JACKSONVILLE, Fla. -- Prosecutors will attempt to convince a jury that Josi Hall's abuse was responsible for his 22-month-old daughter's death and that Hall should be convicted of murder.

Kayla Joy Hall was found dead in November 2008 in the bedroom of the family's San Pablo Road apartment.

Police said Hall, 25, told detectives he had picked his daughter up at 4 p.m. the afternoon before and she was fine when he her to bed, but she was unresponsive when he tried to wake her up that morning.

The medical examiner's autopsy found Kayla died of blunt-force injuries and ruled her death a homicide.

Four months later, Hall was arrested by the U.S. Marshal's Service and charged with murder.

Channel 4 learned that Hall and his wife at the time were both arrested in April 2007 during an investigation into abuse of Kayla, but those charges were dropped due to lack of evidence. When the couple divorced, Josi Hall was awarded custody of the girl.

A jury in the case was seated earlier in the week. Opening statements are scheduled to begin Thursday afternoon.

Dad Accused Of Killing Daughter On Trial

    22-Month-Old Died Of Blunt-Force Injuries

Josi Hall listens during testimony in his murder trial.

Kyla Joy Hall at 9 months old, when the Florida Department of Children and Families investigated allegations of child abuse against her parents. Those charges were dropped when Kyla's mother voluntarily gave up her parental rights.

JACKSONVILLE, Fla. -- Defense lawyers for a father on trial in the death of his 22-month-old daughter rested their case Friday morning after calling their third witness.

Josi Hall was accused of murder last spring, several months after Kyla Joy Hall was found dead in the bedroom of the family's San Pablo Road apartment. An autopsy found that Kyla died of blunt-force injuries.

The medical examiner said the toddler was hit so hard in the chest that her heart burst.

Police said Hall, 25, told detectives he had picked his daughter up at 4 p.m. the day before and she was fine when he put her to bed, but she was unresponsive when he tried to wake her up that morning.

During opening statements on Thursday, prosecutors said the state had proof that Hall was clearly responsible for his daughter's death.

"While Kyla Hall was in her crib, when with ill-will, hatred and spite, blunt-force trauma rained down upon her defenseless body," one prosecutor said.

The defense told the jury that the investigation into Kyla's death was sloppy and suggested that Kyla's mother -- Hall's ex-wife -- might have beaten the girl to death.

Channel 4 learned that Hall and his wife at the time were both arrested in April 2007 during an investigation into abuse of Kyla. Investigators said they found both of Kyla's legs broken and her skull fractured. But those charges were dropped due to lack of evidence and prosecutors couldn't prove who did it.

The couple divorced and Kyla's mom gave up her paternal rights. Josi Hall was awarded custody of the girl -- 11 months before she died.

Closing arguments were to begin late Friday morning and it was expected the jury would begin deliberations in the afternoon.

Jury Convicts Dad Of Killing Daughter

22-Month-Old Girl Died Of Blunt-Force Injuries
    POSTED: Friday, April 23, 2010

Josi Hall listens during testimony in his murder trial.

JACKSONVILLE, Fla. -- It took jurors about 90 minutes Friday afternoon to find a father guilty of second-degree murder in beating his 22-month-old daughter to death.

The couple divorced and Kyla's mom gave up her parental rights. Josi Hall was awarded custody of the girl -- 11 months before she died.

Channel 4's Jennifer Waugh looked into that first Department of Children and Families investigation and learned that the child's court-appointed advocate only met with Josi Hall once and didn't show up at the court hearing where Kyla's custody was determined.

The case file also shows that workers with Jewish Family and Community Services, who cared for Kyla while she was in state custody, were against returning the child to her father, they they did not fight to keep her away from Hall.

Waugh said no one was ever fired or disciplined for the way Kyla's case was handled, but new guidelines were released by DCF calling for more unannounced visits, more documentation about recommendations and a meeting of everyone involved in an child welfare investigation before reunification.

Hall is scheduled to be sentenced May 24.

    From May 2010:

    http://jacksonville.com/news/crime/2...daughter-death

Josi Montell Hall had witnesses and letters on hand to try to convince a Jacksonville judge Wednesday that he didn’t deserve a life sentence...

In the end, it didn’t affect Hall’s sentence one bit. Circuit Judge Elizabeth Senterfitt sentenced him to life in prison, the maximum, for the 2008 beating death of Kyla Hall.
