A legal analyst who viewed the documents said it looks like the defense is trying to discredit George Anthony or possibly blame him for his granddaughter's slaying.
Chief Judge Belvin Perry ordered the state to give him a copy of a recorded phone conversation between defense attorney Jose Baez and life prisoner Robin Lunceford in the case against Casey Anthony Tuesday.
Judge Belvin Perry ordered prosecutors on Monday to turn over a disputed recording that was the subject of a new court filing from Casey Anthony's lawyers.
Chief Judge Belvin Perry ordered Tuesday that he be allowed to review the recording privately. The recording between inmate Robin Lunceford and Anthony's attorney, Jose Baez, has not been made public.
Baez told WESH 2, "We're obligated to investigate everything."
"The loss of Caylee and the pain it has caused the family is very relevant to mitigation," Baez said.
"I expected they would investigate George just like any other witness," Conway said. "We've cooperated with the defense and the state attorney's office transparently."
But Kealing said when he asked if the defense is investigating Cindy and Lee Anthony, Baez didn’t answer.
But Jeff Dowdy, an attorney with death penalty experience, told WESH that he questioned the defense’s contention that George Anthony was being investigated just for the mitigation phase. “That just doesn’t make any sense,” Dowdy said.
Instead, Dowdy speculated that the defense will treat George Anthony as a hostile witness because his testimony is valuable to the prosecution.
