Prosecutors have the girl's phone records, as well as Zimmerman's and Trayvon's, but those have not been released. If records confirm the call took place as she described, it would lend credibility to the state.

"However, if that phone record comes back and says that she was not on the phone with him, that is huge for the defense," says Lyle Mazin, an Orlando defense attorney. "If [the prosecution] says she was on the phone, prove it."

The charge Zimmerman faces requires the state to demonstrate a "depraved mind" acting in a manner "regardless of human life." It's a high burden, attorneys say, and one not well supported by the known evidence.

"It's a tragic incident that this young man died, but they have to be able to prove [the charge]," Mazin said
 
Zimmerman wants evidence private in Martin case

ORLANDO, Fla. (AP) _ Attorneys in the Trayvon Martin case want some evidence kept out of the public realm until trial.



Prosecutors and George Zimmerman's attorneys filed motions Thursday asking a judge to keep statements Zimmerman gave detectives and the names and addresses of witnesses from being publicly released. Both items normally would be part of the public record under Florida law.

Zimmerman's attorney also wants to keep private text messages, emails and journal entries Zimmerman made, at least until he can review them. Prosecutors asked that Martin's cell phone records not be released publicly.

Many bills are adopted in Congress and in state legislatures every year that have controversial and unintended consequences that are revealed after the bill becomes law. Stand Your Ground is one such law and like so many others, certain segments of Stand Your Ground should be amended out — or Stand Your Ground should be repealed.

The evidence Special Prosecutor Angela Corey disclosed in the shooting of black teenager Trayvon Martin suggests it's more likely she'll face charges of prosecutorial misconduct than will George Zimmerman be convicted of second-degree murder.

A multimillion-dollar judgment may accomplish what shame cannot. Mr. Zimmerman has excellent grounds for lawsuits, particularly against NBC, which altered a 911 tape to make it seem he made a racist statement. Once the murder charge is dismissed, he should sue.

Without establishing that the killing was racially motivated, any claim that Zimmerman committed second-degree murder in shooting Martin will not survive. Interestingly, the state in its charging affidavit simply claimed Zimmerman "profiled" Martin, not that he racially profiled him.

This allows the state to keep such a claim open-ended, likely knowing early on that it couldn't sustain the burden of proving racial profiling. More and more, this case looks like it will be thrown out in criminal court and eventually be headed to civil court.

Court motions preview evidence public hasn't seen in George Zimmerman case

............. In a motion asking Judge Kenneth Lester to seal some evidence in the case, prosecutor Bernie de la Rionda writes Zimmerman's statements "are contradictory, and are inconsistent with the physical evidence and statements of witnesses."

Michael Grieco, a Miami defense attorney and former Miami-Dade prosecutor, said Zimmerman's statements could give the state "a tool to attack his credibility" and weaken his self-defense claim..........

Grieco said it's possible the state hopes to meet that burden with other evidence showing Zimmerman's frustration over recent burglaries in his community and his dissatisfaction with local law enforcement.

In his call to police on the night of the shooting, Zimmerman said of Trayvon, "these *******s always get away." A year earlier, he blasted the Sanford Police Department as unprofessional at a community forum after going on a ride-along.

As a prosecutor, "I would use these [examples] to paint a picture of a very angry man," Grieco said. "A wannabe cop."

Zimmerman's attorney actually agrees with prosecutors and wants to keep certain evidence sealed from the public.

"What the media and the general public has to remember is that there's a lot that we cannot release by law, so we're asking people to wait and look at all of the evidence," said Corey. "We've been asking them to do that from the beginning, but no one wants to do that; I don't know how to resolve this."
 
Attorneys will square off in a Seminole County courtroom Friday over whether more evidence in the George Zimmerman murder trial should be kept out of the public eye.

At issue is whether personal information about Zimmerman and the teenager he killed, such as phone records, autopsy photos and statements to police, would be so damaging if made public that they&#8217;d ruin a chance at a fair trial.

Assistant State Attorney Bernardo de la Rionda and defense attorney Mark O&#8217;Mara have joined forces and filed motions to the court to seal things such as Zimmerman&#8217;s statements to police, his text messages and the names and addresses of 22 witnesses who saw or heard the fighting between Zimmerman and Trayvon Martin.

George Zimmerman's bond revoked in shooting of Trayvon Martin

SANFORD – In a shocking and unexpected turn, Circuit Judge Kenneth Lester has revoked George Zimmerman's bond in the shooting death of Trayvon Martin.

The decision came after revelations that Zimmerman and his wife may have conspired to lie about thousands of dollars in donations they'd collected before his bond hearing.

In a new motion, prosecutors accused Zimmerman and his wife of lying to the judge during a bond hearing about money they collected for his defense.

Prosecutors allege Zimmerman's wife knew about the donations her husband had collected through a PayPalaccount, but didn't mention the money at his bond hearing.
