Teacher Killed In Party Shooting
Raul Rodriguez Charged With Murder
POSTED: Monday, May 3, 2010
UPDATED: 10:54 am CDT May 3, 2010
HUFFMAN, Texas -- A teacher was killed and a firefighter was injured in a shooting at a home in Huffman, KPRC Local 2 reported.
Harris County sheriff's deputies said dozens of people were gathered for a birthday party when gunfire broke out in the 300 block of Oak Knoll Drive at about 12:30 a.m. Sunday.
"It was not a brawl," witness Virginia Lloyd said. "It was a birthday party for a 3-year-old."
Deputies said Raul Rodriguez, 44, who lives two homes down from the party, called the constable's office to complain about loud music coming from the home.
Investigators said the situation wasn't resolved to Rodriguez's satisfaction, so he took a gun, flashlight and video camera to the home.
Rodriguez got into an argument with the birthday child's father, Kelly Danaher, 36, officials said. It escalated and Rodriguez shot three people, investigators said.
Detectives said Danaher, who was a teacher and coach at Sorters Mill Elementary School in the New Caney Independent School District, suffered fatal wounds. Two others, Ricky Johnson, 43, and Marshall Stetson, 33, were seriously wounded.
Johnson, a Houston Fire Department senior captain, tried to subdue Rodriguez. According to his friends and family, Johnson was promoted to that position two weeks ago.
Other people restrained Rodriguez at the scene and he was arrested. He has been charged with murder.

A neighbor, 44-year-old Raul Rodriguez, a retired Baytown firefighter, is charged with his murder.Rodriguez is accused of shooting Danaher and two others after he went over to Danaher’s home claiming the music was too loud.
"He had such a commitment to our kids. He loved what he did. He loved the students. He was a truly a gifted teacher He knew from the bottom of his heart that you had to build relationships with kids. That you had to capture their hearts to capture their minds and that is what he did."
Houston FD Capt. Ricky Johnson, who was also shot, is in critical condition.A third shooting victim was treated at hospital and released.
Instead of going next door with a gun, why not phone & say "It's late, turn down the music"? Or even simpler, call 911 with your complaint & let them handle it...... what's the matter with people????

He murders a teacher. Tries to wipe out a high ranking firefighter, and another guy. Over music?
What a da*n shame.
Prayers for this poor teachers family. Prayers for the wounded men as well.
Now, let's see if this nutter has a record? What's the bet on that?

A jury has convicted a Texas man for murdering his neighbor during a confrontation over loud music two years ago, rejecting a claim that he was within his rights to fatally shoot the man under Texas' version of a "stand-your-ground" law.

A Texas appeals court says a 49-year-old man who was convicted of murder after jurors rejected his "stand your ground" self-defense claim didn't get a fair trial and deserves a new one.
Raul Rodriguez was sentenced to 40 years in prison for the 2010 slaying of a 36-year-old man during an argument over loud music in a rural Harris County neighborhood northeast of Houston.

I am sorry for all parties involved. But it is no longer a 3 year old's b-day party at 12:30 am. The shooter should have stayed in his own home. Alcohol or drugs had to be present somewhere in this mess. I hope the shooter is gets re-convicted."If you are lucky enough to find a way of life you love, you have to find the courage to live it."

Jurors sentenced Raul Rodriguez to life in prison Tuesday for killing his neighbor during an argument over loud music.
This was his second trial for the murder of Kelly Danaher, a school teacher. He got 40 years the first time, but an appeals court ruled the first jury got confusing instructions, so Rodriguez was released from prison and tried again.
