Casey Defense Team May Have To Re-File Motion

Eyewitness News has discovered there could be a problem with the motion Casey Anthony's defense team filed to remove Judge Strickland from her case.

If you look closely at the bottom of the motion, Anthony's newest lawyer, J. Cheney Mason, notarized it himself. But an inspection of the notary seal shows Mason's certification as a notary expired in November 2009.

WFTV talked to legal analyst Bill Sheaffer Sunday. He said the fact that it's expired could be seen as a defect and an opening for a judge to deny the motion.

However, the defense would be free to re-file the motion with new notarization.

Defense attorneys for Casey Anthony succeeded in getting Judge Stan Strickland removed from the case on Monday.

"Any judge would want to be very careful about what they do in terms of how it's going to be perceived by others," Florida A&M University Law School professor LeRoy Pernell said.

Pernell wouldn't say if Strickland should recuse himself, but he said the relationship with the blogger was questionable, and Strickland removed himself from the case on Monday evening.

"Particularly a judge in a high-profile case has to always consider the impact of what they say or do, whether it's intentional or not," Pernell said.

The man who arguably became Central Florida's most recognized judge &#8212; without ever making public comment about the case that thrust him into the national spotlight &#8212; left some piercing, parting words for Casey Anthony's defense attorneys on Monday.

In an order granting Anthony's request for him to step down from the case, Orange County Circuit Judge Stan Strickland wrote: "At its core, defense counsel's motion accuses the undersigned of being a &#8216;self-aggrandizing media hound.' Indeed. The irony is rich." In his order, Strickland noted that he did talk to the blogger in court &#8212; with a TV camera rolling, microphones on, and in front of the attorneys.

Strickland wrote that he recently began looking at Internet material and blogs to get an idea of what people are saying about the case, which is relevant to the defense's motion for change of venue. The judge noticed Knechel "admonished and frequently chastised those who came onto his blog for the sole purpose of bashing the defendant and her family." Strickland thanked him for being "fair and civilized." "The content of my words and context (open court) both seemed unremarkable," the judge wrote.

Strickland noted that no one from Anthony's defense team provided him a copy of the motion when they filed it "(courageously!) at 4:48 p.m." Friday.

"Obviously, defense counsel's intent was to maximize exposure, and minimize or delay any response," Strickland wrote.
He noted that Anthony's defense has filed a litany of motions in the last 20-plus months, "in between media interviews, guest appearances on television shows, and press conferences."

Strickland also stated that Anthony's defense was aware of his "brief discussion" with Knechel for months. The defense "seems to have only recently lost confidence in the court's ability to be fair and impartial," Strickland wrote. "The Court takes heed of the Defendant's present uneasiness," he stated. "If past is prologue, some defense motions may be denied," Strickland wrote. "Since the undersigned has now been accused of bias and wrongdoing, potentially each denial of a defense motion will generate renewed allegations of bias."

Strickland said the effect "will be to elevate an otherwise meaningless situation into a genuine appellate issue."

Strickland also noted that the accusation that he's biased in favor of the prosecution "must serve as a source of bemusement" to the three prosecutors assigned to Anthony's case, "each of whom has verbally sparred with the Court many times&#8230;"

Anthony's lawyers also asked the court not release any information about witnesses the defense may call during the trial's penalty phase, if she is convicted of murder. They claimed identifying witnesses favorable to Anthony might prevent them from testifying.

Strickland commented on his decision in his order to disqualify. "Defense counsel, who has been aware of the Court's brief discussion with the blogger/journalist for many months now, seems to have only recently lost confidence in the Court's ability to be fair and impartial," Strickland wrote.

Strickland said that if he did not step down, allegations of wrongdoing could be renewed each time he turned down a motion from the defense. "The cumulative effect will be to elevate an otherwise meaningless situation into a genuine appellate issue," Strickland wrote.

After mentioning the defense's countless television appearances, Strickland added on final note before granting the motion to disqualify. "At its core, defense counsel's motion accuses the undersigned (Strickland) of being a 'self-aggrandizing media hound. Indeed. The irony is rich," Strickland wrote.

Judge Stan Strickland has recused himself from the Casey Anthony case. But it doesn't appear it was a move he was happy to make. In the order, signed Monday, Strickland states until now, enjoying his work has never seemed to pose a problem.

The move comes after Anthony&#8217;s attorneys said Strickland had an inappropriate conversation with the man who blogs about the case. Dave Knechel said the judge had noticed his writing and told him, in person, he thought his blog was fair. That conversation took place in October.

Strickland said it wasn&#8217;t a secret meeting. The conversation happened right after court ended, while cameras were still rolling, microphones were still open. Strickland called the conversation "unremarkable."

Chief Judge Belvin Perry will now rule over the case.

Big changes are coming in the case against Casey Anthony. She's got a new lawyer and now she has a new judge, too. WFTV found out why conversations with a blogger cost Judge Stan Strickland the case. Judge Strickland has presided over Casey's case for almost two years, but Monday he gave it up. The news broke last Friday when Casey's new lawyer filed a motion asking Strickland to step down, because he complimented a crime blogger in court and called him during a hospital stay.

Strickland made his decision quickly, stepping down Monday afternoon after granting the defense's motion asking him to do so. &#8220;At its core, defense counsel&#8217;s motion accuses the undersigned of being a &#8216;self-aggrandizing media house&#8217;. Indeed. The irony is rich,&#8221; Strickland pointedly wrote in his order.

In a separate order, Judge Strickland confirmed his recusal and Administrative Circuit Judge Reginald Whitehead appointed Judge Belvin Perry Jr. in his place; Perry is highly-respected and known as a tough, no-nonsense judge.

Judge Strickland wrote in his order that he was looking at Internet and blog sites to research the extent and content of the publicity, because the defense was asking to move the trial to another county. He wrote that he noticed that Marinade Dave was actually defending Casey Anthony and her family against the bashing. &#8220;This particular blogger/journalist admonished and frequently chastised those who came onto his blog for the sole purpose of bashing the defendant and her family. The Court thanked him for being both fair and civilized,&#8221; Strickland wrote in his order Monday. "The content of my words, and context (open court) both seemed unremarkable."

"Since the undersigned has now been accused of bias and wrongdoing, potentially each denial of a defense motion will generate renewed allegations of bias," Strickland wrote. "The cumulative effect will be to elevate an otherwise meaningless situation into a genuine appellate issue."

Marinade Dave shot back over the weekend, accusing the defense of wasting taxpayer money to find him rather than to find Caylee's alleged nanny, Zenaida Gonzalez.


DEFENSE FILES NEW MOTIONS
Casey's defense has also filed four new motions arguing against the death penalty. Two motions argue Florida's death penalty is unconstitutional, because higher courts are unable to adequately reconsider a case and because women accused of crimes like this face different expectations from jurors.

Another motion argues prosecutors shouldn't be allowed to seek the death penalty, because they originally submitted paperwork saying they would not.

The last motion argues for the defense to keep any evidence for the penalty phase out of the trial itself.


WHAT'S NEXT IN THE CASE?
WFTV checked, and the State Attorney's Office gave another 160 pages of discovery to the defense. All WFTV knows is that it was based on documents they wanted after deposing an FBI agent.

At this time, there are no new hearings scheduled in Casey's case.

The Anthony team wants Strickland off the case for making favorable comments to Dave Knechel, who writes the Marinade Dave blog. Anthony&#8217;s defense team describes the blog as pro-prosecution and says Strickland had validated the blogger.

Two professors at FAMU College of Law faulted Strickland this afternoon.

&#8220;Any judge would want to be very careful about what they do in terms of how it&#8217;s going to be perceived by others,&#8221; Professor LerRoy Pernell told WESH-Channel 2.

Central Florida News 13&#8217;s Jacqueline Fell talked to Professor Rhoda Pierre Cato, who said judges must always appear impartial even as social media flourish.

&#8220;Facebook and all these social networks are available,&#8221; Cato said. &#8220;Yes, judges have normal lives. But they&#8217;re handled a lot differently because these things are scrutinized when judges engage in these kind of activities.&#8221; Cato also told Fell that the Strickland issue needs to be resolved quickly.

Judge Stan Strickland is stepping down from the Casey Anthony case, TV stations reported tonight. In departing the case, Strickland had some withering words for the defense. &#8220;He does indicate in so many simple words here that he has seen the defense seeking publicity in this case before,&#8221; WESH-Channel 2&#8217;s Greg Fox reported.

Fox read Strickland&#8217;s last line in a three-page response to a defense motion seeking his removal: &#8220;At its core, defense counsel&#8217;s motion accuses the undersigned [Strickland] of being a self-aggrandizing media hound. Indeed. The irony is rich. Motion granted.&#8221;

&#8220;Some very harsh words from the judge right there,&#8221; WKMG-Channel 6&#8217;s Mike DeForest said. WKMG DeForest put Strickland&#8217;s move this way: &#8220;He felt like he had to step down from this case because the defense team had questioned his impartiality.&#8221; DeForest highlighted Strickland&#8217;s &#8220;one last parting shot&#8221; at Anthony&#8217;s defense team and its &#8220;media interviews, guest appearances on television shows and press conferences&#8221; as well as its &#8220;litany of motions.&#8221;

Chief Judge Belvin Perry will preside over the Anthony case, Central Florida News 13 reported. Strickland was the judge on the case for 20 months. WKMG&#8217;s DeForest spoke to a legal expert who predicted that Strickland&#8217;s rulings will remain in place and Perry will continue the murder trial as it would have under Strickland.

WFTV-Channel 9 reported that more discovery documents are likely to be released this week. WFTV also noted that a pretrial hearing in Zenaida Gonzalez&#8217;s defamation suit against Anthony is set for May.

A Florida judge in the Casey Anthony murder trial is taking himself off the case. Circuit Judge Stan Strickland granted a motion Monday filed by Anthony's attorneys asking that he recuse himself.

Anthony's defense attorneys had argued that comments the judge made to a blogger recently showed he was prejudiced against Anthony.

In his decision, Strickland denied doing anything wrong. But he says he is removing himself from the case because Anthony's attorneys likely would allege bias each time he ruled against their motions.

In a motion filed Friday by her defense team, it states Anthony will not be able to get a fair trail because of a relationship the defense claims her trial judge has developed with a local blogger.

The blogger is known as "Marinade Dave."

In the motion, Casey's defense states "Marinade Dave" has historically presented stories of severe bias and prejudice against Casey Anthony.

Anthony's attorneys say Judge Strickland recently learned that "Marinade Dave" was ill through one of his blogs and that somehow, some way, got his phone number and called the blogger expressing the judge's concern for the his well being.

The motion also states the alleged relationship was not disclosed to counsel and that Casey's defense team only recently learned about it Sunday, April 11th when an investigator working for the defense was interviewing "Marinade Dave."
