Rafferty was driving force in Stafford killing, trial hears

It is irrelevant who actually wielded the hammer that killed eight-year-old Victoria (Tori) Stafford three years ago, the murder trial of Michael Rafferty was told Tuesday.
“Michael Rafferty and Terri-Lynne McClintic were in this together, together they did this to Tori Stafford, and together they are guilty,” Crown attorney Kevin Gowdey told the jury in his closing address.

In the Rafferty trial, Heeney left out, forced out, a slew of evidence that became public knowledge only after the jury retired to deliberate, rulings of admissibility made largely in pre-trial arguments but also after proceedings got underway in the London courthouse, with the jury sent out of the room. Crucially, jurors never learned of material retrieved from Rafferty’s laptop computer showing that he’d done Google searches on such topics as “underage rape,” that he had an unhealthy interest in child *advertiser censored* and bestiality, that he’d trolled necrophilia websites, that he’d downloaded movies about child kidnapping and child sex killing as recently as 12 days before Tori’s abduction.

Why Tori will always matter

"So this is it? Once the trial is over we're all supposed to just forget about Tori? When it's all over, she's really gone and no one remembers her again?"
The first answer I gave to my wife is one I believe to be true.
"I think people will remember her."

Nine of the jurors who convicted Rafferty of murder, as well as several police officers, attended court to listen to the victim impact statements from eight of Tori's family.
The officers included OPP Det. Staff Sgt. Jim Smyth, who vowed during a tense police interrogation of Rafferty May 20, 2009 to watch when Rafferty was sent from court to a life in prison.

Michael Rafferty is joining fellow murderers ex-colonel Russell Williams and Paul Bernardo in a Quebec prison.

The man who kidnapped, raped and killed eight-year-old Victoria “Tori” Stafford was recently moved from maximum-security Kingston Penitentiary to the maximum-security Port-Cartier Institution about 800 km northeast of Montreal, relatives of the girl said.

“I don’t care where he is, as long he’s behind bars and not receiving any privileges,” Tori’s mother, Tara McDonald, said Friday.

Williams and Bernardo were moved from Kingston to Port-Cartier in the winter, sources told QMI Agency in February.

Victoria Stafford's killer to file appeal, pinning blame on accomplice

TORONTO -- The man convicted of killing eight-year-old Victoria Stafford seven years ago will ask Ontario's top court for a new trial Monday, trying to pin the blame on his accomplice.

Rafferty's lawyer, Paul Calarco, argues in documents filed with the Court of Appeal for Ontario that the judge made several errors, including failing to warn the jury against relying on the testimony of McClintic, "a person of unsavoury character, with a serious history of violence and lying."

But the Crown argues there was in fact a significant amount of corroboration.

"Her testimony was supported by a compelling body of confirmatory evidence, including surveillance video footage; cellphone records; cell tower location data; forensic evidence; and analysis of the victim's blood and DNA from the appellant's car," Crown lawyers Howard Leibovich and Randy Schwartz write in documents filed with the court.

Appeal by killer of 8-year-old Tori Stafford dismissed

Ontario's top court has dismissed an appeal by the man convicted of killing eight-year-old Victoria Stafford seven years ago.

The Court of Appeal for Ontario judges said they didn't believe the arguments presented by Rafferty's lawyer, Paul Calarco.

Members of Stafford's family burst into tears when the case was dismissed.

"In a sense, we can move forward," Rodney Stafford, Tori's father, said after the ruling.

Calarco said the jury, for example, was not given the option of finding Rafferty guilty of being an accessory after the fact.

He said some of Rafferty's actions after the killing — such as cleaning his car, disposing of clothing and giving a false alibi — are consistent with being an accessory after the fact.

The appeal court judges asked Calarco several pointed questions about his arguments, and one judge said Rafferty's actions are "not even close" to being equally consistent with being an accessory.
