After a brief recess, Kaine Horman's attorney - Laura Rackner - argued that the divorce should proceed without abatement.

"If this case goes to trial now, a year from now, or two years from now it will get just as much publicity," said Rackner.

Horman Divorce Case Delayed Until 2011

Attorney Peter Bunch said Terri Horman is no doubt the focus of the criminal investigation into Kyron’s disappearance. He said any testimony or questions about finances that will come up during the divorce proceedings may be used against her by investigators.<snipped>

Terri's attorney wanted the divorce abated, so she wouldn't incriminate herself in any ongoing criminal investigation, her attorneys argued.

Kaine, through his lawyer Laura Rackner, wanted the issue to move forward in a routine way.

Judge Keith Meisenheimer ruled that divorce proceedings will be held until Jan. 6 of 2011.

"Eventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings," Meisenheimer reasoned.

In the mean time, Peter Bunch, Terri's divorce lawyer, said he will petition to modify the custody of the estranged couple's young child, Baby K. <snipped>

Judge delays Terri and Kaine Horman's divorce case until January, agrees Terri faces 'substantial legal risk'

Kaine Horman said after the judge's ruling that he was fine with the brief delay.

"Hey that's 90 days, 3 months from now, " he said, speaking outside the courthouse's front doors.

He said it didn't upset him to see his wife in person for the first time since he left their house June 26. He said he stayed focused on his daughter and his family during the hearing. He declined to comment on whether he would want Terri Horman to be allowed any parenting time with Kiara.

During the hearing, Bunch corrected Rackner, who suggested that Terri Horman's son J was living with his father. No, Bunch said flatly, J is living with his mother.

Over 160 searchers combed parts of the island Oct. 2 and 3, and will be back on Oct. 9 and 10 to search for the missing boy.

One source told KOIN Local 6 that searchers were in the area following up on cell phone pings from the area.

That source said those pings were linked to Terri Horman's cell phone back on June 4th, the day Kyron was last seen.

On Saturday the searchers, directed by the Multnomah County Sheriff's Office, combed the east side of the island – working through the pouring rain to look for clues.

"The message is, again, if someone out there has information about Kyron and his disappearance, we would like you to come forward so we can resolve this investigation and bring Kyron home."
