The owner of a Tennessee court reporting service said Baez and his co-counsel, Cheney Mason, lied to Chief Judge Belvin Perry, saying that he raised his rates on them after the fact. He wrote a letter to the judge and included email exchanges to prove his point.

The defense team's failure to cut a deal in writing for court transcripts cost taxpayers $800 more than it should have, on top of the tens of thousands taxpayers have already paid for Casey's defense, after her lawyers blew through almost $300,000.

The defense is arguing that the evidence is unreliable. But Ashton's motion says the defense argument "contains only conclusory statements of counsel and no authorities suggesting that the procedure is not generally accepted."

Ashton goes on to say the defense motion is "glaringly insufficient" while saying that the test instruments used to detect chloroform in this case are known and the techniques "routinely accepted as evidence in courts throughout the state."

"If there's any moral to the story, get it in writing," said Orlando criminal defense attorney Richard Hornsby, who is not affiliated with the case.

Anthony defense attorney Jose Baez did not return a request for comment on Tuesday.
