The parents of a 6-year-old Martinsville, Ind., boy shot in the head are struggling with the double tragedy of knowing that their 11-year-old son is the one accused of murdering him.

The Morgan County Sheriff's Department has released few details about what they believe went on in the home Thursday afternoon before Andrew Frye, 6, was fatally shot, but after initially saying it appeared to be accidental, on Friday they charged the older boy in the killing.

MARTINSVILLE, Ind. (AP) -- The mother of a 6-year-old boy who police say was fatally shot by his 11-year-old brother was due in a central Indiana court Wednesday on felony charges stemming from her son's death.


WRTV reports Amanda Vandagrifft faces one count of neglect of a dependent resulting in death and three counts of neglect. Boyfriend Matthew Boulden also faces three neglect charges.
 
So sad...why didnt the parents have this gun locked up? Especially when there are children in the house. :(

According to court documents, the 11-year-old held knives to his siblings' throats, threatening to kill them if they didn't do what they were told. The report also said just the week before he had loaded a long rifle and used it to threaten the younger kids, showing them the bullets were in the chambers... [T]he boy told police he had been threatening Andrew with the gun after Andrew refused to clean their room, and shot him in the head. He told police he didn't know the gun was loaded...

Before final sentencing, Judge Thomas Gray chastised Vandagrifft saying: "Society demands we not leave our children alone... You didn't grasp the reality you neglected your children. Andrew (your son) is dead. I'll agree you didn't pull the trigger, but you didn't do anything to stop it either"...

The judge sentenced her to eight years but suspended all but six months. She will serve that time in the Morgan County Jail... Vandagrifft had pleaded guilty to to one charge of neglect of a dependent after her son fatally shot his brother in June 2011.
