This is a really good read guys...there's a lot there...

Now to sit back and watch the Defense squirm...I think they have 4 more days to get their DP motions to the state....
 
so does this mean that the defense will finally have to get some work done? Actually fill in some of the blanks for the State?????:waitasec:

The defense's expert witnesses (who haven't been declared expert yet??) must complete their work at the latest by November 30,2010. I think that also means filing and turning it over by 11/30...but not sure.

Then there are the witnesses regarding RK that need to be deposed, am I right?

Does anyone think they will try to come up with more witnesses at the nth hour?
 
Well that was a big BOOYA to the defense. Love the part about how either the exculpatory evidence does not exist, or the defendant is intentionally violating the rules of discovery. :)

EDIT: Oh I see that's actually an older document, dated September of 2009.


Well just like the defense is revisiting some motions with the new judge...maybe the State is too

I did read it...but not detailed....hence I missed the date...but it is still interesting
 
Great motions. It is entirely reasonable for the State to make these requests at this time. Enough time has passed and the defense has stated in Court they have witnesses ready to testify and dispute State evidence. It's put up or shut up time.

Funny how the witnesses the defense claims are so ready to provide testimony favorable to KC are now shying away from being deposed by the State. They were not shy when they went on tv and provided sworn statements to the defense. Did these people honesly think the State would just accept their statements at face value?

I heart LDB - enough of this nonsense - let's get down to business!!!

Great motions. It is entirely reasonable for the State to make these requests at this time. Enough time has passed and the defense has stated in Court they have witnesses ready to testify and dispute State evidence. It's put up or shut up time.

You know how those old westerns had the line "There's a new sheriff in town", well, HHJP is the "Sheriff" and he's gonna be on this defense big time. I love how this has turned out to a huge reality check for the defense!! After all....remember that Feb 1st deadline that just came and went with zippo, nadda, nothin' from Baez??? I don't think HHJP is going to allow for ANY slacking off in this case. You got what you asked for!!!!

How sad is it that a year and a half later, the SA is having to push the defense experts to complete their exams. And the defense wants us to take their claims of kc's innocence seriously? Please. I did enjoy the SA getting the chance to remind everyone that the so-called experts never finished their work and that the defense never could produce any evidence or witnesses they claimed would prove kc's innocence.

This, to me, REALLY proves that the defense gameplan all along was to put off doing all the necessary work until we, the taxpayers, were paying for it.

Meanwhile, they blew all their money on meaningless BS interviews and depos of Kronks ex-wives, and jail employees that witnessed Casey's meltdown on Dec 11, 2008, and other things I don't recall at the moment.

As a taxpayer, I am INCENSED.

First off...Thank you so much for everything you do! Second: I'm incensed by it as well and I don't even live in Flordia....I truly don't think that the defense has done much 'cept interview a few little peeps here and there---and try & try to get that darn info out of TES and MJ (whow just by chance "interjected" himself in this :sick:)---they want there "day in court" --- They also need to do their job and get it done--

I do wonder if HHJP will tell them that some of this should have been done like yesterday??????:waitasec:

Well, I am not sure that this is going to go over well, but I will give it a shot. To my own horror, I find myself defending - up to a point- the defense. I know, I know, they have been idiots in a number of ways. However, having said that; their witnesses could not do their work or finish their work or even start their work until they KNEW what they were going to be working on. I will be the first to admit that I do not remember when the first scientific evidence started being released to the public. Let's take the autopsy report as an example. When was the final report released? Until that report was released the defense did not know EXACTLY what kind of experts they would need - aside from the obvious second opinion on the autopsy itself - until they knew what the report contained. Their plant specialist, trace evidence specialist, etc. Am I making myself understood enough here? Their experts could not get started until the State turned over evidence for them to examine and report on.

Do I think the defense delayed on purpose? Yes, I do, but we have to give their experts a little slack because their work only began when the State released the evidence and reports to them.

I agree but it's been over a year since the remains were found. Experts from the defense have yet to examine evidence held by SA. And if this were the case what WAS all that money that KC received spent on???? Certainly not her fraud case or the civil trial. After the $111,000 the remainder is said to have been spent on experts and investigators. Experts who have not even taken the opportunity to look at the physical evidence??? There may be a plan here but we just can't see it. If there were, though, why would they want to look at all the TES records to have their investigators check on police records. jmo

I laughed when I saw your post because I well know the feeling of posting a different kind of an idea and then ducking under my desk to "avoid flying tomatoes". The same thoughts came to me - there must be some logical reason why the defense appears to be doing so little work - and is there something going on in the background we just can't see that they are going to pull out of their hat? Some evidence that is going to somehow turn this case on it's head?

Because I think for quite a long time, Baez simply believed everything "his girl" said, and was having such a grand time in front of the media, he forgot to watch the evidence "bottom line". Now he has Lyon(s) and Mason telling him to get ready to save ICA's life, and "fergedaboutit" when it comes to not guilty.

So as to the reason the experts haven't been deposed by the defense and is there a sound reason, it becomes more clear every day that the answer is emphatically "NO".

I would have thought the defense's job would have been easier actually. They have full access to casey. She knows what happened, just have to ask her. The State has to guess based on evidence :)
 
The defense STILL has no respect for this court. I really thought things would be different but they're going down the same road with JB as they did with SS.

If they have a valid reason for not complying with the Judge's order and timeline then they should have told the court at the time or written a motion explaining why they cannot comply.

Waiting for the prosecution to have to announce why they cannot honor the schedule is just more game-playing. Of course the prosecution can't do it if they don't have what they need to set depos.

If the judge doesn't crack down on this I fear we're in for a bumpy ride. Bullies push the envelope, trying to find ways to skirt authority.

I hope JB cannot be bullied.

I admit I am surprised that the defense has thumbed their noses at JB this early in the "new game". I'm stunned and upset.
