Colleen and Robert Middleton don't expect to collect a dime of the $150 billion a civil jury awarded them this week in the death of their son.

They just want the person they say is responsible for his death to be brought to trial. Frustrated at prosecutors' decision to drop the 1998 assault case, the family sought justice - and public awareness - in the civil courts.


#1 Respectfully, why would a court of law even ALLOW this type of judgment knowing there is NO WAY he can pays this (heck, our own gov't couldn't afford this)
#2 Where are the criminal charges?

No thread but it appears the prosecution did not have sufficient evidence to charge him with the crime in 1998 (or the crime of molestation)

Yeah, I get the punitive nature of the judgment but WOW!

In an unrelated case, Collins was later convicted in 2001 for the aggravated sexual assault of an 8-year-old boy. He is currently in prison for failure to register as a sex offender.

Middleton’s mother is pushing now for a murder investigation.

“I want Robert to be treated fairly. I want them to take it all present it to a grand jury and let them decide,” Colleen Middleton said.


I hope this monster is still incarcerated . . .
 
There appears to be a contradiction with what this prosecutor is saying now with what newspapers apparently reported he was saying after the attack. He doesn't recall that? Where would newspaper get it from?
"Newspaper articles from shortly after the attack quoted Pattillo as saying Middleton had implicated Collins to authorities. Pattillo said he doesn't recall that and stands by his statements above."

11 News also asked about a confession 13-year-old Collins had reportedly made while in custody.

"He did," Pattillo acknowledged, but added "there were problems with it."

Pattillo’s philosophy was that it was “better to let him go and get him in the future, than try him and lose it.”

I'm sorry but this "prosecutor" is an idiot! Let's tell his other victims that the state wanted to to catch him the next time!
 
What an awful dumb thing for Pattilo to say, or even think. Get him in the furture after he lights another child on fire?

The horrible pain of this boys family ,seeing the evil done to their baby and he forces the thought on them that this guy will commit this crime again?

The prosecutor is out of touch just a bit.

FTR, Donnie Collins is a RSO after the rape of another child in the late nineties. I don't think there was ever any doubt of his guilt.

HOUSTON—Authorities have made the first step toward charging a Montgomery County man with a horrific murder, 15 years after a little boy was set on fire.

Back in 1998 Don Collins was accused of dousing his neighbor Robbie Middleton with gasoline, setting him on fire, and leaving him for dead.

Middleton survived, but died two years ago of cancer caused by skin grafts. Before he died, Middleton made a deathbed accusation that Collins had sexually assaulted him two weeks before the attack.

A state district judge ruled Monday that the trial of a man charged with dousing a boy with gasoline and setting him ablaze 16 years ago, causing injuries that eventually killed him, should be moved out of Montgomery County because of widespread publicity that could sway potential jurors.

State District Judge Kathleen Hamilton has agreed to a defense request to move the long-awaited trial of Donald Collins, 29, to another location. Collins is being held in the Montgomery County jail on a $1 million bond.

Hamilton asked both the defense and prosecuting attorneys to meet with her Thursday to decide upon an alternate site for the trial, which is set to begin Jan. 5.

Prosecutors say Don Collins of New Caney, now 29, was 13 when he set out to silence a victim of a sexual attack two weeks earlier. They say he caught Robbie Middleton on a wooded path, soaked him with gasoline and set him on fire, burning him so badly that only the soles of his feet were undamaged.

Middleton survived until age 20, but a medical examiner ruled his 2011 death to be a homicide because he succumbed to a cancer caused only by repeated skin grafts. Collins, a convicted sex offender, maintains he is innocent.

In the end, Robbie Middleton, who was then near death, managed to name Donald Collins as the one who raped him nearly 17 years ago and then two weeks later used gasoline to set him ablaze on his 8th birthday.

The videotaped statement was taken 17 days before Middleton died, shortly before his 21st birthday in 2011...

While the jury intently watched the video, Collins kept his back turned to the screen and appeared to be reading a newspaper.

Bond had his client sworn in Friday and informed formally in front of Montgomery County District Judge Kathleen Hamilton of his right to testify in his defense. Collins declined to testify...

The prosecution rested Friday after four days of testimony by witnesses who included world renowned burn surgeon Dr. David Herndon, Middleton's parents and a string of witnesses who said that Collins admitted to them that he burned Robbie Middleton to silence him.
