Michael Blagg's lawyers are criticizing attempts to introduce into evidence a note his wife wrote days before she was killed, saying the prosecution's theory that it was a catalyst for Blagg to murder his wife is nothing more than speculation.

" Prosecutors pushing to introduce into evidence a note Jennifer Blagg penned hours before she was shot to death contend the writing indicated a "severe family crisis" in the Blagg household.

District Attorney Frank Daniels believes the note was directed toward Michael Blagg and sheds light on the motive for him to murder his wife. He is attempting to convince District Judge David Bottger to reverse an earlier decision to suppress the note.... "

I've always been extremely interested in this case. I used to live only a few miles from the Blagg residence, but that was years ago.

It's going to be a really hot case when it comes to trial. Hopefully at that time, it will have it's own forum here.

November 13, is the two year anniversary since the disappearance of Jennifer and Abby. November 12 was the last day that they spent together alive. Sometime later that day or in the early hours of November 13, all that changed.

Blagg Lawyers Want More Time

"Attorneys for murder suspect Michael Blagg asked a judge Tuesday to give a defense expert more time to analyze fingerprint evidence recovered from the home where Blagg's wife was killed.

Public defenders David Eisner and Ken Singer asked District Judge David Bottger to grant an exception to an earlier order instructing prosecutors and defense lawyers to provide all evidence and a final endorsement of witnesses by Jan. 1.......... "

IMO, this man has not one but TWO public defenders, paid for courtesy of the taxpayers. He's living in Warner Robins Georgia with his mother, working and living his life. How much overhead does he have? His family is dead. He's living with his mother for cripes sake! IMO, he should reimburse the county for those public defenders. He has a source of income. He's not indigent.

Hi Quincy! I almost forgot this case was getting close to a trial date. I wonder why they haven't charged him with his daughter's death? Surely, they can't think she is alive somewhere? They didn't find her body at the dump with her mother so did he bury her some place else when he had more time? I've also wondered if his pornography addiction extended to child pornograpy.

Hi Whitewolf! Good questions. Wherever Abby is, there is not much left but her bones. I hope someday she can be found. Then he will be charged for her murder also. As to for the pornography, you know anything could be possible. A little over two months and his trial will begin. I can't wait!

EDITED to add that I bumped this up after reading River's message about deleting old threads. I didn't want this one to go away!! Hope that's OK River? :)

01.01.04Judge grants Blagg more time

A judge Wednesday granted Michael Blagg's lawyers some leeway in preparing their defense of him in the slaying of his wife, giving them more time to analyze fingerprint evidence from the murder scene.

Mesa County District Judge David Bottger instructed a defense expert to complete his testing of fingerprints recovered from the Blagg home by Jan. 31. He backed off an earlier order for prosecutors and defense attorneys to provide all evidence and a final endorsement of witnesses by today......

A former WS poster whose hat was RHGC involved himself in the Blagg case some time ago (just as he'd promised us he would) and at one point was even interviewed about the case on Denver TV. I wonder if RHGC is still trying to prove that a small-time crook named Robert Pachaly killed Abby Blagg.

RHGC also believes Pachaly murdered JonBenet, Susannah Chase, Martha Moxley, to name a few others. RHGC is an attorney and was at one time, I believe, a Connecticut State Senator.

River, if you're reading this, have you heard from Richard lately? It would be interesting to read what he has to say about the Blagg case.

Edited to add: It wouldn't surprise me if he thinks Pachaly murdered Laci Peterson too.

Ahhh yes. I do remember RHGC very well. He had it all figured out. The intruder theory that Michael Blagg tried to portray with the open back door. RHGC said it was very possible the intruder(s) could have climbed over the rear fence as it faced a busy street.

One thing, the street is not busy, and the other thing is the fence is a 6 foot cedar fence. Climbing would not be impossible, but putting a body and or bodies over the fence would.

Of course it was Robert Pachaly. Came all the way to Grand Junction. :doh:

Ivy, as I recall someone posted a long time ago here at WS that RHGC was coming back here. Haven't seen him.

RHGC emailed not too long ago to report that he's just fine. He's still convinced that Pachaly murdered everyone in the Western Hemisphere.

Remember, this guy supposedly murdered Darlier Routier's boys, as well. That Pachally really gets around. :rolleyes:

RHGC is doing whatever he does this time of year. Travels, I think. He'll be back soon. Ned keeps track of him, as well.

I just posted this link in the "Missing But Not Forgotten" thread for Abby Jo. To sort of put a face to the name, this interview with Michael Blagg was done by the Denver NBC Channel 9 in February of 2002. Just a few days before his attempted suicide. A few months before Jennifer's body was discovered in the landfill.... It's chilling.

Michael Blagg’s defense attorneys say they will introduce evidence at his murder trial disputing a claim that Jennifer Blagg told another woman she was being abused and needed help getting a divorce.

In a motion made public Friday, public defenders David Eisner and Ken Singer argued statements made by a former employee of a legal-services agency indicate a woman who talked to the employee was not the slain, stay-at-home wife and mother..............

For a little background on this Louella Cross...This is a portion of the arrest affadavit which talks about LE interviewing Ms. Cross:

"24. On 11/16/01 and 11/17/01, Investigator Jim Hebenstreit interviewed Louella Cross. Louella Cross stated she use to work for Colorado Legal Services Up to 11/09/01. Louella Cross stated around the beginning of November 2001, a woman and young girl came in to Colorado Legal Services. The woman was frightened. The woman made mention "She couldn’t handle it anymore? can’t take anymore of this abuse." Louella Cross asked the woman if there was domestic violence; the woman said yes. The woman asked to see an attorney. Louella Cross advised her that she needed to fill our an intake sheet and the attorneys would review it. The woman became upset that she couldn’t see an attorney and did not want to fill our paperwork. Louella Cross stated the woman was "scared to death." Louella Cross described the woman as being approximately 5'4" to 5'S", somewhat slender build, and her hair was kind of a brown color. She could not remember what the woman was wearing. Louella Cross stated the little girl was approximately 5 to 6 years old, wearing bib overalls, a blouse with puffy sleeves, white in color, with some stripes. Louella Cross stated she read the article in the newspaper and saw the picture of the missing mother and child and believed these were the two that were in her office approximately two weeks ago. Louella Cross states that what stuck in her mind was that the woman was from South Carolina. Investigator Jim Hebenstreit showed two photographs of Jennifer Blagg and Abby Blagg to Louella Cross. Louella Cross immediately stated the picture of the little girl was the same little girl that came into her office with her mother looking for an attorney. Ms. Cross stated she was almost positive that the photograph of Jennifer Blagg was the mother who came into her office. "

Today was a pre trial conference as the news media called it. Blagg was not present, but his attorneys and the DA were there to work out the details.
