trial, which he scheduled for Nov. 16. He said people who might find themselves in similar situations need to know how the court handles such a case.

Nicole Kirkpatrick, of 888 Lehigh Ave., pleaded no contest Monday to complicity to escape. She allowed Robbi Potter to use her cell phone to call Candace Watson for a ride after he walked away from the local Volunteers of America halfway house in late May.
A judge is expected to decide Haylee's custody at a trial later this month. She has been in foster care since returning to Ohio in July.

Wow! I somehow lost track of this story after the Haylee was found safe with her mom and RP. (I hadn't discovered WS yet at that time!) I can't believe these sentences are so light! WTH? And the grandmother was indicted for drug trafficking? Yikes... Good thing they kept Haylee in foster care. What a shame! I hope things look up for her from here on out!
P.S. I just added this same post-script to another post in this forum to say sorry to barge in out of (seemingly) nowehere! Believe it or not, I actually do know which forum I'm in, which is hard to tell since this post wasn't specifically astro-related. I know people do stumble in here accidentally from time to time. At any rate, I've been avidly reading updates here on several of the current cases for several weeks now, and find what you do here pretty amazing.

Potter was the focus of a nationwide manhunt this year when he walked away from a halfway house in Mansfield and went on the run with his girlfriend, Candace Watson, formerly of Crestline, and her 4-year-old daughter, Haylee Donathan.
Potter was convicted in 2005 in Crawford County on two counts of sexual battery, both third-degree felonies, and one count of interference with custody, a fifth-degree felony.
Potter was on parole when he fled the halfway house. Potter is a registered sex offender, and left the jurisdiction with a minor child and without reporting a change of address to his parole officer.

Richland County Juvenile Court Judge Ron Spon is expected to decide custody after a five-day hearing scheduled to start Jan. 4.
"There is no doubt that 2009 was a traumatic year in the young life of Haylee Donathan," said Carl Hunnell, spokesman for Children Services, the child protective agency that has temporary custody of her. "We remain hopeful that 2010 will be much more positive as we seek to find Haylee a permanent home with a loving family in a stable environment.
"At that point, we are hopeful her name and face can fade from the front page, and she can begin a more normal life for a child."
Maternal grandmother Mary Watson, who was indicted on three charges of drug trafficking and faces a Feb. 4 trial, and paternal grandmother Connie Donathan also want to raise Haylee.
As for Potter, he received a three-year sentence last month after pleading guilty to escape and failure to provide change of address. Federal agents who were upset with the sentence -- Potter could have gotten 10 years -- said they might pursue charges at their level.

Stop-gap measures toothless at halfway house, say officials

Convicted sex offender Robbi Potter’s escape from the local Volunteers of America in May ratcheted up the fear many area residents already have about the halfway house.
After serving a prison term for two counts of sexual battery involving 7- and 9-year-old victims, Potter broke a window and fled from the VOA on May 28. With the help of a small network of conspirators, he was on the run for nearly a month before his arrest at a Christian retreat center near San Diego.
Also, while escapes among the 24 halfway houses supported by the Ohio Department of Rehabilitation and Correction average 12 percent statewide, the rate at the local VOA is 3 percent.
Those escape numbers, however, don’t account for men assigned to the facility who never show up or are kicked out. Ideally, the latter offenders are picked up, go to court and are sent back to prison.
But that’s not always how it turns out.
“It’s a necessary evil,” said Richland County Assistant Prosecutor Bambi Couch-Page, who handles most of the office’s sex cases. “Without it, there is no treatment for them. Without the treatment, we don’t have a chance of rehabilitating a sex offender.”

Richland County Children Services, which has temporary custody of the 5-year-old and has filed for permanent custody, is presenting its case first. Social worker Amanda Campbell, assigned to the case, was the first witness. She will be back on the stand when court resumes this afternoon.
Prior to Campbell taking the stand, several parties gave their opening statements.
Children Services attorney Edith Gilliland told Judge Ron Spon the agency is the best choice for custody of Haylee.
“This young child is in desperate need of stability,” she said.
Jodie Dees, Watson’s attorney, said her client is eligible for early release in April.
“Children Services is kind of jumping the gun in this matter,” he said. “They’re simply stating that reunification is not possible.”
Other parties in the case waived their opening statements.

Richland County Children Services Communications Supervisor Carl Hunnell said the agency is not only seeking permanent custody but it's also asking the court to waive all reasonable efforts to reunite the family. Hunnell said the agency believes, based on the parents incarceration and past history with the child, her long-term future with them is not good.

Amanda Campbell, the social worker assigned to the case, was Gilliland's main witness. In August, she met with Haylee's parents, Candace Watson and James Donathan, at the county jail. They were incarcerated for their roles in the escape of convicted sex offender Robbi Potter from the local Volunteers of America in late May.
Campbell said Watson, formerly of Crestline, told her she had used crystal meth and was hospitalized several times. Watson reportedly said she stopped cold turkey and hadn't used meth for two years.
Campbell said Watson told her she had been friends with Potter for some time.
"She said she was a little stressed out, and she never meant to go that far (away)," Campbell said of the couple's June 23 arrest at a Christian retreat center outside San Diego.
Gilliland also asked Campbell about one of Haylee's supervised visits with her maternal grandmother.
"She talked to Mary, but there wasn't much interaction," Campbell said. "Haylee didn't appear to be very comfortable. Toward the end of the visit, Mary got emotional. That upset Haylee."
Crystal Fikentscher, Hay-lee's preschool teacher, was the other witness. She said Haylee refers to her foster parents as her mother and father. Haylee has been with the family since July.

Counselor: Abrupt change could slow Haylee's progress

Carla Kirtland-Schweyer of Family Life Counseling & Psychiatric Services was the only witness this morning on the second day of a custody hearing before Richland County Juvenile Court Judge Ron Spon.
Kirtland-Schweyer has had weekly counseling sessions with Haylee since August. She said she initially worried about Haylee.
“I was concerned about her ability to quickly call her foster parents Mom and Dad,” Kirtland-Schweyer said. “There was no struggle with accepting them — she just latched onto them.”
Kirtland-Schweyer said a child who had a strong relationship with biological parents would mourn their loss.
The counselor also said the lack of bowel and bladder control Haylee initially showed with the foster family could indicate insecurity associated with previous trauma.

Kirtland-Schweyer said Haylee initially suffered from Reactive Attachment Disorder, which causes several behavioral problems such as a fear of of being alone.
She said Haylee has overcome the disorder, but could regress if she's removed from the care of her foster parents. Kirtland-Schweyer said Haylee has developed a strong relationship with her foster parents and is making significant progress.

Counselor says child happy in foster care

Five-year-old Haylee Donathan knows where she doesn't want to live.
"She said she did not want to go back to Mommy Candace's family," counselor Carla Kirtland-Schweyer said Tuesday on the second day of Haylee's custody hearings before Richland County Juvenile Court Judge Ron Spon.
Kirtland-Schweyer said Haylee has bonded with her foster family. During a Dec. 28 counseling session, Haylee's foster mother revealed a disturbing nightmare the child had.
"She dreamt her foster mother got shot," Kirtland-Schweyer said. "It identifies the intensity of the fear that Haylee expresses about losing her foster mom. In her mind, there's some connection to all of that (cross-country trip)."
Jodie Dees, Watson's attorney, asked how it came about that Haylee said she didn't want to return to her family.
"She just blurted that out after discussing the dream," Kirtland-Schweyer said.
Spon questioned Kirtland-Schweyer about a San Diego doctor's report that said Haylee's body had 13 marks on it.
"My daddy whipped me with a belt," the doctor quoted Haylee as saying, presumably about Potter. "He did it lots of times."
Haylee apparently has referenced more than one mom and dad during her talks with counselors and doctors.
Connie Donathan then asked if Haylee spoke of her family in a positive or negative tone.
"It was a negative tone," Kirtland-Schweyer said.
"With Mary Watson, I had concerns with a depressive diagnosis, as well as allegations of drug and alcohol abuse," Burggraf said. "About Connie, the issues centered around the fact her son is incarcerated.
"She made it very clear that should he be released and he had nowhere to go, she would take him in. If that was a problem for Haylee, she would have to side with her son."

At least one of Haylee Donathan’s foster parents is expected to testify this afternoon in the continuing custody hearing before Richland County Juvenile Court Judge Ron Spon.
Children Services has temporary custody of Haylee and has applied for permanent custody. Heather Higgins, an intake investigator for the agency, was the lone witness this morning. She did home studies on both grandmothers, Mary Watson and Connie Donathan, as well as Ken and Loretta Means, Haylee’s cousins. All parties are seeking custody. Higgins did not make a recommendation.
If Children Services finishes its case this afternoon, Jodie Dees, attorney for Candace Watson, will start hers. She previously said she would have Candace testify.

Foster parents willing to keep Haylee

Phil Naumoff, attorney for Haylee's father, James Donathan, asked the foster mother if she has become attached to Haylee.
"Haylee is a wonderful child. I am attached -- she's in my care," she said. "(But) if she was removed from my care, I would want only the best for her."
To hear the foster father tell it, Haylee was much different on July 22.
"She was shy, reserved, somewhat frightened and very unsure of her surroundings," he said. "She was very clingy. She didn't want to be left alone, didn't want to sleep alone."
The foster parents have taken Haylee to three supervised visits with maternal grandmother Mary Watson while she has been in their care. The foster mother said Haylee was reluctant to go and had to be coaxed from a room for the last visit.
"It's very sad," she said.
As the woman testified, Candace Watson dabbed her eyes with a tissue.
The foster parents, who work in telecommunications and have a combined income of at least $130,000, also are raising a 16-year-old foster daughter. They have had five foster children since getting their license in February.
Jodie Dees, representing Candace Watson, asked the foster mother if Haylee had received the letters her mom sent. Candace and Mary Watson both wept during the questioning.
"I'm not aware of anything that's been provided," the foster mother said. "I have everything that's been provided by the agency."

Cousin makes case for raising Haylee

Means testified Thursday on the fourth day of the 5-year-old's custody hearing in Richland County Juvenile Court. Her husband Ken is Haylee's third cousin on the maternal side.
A nursing assistant at an Ashland nursing home, Means said a Children Services employee told her she and Ken would get Haylee if they had a clean criminal background and no previous dealings with the agency. A tearful Means said she later discovered Haylee was in foster care from reading the News Journal. Haylee has been with a foster family since July 22, when she was returned from San Diego.
Means and her husband met later with a Children Services supervisor, who told them they were turned down for temporary placement because they had little to no prior relationship with Haylee. Loretta has never met Haylee. Ken later testified he has seen her twice, spending about two hours with her.
When court adjourned, Children Services spokesman Carl Hunnell elaborated.
"The Means were conditionally approved in an agency home study, but such an approval does not mean the child's placement is certain," Hunnell said. "We felt it was in the best interests of the child to be placed in this therapeutic foster home. We stand behind that decision today."

Testimony ends; Haylee decision expected Monday

Richland County Juvenile Court Judge Ron Spon listened to five attorneys and two grandmothers and said he would announce his decision Monday.
Spon will be ruling on two issues. He must decide whether to terminate parental rights — as Children Services has requested — and who gets custody of Haylee.
Prior to the parties making their appeals before Spon, Haylee’s appointed court advocate made his recommendation. Dupree Taylor said he thinks Haylee should remain in the custody of Children Services for the time being but ultimately should go to Ken and Loretta Means, Haylee’s third cousins on the maternal side.
Taylor said he based his recommendation on the Means’ relationship.
“They’re very warm and loving. To me, their bond is extraordinary,” he said. “I got the feeling they would provide love and affection to any child.”
Under questioning from attorney Phil Naumoff, representing Haylee’s father, Taylor said the foster parents asked him about his recommendation. The advocate said he told them it was subject to change. Taylor said the foster mother became angry and the parents didn’t cooperate with him afterward.

Decision In Haylee Donathan Case Could Come Monday

Richland County Children Services placement program supervisor Lori Feeney and Court Appointed Special Advocate Depree Taylor testified about the placement of Haylee with her foster family over the Means.
Feeney said the goal was to place Haylee in a trained and certified foster home. She said the Means were not trained and had no prior relationship with Haylee.
The Means testified Thursday they had very little contact with Haylee but, were told by an intake investigator that Haylee would placed in their home. The Means also said they would be willing to take whatever training was required to get Haylee during their home visit with the intake investigator.
Feeney said if the Means would have had a relationship with Haylee she would have looked at their case differently. Taylor said he recommended that Haylee remain in the temporary custody of Richland County Children Services and later be placed with Ken and Loretta Means.
Spon is expected to announce his decision on Monday.

Children Services attorney Edith Gilliland said Haylee has been through enough.
"It's time to provide a sense of stability, a sense of safety and a sense of well-being so that she can move forward," Gilliland said. "We can only come to one conclusion: The child deserves this finality."
The foster parents, who are not a party in the case, have said they would like to raise Haylee. Children Services would make that determination if awarded permanent custody.
Ken and Loretta Means, Haylee's third cousins on the maternal side, also are seeking custody. Some of the attorneys representing other family members said if their clients didn't get Haylee, they hoped she would go to the Means family.
Phil Naumoff, who represents Haylee's father James, was one of them.
"Parental rights should not be severed," Naumoff said. "We would ask that legal custody be given to the Means. Let's show this young girl that she can be loved within that bloodline.
"She deserves that."
After the hearing, Children Services spokesman Carl Hunnell said the claim the agency wants to avoid suitable family members and place children in foster care is incorrect.
"Despite testimony introduced in court, our policy is to always look for a suitable relative first when it comes to placement of a child," he said.
As of Friday afternoon, Hunnell said, 79 percent of the 211 children the agency has placed are with relatives.
"We have just 43 children in foster care homes at this time, and we have 168 living with a grandparent, aunt, uncle, etc. Compare that 43 number to 1999 when we had 288 children in foster care homes," Hunnell said. "When we don't place a child with a family member, there are valid reasons. Foster homes are the exception, not the rule."

Mary Watson said if her son’s case weren’t so high profile, Cyle Watson would not have been sentenced so severely on Monday.
Haylee Donathan’s maternal uncle was handed three years of community control upon his release from prison. Now incarcerated at Ross Correctional Institution, Watson was sentenced last summer to eight years for a probation violation unrelated to the Haylee case.
Richland County Common Pleas Judge James DeWeese told Watson, 22, that if he violates his new probation terms, he could receive up to five more years in prison and a $1,000 fine.
Upon release, Cyle must get and keep a full-time job, beginning at the Volunteers of America in Mansfield. He will also be subject to a substance abuse evaluation, may not live with any girlfriends and must have no contact with anyone involved in the Haylee incident.
Cyle Watson, charged with complicity to escape, was solemn as he listened to his fate Monday.
When asked if he wanted to make a statement, he looked down at his feet and replied, “No, sir.”
Mary fears her own fate.
“I’m high profile, too, so they’re probably going to slam it to me, too,” she said.
“Praying isn’t helping. I know God’s out there, but our prayers aren’t working.”

Following testimony last week from the parties seeking custody, social workers and psychologists, Spon said his ruling was based on the best interest of Haylee.
Children services communication supervisor Carl Hunnell said this decision by Judge Spon is a victory for the future of Haylee. He said the nightmare for Haylee is finally over and now she will be able to stay in the same and stable home of her foster family. Hunnell said the agency will now move ahead with the process of determining a permanent and adopted home for Haylee.
Hunnell said its time for Haylee's name and face to fade away from the media. He said its time for her to be a little girl and this decision makes it possible.

Judge's decision was the correct one

Taking a child away from parents and other kin is a decision that should never be taken lightly, and there is no reason to suspect Richland County Juvenile Court Judge Ron Spon took it lightly in the case of Haylee Donathan.
Haylee has been in the custody of Richland County Children Services for several months and, after Spon's decision Monday, will remain so.
Spon clearly explained his reasoning to those in his courtroom. One by one he listed the family members who wanted custody of Haylee, then he explained why giving them custody would be unwise.
After he checked off each name, Children Services became the only remaining option.
Haylee's best chance of having a loving home rests, sadly, outside her own family. She will stay with foster parents and may eventually be adopted.
Yet when circumstances force government officials like Judge Spon to make a decision, that decision will sometimes take children away from blood relatives for their own good, as happened in the Haylee Donathan case.
It's a sad situation, but in this case, one that gives one little girl her best chance at happiness.

Grandmother pleads guilty to drug charges

Haylee Donathan's grandmother pleaded guilty Monday to three counts of drug trafficking.
Mary Watson, 47, could receive up to 3 - 1¼ & 2 years in prison at her March 15 sentencing. She sold morphine, hydrocodone and alprazolam in three separate incidents. The METRICH Enforcement Unit handled the investigation and arrested Watson on Sept. 1.
Prosecutors amended the original charge regarding the sale of morphine, ruling Watson did not sell the drug within the vicinity of a school. They reduced the charge from a third-degree felony, punishable by up to five years in prison, to a fourth-degree felony, which carries a maximum penalty of 18 months.
"I'm just glad it got bumped down to a (felony) four," Watson said. "I was worried about it." Defense attorney Lore Whitney deferred comment until sentencing.
Richland County Assistant Prosecutor Gary Bishop said his office would not make a sentencing recommendation. Watson could receive a fine of up to $10,000 and have her driver's license suspended for five years.
METRICH, which began its investigation of Mary Watson before her daughter ran off with Potter, wanted Juvenile Court Judge Ron Spon to have the information before he decided custody.

Angel, thank you for updating on all of these cases! I'm sure it takes you hours daily to keep up on every one of these sweet little children. The world would be a much better place if more people were like you. God bless.
I'm so glad that little Haylee was placed permanently with those foster parents. She will have a much better chance at a happy life this way. If only little Caylee had had this chance.

DeWeese sentenced Mary Watson, 48, of 271 S. Main St., to six months in prison for one count of drug trafficking. He gave her two years probation for two other counts of drug trafficking. Watson, who could have received up to three-and-a-half years in prison, sold morphine, hydrocodone and alprazolam in three incidents last spring and summer. She was arrested Sept. 1 and pleaded guilty last month.
Wearing a pink pantsuit and carrying an oxygen tank, Watson told DeWeese she wasn't herself when she sold the prescription medication. She blamed part of her problems on stress, including not knowing the whereabouts of her daughter and Haylee. Watson also cared for her ailing mother.
"Does your stress cause you to sell drugs?" DeWeese said.
Watson said she sought help at the Center for Individual and Family Services. Defense attorney Lore Whitney asked DeWeese to consider probation because Watson took care of her mother and was not in good health.
In sentencing Watson to prison, DeWeese pointed to her previous record, which included drug trafficking. "It's pretty hard to believe you didn't know what you were doing," the judge said. "It's consistent with your past behavior."
Whitney asked DeWeese if Watson could have a day to get her affairs in order, but the judge refused the request, saying Watson had six weeks to do that between her plea and sentencing.
Mary Watson is handcuffed by corrections officer Jessica Cole after being sentenced to six months in prison Monday.
