Casey Case Goes Before New Judge Friday
Friday, April 30, 2010 1:03:47 AM

"Judge Perry expects you to get to the point and he values his time and he takes it personally when you waste his time," said Richard Hornsby, a criminal defense attorney.

"You went from the most defense friendly judge, or what most defense attorney's would want -- Judge Strickland -- to the one judge most prosecutors want because they have a case. They have their evidence and they know they're in the right most of the time," Hornsby said.

Hornsby said Perry is a by-the-book judge, but that guarantees nothing for the defense. "You can have a very fair judge but if you lose the case, you have to be prepared to pay the ultimate penalty -- whether it's the maximum sentence or in Casey Anthony's case, the death penalty," Hornsby said.

The hearing was merely a formality. Judge Belvin Perry got acquainted with the case’s key players and discussed deadlines, including the deposition of all witnesses, as well as deadlines for future motions.

Another hearing will be held on May 6th about the defense team budget. Additional hearings will be held on May 11th and 12th for defense death penalty motions.

Judge Perry wanted the attorneys on both sides to know he has strict rules and he expects them to be followed. An order went out to both prosecutors and Anthony’s defense attorneys to make sure the rules are clear. Counsel has to stand when court is opened and adjourned. And disparaging personal remarks won't be tolerated. Judge Perry is also mandating deadlines for new discovery and pushing to move past any unresolved motions. The order also says the attorneys must refer to everyone by their last names only, ask permission before approaching the bench, and they can't make gestures or facial expressions that show any disapproval while witnesses are testifying.

UPDATED: Judge Says Casey Trial Could Take 4-6 Weeks
Posted: 4:06 pm EDT April 29, 2010
Updated: 11:07 am EDT April 30, 2010
<snipped>
Once Judge Perry arrived, things got going quickly, with the judge carrying a firm tone, pressing both parties on outstanding motions, including for change of venue and dealing with the death penalty. Perry scheduled a hearing during the week of May 10 to discuss several motions dealing with the death penalty.

Regarding the change of venue request made by the defense, Judge Perry said he would consider it but, if he did change the venue, it would not be disclosed until the last minute. He also said it's possible they could get the jury from a pool outside of Orange County and still hold the trial inside the county. Judge Perry said, once the trial starts, if the jury were to be sequestered, he would work five and a half days a week (a half-day on Saturdays).

Judge Perry asked the two parties about the scheduled trial start date of May 9, 2011 and if they were okay with it. Both seemed satisfied with that date. “I would like to do it sooner, but it looks like ya’ll have agreed on something. My only concern is that, as you know, under our system of laws, the adversary system of justice is memory dependent and, unfortunately, memories deteriorate over a period of time,” Judge Perry said. “I will think about it. I’m inclined to stick to the same schedule, but once we do that I will enter an order and you will be stuck with it.”

Judge Perry then pushed for information much more aggressively than in previous hearings, pressing the two parties on how long the trial will take. After brief discussion, Judge Perry suggested that it sounded like the guilt/innocence phase of the trial would last between four and six weeks with one week for sentencing if Casey were found guilty.

"As you know, we will have status hearing every 45 days to make sure you are following this schedule," Judge Perry said, referring to the schedule he'll provide to be sure they're ready for the trial date.

UPDATED: Casey Anthony: Perry sets key dates, mulls trial options
Casey Anthony and her defense team before Chief Judge Belvin Perry Jr.

11:22 a.m. EDT, April 30, 2010
<snipped>
Among the items Perry is discussing with defense attorneys and state prosecutors today: pending motions, pre-trial and trial dates, deadlines for future motions, and deadlines for when evidence will be released as part of the discovery process. The tenor of Anthony's case already has changed dramatically with Perry on the bench during the first meeting.

Perry is pressing attorneys to move now with the case. He set one hearing – to determine how much public money the defense plans to spend – for May 6. He set several others hearings, including whether jury selection should be moved to another county – for the following week.

State prosecutors said there are now 250 witnesses, 90 of which defense attorneys will likely want to question before trial. Also discussed is a possible change of venue. "It is no secret that this case has received widespread publicity," Perry said. If he grants a change of venue it will not be disclosed until "the last possible moment" because of possible media coverage and disclosure of case details to potential jurors.

After talking to attorneys, Perry predicted the trial would last four to seven weeks. Tentative trial date, set earlier, stays at May 9, 2011.

Throughout the hearing, prosecutors and defense attorneys maintained an orderly air which is different from other hearings that were filled with bickering.

Friday Casey Hearing Will Be 1st With New Judge
Status Hearing Slated For 9:30 A.M.

When Perry takes the bench on Friday at 9:30 a.m., he has told both sides to be prepared to discuss the following:
•Deadline for depositions of all ordinary and expert witnesses.
•Deadline for future motions both pending and unresolved.
•Pretrial and trial dates.

Sources in the case said the number of emails between the two sides has picked up, and they've already met once in anticipation of Friday's hearing.

Perry also told lawyers to re-familiarize themselves with his 15 point courtroom decorum policy, address remarks to the judge and not each other, and avoid disparaging personal remarks or acrimony towards opposing counsel. The last point is aimed clearly at Jose Baez and prosecutor Jeff Ashton, who have been known to mix it up a little in previous hearings.

UPDATED: Casey Faces New Judge In Court
Friday, April 30, 2010 9:32:25 PM
<snipped>
Analysts had called Perry a “no-nonsense” judge, and that was reflected in the first court hearing in the case.

The judge was all about the calendar, pushing both the prosecution and defense to be ready for trial. At one point, when Perry was talking to defense attorney Jose Baez about his budget for the Justice Administrative Commission to pay for Casey’s discovery process, he said: “That needed to be done, like, yesterday.”

Perry set the hearing for May 6, then started pressing the attorneys to get all their pending motions resolved, and until May 10 to prepare them for his decision.

Both sides said they had a lot to do -- for example, the state trying to get depositions from as many as 250 witnesses. Perry said he wants a schedule of when they will take depositions. Anyone who misses a set deadline could be held in contempt of court. “I will not be taking the excuse, ‘They don’t show up; we need a delay.’ Give them a courtesy call, and if we need him, I’m sure the sheriff, Jerry Demings, will be helpful in making those witnesses available,” Perry said.

Defense Files Objection About Former Judge
Judge Stan Strickland recused himself from the case earlier this month, and was critical of the defense in responding to their request that he step down. Defense attorney Cheney Mason filed an objection with the court Friday, taking exception to Strickland's response.

New Motions Filed
Among them is a motion to seal jail visiting log records. The defense said if they cannot keep confidential the people visiting Anthony, they cannot properly prepare her case for trial. A memorandum supporting motion to declare death penalty unconstitutional was also filed, along with a motion seeking a protecting order with respect to death penalty. The defense wants to protect Anthony from revealing any information relating to any potential witnesses or testimony in a penalty phase proceeding prior to a first-degree murder conviction, if should that happen.

Secondary Casey Anthony attorney leaves case

One of Casey Anthony's attorneys has removed himself from her case after getting in trouble with the California Bar.

Todd Mancuso said in a motion this week he was on "involuntary inactive status."

Mancuso told the defense team for the mother accused of killing 2-year-old Caylee Anthony in February he had entered an alternative discipline program.

Anthony is still being represented by Kissimmee-based attorney Jose Baez, prominent Orlando lawyer Cheney Mason and two other out-of-state attorneys.

The trial is scheduled to start in May 2011.

UPDATED: Casey Judge Discusses Change Of Venue
POSTED: Thursday, April 29, 2010
UPDATED: 2:03 pm EDT April 30, 2010

Casey Anthony on Friday made her first appearance before a new judge, who made it clear that her trial will be held in Orange County although the jury may be chosen elsewhere.

Perry set a closed-door hearing on defense costs, which will be paid for by taxpayers, for May 6; several other open-court hearings will be held the following week. Later in the hearing, Perry said that the May 9, 2011, scheduled start date for Anthony's murder trial will likely remain.

Perry also discussed a possible change of venue. The state said it will not oppose most of the defense motion for a change of venue, but that only means a jury would be chosen in another Florida city. The jurors would then be brought back to Orange County for the trial, which attorneys predicted could take up to nine weeks.

In the next two weeks, Judge Belvin Perry said he plans to address most of the outstanding motions and issues in the case. He also sent a strong signal about where the murder trial will be held. Perry said he plans to decide the defense team's budget, any death penalty challenges and a request to have the trial moved in just weeks.

With lawyers on both sides displaying their best behavior, and Casey Anthony mostly stone-faced, Perry made his first order of business setting the defense team's budget hearing for Thursday.

Perry said he wanted to move the start date of the trial up, if possible, but he reluctantly kept it as scheduled on May 9, 2011. Perry said he plans to keep things moving and promised status hearings every 45 days to make sure everybody is on track. He even offered to have the Orange County Sheriff's Office help make sure witnesses scheduled for depositions make it there with no excuses.

Casey's defense mad about judge's insult-filled motion
By Bob Hazen @ April 30, 2010 10:54 AM

"In a motion filed today, J. Cheney Mason objected to Strickland's criticism of the defense.
The judge, in filing his order, chose to utilize that opportunity, even though improvident and innapropriately so, to insult defense counsel and do so by either serious mistaken recollection of the facts or worse," Cheney wrote.

ORANGE COUNTY, Fla. -- Casey Anthony sat emotionless during the first hearing in her case in front of a new judge.
Judge Belvin Perry said the jury in the case likely will not come from Orange County, but he doesn't plan to move the trial either.

Judge Perry talked in some detail about a change of venue, how long the trial could last and said that the jury could be sequestered.

"It is no secret that this case has received widespread publicity," Perry said. "The only way ... to make sure that they are no infected or polluted during this proceeding is to sequester them."

The trial, scheduled to begin May, 9 2011, is expected to last between four and six weeks.
Another week will be needed for the sentencing phase if there's a conviction, according to authorities.

Casey will stand trial for killing her daughter Caylee and Judge Perry is clearly ready to get the show on the road May 9, 2011, made it clear that date will not be extended.

I'm inclined to stick to the same schedule, but once we do that I will enter an order and you will be stuck with it."

Prosecutors said they believe some out-of-state witnesses are stonewalling

"I'm quite sure that Sheriff Jerry Demings will aid us in going to make those witnesses available for deposition," Judge Perry said.

The judge also took issue with the fact the defense still hasn't talked to the Justice Administration Commission to go over how much the case will cost taxpayers.

"I got time next week and the following week. That needs to be done like yesterday," Judge Perry said.

There will be regular status hearings on the case.

A status hearing every 45 days to make sure you are following this schedule," Judge Perry said.

"We want Casey to have a fair trial. We love the knowledge Judge Perry brings to the bench," Jose Baez said after the hearing;

Casey Anthony: No-nonsense Judge Belvin Perry wows reporters

Chief Judge Belvin Perry won favorable reviews for the way he guided a hearing this morning in the Casey Anthony case.

Perry is the new judge in the high-profile case, and his style at the Anthony hearing was the top story on noon newscasts.

WKMG-Channel 6’s Tony Pipitone said, “He runs a no-nonsense court. The decorum was impeccable. Everyone stood when they were speaking. They addressed the judge. They didn’t address each other. It was like they were all back at law school trying to act like young lawyers.”

WESH’s Bob Kealing agreed. ”If you blinked once during this 45-minute hearing, chances are you missed the judge scheduling something,” Kealing said.

Defense attorney Jose Baez was seen on WFTV saying: “We love the knowledge that Judge Perry brings to the bench.”

Yeah, a lot of people love Perry at first glance.

Casey Anthony: Stations see a new, serious attitude with a new judge, Belvin Perry, in charge
posted by halboedeker on April, 30 2010 5:55 PM

WOFL-Channel 35 anchor Sonni Abatta saw ”a whole new attitude” with Chief Judge Belvin Perry taking over from Judge Stan Strickland, who recused himself from the case. “Judge Perry is very direct and made it clear he doesn’t want anything to slow down this case getting to trial, which is now set for a year from now,” WOFL’s Holly Bristow reported.

WESH anchor Jim Payne said Perry “set up an ambitious schedule to put this trial back on the fast track.”

WESH’s Bob Kealing said Perry displayed a vintage style in asking direct questions and seeking direct answers. “He also sent a surprise signal today that this trial will be held right here,” Kealing said outside the Orange County Courthouse. Kealing quoted a lawyer who said that Perry “is like having a general on the case.”

WESH’s Kealing highlighted that Anthony chuckled briefly before the hearing but “sat emotionless” during the hearing.

WFTV’s Belich said that Anthony’s “expression was serious, her jaw tightened when the death penalty was mentioned.”

WOFL anchor Abatta noted that Casey Anthony wore a pink shirt and had her hair pulled back. Abatta explained that Cindy Anthony waved at Casey and mouthed “I love you” at her daughter when the young woman was escorted in handcuffs out of the courtroom. Casey Anthony briefly smiled at her parents, Abatta added.
