WA - Mark Studenny to get his dental license back after child porn conviction

    http://www.seattlepi.com/local/42725...tml?source=rss

Dentist convicted on child porn charge can get license back

"A dentist stripped of his license after being convicted of possessing child pornography will be able to get his license back, according to a recent Department of Health order.

In 2006, Mark Studenny was convicted of one count of possessing child pornography in a federal court in Texas. A former Air Force captain with a Renton address, Studenny was caught with 13 child pornographic movies and 576 images of child pornography or child erotica on his computer, according to Texas court records. In 2007, Studenny lost his dental licenses in Texas and Washington.

    and

"This guy had 500 images of child pornography on his computer. He was convicted for that. It's reason enough to pull his license," said Quarnstrom, a Seattle dentist who has since left the commission.

"Now it's been undone. So how are the citizens of the state protected? The point is, not very well."

Prosecutors said Studenny was part of a suspected child porn sharing network, and had admitted to viewing child pornography for more than three years, according to court documents...."

To me, it sounds as if the commission didn't want to fight. I guess that's why the one dentist who was on the commission and whom I quoted, is no longer on the commission. It appears that the state would rather put children at risk than fight a man in court over his right to practice dentistry.

I could have seen them giving him some sort of provisional license to work only doing charity dentistry (as there's such a huge need) with adults WITH A CHAPERONE. That way, his skills wouldn't be wasted but no child would be in danger. But, instead, it sounds as if he's "good to go".

    I'm not getting it.

"Good to go" is right, Izzy.

Watch him be one of those Dentists that insists on seeing the kids without their parents present because we all know parents project their fear of Dentist's on to their children.

Oh yeah and he'll start a Brushyland typle of setting. Carousel, video games. No doubt give kids a present after their check-up. I know he's not a Pediatric Dentists but he's a bloomin pervert.

    Never ends.

    Oh my biggest pet peeve!!!
We had to find a new dentist down here (where we don't have alot of Pediatric dentists to begin with as well dentists who take insurance of any kind)& I cannot tell you how many have the "no parents"policy!!Some even want you to sign an agreement! WTF!
I have always liked going to the Dentist so my kids have no weird dental fears(& if they did wouldnt it make even MORE sense for Mommy to be right there??)
I do not care how 'open' the exam areas are(& in all fairness the majority are all open )my kids aren't going back alone.Hell no!
I quietly sit in a corner & read a book how is that disruptive? It's not!

We (thankfully)found a dentist who not only insists parents come back in his a totally open exam room(they knocked down the walls and everything is seperated by 'pony walls') BUT he has cameras with visable moniters.
Why cameras?Well his brother was also a dentist who got caught molesting patients (& then killed himself after losing his license) so our Dentist is protecting everybody.
Sad it has to be that way but it makes me feel better.

How can we ever hope to win the battle against child pornography if we continue to give slap-on-the-wrist punishment to offenders? Less than two years in jail and now he's allowed to practice dentistry again. Would his license be reinstated if he were convicted of sexually abusing a child, because I don't see much difference.
"He exhibits no sexual interest towards children of any age and is considered to be at low risk to sexually offend a child," Studenny's therapist is quoted as saying in the document.
Seriously? Well, he was interested enough to accumulate 576 images over three years. That doesn't exactly spell indifference in my book. Further, an individual who derives pleasure from observing a child being sexually abused is a mere hair away from being a physical abuser himself. The case of Alan Paul Streiper is one in recent memory where a penchant for internet child pornography led to a plot to abduct a child. Thankfully, in that case, Streiper plotted with an undercover LE agent. But how many other Streipers are out there, including this [ahem] disinterested dentist?

Please note that I am speaking here concerning the appropriateness of parents in the dental office and NOT of the right of a pedophile to practice dentistry. I believe that there is a legitimate reason that some offices have policies excluding parents from the exam rooms. Some policies fly for me and some don't. And obviously a pedophile doctor/dentist is going to take advantage of those policies. Most dentists will encourage a parent to be present for a cleaning or simple exam. However, if a child is freaky or in horrible pain, parents are frequently ushered out. Should we leave? That's up to the parent and dependent on the situation.

There was an exposť a year or so ago about children's dental care as provided under Medicaid. I've seen short clips of the disturbing things done to children while out of their parents sight--the strapping down, rough treatment, etc. I don't know if it's the norm or not. I've ridden in the back of ambulances enough times to know, though, that not all medical treatment is gentle. I think that these types of things are the reason that some procedures are done without a parent present unless that parent shows an ability to deal with very traumatic scenes.

I know this is the express reason that my beloved vet will take one of my dogs "in the back" to do a test. The dog is muzzled and forcibly held down as they struggle and cry. Most pet owners don't want to see that and vets respect that. I've been doing dog rescue for so long that I now (or could before I got sick) handle any sort of treatment so I went in the back with the vet.

I've been parenting sick children long enough to be invited to help with procedures--even as the child screamed in pain or fear. It's one thing to have a seven year old crying that they don't like the dentist drilling on their tooth. A parent who is present and calm can quiet a child. It's quite another issue to have to help place restraints on a raging, kicking, screaming 12 year old and be instructed as to how to give him his fifth enema of the day. Some parents can and some can't handle it. It's up to the parent to know their limits.

Our three sons were all circumcised but my husband was only present at the last circumcision. Needless to say, our grandsons are not circumcised as it was so disturbing. I've observed two of my children having C-sections and been present for all sorts of invasive medical treatments. I've helped with suturing. But not all parents can stomach these sorts of these things nor can they handle it when their child screams in pain and begs for the parent to stop the pain. I think this is why sometimes, it is necessary for a parent to not be present. However, that's what fully background checked and thoroughly supervised chaperones are for. JMO

    Just not acceptable!

I don't care for what reason they gave him his license back. (snip of article below) He does not get a second chance. He did not say "Screw Up", he is out. He is a pedophile. What is wrong with our world that we just cave in on issues like this? Just pull the man's license and keep it. He does not deserve his right to practice anymore or for that matter, be around children. Not a hard decision. Geez...

The (Dental) Commission ... determined that no other remedy other than indefinite suspension would adequately shield the public from further exploitation."

But months after being suspended in Washington, Studenny sued the state, saying he was denied due process. A King County judge sided with him and vacated the suspension order in March of 2009. That put the case back in front of the state's Dental Quality Assurance Commission.

Last month, the state Department of Health said Studenny, 34, can get his license back, with restrictions. He must pass a dental board exam, refrain from taking any part in the treatment of minors, and comply with his 30-year criminal probation. He also can't own a dental practice for three years.

    Oh here we go again:
    Snip
The brief also said Studenny had a bipolar disorder that caused him stress, which led to pornography and alcohol use. It said he was on medication and in Alcoholics Anonymous.

More excuses. This guy is scum and I can't believe they gave him his license back after reading the article. This is plain sick.

What a slap in the face for all those with bipolar and/or substance addictions who keep their hands off children and do NOT look at child pornography which promotes child abuse. Every human being has stressors. Thankfully not all use those stressors as an excuse to commit nasty crimes. Shame.

He has to wait three years (gee, that's a really long time) to own a dental practice. Is there going to be a sign on the door identifying the practice as belonging to a convicted child porn collector and which alerts parents that no children are permitted on the premises?
