Police say an Albany man confessed that he repeatedly beat his girlfriend's 19-month old daughter. That little girl died. Now, That man and the toddler's mother are charged with murder!

28-year old Gregory Evans didn't speak as he was led away in handcuffs to the Dougherty County jail Tuesday night, but he did speak to investigators and admitted beating little Janaysia Stevenson on at least three different occasions.

Edwards says there's no justification for Stevenson to allow her little girl to suffer without reaching out for help. He said, "We cannot condone it. We can't accept it, we can't live with that and allow those things to happen and if nothing else if the prosecution spurs people to take action, then that's what we hope to achieve. If you're going to sit there and let it happen, you're going to do down with it. If you're afraid of something, you should be afraid of being prosecuted."

Exactly, how can a "mother" be afraid of her life and just sit there and watch? HOW ABOUT BEING AFRAID FOR YOU'RE CHILD'S LIFE??? How about that??

2012 - Glenda Brown, director of the Springs Little Citizens Learning Academy on Radium Spring Road, pleads guilty to not reporting abuse.

Brown was given a pre-trial diversion sentence, and must pay a $300 fine. Prosecutors plan to seek the death penalty against Gregory Evans for the toddler's beating death. The mother, Chaitia Stevenson, is also charged with murder for not protecting her child.

Prosecutors hope the death penalty trial can be held next year. "We are trying to schedule all of the hearings that are related to pre-trial motions so that we can get them done by the end of this calendar year," said Greg Edwards. Dougherty D. A.

His defense team, the Capital Defenders, argued that the Grand Jury that indicted Evans did not meet constitutionally mandated diversity standards.

One expert testified why he believes the Grand Jury was not a fair cross section of the community.

But the judge and prosecutors said there was confusion over the numbers used to reach that conclusion.

Evans has been locked up since 2011 with more than 100 motions filed since then. He's an example of how slowly the wheels of justice turn in a death penalty trial.

"The process that's outlined requires the court take steps to make sure every potential issue and right of the defendant is recognized and addressed by the pre-trial motions so everything that can be considered is considered before we get to the trial," explained Edwards.
