Peterson is due in court at 10:30am.
I wonder if anything will get accomplished.
I didn't think it was worth the long drive just to hear that the date has been extended again.:banghead:

At a hearing Monday before Judge Schoenstedt, Peterson's attorneys called three witnesses from the Bolingbrook Police Department.

One witness, Bolingbrook police Sgt. Jeff Drabek, said he and Peterson had both been members of the REACT SWAT team, which had been authorized to carry military-style automatic weapons such as the AR-15. He also said because the Bolingbrook Police Department did not have enough of the weapons in its arsenal to accommodate the whole REACT team, the officers were permitted to buy their own weapons.

Prosecutors contend that the federal exemption on weapons has to do with police officers being allowed to carry concealed firearms while off duty, not with modified military-style weapons such as the one Peterson had.

In a separate motion, the defense is also mounting a Second Amendment argument against the gun charges. The state statute that bans automatic weapons with barrels under a certain length is being challenged on claims that it violates the right to bear arms, following the McDonald v. Chicago ruling in the U.S. Supreme Court that forced the City of Chicago to toss its handgun ban.

Is this a law we really want to overturn. That opens the door for fully automatic assault weapons, hand grenades, etc.

They were his favorites, and he didn't want anything to happen to them," Stephen Peterson testified, saying his father put the weapons in an upstairs bedroom. Stephen Peterson's wife, Teresa, a Housing and Urban Development special agent, also testified that she saw Drew Peterson carry two bags into the house.

The Tribune reported in 2007 that Drew Peterson also transferred a large amount of money — "a couple hundred grand," according to defense attorney Joel Brodsky — to his son shortly after Stacy Peterson's disappearance.

Bolingbrook Police Chief Kevin McCarthy testified that Peterson was never given permission to modify his personal weapon, though some paperwork related to that weapon was missing. Peterson's former partner Alex Morelli testified that a number of officers had changed their gun barrels "to make them more efficient" with the police chief's permission.

Closing arguments are scheduled for Sept. 7.

Galesburg, IL – Police investigators and dive teams spent much of Monday in a Knox County lake, following up on a tip in the disappearance of Stacy Peterson.

”This is part of the Stacy Peterson investigation”, confirmed Illinois State Police spokesman Tom Burek.” We’re looking for evidence to follow up on a lead’.”

Several divers searched a stretch of shoreline in Lake Storey near Galesburg Monday. The small lake is just off Route 150. Burek says the search was connected to a previous one in Peoria back in June, and Lake Storey on August 3rd.

Peterson's attorneys are expected to argue for dismissal of the charges on the basis of Peterson's immunity as a police officer at the time of the offense.

The status hearing in the murder case was very short, with the Judge noting that the appellate court has accepted the case, and now everyone will just wait.

The defense has renewed their motion to release Peterson pending the appeal. That motion first brought before the trial judge, has been renewed with the appellate court. The defense continues to wait for a ruling. The court will rule on the record.

Brodsky told In Session’s Jean Casarez, that if their motion to dismiss is not granted, this case will go to trial most likely before the end of the year.

After Stephen Peterson testified, Bolingbrook police Sgt. Jeff Drabek was shown a photograph from the true-crime book "Fatal Vows: The Tragic Wives of Sgt. Drew Peterson." The picture showed Stacy Peterson wearing nothing but a sport coat and her sister, Cassandra Cales, toting an AR-15 while dressed in Drew Peterson's SWAT gear.

The rifle Cales was pictured holding has a different barrel than the one Stephen Peterson surrendered to Hardy, Drabek said. Swapping the barrel out for a shorter one is a simple procedure and can be done in a matter of minutes. But while it may be quick and easy, it is not legal.

Chief McCarthy testified that Peterson was not granted permission to modify the rifle, and in fact never asked to do so.

McCarthy also said shortening the barrel is forbidden by state law and that his officers are "responsible for knowing state statute, understanding state statute and obeying state stature, just like everybody else."
 
I spent the evening organizing the Stacy-Drew-Kathleen huge case archive album into manageable smaller sections. Now they all have working "view all" at the page bottoms. And the main album has lots more room for expanding.
It all still needs a bit of tweaking, but not too much.
