Washington man caught Amtrak in hopes of having sex with two boys in Portland

"A Shoreline, Wash., man named James E. Eggleston was trolling a back-channel Internet site in 2008 when he came across what purported to be a fellow pedophile in Portland.

The two men planned for Eggleston to come to Portland so they could both molest the man's sons, ages 3 and 5. Eggleston caught the Amtrak and checked into a Quality Inn. He brought candy, coloring books and an assortment of sex toys.

On March 14, 2008, Eggleston was arrested at the inn...."

What this man did is reprehensible and disgusting. I do not buy into the argument that he should be lightly punished as their was no "real" child waiting at the hotel. It was a sting. However, I'm having a real difficult time with the discrepancy of this sentence and the one covered below.

In Eggleston's 2008 arrest, he travelled 209 miles south to Portland to have sex with boys under the guise of a sting. In the case below, Rasmussen traveled 300 miles north to a suburb of Portland in 2008 to have sex with little girls also under the guise of a sting. Both carried sex toys and "supplies".

Both pleaded guilty. Why did one man get 60 days (he was released early too) and one get 16 years? Is it strictly because of the crossing of state lines? And why the tremendously long wait between arrest and sentence for Eggleston? Rasmussen has long since served his time and been released.

"A Clackamas County [OR] judge sentenced a Medford travel agency owner and civic leader today to 60 days in jail and ordered him to enter a treatment program for sex offenders.

Kelly Ray Rasmussen, 48, also was sentenced to five years of probation and must have no unauthorized contact with minors.

Rasmussen pleaded guilty in February to online sexual corruption of a child. He was arrested last fall [Oct. 2008] after setting up a meeting in Clackamas County with a fictitious 13-year-old girl. Prior to that, he had tried to arrange a meeting with an 11-year-old girl. In both cases, a police officer pretended to be the girl......"

Have you noticed Miss Izzy any trends in terms of the sex of the potential victims? Like if the victims are male does a male perp get more time than if the victims were female? Time & time again we horrific stories from different states(& countries)with wildly different sentences.
I really do pray that one day ANY crime against a child was a federal one & there were very harsh & CONSISTENT charges & sentences!!!!!
 
When it comes to really young children, I do think we see longer sentences even though the laws aren't always specific. In these two cases, the one man got 60 days for trying to meet up with who he thought was an 11 year old and a 13 year old girl.

In the case of Eggleston, who got 16 years, he was trying to meet up with little boys, 3 and 5. That could be one of the reasons that the sentence was longer. The legal reason I think it was so much longer, though, is the state line issue. If they are going to do stings and want to give people really long sentences, why not entice them over the border? Rasmussen most assuredly would have traveled another 10 miles, over the bridge into Washington.

I actually think that the distance traveled is a component which should be figured in--length of time to consider your actions. There's a law called the Mann Act which was originally intended for crimes of white slavery. It's not always used but could be, far more often. Several notable people have been charged under it--Jack Johnson, the famous boxer ("The Great White Hope" film), Frank Lloyd Wright and Charlie Chaplin. It has to do with transporting a person over a state line (not necessarily a minor) with the intent to sexually exploit. It does not cover a person traveling to another state to exploit, however.

The UK has far more specific levels or tiers of abuses as related to child abuse and child *advertiser censored*. I'm not so sure, though, that it has had a better outcome of our less specific system. And each US state has different laws.

Slightly O/T but I've always told my children that they'd better know the laws pertaining to sexuality in every single state and country they visit. I've long felt that these issues should be discussed far more often at the middle school and high school level. Most teens don't even know the age of consent or the penalties attached in their own state. American kids travel more and more. Do they know the age of consent in places they travel? Doubtful. An 18 year old traveling to another state might be fine having sex with a 16 year old in some states but might find themselves in jail in others. We post speed limits, littering laws and penalties, alerts about child safety seats and the use of seatbelts on the side of roads, why not criminal penalties for other crimes? They should be posted in public restrooms and should flash on your computer screen every time you open it, IMO.
 
I have no words to even share on this story. People are just sick. The abuser's should receive long term sentences when any child is thought to be sexually abused. These people are given a cake walk. IMO. I think the crimes won't stop till we have toughter laws and sentencing. It does not matter to me one bit that it was sting. The man was involved. This scene is like one out of, "To Catch a Predator" and they are set up too. It is the crime that is about to be undertaken that should be taken into consideration. This is a way to prevent more child, sexual abuse in the future. I believe it is a good method of catching these predators.

Goz--ITA. I'm just perplexed as to the vastly different sentences. Clackamas County (where Rasmussen was sentenced) is adjacent to Multnomah County (where Eggleston was sentenced). My guess is that they were arrested only a few miles from one another. The crimes seem equally depraved. Both were stings--no real child was involved. Neither man had a criminal record. The arrests occurred within the same year, 2008. Both pleaded guilty. Both are middle-aged, employed white men. But only Eggleston crossed a state line--the bridge over the Columbia River.

I'm trying to figure out what caused this disparity. Was it the caliber of the attorney? Rasmussen had a high dollar specialist in the field, Lisa Maxfield. I'm not certain about Eggleston's attorney, Lisa Hay. Was it the gender, the age of the purported child? The judge? There was no jury as both men pleaded guilty. I'm just curious. Eggleston got more time than many adults who actually do sexually abuse a child. I can't wrap my mind around that just yet. Rasmussen hardly got a flick on the wrist.

On a side note, while checking a detail on this case, I just noticed that it shows up on the "boychat" site. Good. Hope those fellows pay attention.

Surely on appeal, this will be questioned unless a child victim comes forward, as he could be said to have been bragging. There was also the issue of him sending some child *advertiser censored* to the undercover officer. IIRC, nothing like this came up for Rasmussen. And I'm sure they asked him online if he'd done it before. Other details are in this article. It just fries me that there's even a chatroom called "#baby&toddlerlove".

I love babies and toddlers and I could talk all day about their cuteness. I also adore your preteen girls in all their silliness. These men sully what most of us find so pure and dear.
