KALISPELL - A convicted sex offender pleaded not guilty to a pair of felony charges Wednesday in Flathead County District Court. Jason Franks is now accused of molesting a 5-year old Kalispell boy.

The 41-year old was arrested in Missoula on December 2nd after failing to register as a sex offender. That same day, prosecutors in Flathead County charged him with felony sexual assault and sexual intercourse without consent, after a Kalispell Police Department investigation alleged he had sexual contact with his girlfriends son beginning in 2009.

Franks faces a maximum of 100 years in prison for sexual assault and 100 years in prison for sexual intercourse without consent.

Wonder if mom knew he was a RSO. I would think as a single mother (or father too) I would look online or go to the local law enforcement office) to see if my new partner was a RSO before exposing this person to my child.

Yes the mom knew he was an RSO.

There were several instances that mom waited on reporting. One in which she heard her her little boy yelling from a public restroom. Door locked. Mom had them unlock the door. RSO naked having sexual conduct with her child, BUT she didn't think it was what it looked like.

Alrightie then. Do we arrest her?

On April 13, the mother reported an incident on March 15 in which her 7-year-old son accused Franks of having sexual contact with his younger brother while she was at work.

MINE: who did she report it to and what sort of investigation was done?

On Oct. 28, a Kalispell detective interviewed the older brother, who said Franks frequently molested the 5-year-old when their mother was away.

MINE: Was this the investigation that finally got this man arrested and if so why more than a month til charges were filed?

Subsequent investigation revealed that the 5-year-old had told a counselor about the alleged abuse.

MINE: The five year old told a counselor about the abuse when?? What action was taken then?? This reads as if during this investigation it was discovered that the child reported to a mandated reporter previously?? Is it just the way I am reading it or have a lot of people let this little guy down??

Jason Dean Franks, 42, cried and smiled in an outpouring of emotion as a jury pronounced him not guilty of charges of sexual intercourse without consent and sexual assault after having been accused of molesting a 5-year-old boy between Aug. 1, 2006, and Dec. 31, 2006...

[Defence lawyer Bennett] argued that the case should have been dropped when the initial forensic interviews came back negative, and that the therapy process the boys went through was “insufficient and scientifically unsound to corroborate these charges.” Bennett also said the forensic interviews that took place afterward were completed improperly...

According to Bennett, cases involving alleged sexual abuse of children are always difficult to defend because people are always going to believe that the alleged crimes happened.

“People in their hearts don’t want to believe that a child might not be truthful about something like this, and so deep down they have this feeling that this must have happened and they don’t understand that that’s not true,” Bennett said.

Franks, who was previously convicted of sexual assault in 1992, was acquitted in the molestation case involving the 5-year-old. He was charged in 2011 with sexual intercourse without consent and sexual assault in the case of the 11-year-old girl.

November 2012:

A man previously convicted of raping a 12-year-old girl in 1992 has again been convicted of rape, this time of an 11-year-old girl in 2006.

In addition to the guilty verdicts on both charges, the jury also found that the victim was under the age of 16 and Franks more than three years her senior at the time of the crime. That ruling increases the possible penalty Franks now faces — between four years and two life terms in prison and a fine of up to $100,000.

October 2014:

The Montana Supreme Court has reversed the 2012 conviction of a Kalispell man found guilty of raping an 11-year-old girl and ordered a new trial...


The girl told her father in 2010 that Franks, his former roommate, raped her four years earlier. The girl told police she came forward after all that time after reading a newspaper story in which Franks was accused of molesting a 5-year-old boy and she wanted to help in that case...

Stadler ruled that prosecutors could reference the other charge in trial only as the reason for the girl waiting to make her allegations. Prosecutors did abide by those limitations, however, McGrath wrote.

A prosecutor said in his opening statement at the trial that Franks was “accused of raping a little boy.” After Franks testified that he had been acquitted of those charges, the prosecutor asked him if he heard his attorney say “that not guilty doesn’t mean innocent.”
