Do the defense really believe they can get a 'Not guilty" verdict

It looks like with all the bruhaha the defense has been trying, even they seem to realize the chances of Casey Anthony getting aquitted are about as good as Fran Dreser becoming a singing sensation.

I don't think that the Defense think that they can get a "not guilty" verdict. That said, I do think that they are going after a lesser verdict than 1st. degree murder. IMO, they have a much better chance of a lesser charge than a "not guilty" verdict.:twocents:

Good luck. Manslaughter would have to be reckless killing (not intentional though). Can't see how when the kid goes missing she is out partying.

I think they are trying to save her life at this point. It's my own opinions that the defense knows the State's case is overwhelming; it's going to be a miracle if they get a lesser charge, but doable, and so is LWOP. I don't believe for a minute the defense thinks KC will ever be a free woman again.

So why didn't they took the plea deal?

So why didn't they took the plea deal?

I wasn't aware that there was a plea deal. I thought all she was offered was some sort of limited immunity type thing.

I agree with Turnadot that they are just focusing on saving her life, at this point.

So why didn't they took the plea deal?

At the time the plea deal was being discussed, Caylee's body hadn't been found. And I believe that part of that deal may have been to give info on where it might be found.

But once the body was found, the DP went back on the table and the plea deal was withdrawn. Remember it takes agreement on both sides for a plea deal and after all that has happened, I wouldn't look for a deal.

IMO the defense knows she is going to prison. I believe they are just working to get the lowest charge they can get. Manslaughter or even 2 nd degree. Anything but LWOP or DP.

So why didn't they took the plea deal?
This is just my own conjecture:

Because KC wanted to roll the dice in court. She's a narcissistic personality and truly believes she will be found not guilty, and walk out into the Florida sunshine. Her ego clouds her ability to apply logic and reason to her situation.

So can't wait to see the look on her face when she gets a 'Guilty" verdict.

If Casey were to plea would Jose still be credited as a death penalty attorney or would that be shortening the process if they didn't proceed with a jury trial? Jose is out for a feather in his cap.

Kathi Belich said that Casey had the opportunity to plead before jury selection but turned it down. Speculation as to whether this was true or not but it is on the wftv website.

Before Caylee's body was found a letter from JB to the SA surfaced that indicated they might be negotiating a deal. Though it wasn't publicly discussed, the SA had taken the DP off the table publicly, then the letter surfaced. Then Caylee's body was found. At that point the SA put the DP back on the table. And I don't remember for sure but I believe the SA even acknowleged that there had been some discussion about a deal.

I agree and think that she is just so far off base and not grasping the reality of all of this. I believe she thinks she will be out partying it up again within a few months. I don't think she believes that she will be found guilty. I suppose she is just in DENIAL. She needs to wake the heck up and realize she will most likely never walk out into the Florida sunshine again a free woman. She should have thought about that before killing little Caylee.

Even if they don't believe it, doesn't mean they won't still try it.

Mr. Mason said Casey would walk out on his arm. Mr. Baez said my client is innocent.

Wishful thinking perhaps - Mr. Baez wanting a not guilty vervict of a DP case to put in his career scrapbook to brag about to all of his future DP potential clients. But if he has any hope of having a career as a good Lawyer, he has to realize that this is not being realistic.

Should have encouraged his client to change her plea and serve her punishment for what she has done to Caylee........Justice for Caylee just around the corner........JMO

I think Casey thinks, 'I'm going to throw everyone I know under the bus. Surely this is going to raise reasonable doubt!'. Casey is a sick puppy and if Jose had done the right thing when Todd Maclusco was on the team they would have gone for a mentally ill defense or had her confess to an accident. (I'm sure they could have contrived an accident story that would line up with what was known about the body, Casey's actions, etc.)
Casey is guilty or Casey would not be where she is right now.

I just had to go dig up this post from December 31, 2009. I think what was suggested today for a defense, was Andrea Lyon's idea from way back. I think, after she reviewed everything in the case, she thought this was the only possibility of a defense that might work.

Not to get a Not Guilty - but simply to spare Casey from the death penalty. That's what Andrea's all about - keeping people from being put to death. One might say keeping guilty people from being put to death.

Andrea Lyon will be out to spare KC's life, not CA and GA's reputation or feelings. She's a tiger who wants to win at any cost.

Going through the allowed and disallowed mitigating factors, Andrea has extremely little she will be permitted to work with. I believe, therefore, she will aggressively attack the parenting of CA and GA, saying CA was emotionally abusive, and GA emotionally neglectful, and that this resulted in mental/emotional issues in KC that led to KC killing Caylee.

I believe this is why she specifically chose the mitigation specialist she did. Mitigation specialists come from a wide variety of backgrounds. Barrett's background is social work. I've been reading up on what mitigation specialists do, based on their specific backgrounds. My money is on Barrett developing a history of emotional abuse leading to mental/emotional issues (not insanity - insanity's not needed for mitigation).

I think the jury will accept and understand the explanations developed and presented. People want explanations, people want to know why. I don't know if the defense will be able to take the majority of the jury that one step further necessary where they will see this explanation as mitigating to the extent that they feel KC's life should be spared. I think they could lead some jurors to it, but I just know if they can lead a majority to it.

Please note, before jumping on me, that when I say accept this explanation of why KC killed Caylee, I do not mean that the jury will see it in any way as an excuse for killing Caylee. There is no excuse for KC killing Caylee, and I am confident the jury will know that.

In no way do I think any juror will think it was 'okay' for KC to kill Caylee, or that it was in any way CA or GA's fault that KC killed Caylee. Just simply what I said, that they could understand and accept this explanation of how KC came to kill Caylee.

Okay, you can jump on me now. :)

They think she will be found not guilty and I think KC has convinced herself she did nothing wrong, that the nanny actually took Caylee and they have no evidence to suggest otherwise. I don't think her atty has given her the best advice.

Every criminal defense attorney/team goes to trial with the belief that they can win. Baez and Co. are no different, and they really wouldn't be doing right by their client if they told Casey otherwise. The DT has convinced Casey that they will win this lock, stock, and barrel. IMO, this "dream team" is exactly that - dreaming.

I don't believe for a minute the defense thinks KC will ever be a free woman again.

But, again, this would mean that the state will not accept a LWOP plea deal. However, the general view is that the state have offered, and are still amenable to, a LWOP plea deal.

The only way that would make sense is if ICA is refusing to plead out for LWOP notwithstanding Counsel's advice.

AND DUCT TAPE- don't forget the duct tape. Duct tape says first degree murder, not reckless homicide or manslaughter.

Whoops- I put duct tape on my child. Accidental stupidity...my bad. NOPE.

Murder in the first degree. I think they will try to save her life and the disclosure of strategy this morning tells us all we need to know about what their plan is.
She killed her child because of her poor upbringing.

:twocents:

Hung jury is a long shot
.Mistrial based on JB's ineptness tainting the jury, maybe.
Not Guilty? No way
