Midland mother arrested for attempted murder of 1-year-old son

Iris Rodriguez was arrested by the Midland County Sheriff's Office early Monday at Midland Memorial Hospital and charged with Attempted Capital Murder of a Person Under 6 Years of Age for injuries suffered by her 19-month-old son.

According to a Sheriff's Office affidavit, investigators were called to Midland Memorial Hospital West noon on Monday in reference to a 19-month-old male with a broken left arm.

According to the affidavit, Rodriguez told investigators the arm was broken when the child fell down a flight of stairs last week.

Doctors also witnessed bruising to the child's face and head, which they determined to have been caused in the past 24 hours. If left untreated, the injuries could have been fatal, doctors told investigators.

Midland County investigators have arrested the 18-year-old live-in boyfriend of the teen mom who was charged this week for attempted capital murder of her son.

Joseph Mark Charles was arrested late Tuesday on a first-degree felony charge of aggravated assault with a deadly weapon and their alleged attack of on the boy.

During the investigation, the boy’s 2-year-old sister was found to have been abused in the past few days with bruises and swelling to her body as well. She also had injuries consistent with that of sexual assault, investigators said.

Charles also has been charged with aggravated sexual assault for allegedly abusing the girl as well.

On Monday, authorities were called to the Midland Memorial West Campus when a 19-month-old boy had been admitted with a broken arm and multiple bruisings and bites to his body.

An arrest affidavit obtained by the Reporter-Telegram states that upon investigators' arrival, the victim also had swelling and bruising to both his eyes and was unable to open them. He was also treated for abrasions to his face and mouth and had bites to his shoulders, breasts and right foot.

Doctors also found bruising to his genitals and stomach area and that his left leg had been burned.

After investigators saw the injuries to the baby, they ordered a SANE (Sexual Assault Nurses Examination) to be performed on both the boy and his 2-year-old sister. His sister was also treated at the hospital for several bruises on her body.

After the examination, doctors found that the girl's genitals had been bleeding and that she had an abrasion on them which is "an acute injury" consistent to that of sexual assault, according to the affidavit.

Investigators questioned the mother of the toddlers again on Tuesday, and she told authorities then that she is scared of her boyfriend and that he has beaten her in the past.

According to the affidavit, she stated that Charles would take the two children "to lay them down and not let her into the room."

The affidavit states that when Charles would take the children into their room, Rodriguez said "the kids would always end up crying and he would not let her in the room with them."

Upon a search of their Midland County home, investigators found semen on one of the beds.

Charles was charged with aggravated sexual assault of a child in connection with the abuse the 2-year-old girl sustained.

Both Rodriguez and Charles are being held at the Midland County Detention Center. Rodriguez's bond is set at $200,000; Charles' bonds are set at a total of $1 million for both charges.

The 19-month-old baby was listed in stable condition Wednesday.

Midland Memorial Hospital said the boy is in serious but stable condition (Tuesday 10 p.m.) according to his great-grandmother the injuries she saw were too much to bear.

"He had his eyes closed, purple and he had his face and head very swollen and his head was bleeding from the inside; that he was beaten a lot. And that he had bite marks," said Rosa Ulate.

Her granddaughter, 19-year-old Iris Rodriguez is in jail charged with the attempted capital murder of the child.

Ulate says she tried to stop Rodriguez from seeing her granddaughter but to no avail - he continued to come over.

"I know she's not a good, responsible mother, but I know she's not capable of doing that. I know that it was the boyfriend," said Ulate.

For now the little girl is staying with her great-grandmother while her younger brother is in the hospital.

"We did make the decision to allow the 2 1/2 year old to remain in her grandmother's care but CPS will remain the legal guardian at least temporarily."

When the boy recovers it will be up to CPS to determine where he goes.

"Our thoughts are with this child right now as he's struggling with injuries that were horrendous," said Marleigh Meisner, Child Protective Services spokesperson.

A 19-year-old Midland mother, indicted last year in one of the most violent child abuse cases Midland County investigators said they had ever seen, pleaded guilty Friday for her involvement and was sentenced to the maximum prison term.

Iris Liliana Rodriguez was sentenced to 10 years in the Texas Department of Criminal Justice by Judge John Hyde for a third-degree felony of injury to a child.

August 2011 -

A 19-year-old Midland County man who abused his girlfriend's two toddlers in spring 2010 has pleaded guilty to the crimes and was sentenced to 35 years in prison, officials said Friday.

Joseph Mark Charles was sentenced Thursday before Judge John Hyde for charges of indecency with a child by contact and injury to a child.

Assistant District Attorney Laura Nodolf said Charles must serve half of his time before being eligible for parole and also will serve a lifetime of sex offender requirements.

I know that the little girl's father had come forward, but not sure if she went with him or not.

I agree, but Carmeleyesd is right. If we can sentence a child pornoghapher to to consecutive terms totaling a triple-digit sentence, we should be able to sentence someone who actually raped a child to LWOP.
