Baez Bar complaints explained
Discovery violations and Casey's probation prompted complaints

One complaint stems from Baez's failure to share discovery information with the prosecution last winter as the Anthony case was heading to trial, according to Francine Walker with the Florida Bar.

That was not a surprise because Baez was sanctioned in January by Chief Judge Belvin Perry and made to pay a fine for his "willful violation" of a court order.

The other complaint, which was less apparent before today, involves Baez's failure to disclose to the court that Casey Anthony was being allowed to serve probation for her check-fraud case while in jail awaiting trial for murder in the death of her 2-year-old daughter Caylee....

Phone Call Halts Casey Anthony Deposition Filing


Matt Morgan, John Morgan's son, who works with his family's law firm, tweeted that he was at the Orange County Courthouse on Tuesday to file the deposition when he received a call from Anthony's attorneys, saying they were going to file an emergency motion to seal the video.

Casey Attorney: Releasing Depo Would 'Inflame' Public Opinion

Matt Morgan, John Morgan's son, who works with his family's law firm, said that he was at the Orange County Courthouse on Tuesday to file the deposition when he received a call from Anthony's attorneys, saying they were going to file a motion to seal the video.
If the deposition had been filed, it would have been available to the public. Morgan and Morgan also planned to post the video on its website, Matt Morgan said.
A hearing on the objection is now scheduled for Thursday at 3:30 p.m.

"There is no proper legal basis for the filing of the transcript and the videotape," Greene stated in his objection to the opposing side's efforts to file those items in court records.
But Gonzalez attorney John Morgan has argued in his court papers that during Anthony's Oct. 8 deposition her lawyer "asserted his client's Fifth Amendment rights and instructed her not to answer the majority of questions."
Morgan wrote that he wants to "compel these answers as no valid privilege exists." Filing the deposition is necessary for the court to rule on the matter, Morgan argues.
 
Casey Anthony: Hearing over, judge to decide deposition issue within 10 days

Ultimately, no decision was reached. Judge Lisa Munyon heard brief arguments from both sides, and said she will issue a written order in the next 10 days.

Soon after the hearing began about 3:30 p.m., Munyon accepted a written transcript of the deposition, but placed it under seal until her ruling comes down.

John Morgan, who represents Gonzalez, followed, asking Munyon "are we going to give special treatment to one citizen of Orange County" that no one else has received?

Morgan said Anthony wants the deposition sealed "because of money," adding that she and attorney Jose Baez, who represented her at criminal trial, want to sell her story and tell it their way.


"We want her to be treated no better and no worse than anyone else in Orange County," Morgan says.
