Hearing Sought On Anthony Defense Costs
Orlando defense attorney Richard Hornsby said he expects the hearing to be closed or the specifics kept confidential so prosecutors don't get any clues as to how Anthony's defense team plans to mount her defense. In order to set the defense's budget, Hornsby said he expects Anthony's lawyers will have to lay out line item by line item the expert witnesses they plan to rely on and any other investigative costs they expect to incur.
The total amount of taxpayer money Strickland grants them may be revealed, but it will be up to him to determine what money requests are reasonable and which are not. "At the end of the day, Judge Strickland is going to ask: 'Would a reasonable attorney need these services to properly defend somebody?' And if he believes they do, he is going to agree to set a budget to allow them to engage that amount of services," Hornsby said.

Defense attorneys filed their four-page motion with two dozen pages of exhibits and supporting documents late Friday. According to the motion, blogger Dave Knechel, known online as "Marinade Dave," has a "relentless pro-prosecution bias," defense attorneys Jose Baez and J. Cheney Mason wrote in their motion. Casey Anthony fears she will not receive a fair trial, they say.
Knechel was questioned this month by a private investigator working for the defense. He told the investigator that Strickland called him to the bench to say "what a great blog I have," and said the judge described the blog, marinadedave.wordpress.com, as "really fair," according to the motion.
At some point, Strickland learned the blogger was ill and telephoned to express his "personal concern" for the man's well-being, according to the motion. "Judge Strickland's deliberate courting of a well-known media figure raises the inference that Judge Strickland seeks publicity in his own right, and that his rulings and decisions from the bench could be improperly influenced by his desire to secure the outcome that maximizes that publicity," the defense writes.
Knechel, 57, told the Orlando Sentinel that he strives for fairness on his blog and doesn't think the judge should disqualify himself. "I don't think he's biased because he reads," Knechel said. "I'm very upset at this because they went after a really good man. There's no way Casey could get a better judge."
Attempts to reach Strickland were unsuccessful.
Knechel's blog, on which the most recent post is about the case of another high-profile missing child, Haleigh Cummings, 5, in Putnam County, won an Orbbie award for best news blog in December from the Orlando Sentinel.
Also Friday, a motion was made public showing Anthony's attorneys are requesting a hearing before Strickland to set a budget for the defense. No hearing date has been set yet.

A young woman who was one of Casey Anthony's jailhouse friends spoke exclusively to WFTV on Friday in her first one-on-one interview. She said Casey described how she used to knock her daughter Caylee out with chloroform.
“She would pour it on, like, a rag, like, a wash rag, and put it on the baby's face,” 21-year-old Maya Derkovic told WFTV reporter Kathi Belich.
Derkovic is a convicted killer. She said she met Casey in the Orange County jail. Derkovic reported details of her whispered conversations with Casey to detectives; the two used to talk in the jail through an air vent.
Derkovic said she called investigators around Thanksgiving last year, because “it was the right thing to do” concerning the murder of a child. She insists she has no intention of asking for time off her 30-year sentence.

Casey Anthony’s defense filed a motion Friday to have Judge Stan Strickland removed from the case. Jose Baez claims that Strickland should be removed because he has had contact with a blogger, who covers the Casey case, named Dave Knechel, otherwise known as Marinade Dave.
The defense cited the incidents with Knechel and called Judge Strickland a publicity hound who's concerned about politics, and made a comment about not wanting to set a trial date until after his re-election.
Knechel spoke to Eyewitness News on Friday night, and said he thinks the defense is taking a big risk by filing the motion to remove Judge Strickland. "They're putting their hands in hot water. They don't know what the outcome is going to be. Who will the next judge be?".
Eyewitness News Legal Analyst Bill Sheaffer agrees, saying the motion is a mistake because Knechel is not directly involved in the case. Sheaffer said the defense could not ask for a more impartial, patient, or fair judge.

You investigate and you are very fair to everyone." Later in the conversation Strickland said “No, you are very good as a writer and you stick to the facts. You are very fair and I'm impressed." Anthony’s defense said that conversation is grounds for the Strickland to remove himself from the case.
News 13 spoke a local attorney, who has been following this case very closely, who said Strickland stays, Anthony's defense team could use his ties to the blogger as a point to appeal.
Meanwhile, if he steps down, another judge would take over the case, and the case would likely pick up right where it left off. However, the defense could go back and question every motion since the beginning of the trial.

However, ever since he started writing about Casey Anthony, it has skyrocketed to around 100,000 hits a month. He told News 13 he's a writer who is naturally inquisitive, always asks questions, and talks to just about anybody.
Now he's become a part of the Anthony case. Dave Knechel is more commonly known as Marinade Dave. It's his webpage where he mostly blogs about Anthony. "I go to the hearings, I write about it and I try to take a more neutral stance," Knechel said.
One day after a court hearing in October, his writing was recognized by Judge Stan Strickland. Anthony’s defense said that conversation is grounds for the Strickland to remove himself from the case.
In his opinion, Knechel said what the judge reads or watches on TV doesn't make a difference. "I don't think he would formulate an opinion based on what somebody writes on a newspaper on a blog on a forum on any sort of media outlet," Knechel said.
News 13 asked Knechel about his relationship with Strickland, who said there's nothing there. "I wouldn't say that we’re friends,” Knechel said.

WFTV anchor Martie Salt explained that Derkovic shared “whispered conversations” with Anthony in the Orange County Jail and later told investigators about their chats. Anthony is charged with first-degree murder in the death of daughter Caylee.
“She said that she used to knock the baby out so she could go party,” Derkovic said. “She would put her to sleep. Then she would come back and the baby would still be asleep.”
Derkovic hadn’t told authorities about chloroform, Belich reported. But Derkovic shared that detail in the WFTV interview even though she had trouble pronouncing the word.
Derkovic said Anthony put the child to sleep to keep the child from Cindy Anthony, Casey’s mother. Derkovic said Casey felt something of a sibling rivalry toward her child and was jealous of attention the toddler received.
Derkovic tried to get Anthony to open up about Caylee, but was unsuccessful, Belich said. “Nothing I ever said to her actually registered,” Derkovic said.
Belich said that Derkovic answered all of her questions in a 90-minute interview. Belich also reported that Derkovic said she wants no time off her 30-year sentence for sharing information about Anthony.

Casey Anthony’s defense team was getting bad reviews for filing a motion late Friday asking Judge Stan Strickland to remove himself from the case.
“There is little doubt that one day the defense will be looking back on this motion as the worst move they’ve ever made,” said Orlando defense attorney Richard Hornsby in offering analysis for WESH-Channel 2. “Judge Strickland has previously shown fairness to Casey Anthony in the way he sentenced her in the check case.”
Knechel told WFTV that Strickland was very fair. And Knechel said of the defense motion: “They’re putting their hands in hot water. They don’t know what the outcome will be. Who will the next judge be?”
WKMG anchor Louis Bolden reported that Strickland may have to rule on the motion in the next 30 days — and if he doesn’t, the motion would automatically be granted. WKMG said that Strickland wasn’t commenting.

Casey Anthony's defense team filed a motion on Friday asking Judge Stan Strickland to take himself off of the case after attorneys said he formed a friendship with a pro-prosecution blogger.

Knechel started his online blog Saturday by saying, "To say I was blindsided by this defense is an absolute understatement." He went on to say "this motion is eating me up inside because I will forever be remembered as the defense's scapegoat."
Just hours before the motion was filed, Knechel told News 13 about his relationship with Strickland. Knechel said the judge had noticed his writing and even told him, in person, he thought his blog was fair.
Knechel said he now wishes he would have kept that interaction to himself. But Knechel isn't holding back on what he thinks should happen with this case and his feelings for Anthony's defense team.
“What the judge needs to do is toss this motion out because it smacks of desperation. When Baez and Mason must attack a blogger and a distinguished member of the court, clearly, they have run out of options," Knechel said.
