Sources: George, Cindy Anthony's Attorney Quitting
Sources Say Move Result Of Defense's Recent Filings

According to sources, Conway's move comes as a result of a new filing by Anthony's defense in their ongoing dispute with Texas Equusearch.

In that filing, Jose Baez, Casey Anthony's attorney, claims Conway was given unrestricted access to review 4,000 pages of volunteer documents while the defense has not been given the same access.

In addition, NBC has sent out an advisory saying Conway will be on the "Today" show later Monday morning with a "major announcement." This begs the question will Conway use this national forum to air some of the ongoing grievances he's had with Anthony's defense team in general, and Jose Baez specifically?

"With regret, I am forced to resign as George and Cindy Anthony's attorney. The defense motion filed on Aug. 9, 2010, contains allegations that are not, in fact, true. As an officer of the court, I cannot stand idly by knowing allegations involving me have been misstated."

Brad Conway told the Orlando Sentinel he resigned

"With regret I am forced to resign as George and Cindy Anthonys attorney," Brad Conway stated in an e-mail.

Conway said a motion filed by Casey Anthony's defense earlier this month contains untrue allegations involving him. And because of that motion, Conway said, he is now a witness to an inaccurate legal pleading filed in court.

"As such, I cannot continue in good conscience as a legal representative," he said. "George and Cindy Anthony have done nothing improper, it is the failure of the defense to verify the facts alleged in their motion that forces my withdrawal."

Attorney Brad Conway announced Monday that he is no longer representing Casey Anthony’s parents because of something Casey’s lawyers did.

Brad Conway said in an email that a motion filed by the defense earlier this month contains untrue allegations involving him. Conway says, because of that motion, he is now a witness to an inaccurate legal pleading in court and cannot continue to represent anyone related to the case.

"I've become a witness now to pleadings that have been misstated," he said. "As an officer of the court, I can't stand by and knowingly participate in something that is false."

In a statement carried by several news organizations, Conway said: "George and Cindy Anthony have done nothing improper, it is the failure of the defense to verify the facts alleged in their motion that forces my withdrawal."

Conway on Monday released the following statement regarding his resignation:

"With regret, I am forced to resign as George and Cindy Anthony's attorney. The defense motion filed on Aug. 9, 2010, contains allegations that are not, in fact, true. As an officer of the court, I cannot stand idly by knowing allegations involving me have been misstated. I am now a witness to an inaccurate legal pleading filed in our court system. As such, I cannot continue in good conscience as a legal representative. George and Cindy Anthony have done nothing improper, it is the failure of the defense to verify the facts alleged in their motion that forces my withdrawal. I will continue to support the Anthonys, will continue to attend hearings and the eventual trial, and most importantly, I will continue to search for the full truth regarding the killing of Caylee Marie Anthony."

Casey Anthony: Brad Conway made his announcement on 'Today' for a reason

The same reason that Casey Anthony's parents appeared on the NBC show on Friday. The show has worked to gain their trust behind the scenes, and the Anthonys will turn to people they feel comfortable with -- not people who will put them on the defensive.

There are bonuses, too, in talking to "Today." By going there, a guest reaches the biggest audience of the morning programs. The show also flies guests to New York for interviews; Ann Curry questioned Conway in the studio.

A closed-door meeting in Judge Belvin Perry’s office followed Brad Conway’s announcement that he would no longer represent George and Cindy Anthony, WESH-Ch. 2 reported at noon today.

In New York this morning, Conway announced his decision to leave on NBC’s “Today.” Conway told NBC’s Ann Curry that he was a witness to false pleadings by the defense over Texas EquuSearch records. Conway said he had to withdraw because the defense had misrepresented his role and actions.

Case highlights Fla. death penalty law

If the murder trial of Casey Anthony ends in a conviction it will bring Florida's "hybrid" death penalty into the case, legal experts say.

In Florida, however, an 11-1 vote for death would be a strong show of support for a death sentence and judges would normally be inclined to rule that way, experts say.

But under the state's "hybrid" system they are not required to, and are free to ignore the jury's penalty decision.

Casey Anthony: Jose Baez complains about Brad Conway ’sideshow’

Conway on NBC’s “Today” this morning alleged that Baez had filed misleading pleadings about Conway’s dealings with Texas EquuSearch. Conway cited that reason in announcing he was withdrawing from representing George and Cindy Anthony, the parents of Casey Anthony.

Yet WESH-Ch. 2’s Bob Kealing reported that defense attorney Cheney Mason said Casey Anthony’s team and EquuSearch had reached a settlement over reviewing the volunteer group’s records. “The issues that Brad Conway brought up are moot in his [Mason's] words,” Kealing reported.

"The Anthonys conveyed that issue to me," said defense attorney Jose Baez.

Mason and Baez said they had been denied the full access to records that was given to Conway until Monday morning when Judge Belvin Perry Jr. called a meeting that finally settled the issue.

"The defense will be allowed full inspection of all TES documents," said defense attorney Cheney Mason.

The defense says the documents could prove Caylee's body was dumped at the crime scene after Casey was arrested.

The judge in the Casey Anthony murder case summoned attorneys to his chambers this morning and -- in secret -- hashed out an agreement on how the defense can review records of volunteers who searched for her daughter's body back in the summer of 2008.

Details of the agreement will not be public until Judge Belvin Perry issues an order.
