UT - Rilyn Gilley, 2 mos, shaken to death, Roosevelt, 28 Feb 2011
Duchesne County Attorney Stephen Foote told the court Thursday that an autopsy showed Rilyn died as a result of closed head trauma, consistent with being shaken.
Foote told the court that he was reducing the child abuse homicide charge originally filed against Gilley from a first-degree felony to a second-degree felony, in exchange for her plea.
He also agreed to recommend that she serve 150 days in jail in lieu of prison time.
Harmond agreed to follow the recommendation for jail time and placed Gilley on three years' probation.
The judge also ordered her to take a parenting class, saying that he didn't believe she acted "intentionally or maliciously" when she caused her daughter's death.
After the hearing, Foote called Rilyn's death "a tragic mishap."
"I don't think there was any intent to cause a death," he said.
"I think it was a negligence issue, and that's why we pled it the way we did."
Foote noted that Gilley was 19 years old when she got pregnant and became a parent at age 20.
The baby's father and his family did not offer any support after she was born, the prosecutor said.
That left Gilley to rely on her own mother for help with an infant who was taking medications for acid reflux and colic.
So Mom was 20 and had a baby with reflux... so when she shook the baby to death that was "negligent."
My 8 year old daughter has still not slept through the night. She cried 18-20 hours a day for at least the first 9 months.
I was 18 and single, with two kids 10 months apart, both with special needs... and no family help at the time.
Young and reflux is not an excuse. I can't believe this came from the prosecutor.
Facebook - family has a couple of pictures of Rilyn and her headstone.
There is also a father/grandfather... not just a mother/grandmother.

that fb profile's photos are private & I don't see any mention of her deceased baby anywhere ...

Apparently she did have a picture of her and Rilyn as her profile picture at one point.
The thumbnail comes up in a search but then isn't available on facebook anymore, when you click on it.
It is still here though:
Her Mom (same last name, in friends) DOES have pictures of her deceased baby as a profile picture AND her deceased baby's headstone as well.
There are also comments from Samantha on those pictures... about how of course the baby is beautiful, it's HER daughter.
She had to change the profile picture to REMOVE the baby's picture at some point...
Her family kept the pictures of her baby up... while she replaced her baby girl with a picture of a guy.
Although, let me give her credit... when her Mom posted the picture of the headstone, Samantha does respond and say she misses her.
Maybe she was innocent... I just find the prosecutor defending her to be quite offensive.

Yeah, I was 19 when I got pregnant with my oldest son. I already had a two year old. My son didn't sleep through the night until he was 2, he threw up huge amounts, screamed constantly, and was on medication every time he ate, for acid reflux. And how much support did I have? 0%. And how many dead babies do I have? 0. She has no excuse. People make me sick.JMO. Unless there's a link, I can't prove it.
