"Everyone has been waiting to know when I'm gonna rule on this last motion," Judge Perry said in Monday's hearing. "It is a very complicated, record intensive motion."

News 13 legal analyst, Orlando criminal defense attorney David Fussell, says not only will the judges decision affect the Casey Anthony case, it could affect future criminal proceedings all across the country.

"It will be something other courts will look at later to make a decision in similar cases," Fussell said.

ORANGE COUNTY, Fla. -- Chief Judge Belvin Perry is expected to decide if never-before-used scientific evidence will be used against Casey Anthony. It's a test of the air from Casey's trunk that witnesses said smelled like death.

There are indications that the ruling will come down on Wednesday. It could be a landmark decision, so Perry is taking his time.

Jury selection is on Monday, May 9 in the most anticipated murder trial in Central Florida history.

Media groups appeal judge's rules for Casey Anthony jury selection

But a copy of the appeal obtained by the Orlando Sentinel shows a 28-page petition filed on behalf of WPTV-TV, WFTS-TV, Naples Daily News, Scripps Treasure Coast Newspapers and the Associated Press.

The filing of the appeal is significant because it could lead to a delay in the start of the trial's jury selection, which is scheduled to commence Monday morning.

New organizations that agree to sign the confidentiality agreement would be given advance notice of the jury selection location on Sunday. Those not signing the agreement would not receive an advance notice.

It found that Joseph Njonge was denied his constitutional right to a public trial by King County Superior Court Judge Laura Middaugh's handling of jury selection. Even though no one, including the defendant's counsel, objected at the time to closing the courtroom, the judge should have held a hearing first to consider objections, the appellate panel said.
