Should Jose Baez be Charged with Subornation of Perjury?

Subornation of perjury is a legal term describing the crime of persuading another to commit perjury.[1]
It may be applied to an attorney who presents testimony (or an affidavit) the attorney knows is materially false to a judge or jury as if it were factual. Generally, the knowledge that the testimony is materially false must rise above mere suspicion to what a reasonable attorney would have believed in the circumstances. For example, the attorney cannot be wilfully blind to the fact that their witness is giving false testimony. An attorney who actively encourages a witness to give false testimony is clearly guilty of suborning perjury.

If it is found he compelled CA to testify in the manner she did or knowingly let her lie he should be punished IMO

Yes, I strongly suspect Jose Baez is guilty of subornation of perjury. Not only in the instance of Cindy Anthony lying about her computer searches but also of several witnesses during the defense's case-in-chief. I honestly see him as a dishonest and unscrupulous attorney that breaks and bends all kind of rules and laws to get his way.
 
Investigation in order.

CA would have to give him up ... meaning she'd have immunity ... and it would still be tough to prove the wink, wink, nod, nod.
 
Plus other things when the judge finally has a chance to review the happenings of behaviors of JB in the court room.

Casey was asked on two separate occasions (that we know of) if she was happy with her representation. Her parents said they didn't care for Baez. Let's not forget Mason, Simms and Finnell are on her DT. Also, Linda Kenney Baden, Terrence Lenamon (sp) and Andrea Lyon have been members of the team at one time or another. IIRC, she was locked up when she first heard of Baez. Don't know if someone specifically gave her his name or she overheard someone mentioning him. IMO, there is only so much the courts can do. The 6th amendment guarantees a right to counsel - not the perfect counsel.
 
Nope. Do not believe he HAD to 'induce' anyone to lie. Those who lied, did so on their own, albeit, to what he perceived to be to the DT's advantage.

The "liars" had their 'own' reasons/agendas ............. imo. I will say, I doubt he discouraged these 'acts.' jmo

But IF he KNEW what she was going to testify to beforehand and put her on the stand it's still SoP IMO

That's right she has been asked over and over and she always says she is satisfied with her Counsel

Jose's "tactics" and "behavior" both IN and OUT of the Courtroom, have been unprofessional and unethical ...

In other words ... his "behavior" comes across as downright "sleezy" !

Besides ... what attorney would let his client sit in jail for 3 years for an "accidental drowning" ? Really ...

If he is NOT disbarred after this trial is over ... I will be real "surprised" ...

As much as I dislike Baez's tactics I don't think he willfully encouraged this story. I think ICA gave it to him and demanded he present it to the court and he feels it's his sworn duty to do what the client wants.

The problem with Baez may be that he didn't try hard enough to give her good legal advice and talk her out of these ridiculous accusations toward everyone else. He also didn't try hard enough to convince her to take a plea early on.

Then again, knowing ICA he might have really tried hard but she wouldn't schwallow his recommendations and demanded that her lies be heard round the world.

I agree and further if he were charged it would have to be proven in a court of law that he knew that the witness was going to lie and put her on the stand anyway or that he asked her to lie or that he....a lot to prove in a court of law. Proving this would be very difficult. JMHO.
 
If that happened then I wonder if there would then be a mistrial? I would really hate to see that and then her do a plea deal:(

That IF seems to be a very big if and I'm sure if that if worked you could punish any and every attorney. :)
 
I voted no... because I think that when this is over, the state of Florida will just want to distance themselves as much as possible from anything "Anthony"

Although, I DO think Judge Perry has something in store for Mr. Baez when this is all said and done!
 
I think there is going to be lots of fireworks concerning Jose Baez and "his" practice of the law.
 
Maybe JB and ICA have plans for when she's set free, to go into business together. A new mail order bikini business with ICA being the model :innocent::crazy:
