    ME - Teacher cleared of child porn charges/disturbing interpretation of law

    And just because the defense attorney says it, it's true? Does this decision really reflect the laws of the state of Maine? I guess the judge and jury agreed. Because I don't know all the facts, I surely can't pass judgement but I think may judges would take issue with this attorney's defense.

    If Mr. Douglas is not guilty, he's not guilty and his name needs to be cleared but this sure seems curious to me. I wonder if the state will appeal?

    Maine teacher cleared of child porn charges

    "A jury in Maine has cleared a former junior high school teacher of charges of possessing child pornography on his school-issued laptop computer. A Sagadahoc County jury deliberated two hours Tuesday before finding 43-year-old Michael J. Douglas not guilty..."

    "...Douglas, of Augusta, was formerly a science teacher at Mount View Junior high School in Thorndike. He resigned in April 2009.

    According to the Kennebec Journal, defense attorney Walter McKee told jurors that Douglas viewed child pornography but did not possess it. He said when someone goes on the Internet and looks at an image, it isn't the same as possessing it.

    So who knew that anyone can simply look at child porn in Maine and not be in possession of it? And how many men and women are sitting in state and federal prisons due to just "looking"?

    It sure seems that Mr. Douglas has hired some might fine attorneys. He's skating on the edge with those behaviors. Talk about a "ropes" course!!

    If the porn was never made in the first place, no child would have been harmed.....what difference does it make if a perp chose own a copy?? The child is just as damaged either way.

    I don't think there is any difference between viewing and owning child porn; Just different levels of perviness, IMO. Producing it is a horse of a different color though. None of it is innocent. Every single act damages a child in my opinion. If a person views child pornography they harmed that child because they created a market for someone to make money from it.....

    Thank you, impatientredhead. I guess the story's not over.

    The reason this story bothered me so much is that many men and women have used the argument that they were "just looking". That hasn't flown with hundreds of juries. If you look, it's often considered possession. I'm trying not to judge. I'm just very curious as to how a jury will look at this.

    Note that Douglas says this in the link above:

    "In an affidavit filed with the court by Maine State Police Trooper Corey A. Smith, Douglas admits he accessed child pornography for years via the Internet on both his school-issued laptop and his home computer...."

    Accessed, viewed, possessed, traded......it all feeds the industry of exploiting and abusing children, IMO.
