This is the first in a series of articles in which we will look into the July 29, 2002 unsolved shooting death of Nichole “Nikki” Lynn LaDue January in Pass Christian, MS not far from Biloxi.

Nikki had moved there from New York with her first husband Mike and little boy. They were going to start a new life and looked for employment on the gulf coast where the casinos were just beginning to boom.

Nikki was always smiling, a vivacious loving young mother. The night of July 28, 2002 Nikki was on the balcony on the phone, her young son was just inside. They were all packed and ready to move the next day. Nikki was going home, she knew it was best for her son. He was her whole world. She would never leave him, she was his protector.

Her mother Bonnie LaDue has made it her mission in life to uncover whatever it was that was in secret and uncover the lies that were told. She wants to learn the real truth not only for family but to help others.

Nikki’s case was unusual and she believed someone would jump on that and do something about it. Instead 9 years has gone by, with no investigation, and no arrests.

Bonnie had to deal with the State of Mississippi from Florida. She felt like her arm was tied behind her back, being 12 hours away from the scene of the crime. She couldn’t get in front of the local officials and get answers she needed.

Since Nikki was killed in 2002 Bonnie has made 5 trips back to Pass Christian, MS. It’s not been easy. Much of what she does has to be done over the phone, through the mail or email. It’s frustrating because they can so easily ignore you, an they do.

Bonnie is proactive on Nikki’s case and is thankful for the internet organizations “RealCrimes” in 2005, JC Berry's "When Justice Fails" in 2009. and “CrimeWire” in 2011.

Somehow she finds the strength and keeps going. She says, “You just put one foot in front of the other and keep going.”

Due to Katrina many of her Mississippi friends lost photos and videos of Nikki. Bonne begged please send me anything. She has so little left of her Nikki.

There are some written memories from friends kept in a suitcase. Some from her childhood, some from her teenage years - through adulthood. Nikki was loved by many. She was a beautiful baby, always smiling. All the mom’s would ooh and ahh over her, she was the personality kid.

She is Nikki’s Mom forever and will be her protector forever. This has gnawed at me and I can not get it out of my mind. It never leaves her, her great love for Nikki and her desire to know the truth.

Bonnie is just a smalltime girl and Nikki’s death has changed her into someone who now searches for the truth. It’s important to find murderers, because they’ll murder again. “Anyone close to Nikki who knew and loved her, they and I don’t believe it was a suicide.” Bonnie said, “If you don’t believe it was a suicide then you have to say it was a murder. It certainly wasn’t an accident. I should just let a murderer walk? A murder of my child? “NO!”

Nikki was the best Mom. They were best friends, they loved to cuddle, she wanted him by her side all the time. She was so in love with her son, her only child. They had been through a lot with the breakup of her first marriage. Nikki never would have left him alone and shot herself with him on the other side of the wall.

Nikki and her Mom talked on the phone all the time. She didn’t share the problems in her new marriage with her mom. She found out about them later after Nikki’s death from her friends. The last time Bonnie spoke to Nikki they were both looking forward to her coming home. She was planning on leaving her alleged controlling husband.

Nikki was very smart and was going to protect her son. She was on her way home the next day. Her parents hadn’t seen her in 8 months and instead they get the call.

Had Nikki found out something? Maybe something about who she was really married to? Marriage is a serious thing. Nikki had romance in her soul and was a trusting “You look like an honest person, you are one aren’t you?” Phil was in charge of security at the Grand Casino. They were married not long after they began dating. Just for 2 years.

According to friends Nikki changed after marrying Phil, “He had her on a short leash.” They met at the Grand Biloxi and he lost his job just prior to Nikki’s death. He wanted them to move and NIkki didn’t like the idea.

Phil is who found Nikki dead on her balcony, he moved the blood covered phone from her hand. He lead Nikki’s family to believe Nikki had O.D. Just 1 hour after the “911 call” Phil allegedly calls Nikki’s Dad “I have bad news Nikki committed suicide.” Funny you’d think someone who claimed he was a SWAT police officer would know better than to disturb evidence and rush to judgement. Why mislead?

How does one commit it by gunshot to the head.

Or how does one, have a phone in there hand, commit suicide

If she was on the phone on the balcony, and was shot while she was on the phone, that would have been known. But even then the phone would not had her prints in blood on it. and would-not had been found resting on the table face up?


I also believe she was murdered.
If this happened a week ago.
I would feel uncomfortable posting in public.

But since it was almost 9 years ago
not so much.

My biggest question i have, that i have not found so far
is the other brand of cigarettes that were there.

Was it ever determined whom in her inner cicle.
Or anyone she knew for that matter or the family.
Whom smoked that brand?

And all those phones calls that was placed to her that night.
She had to go.

I wonder how many of those were placed around the time she was killed.

From what i have that you have posted.
It seems there were two there that night on the balcony.
At some point she was shot. The killer either made a call, or accepted a call with the bloody hand. If the sliding door was shut. If there was, i am assuming. Then she didn't shut it. The killer did after leaving. So the child could not get out there. Or the phone got knocked off and the killer put it back, to make sure there appeared to be no struggle at the scene. So it would appear she committed Suicide.

They chose the suicide plan, in stead of robbery murder.
Because by ransacking the condo. That would have led to a more
thorough investigation.
But with the sloppy suicide re enactment.
They either knew in advance, or at least was pretty confident to begin with.
That a suicide plan would not be investigated any further.

And until you post more.
I suspect she was set up that night.
She had to go!
And all the phone calls place that night.
Was that to create some alibi that the time she was killed.
I was placing calls. Even if those calls were blocked i believe i read.

Remember Part one was 9 years - no investigation - no arrests.

This is second of a series of articles where we look at the mysterious death of Nikki LaDue January. Now we look at the day before and after her shooting death. Remember I told you this story will pin you're ears back. Well just you wait. There's more...

Nikki had been staying with Grand friend Nancy Burge for a few days before their trip to visit Nikki’s parents. Nikki and her little boy hadn’t seen her parents in 8 months. They were all excited about the visit.

Nancy was one friend Phil approved of. Phil later stated Nancy was a lesbian. Maybe he found her less threatening as a friend? Phil called Nancy at 10:30 pm the night of the shooting, stating he couldn’t find Nikki. When Nancy got home she noticed Nikki’s car was not there. She felt something was wrong and told her son she was going to go check on Nikki. But returned saying she had changed her mind after a few blocks.

Instead she would go there the next morning, not at the scheduled 8am as planned, but at approximately 9:30am. It was reported she was let into the condo by the 5 yr old son. Nancy aledgedly says the little boy tells her Mommy is still sleeping. But Nancy can’t find her. Phil suddenly appears on the scene Nancy asks him, “What’s going on here? Where’s NIkki? “I can’t find heri” Phil allegedly responds ridiculous and goes directly to the ajar balcony door and finds Nikki.

Nancy removes the little boy from the Condo. She allegedly says, "Son take him out of here." which son? Her son or Phil's son? We're not even sure who all was there and when.

She then calls 911. She says “He came in tonight, the girl was suppose to move today.” Dispatcher: “Who’s in the apartment” Nancy, “The husband is right now.” (See transcription)

Why would the 5 yr. old son say mommy was still sleeping? Someone tell him that? Is it that easy for a 5 yr. old to open a locked door? Why wasn’t he questioned?

Why the rush to judgement by the police? Her death certificate was signed only 2 hours later, indicating suicide. Why no investigation? Phil was supposedly an ex police officer, here was the love of his life, why no request for an investigation until much later? Phil later write a letter telling police he doesn’t think his wife committed suicide. He also admits he tampered with the evidence. Removing the bloody phone he found in her hand.

Phil also tells a tale of true love, not trouble in his relationship. There was a typed letter from computer saying she was sorry for using drugs. But we’ll never know who wrote that letter or when because supposedly Phil (w/sons help) wiped the hard drive clean. Why?

Changing husbands
Nikki had let it slip to a few close friends it was more than just a quick visit her then husband thought. Nikki was calling it quits. Time to stop changing husbands, she had only been married to Phil for a few years and Mike before that. Nikki had seen the light, she had enough and was going to make a change for good this time. She was protecting her son, her shining light he was the one good thing that had come from being married.

While Nikki had spent the last week packing up. Phil had gone on a head to Shreveport, LA where he gotten a job at Boomtown Casino. Things hadn’t gone well at the Grand for Phil. Rumors are Mr. January and a female patron of the Grand, had a problem in a holding cell, something maybe violent and sexual? Also according to undisclosed sources Mr January had been falsifying payroll records. So he was fired.

Friends allegedly claim Phil would make Nikki cry, he threatened her, held the mail key, left her post-it notes in the condo calling her a piece of **** and a *advertiser censored*. They had a fight the night of her death. Nikki told friends she was scared of phil’s bad temper. Phil was extremely controlling of Nikki watching her every move.

The night Nikki was shot was the night before she was to make her escape. Freedom was so close she could feel it and she wanted to celebrate by saying goodbye to old friends. She dropped her son off at a sitter around noon, she picked him up around 11pm. The sitter said Nikki seemed fine they even chatted for 20 mins or so.

Eric Hunsicker, another friend from the Grand was with Nikki from noon until 9pm -(he was one of the last persons to see her alive.) Eric had listened to Nikki before complain about her unhappy marriage and how she did not want to move to Shreveport. She could think of better ways to spend her life then with with “mean and crazy Phil.” Today she was in a good mood, they were just hanging out having fun.

Then at around 9pm Nikki said she had to make a call, after several minutes she returned upset saying she had to go...NOW. Was Phil there or on his way? The last time Eric talked to Nikki was at 12:36pm she had received numerous calls from Phil. Nikki told Eric not to tell anyone they had been together or if asked to not say they knew each other.

The big gamble
The big gamble was getting away and getting their freedom. Contrary to what Phil told the police there’s wasn’t a happy marriage. Phil had been watching her like a hawk. Stalking her, controlling her, calling her. He kept her looking over her shoulder. She never knew where he was. He’d block his number or use a calling card so the caller ID was all 0”s.

And according to phone records numerous calls were made between 11pm 0n 7/28 until 1:40am on 7/29 using this method of hiding his whereabouts. Phil has no verifiable alibi for the night of Nikki’s death. Many believe he was in town, or coming to town to get Nikki.

The gun used to kill Nikki was Phil January’s. Nikki didn’t like guns and didn’t want them anywhere near her or her 5 yr. old son.

There are many accounts of Mr. January’s possessiveness of Nikki. Many witnessed him being mean and mentally abusive. He knew Nikki didn’t want to move to Shreveport he allegedly told friends that Nikki wanted to break it off.

Phil erased the hard drive of their computer (with the help of his son) after Nikki’s death. Phil’s history of physical violence and suspect work ethics (Grand Casino). He does not have a clear alibi and could have been right there.

Why no investigation into this shooting death? Neighbors across the way from the balcony report hearing what they thought to be fireworks or chairs or tables falling. That doesn’t fit with one gunshot to the head. He could have pulled her apart like a rag doll. She weighed 110 he over 250. She's be easy to handle with drugs and alcohol in her system.

Very good questions Mr TT. I think it was bad police work and the fact that the lead prosecutor was a child molester who got 40+ years. He took polaroids which in my opinion where sexual. Bad police work.
I don't know if we can get it changed, if any case needs to be it's this one. This would make one heck of a 20/20 or Dateline.

We seek a reopening of the case, a changing of the death certificate to murder and a real investigation. There are lots of interviews and I think a statement analyst would have a field day with some of them.

Catch as catch can
This is the third in a series on the mysterious death of Nikki LaDue January. She was killed by a single bullet to the head on 7/29/2002.

In the second series I told you about Nikki’s last night before freedom (death). The flurry of calls made between Nikki and Phil’s 000000’s ID (possibly to establish an alibi?)

Phil had even called Nancy saying he couldn’t find Nikki. Nancy had an uneasy feeling and was disturbed to not see Nikki’s car in her drive when she got home. She told her son she was going to check on Nikki but came back after only going a few blocks.

Phone records showed Nancy called Nikki the night she was killed at 3 am and 3:30am they were not answered and the last to come in.

Monday morning Nikki’s friend Nancy Burge, from the Grand Gulfport Casino came by around 9:30 am (instead of the agreed upon 8am) on July 28th. She said she was surprised to be let in by Nikki’s 5 yr old son . The little boy had told her “Mommy was still asleep” but Nancy couldn’t find her,searching the condo twice. Phil then shows up and promptly sees the balcony door ajar and finds Nikki dead on the balcony. Riga mortis had already set in. Nancy then calls 911.

The babysitter, heard about Nikki’s death the morning of Monday July 29th around 11am. She couldn’t believe her ears. She had just seen Nikki the night before. She decided to call the phone number Nikki left her in case of an emergency. A young man named Jason Burge answered the phone he told her where Nikki lived, he said his Mom was there.

To put you on the spot
Nancy wasn’t there when the sitter arrived at approximately 11:45am. Phil, a young man and one police car with a lone officer were all that were there. The sitter approached the police officer and explained who she was, she gave him her name and number and told him Nikki was fine when she left her house with her son the night before. She then spoke to Phil explaining who she was and how sorry she was. She noticed Phil had lots of tiny specs of blood on his face and shirt. The police never contacted the sitter, there was no investigation.

According to Jason Burge, Nancy’s son, he and his dad rode over to the condo in the early afternoon. When he got there the only persons present were Nancy, Phil, Jason’s Dad, and Jason. Jason then took his Dad's truck to McDonald's in Long Beach to pick up a few burgers for the four of them. Later on, Phil's friend and wife arrived to clean the balcony, they were alone.

The following day Tuesday there was a gathering of Phil's family and a friend to complete the process of moving everything out of the apartment. Nikki's ex and a couple of his friends also showed up to gather all of her son's belongings.

The Grand Casino held a memorial service for Nikki. Phil was there with many co-workers and friends. Phil was wearing a white bandage on his hand.

It’s your funeral
When Phil arrived at the funeral home in NY the day before her funeral, one of the first things noticed were his swollen hands....they were badly bruised and scratched up. When asked what happened, he allegedly said he had been punching the cement wall that surrounded the condo complex the day Nikki died. Why did no one question of this and how the blood got onto his face?

Nothing about the scene of the shooting makes sense. Nikki was found in a chair with her right knee held by the table in front of her and her left leg down. Phil, the person who found her, has stated in writing, “The gun was sitting beside her on a small padded wicker stool with rod-iron railing.”

A maintenance man found a shell casing in a swimming pool, 20 feet over from the balcony and three floors down. The gun, which was owned by Phil, was a Sterling .380 semi automatic.

However, the police photo shows Phil’s pistol on the chair, under Nikki’s left thigh. How do you shoot yourself in the temple and then place the pistol under your thigh? Also while you hold a phone in your hand, commit suicide by gun. Get blood on the phone afterwards, and then the phone is found resting face down on a table? Would she not use the same hand to talk on phone or shoot gun?

On the table lay a pack of Nikki’s Marlboro Medium 100’s, but they were to her left, not to the right where a right handed person would normally place them. On the far side of the table, lay a pack of Marlboro Red 100’s with a lighter beside them, perhaps indicating that someone else was there that night.

Phil smoked Marlboro Reds. Nikki was a cigarette snob and did not smoke anything but her own brand. The portable phone, was face down on the table, covered with blood. A pathologist was hired to do a private autopsy and told the family that Nikki died instantly. So who bloodied the telephone? Since police didn’t seize it as evidence, it will never be known whose prints were on it or on the lighter. Verbal description.

Wanted a police investigation
Within two hours police closed the case as a suicide. The chief investigator, Pass Christian Police Officer Tom Putsay, told the family that no autopsy or investigation was deemed necessary. No fingerprints were taken and there was no gun powder residue test to determine whether Nikki had fired a gun. Strong physical evidence that somebody WAS ON THE BALCONY WITH Nikki at the time of the shooting was totally ignored, as was information from several individuals that Nikki’s death was very likely linked to an interstate drug operation involving people from the Grand Casino in Gulfport.

The crooked circle
In March, 2003, the Grand Casino conducted an internal investigation of Grand personnel and their alleged involvement with the distribution of illegal drugs. In the course of that investigation, information surfaced about “The Oxy Ring,” a group of individuals at the Grand Casino who allegedly travel to New Orleans and Houston to obtain Oxycontin from crooked doctors. Those drugs are then brought back and sold on the street. We’ve also learned that, on Sunday, July 28, 2002, a big drug party was held at a private residence and attended by people from the Grand. Nikki is said to have attended. Allegedly no one remembers what time she left or if someone accompanied or followed her.

I’ll see ya in jail sometime.
Update May 12, 2005 the chief investigator in Nikki’s case, Tom Putsay, has been arrested on charges of sexual battery and is being held in the Harrison County Jail under a $200,000.00 bond. Putsay, a 21 year veteran of the Pass Christian Police Department, is accused of sexually molesting a juvenile female. A 19 yr old at the time stated he begun molesting her at age 9. Pustay's wife testified he confessed to her.

He was found guilty and ordered to 40 years in prison. He will be 92 when eligible for release. This supports the belief that Officer Putsay’s character and credibility as a criminal investigator are, at the very least, questionable. And is ongoing molesting of children abuse was definitely a key factor in his poor investigation of this case.

Well, I am not sure how to do this.
But it seems you may have to get her exhumed.
Have an autopsy performed

The ME then can change the DC from suicide to homicide.
Then you can have your investigation.

DA wont touch the case as it stands now.
Nothing for the Grand Jury to look at.

She was exhumed in New York. They could not change the MS death. But the forensic pathologist said it wasn't suicide. There was a strange brush mark on the side of her face,

Beyond him, am I the only one who finds it odd that Nancy, when calling 911, referred to Nikki at "the girl"? That seems an oddly impersonal way to refer to someone... certainly not the way I would refer to my best friend during a crises. That coupled with the fact that she originally left that evening to "look" for Nikki but changed her mind for some unknown reason after only driving a few blocks sets off warning bells in my head too.

Also the fact that Phil trusted Nancy is scary in and of its self. Have her phone records ever been checked? What made her 'change her mind' about checking on her friend after traveling two blocks? Did she know that Nikki was with a male friend that afternoon? Did she tell Phil where Nikki had been? Too much evidence points away from suicide, to be ignored. Good point about the conversation, calling Nikki 'the girl'. Very impersonal and when I first read that, felt the need to re read it.

Where is her son now? Who is the Mother of Phils other son? Where is she now and has he ever been violent against her?
 
There's been a lot of talk in the area and on Nikki's sites. Tracking all IP's. 95% are not from other pages but from own source like postcards mailed out and flyers put up in and around the area.

Some things I'd like to run by my friends here at Websleuths:

I've been thinking the gun was placed under her. What if she placed it there herself for safety sake. She placed it so it wouldn't go off and shoot herself. Why no bullet testing? She was found in a position like she was a sleep against the wall. Was she drugged? Then shot?

Something had happened that day or night which made her feel threatened. She was leaving the next day and she would be taking Zack and secrets. What happened to Nikki? Was it a lovers quarrel or a drug hit or suicide or something more?

What did Nikki have that someone didn't want her to leave with. Why did that person not kill her son who slept inside. Why the rush to judgement by LE?

Someone didn't want Nikki to go - what's the motive? Every time the family looks for answers they hit a dead end. People get scared off. Why and who is doing that and why?

No x-rays so the bullet or fragments maybe still inside her head?

If she was so scared why was her son still there? Did she know the person who was threatening her wouldn't hurt him?

Was it drugs, was it custody of Zack? Who had keys to the apt. The Condo owner did. His name is Paul. Her ex did Phil.

Many people from MS, TX, NY are looking at this case everyday.
 
It is always Law Enforcement's responsibility to prove who killed someone even if it is suicide. It's just like any other case, it's MURDER. Who murdered Nikki, someone else or herself? It should never be "It looks like Joe did it, somebody get a rope." This is what they did to this little 5 year old boy's mommy. It is either incompetence or corruption, there is no third choice.

Strong words? Ponder these facts:
  • 7/29/2002 Official Police Form is not completed offense is labeled within moments "Suicide" Officer Davis says wound appears to be a bullet hole.
  • The weapon is labeled a "Pistol" no make or model listed, evidence collected is said to be casing and bullet but no caliber is listed.
  • There is no mention of the gun found - believed to be husband Phil January's (Nikki was sitting on it - it was placed under her right thigh, in an awkward almost phallic position shown in polaroid later obtained by families PI)
  • Police narrative by Lead Det Tom Pustay includes some statements but isn't completely filled out. Includes a casing being found sometime before 9:45am by Condo owner Del Carr who wasn't sure who it might belong to. (Det Pustay arrested in 2005 convicted for Child Abuse - Pustay will be 92 when eligible for release)
  • There is no note of any testing being done, no autopsy, no toxology report, no x-rays, no fingerprints of gun or bloody phone or apt, no metal or parrifin tests at the time of Nikki'd death. Though later when Husband Phil asks Det Pustay he states there was a metal test ...but no one has a copy of it.
  • All physical evidence is missing, clothing, bloody phone, bullet, casing, gun. Pustay state's - not needed in a suicide.
  • Husband Phil January asks how many rounds were left in gun? Good question right? How about was the gun tested and the bullet and casing compared to those rounds left in chamber. What about fingerprints? Could they explain how Nikki could shoot her self and then turn the gun around and sit on it?
  • Husband Phil a self described ex police officer removed the bloody phone from Nikki's hand and tells this to the police in a letter. Why would he move evidence?
  • Family requests an independant autopsy in NY, the only autopsy done is found to be inconclusive. The family's PI requests supporting evidence to be sent to Pathologist with intent to prove suicide or other manner of death. Pathologist receives blurred polaroid photos, no hard evidence. Toxology tests don't show levels but indicate the presence of cocaine and amphetamines. (Nikki did have a past problem with pain killers friends said Nikki reaction was often opposite to normal drug reaction)

The phone records have not been checked except what ones family could get their hands on. The police did not.

The son is with Nikki's first husband.

The Mother of Phil's children I believe is still in TX. Yes, I do believe there was some abuse in their relationship you can check on Real Crimes.

Paul Morreale, owner of the condo where Nikki died (he had a key to condo and lived nearby)...he was also her casino colleague and friend of both she and her 1st husband. Rumored to be ...lets say somewhat a ladys man and some say a ....shady character.
