Cindy Anthony re-told every detail of when her daughter Casey told her she hadn't seen little Caylee in 31 days. <"Cindy Anthony/ Caylee's grandmother">
"I was in shock,' said Cindy Anthony, Caylee's grandmother I couldn't believe what I was hearing."

Prosecutors wanted the 911 tapes to be used in the trial because it is the first time Caylee was reported missing. They say Cindy Anthony spoke with "excited utterances", which means she didn't have time to make up a story or fabricate what she was saying.

Casey Anthony broke down as her brother Lee Anthony took the stand to talk about what happened that day that led up to the 911 calls." said Linda Drane Burdick, assistant state attorney

Political analyst Will Jay says he's not surprised the judge ruled in the state's favor. "The state certainly is going to use them, and now that they have a pre-trial ruling that they're admissible you can maybe expect to see them in opening statements even," Jay said.

So while the defense team may want the 911 tapes to go away, it appears that they won't.

Lunceford was a career criminal and is under criminal investigation at the prison where she's in for life. Baez claims the prison wrongly recorded their phone conversation so he wants it to be sealed.

&#8220;One of the first lessons the defense learned in this case was there&#8217;s no expectation of privacy in either a correctional facility or a jail,&#8221; WFTV legal analyst Bill Sheaffer said.

But WKMG-Ch. 6&#8217;s Mike DeForest reported that Baez is fighting the call&#8217;s release because he didn&#8217;t know he was being recorded. &#8220;He believes that it would be illegal to release that audio to the public,&#8221; DeForest said.

Then DeForest explained there&#8217;s typically an announcement that a call is being recorded when an inmate speaks to someone.

&#8220;In his motion, Jose Baez points out that the inmate actually called his assistant and the assistant transferred the call to his cell phone,&#8221; DeForest said. &#8220;It&#8217;s unclear whether the prison told the assistant, and the assistant didn&#8217;t tell Jose Baez, or the prison didn&#8217;t notify them at all.&#8221;


WFTV also reported that the Anthony defense team canceled depositions today with three Orange County sheriff&#8217;s investigators and hadn&#8217;t given a reason for the cancellation.

"Inmate Lunceford made several requests to have calls forwarded to persons that are not on her assigned calling list," and the ex-inmate agreed, according to that report.

It could not immediately be confirmed if any of those were the calls forwarded to Baez in May, but if they were, state Corrections spokeswoman Gretl Plessinger said Baez would not have heard the recording identifying the call coming from the prison.

Derkovic, 21, has since been transferred to the Broward Correctional Institution, where she is serving a 30-year sentence for a 2007 second-degree murder conviction out of Orange County.

LMAO how SPECIAL does JB think he is? if he talked to an inmate on a phone, YES IT CAN AND will be recorded. If he was her attorney at the time, that is a different story but I just think that JB is trying to make it look like LE is against him for the ignorant or uninformed people.... this is not rocket science? this is the VERY reason JB won't let Casey call or visit with her family or anyone else and now all of a sudden he don't know the laws? hahahahaha Good one JB I can't wait to hear what is on the tapes.

Well it looks like somebody got caught with their hand in the cookie jar while I was away, as our good friend Jose Baez filed an eight paragraph Motion for Protective Order Regarding a Telephone Recording of Robin Lunceford.

And since I had nothing better to do after a week long vacation, I thought it would be nice to annotate and analyze the eight paragraph motion for my unfaithful readers to help them understand what really transpired between Jose Baez and Robin Lunceford.
